सा.का.जन. 119(अ).—केंद्रीय सरकार, सरोगेसी (जवजनयमन) अजधजनयम, 2021 (2021 का 47) की धारा 50
द्वारा प्रित्त िजियों का प्रयोग करते हुए, सरोगेसी (जवजनयमन) जनयम, 2022 का और संिोधन करन े के जलए जनम्नजलजखत
जनयम बनाती ह,ै अर्ाात:्-
1. (1) इन जनयमों का संजिप्त नाम सरोगेसी (जवजनयमन) संिोधन जनयम 2024 ह।ै
(2) ये रािपत्र म ें इनके प्रकािन की तारीख को प्रवृत्त होंगे।
2. सरोगेसी (जवजनयमन) जनयम, 2022 म,ें प्ररूप 2 म,ें पैरा 1 म,ें उप-पैरा (घ) के स्ट्र्ान पर जनम्नजलजखत रखा िाएगा,
अर्ाात:् -
"1 (घ) (i) सरोगेसी करवाने वाले िंपजत्त के पास आिय रखने वाले िंपजत्त के ही िोनों युग्मक होने चाजहए।
तर्ाजप, यदि जिला जचदकत्सा बोडा यह प्रमाजणत करता ह ै दक आिय रखने वाले िंपजत में से पजत या पत्नी की ऐसी
जचदकत्सीय जस्ट्र्जत ह,ै जिसके कारण िाता युग्मक के उपयोग की आवश्यकता है, तो िाता युग्मक का उपयोग करके सरोगेसी
की अनुमजत इस ित ा के अधीन अनुज्ञात होगी दक सरोगेसी के माध्यम से िन्म होने वाले जिि ु में आिय रखने वाले िंपजत्त स े
कम से कम एक युग्मक अवश्य हो;

(ii) सरोगेसी करवाने वाली एकल मजहला (जवधवा या जिसका जववाह-जवच्छेि हो गया ह)ै को सरोगेसी प्रदिया
का उपयोग करने के जलए स्ट्वयं के डडंब और िाता िुिाणओंु का उपयोग करना होगा;"।

NOTIFICATION
New Delhi, the 21st February, 2024
G.S.R. 119(E).—In exercise of the powers conferred by section 50 of the Surrogacy (Regulation) Act, 2021
(47 of 2021), the Central Government hereby makes the following rules further to amend the Surrogacy (Regulation)
Rules, 2022, namely:-
1. (1) These rules may be called the Surrogacy (Regulation) Amendment Rules, 2024.
(2) They shall come into force on the date of their publication in Official Gazette.
2. In the Surrogacy (Regulation) Rules, 2022, in Form 2, in paragraph 1, for sub-paragraph (d), the following
shall be substituted namely:-
“1(d)(i) couple undergoing surrogacy must have both gamete from the intending couple. However, in case
when the District Medical Board certifies that either husband or wife constituting the intending couple suffers
from medical condition necessitating use of donor gamete then surrogacy using donor gamete is allowed
subject to the condition that the child to be born through surrogacy must have atleast one gamete from the
intending couple;
(ii) single woman (widow or divorcee) undergoing surrogacy must use self eggs and donor sperms to avail
surrogacy procedure;”.

Note.- The principal rules were published in the Gazette of India, Extraordinary, Part II, Section 3, sub-section (i) vide
number G.S.R. 460 (E), dated the 21st June, 2022 and subsequently amended vide numbers G.S.R. 772 (E),
dated the 10th October, 2022, G.S.R. 179 (E), dated the 14th March, 2023, G.S.R. 415 (E), dated the 8th June,
2023 and G.S.R. 494 (E), dated the 11th July, 2023.
