Madhava Chary, Technical Officer (Head Draughtsman) representation, dated 26.02.2011. ***** O R D E R: In the reference 1st read above, it has been brought to the notice of the Government that a trap case was registered by the Anti-Corruption Bureau authorities against Sri. K. Madhava Chary, Technical Officer (Head Draughtsman), office of the Superintending Engineer, N.S.L.B.C. O & M Circle, Miryalaguda, Nalgonda district as he demanded and accepted the bribe amount from the complainant. 2. In the reference 2nd read above, the Director General, Anti-Corruption Bureau, Hyderabad in his final report has recommended to prosecute the accused officer Sri. K. Madhava Chary, Technical Officer (Head Draughtsman) in a competent Court of Law under Prevention of Corruption. Act, 1988 besides initiation of departmental action against Sri. K. Madhava Chary, Technical Officer for non-submission of Annual Property Returns to the Department in his service regularly. 3. In the G.O. 3rd read above, departmental proceedings under rule 20 of A.P. Civil Services (CC & A) Rules, 1991 have been initiated against Sri. K. Madhava Chary, Technical Officer (Head Draughtsman), formerly office of the Superintending Engineer, Nagarjuna Sagar Left Branch Canal, O & M Circle, Miryalaguda, Nalgonda district, as he failed to submit his Annual Property Returns to the department during the period from 02.12.1996 to 19.11.2008. (P.T.O.)::2:: 4. In the reference 4th read above, Sri. K. Madhava Chary, Technical Officer (Head Draughtsman) has submitted his written statement of self defence, denying the charges framed against him. The written statement of self defence of Accused Officer was not convincing, as such the Engineer-in-Chief (A.W.), Irrigation & CAD Department, Hyderabad was requested to institute an inquiry into the charges framed against Sri. K. Madhava chary, formerly Technical Officer (Head Draughtsman) duly appointing a competent Enquiry Officer of proven integrity, and also a Presenting Officer to defend the case before the Inquiring Authority on behalf of disciplinary authority vide reference 5th read above. Accordingly, the Engineer-in-Chief (A.W.), Irrigation & CAD Department, Hyderabad appointed the Superintending Engineer, Investigation, Office of the Chief Engineer, Hydrology, Hyderabad as Inquiry Officer vide his office Memo. 6th read above. 5. In the reference 7th read above, the Engineer-in-Chief (A.W.), Irrigation & CAD Department, Hyderabad has furnished the enquiry report submitted by the Superintending Engineer, Investigation, Office of the Chief Engineer, Hydrology, Hyderabad for taking further action in the matter. The Inquiring Authority in his inquiry report dated 06.12.2010 held that the charges framed against Sri. K. Madhava Chary, Technical Officer as proved. 6. In the reference 8th read above, a copy of the report of the Inquiring Authority was communicated to Sri. K. Madhava Chary, Technical Officer (Head Draughtsman) inviting his representation on the findings of the Inquiring Authority. In the reference 9th read above, Sri. K. Madhava Chary, Technical Officer (Head Draughtsman) has submitted his representation, requesting to exonerate him from the charges framed against him, as it is a procedural lapse due to non awareness of service rules. 7. After careful examination of the matter, Government have observed that the contention of the charged officer i.e. lack of awareness about Service Rules is untenable. Therefore, Government have decided to award the minor penalty of withholding two Annual Grade Increments without cumulative effect against Sri. K. Madhava Chary, Technical Officer (Head Draughtsman), formerly Office of the Superintending Engineer, N.S.L.B.C. O & M Circle, Miryalaguda, Nalgonda district. Accordingly, it is hereby order to award the minor penalty of withholding of two Annual Grade Increments without cumulative effect against Sri. K. Madhava Chary, Technical Officer (Head Draughtsman), formerly Office of the Superintending Engineer, N.S.L.B.C. O & M Circle, Miryalaguda, Nalgonda district under sub-rule (iv) of Rule 9 of Andhra Pradesh Civil Services (CC & A) Rules, 1991. 8. The Engineer-in-Chief (A.W.), Irrigation & C.A.D.
