## Policy Analysis Report: Aircraft Investigation of Accidents and Incidents Amendment Rules, 2022 **1. Executive Summary:** This report analyzes the Aircraft Investigation of Accidents and Incidents Amendment Rules, 2022, a set of amendments to the Aircraft Investigation of Accidents and Incidents Rules, 2017. The core purpose of these amendments is to refine the process of aircraft accident and incident investigations, specifically relating to witness examination and removing rules 18 and 19. Key findings indicate changes to rules regarding witness testimony and the removal of rules 18 and 19. **2. Introduction:** This report provides an informative analysis of the Aircraft Investigation of Accidents and Incidents Amendment Rules, 2022, based solely on the provided policy text. The analysis focuses on understanding the changes introduced by these amendments and their potential impact. **3. Policy Overview:** * **Original Policy:** The amendments pertain to the Aircraft Investigation of Accidents and Incidents Rules, 2017. * **Core Objective(s):** The amendments appear to refine and improve the process of investigating aircraft accidents and incidents. This is inferred from the changes made regarding witness examination and the removal of specific rules. **4. Background and Rationale:** The amendments likely address perceived shortcomings or areas needing clarification within the original 2017 rules. The amendments specifically focus on refining the process related to witness testimony, potentially indicating issues or areas needing strengthening in the original rules. The removal of rules 18 and 19 indicates that these rules were deemed unnecessary or obsolete. **5. Key Provisions / Changes:** This section focuses on the specific changes introduced by the 2022 amendments: * **Change 1:** Rule 10, subrule 1, clause a is amended to substitute the existing clause with a new clause: "a to call and examine any witness relevant to the investigation, and to require such witness to furnish or produce information or evidence or to answer or returns to any inquiries he thinks fit to make;". This broadens the power of the investigator related to witness testimony * **Original Policy Part Affected:** Rule 10, subrule 1, clause a of the Aircraft Investigation of Accidents and Incidents Rules, 2017. * **New Rule:** Investigators have the authority to call and examine any relevant witness, and require them to furnish information, evidence, or answers. * **Effect of Change:** This appears to reinforce and clarify the investigator's authority to obtain information from witnesses, potentially addressing ambiguity or limitations in the original clause. It clarifies the extent of information that a witness can be asked to furnish and ensures they answer any inquiries the investigator makes. * **Change 2:** Rule 10, subrule 1, clause b is amended such that the word "person" is substituted with the word "witness." * **Original Policy Part Affected:** Rule 10, subrule 1, clause b of the Aircraft Investigation of Accidents and Incidents Rules, 2017. * **New Rule:** Replacing "person" with "witness" in clause b. * **Effect of Change:** This change tightens the focus to *witnesses* involved in the investigation, clarifying the scope of the specific clause (the content of the clause is not shown, so a fuller explanation is impossible). * **Change 3:** Rule 18 and 19 are omitted. * **Original Policy Part Affected:** Rules 18 and 19 of the Aircraft Investigation of Accidents and Incidents Rules, 2017. * **New Rule:** Rules 18 and 19 are removed entirely. * **Effect of Change:** Without the content of Rules 18 and 19, it is impossible to determine the exact effect, but their removal suggests they were deemed either redundant, contradictory to other rules, or no longer necessary for the effective investigation of aircraft accidents and incidents. **6. Target Audience and Stakeholders:** Based on the text, the primary target audience includes: * Investigators of aircraft accidents and incidents. * Witnesses involved in such investigations. * The Ministry of Civil Aviation. * Any individual or organisation involved with aircraft accident investigations. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The Ministry of Civil Aviation is responsible for implementing and overseeing these amendments. * **Timelines/Procedures:** The amendments came into force on the date of their publication in the Official Gazette (April 22, 2022). * **Implementation of Changes:** The key agencies involved in aircraft accident and incident investigations will need to update their procedures to reflect the changes to Rule 10 and the removal of Rules 18 and 19. Investigators need to be aware of their expanded authority regarding witness examination. **8. Expected Outcomes / Impact of Changes:** The likely intended outcomes of these specific changes include: * **More Effective Investigations:** The clarified authority regarding witness examination may lead to more thorough and effective investigations. * **Streamlined Processes:** The removal of Rules 18 and 19 suggests an attempt to streamline the investigation process by eliminating unnecessary or redundant regulations. * **Improved Clarity:** Replacing the word "person" with "witness" in clause b will provide clarity. **9. Conclusion:** The Aircraft Investigation of Accidents and Incidents Amendment Rules, 2022, represent a refinement of the existing framework for investigating aircraft accidents and incidents. The changes focus on clarifying the investigator's authority in witness examination and streamlining the rules by removing rules 18 and 19, potentially leading to more efficient and effective investigations. The changes highlight the ongoing effort to improve aviation safety through robust and well-defined investigation procedures.
