(cid:1)क अनुfा कपट (cid:26)ारा (cid:14)ा8 क(cid:25) गई थी; या (ङ) क(cid:20)(cid:24)ीय सरकार, गृह मं,ालय (cid:26)ारा कंपनी या िनगिमत िनकाय क(cid:25) सुर’ा अनापि(cid:28) वापस ले ली गई ह ैया नकार दी गई ह।ै”। [फा.सं.एवी-11012/2/2013-ए] शेफाली जुनेजा, संयु(cid:30) सिचव (cid:10)(cid:10)(cid:10)(cid:10)टटटट(cid:12)(cid:12)(cid:12)(cid:12)पपपपणणणण....- मूल िनयम तारीख 23 माच-, 1937 क(cid:25) अिधसूचना सं. वी-26 (cid:26)ारा भारत के राजप, म(cid:20) (cid:14)कािशत (cid:1)कए गए थे और अंितम संशोधन तारीख 4 अ(cid:14)ैल, 2018 को भारत के राजप,, असाधारण, भाग II, खंड 3, उप-खंड ((i) म(cid:20) (cid:14)कािशत तारीख 4 अ(cid:14)ैल, 2018 क(cid:25) सा.का.िन सं. 333 (अ) (cid:26)ारा (cid:1)कए गए। MINISTRY OF CIVIL AVIATION NOTIFICATION New Delhi, the 20th June, 2018 G.S.R.575 (E).─ The following draft of certain rules further to amend the Aircraft Rules, 1937, which the Central Government proposes to make in exercise of the powers conferred by section 5 of the Aircraft Act, 1934 (22 of 1934), is hereby published as required by section 14 of the said Act, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules will be taken into consideration after a period of thirty days from the date on which copies of the Gazette of India, in which this notification is published, are made available to the public;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Objections or suggestions, if any, may be addressed to the Director-General of Civil Aviation, Opposite Safdarjung Airport, New Delhi-110003 or mailed to dgoffice.dgca@nic.in; Any objection or suggestion which may be received from any person with respect to the said draft rules before the expiry of the period specified above will be considered by the Central Government. Draft Rules 1. (1) These rules may be called the Aircraft (……. Amendment) Rules, 2018. (2) They shall come into force on the date of their final publication in the Official Gazette 2. In Schedule XI to the Aircraft Rules, 1937,— (A) paragraphs 3 and 4 shall be omitted; (B) for paragraph 5, the following paragraph shall be substituted, namely: — “5. (1) An application for Air Operator Certificate shall be made to the Director-General in such form and manner as may be specified by the Director-General which shall be signed by the applicant or by a person duly authorised in that behalf by the applicant and the application shall be made at least six months before the date on which it is planned to commence the scheduled air transport services. (2) Before making the application to the Director-General, the applicant shall obtain an initial No Objection Certificate for his proposal from the Central Government by making an application to the Ministry of Civil Aviation in such form and manner as may be specified by the Director-General. (3) For granting the initial no objection certificate, the Central Government shall consider the proposal taking into account factors such as the financial soundness of the applicant, his operational plan, the clearance from security angle of the applicant organisation including its Directors, and any other factor that may have a bearing on the proposal from policy angle. (4) The initial no objection certificate shall be valid for a period of three years from the date of issue. (5) A fee of rupees two lakh shall be payable for making the application for initial no objection certificate.”; (C) for paragraphs 6 and 7, the following paragraphs shall be substituted namely: — “6. An Air Operator Certificate under this Schedule may be granted in the following categories: (a) Scheduled Air Transport Services (Passenger) (b) Scheduled Commuter Air Transport Services (Passenger) (c) Scheduled Air Transport Services (Cargo) Explanation: Scheduled Commuter Air Transport services shall be operated between airports and/or helipads as may be specified by the Director-General from time to time. 7. Only multi-engine aircraft with maximum certified take off mass of not less than 5700 Kgs. in case of aeroplanes and 3175 Kgs. in case of helicopters shall be used for operations by the holder of the Air Operator Certificate under this Schedule. The aircraft shall meet the requirements as may be specified by the Director-General: Provided that the holder of scheduled commuter air transport services (Passenger) may use aircraft with certified take off mass from below 5700 Kgs. and not exceeding 40000 Kgs. Provided further that turbine-powered single engine aeroplane having maximum certified take off mass below 5700 Kgs. and turbine-powered single engine helicopter having maximum certified take off mass below 3175 Kgs. may be used for operations under the scheduled commuter air transport services provided that – (i) the number of certified passenger seats shall not exceed nine; (ii) the aeroplane shall be equipped with minimum equipment for operation at night and/or instrument meteorological conditions; and (iii) the helicopter shall be flown under day VFR only.”; (D) in paragraph 8, — (a) for sub-paragraph (1), the following sub-paragraph shall be substituted, namely:-¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 5 “(1) The Director-General shall consider the application for the Air Operator Certificate as speedily as possible and upon being satisfied that the applicant has met the laid down requirements, shall grant the Air Operator Certificate subject to such conditions as may be specified therein.”; (b) sub-paragraph (2) shall be omitted; (E) for paragraph 9, the following paragraph shall be substituted, namely: — “9. (1) The Air Operator Certificate shall be valid for a period not exceeding five years as may be fixed by the Director-General at the time it is granted and may be renewed by the Director-General for a maximum period of five years at a time upon being satisfied that the holder has been performing the services under the Certificate satisfactorily and has the capability to continue the services. (2) A fee of rupees twenty lakhs shall be payable for the issuance of an Air Operator Certificate and rupees ten lakhs for renewal thereof: Provided that in case of issue of an Air Operator Certificate to operate Scheduled Commuter Air Transport service the fee payable shall be rupees ten lakhs and rupees five lakhs for renewal thereof. (3) The fees payable under this Schedule shall be paid in the manner as prescribed by the Director- General.”; (F) in paragraph 15, in sub-paragraph (2), — (a) clause (d) shall be omitted; (b) for clause (e), the following clauses shall be substituted, namely: — “(e) that the permit was obtained by fraud; or (f) that the security clearance of the company or the body corporate has been withdrawn or denied by the Central Government, Ministry of Home Affairs.”.
