O R D E R:
In the reference 1st read above, it has been brought to the notice of
Government that Sri K. Muralidhar, Executive Engineer along with others
alleged to have committed irregularities in temporary flood protection works
taken up in Dowlaiswaram Head works Divn.and recommended for initiation
of suitable departmental action against him along with others.
2. After examining the matter, in the reference 2nd read above,
disciplinary proceedings have been initiated against Sri K. Muralidhar,
Executive Engineer under rule 20 of APCS(CCA)Rules 1991 by framing
articles of charge.
3. In the reference 3rd read above, the charged officer has submitted
his written statement of defense denying the charges framed against him.
4. After examination of the WSSD of the charged officer, Government
have considered to place the matter before the Commissionerate of
Inquiries to conduct enquiry into the charges framed against the charged
officer along with others involved in this case. Accordingly In the reference
4th read above the case was entrusted to COI for enquiry by appointing Dr.
Subrendu Bhattacharya, iAS, COI as Inquiring Authority. Subsequently in
the reference 5th read above, Sri Jitender, IPS, Commissioner of Inquiries,
General Administration Department has been appointed as Inquiring
Authority in place of Dr. Subrendu Bhattacharya, IAS as he retired from
service on 31.12.2011
5. In the reference 6th read above, Smt. K. Himabindu, W/o Late K.
Muralidhar, I/C SE(Retd.), while enclosing a copy of the death certificate,
has stated that her husband retired from service on 31.01.2010 and died on
14.06.2011 and requested for dropping the disciplinary proceedings initiated
against her late husband and for release of all pensionary benefits of her
husband from the date of retirement.::2::
6. Government, after examining the entire issue, have decided to abate
further action against late K. Muralidhar, I/C SE(Retd.), subject to condition
that if any loss caused or misappropriated Government amount by the
deceased Government servant is established in future, the same will be
recovered from the legal representatives on record to conclude the
disciplinary proceedings.
7. Accordingly, Government hereby order to abate the disciplinary
action against Late K. Muralidhar, I/C SE(Retd.) initiated against him in
respect of irregularities in temporary flood protection works taken up in
Dowlaiswaram Head works Divn., subject to condition that if any loss
caused or misappropriated Government amount by the deceased
Government servant is established in future, the same will be recovered
from the legal representatives on record to conclude the disciplinary
proceedings in terms of orders issued in G.O.Rt.No.1097, Finance &
Planning (FW.Pen.1) Dept., Dt. 22-06-2000 and G.O.Rt.995
Finance(Pension-I) Dept., Dt.21-12-2002 and Smt K. Himabindu, W/o Late
K. Muralidhar, I/C SE(Retd.) is authorized to receive all eligible pensionary
benefits of her late husband.
8. The I&CAD(Ser.II) Department / Engineer-in-Chief (AW), I&CAD
Department, Hyderabad shall take necessary action accordingly.
