O R D E R:
In the reference 1st read above, on the allegation of demand and
acceptance of bribe, Sri Md.Misbahuddin, Senior Assistant was placed under
suspension and subsequently he was reinstated into service without prejudice
to the outcome of the criminal proceedings in the reference 2nd read above.
2. In the G.O. 3rd read above, sanction was accorded for prosecution of
Sri Md.Misbahuddin, Senior Assistant in a Court of Law.
3. In the Judgment 4th read above, the I Additional Special Judge for SPE
& ACB Cases-cum-V Additional Chief Judge, Hyderabad acquitted Sri Md.
Misbahuddin, Senior Assistant, resulting that the Accused Officer found not
guilty for the offences punishable under section 7 and 13(1)(d) read with
Section 13(2) of Prevention of Corruption Act, 1988.
4. In the G.O. 5th read above, Government after careful examination of
the matter, have dropped further action against Sri Md.Misbahuddin, Senior
Assistant.
5. Sri Md.Misbahuddin, Senior Assistant in his representation 6th read
above, requested to regularize the suspension period from 04.11.2002 to
27.04.2005 as duty period for all purposes.
6. In the letter 7th read above, while forwarding the representation of
Sri Md.Misbahuddin, Senior Assistant, the Transport Commissioner, Andhra
Pradesh, Hyderabad has stated that he was under suspension from
04.11.2002 to 26.04.2005 A.N.

7. Government after careful examination, have decided to treat the period
of suspension w.e.f. 04.11.2002 to 26.04.2005 A.N. as the period spent on
duty for all purposes in respect of Sri Md.Misbahuddin, Administrative
Officer(Retd.).
8. Accordingly, Government hereby regularize the suspension period
w.e.f. 04.11.2002 to 26.04.2005 A.N. and treat as period spent on duty for
all purposes in respect of Sri Md.Misbahuddin, Administrative Officer(Retd.).
6. The Transport Commissioner, Andhra Pradesh, Hyderabad shall take
further action in the matter accordingly.
