(cid:28)योगशाला के साथ या कृिष िवपणन सलाहकार %ारा अथवा साधारण (cid:16)णे ीकरण और िच(cid:22)नाकं न िनयम, 1988

GGGG....SSSS....RRRR.... 555599999999((((EEEE))))....———— The following draft of Bhagar Grading and Marking Rules, 2018 which the
Central Government proposes to make in exercise of the powers conferred by section 3 of the
Agricultural Produce (Grading and Marking) Act,1937 (1 of 1937), as required by the said section for
information of all persons likely to be affected thereby, and notice is hereby given that the said draft
rules shall be taken into consideration after the expiry of a period of forty-five days from the date on
which the copies of the Gazette of India containing this notification are made available to the public;
Any person desirous of making any direction or suggestion in respect of the said draft rules,
may forward the same, within the period specified above, to the Agricultural Marketing Adviser to
the Government of India, Directorate of Marketing and Inspection, CGO Complex, NH-IV, Faridabad
(Haryana)- 121001, who shall forward the same to the Central Government for consideration.
All objections or suggestions which may be received from any person with respect to the
said draft rules before the expiry of the period so specified will be taken into consideration by the
Central Government.

1111.... SSSShhhhoooorrrrtttt ttttiiiittttlllleeee,,,, aaaapppppppplllliiiiccccaaaattttiiiioooonnnn aaaannnndddd ccccoooommmmmmmmeeeennnncccceeeemmmmeeeennnntttt.- (1) These rules may be called the Bhagar
Grading and Marking Rules, 2018.
(2) They shall apply to Bhagar, commonly known as samo seed obtained from seed of a
grass Echinochloa colona L. intended for human consumption.
(3) They shall come into force on the date of their final notification in the Official
Gazette.
2222.... DDDDeeeeffffiiiinnnniiiittttiiiioooonnnnssss.-(1) In these rules, unless the context otherwise requires:-
(a) " Adviser" means the Agricultural Marketing Adviser to the Government of India;
(b) "Authorised packer" means a person or a body of persons who had been granted
certificate of authorisation to grade and mark the bhagar in accordance with the
grade standards and procedure specified under these rules;
(c) "Schedule" means a Schedule appended to these rules.
(2) Words and expressions used in these rules and not defined but defined in the
Agricultural Produce (Grading and Marking) Act, 1937 and General Grading and Marking
Rules, 1988 shall have the same meanings as are assigned to them under that Act.
3333.... GGGGrrrraaaaddddeeee ddddeeeessssiiiiggggnnnnaaaattttiiiioooonnnnssss.- The grade designations to indicate the quality of Bhagar shall be as
specified in column I of Schedule-II.
4444.... QQQQuuuuaaaalllliiiittttyyyy.- For the purpose of these rules, the quality of bhagar shall be as specified in
Schedule II.
5555.... GGGGrrrraaaaddddeeee ddddeeeessssiiiiggggnnnnaaaattttiiiioooonnnn mmmmaaaarrrrkkkk.- The grade designation mark shall consist of “AGMARK insignia”
consisting of a design incorporating the certificate of authorisation number, the word "AGMARK",
name of commodity and grade designation resembling the design as specified in Schedule-I.
6666.... MMMMeeeetttthhhhoooodddd ooooffff ppppaaaacccckkkkiiiinnnngggg.- (1) Bhagar shall be packed in new, clean and dried jute bags, cloth
bags, poly woven bags with inner lining of food grade material or poly pouches, High Density Poly
Ethylene bags of food grade material or any other packing material as approved by the Adviser.¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 7
(2) The packages shall be clean, sound, and free from insect, fungal infestation which shall
safeguard the hygienic, nutritional and organoleptic qualities of the bhagar.
(3) The containers including packaging material shall be made of such substances which are safe
and suitable for their intended use and they shall not impart any toxic substance or undesirable
odour or flavour to bhagar.
(4) Bhagar shall be packed in pack sizes in accordance with the provisions of the Legal
Metrology ( Packaged Commodities ) Rules, 2011 or in accordance with the instructions
issued by the Adviser from time to time.
(5) Each package shall contain bhagar of the same type and of the same grade designation.
(6) Each package shall be properly and securely closed and sealed.
7777.... MMMMeeeetttthhhhoooodddd ooooffff MMMMaaaarrrrkkkkiiiinnnngggg.- (1) The grade designation mark shall be securely affixed to or printed
on each package in a manner approved by the Adviser or an officer authorised by him in this
behalf in accordance with the provision of rule 11 of the General Grading and Marking Rules, 1988.
(2) In addition to the grade designation mark, following particulars shall be clearly and indelibly
marked on each label or package, namely :-
(a) Name of the commodity;
(b) Place of packing;
(c) Lot or batch number;
(d) Date of packing;
(e) Grade;
(f) Net weight;
(g) Maximum Retail Price (inclusive of all taxes);
(h) Best before…….date………month……..year;
(i) Name and address of the authorised packer;
(j) Any other information as may be specified under the Legal Metrology (Packaged
Commodities) Rules, 2011, the Food Safety and Standards Act, 2006 or instructions
issued by the Agricultural Marketing Adviser or any officer authorised by him from
time to time;
(k) Crop year or season (optional);
(l) Country of origin or Origin of produce or Geographical region (optional).
(3) The ink used for marking on packages shall not contaminate the product.
(4) The authorised packer may, after obtaining prior approval of the adviser or an officer
authorised by him in this behalf, mark his private trade mark or trade brand on the graded packages
provided that the same does not indicate quality other than that indicated by the grade designation
mark affixed to the graded packages in accordance with the provisions of these rules.
8888.... SSSSppppeeeecccciiiiaaaallll ccccoooonnnnddddiiiittttiiiioooonnnnssss ooooffff cccceeeerrrrttttiiiiffffiiiiccccaaaatttteeee ooooffff aaaauuuutttthhhhoooorrrriiiissssaaaattttiiiioooonnnn....---- In addition to the conditions specified
under the sub-rule (8) of rule 3 of the General Grading and Marking Rules,1988 the following shall
be the special conditions for every certificate of authorization issued for the purpose of these
rules, namely:-
(1) The authorised packer shall either set up his own laboratory as per the specified norms or
have access to an approved State Grading Laboratory or cooperative or association laboratory
or a private commercial laboratory manned by a qualified chemist approved by the Adviser or an
officer authorised by him in this regard in accordance with rule 9 of the General Grading and
Marking Rules, 1988 for testing the quality of bhagar.
(2) The premises shall be maintained in perfect hygienic and sanitary conditions with proper
ventilations and well lighted arrangement and the personnel engaged in these operations shall
be in good health and free from any infectious, contagious or communicable diseases.
(3) The premises shall have adequate storage facilities with clean and proper pucca flooring and

(4) The authorised packer and the approved chemist shall observe all instructions regarding
testing, grading, packing, marking, sealing and maintenance of records which may be issued by
the Adviser or any other officer authorised by him in this regard from time to time.

GRADE DESIGNATION AND QUALITY OF BBBBHHHHAAAAGGGGAAAARRRR
1. Bhagar shall be obtained from seed of a grass Echinochloa colona L. intended for human
consumption.
2. Minimum Requirements:
(1) Bhagar shall be:-
(a) dry, clean and wholesome;
(b) white to creamy white or grayish colour and translucent;
(c) in uniform size, shape, colour and be in merchantable condition;
(d) free from artificial colouring and polishing agent;
(e) free from obnoxious smell;
(f) free from rodent hair and excreta, filth, moulds, live insects, dead insects, insects
fragments and fungus;
(g) free from abnormal taste, flavour and odour.
(2) It shall comply with the restrictions in regard to the limits for metallic contaminants,
crop contaminants, naturally occurring toxic substances, insecticides and pesticides
residues, microbial requirements and other food safety requirements as specified under
the Food Safety and Standards (Contaminants, Toxins and Residues) Regulations, 2011
and the Food Safety and Standards (Food Products Standards and Food Additives)
Regulations, 2011, made under the Food Safety and Standards Act, 2006 (34 of 2006) for
domestic trade.
(3) It shall comply with the residual limits of heavy metals, pesticides and other food safety
requirements as laid down by the Codex Alimentarius Commission, or importing countries

4. Other requirements:
(i) The condition of the Bhagar shall be such so as to enable it.-
- to withstand transport and handling; and
- to arrive in satisfactory condition at the place of destination.
(ii) Bhagar shall be stored in dry and hygienic place at normal room temperature.
5. Explanation:

a result of heat, moisture, weather or microbes.
“WWWWeeeeeeeevvvviiiilllleeeedddd GGGGrrrraaaaiiiinnnnssss”: Weeviled grains are grain kernels that are partially or wholly bored by
insects injurious to grain but do not include germ-eaten grains and egg-spotted grains.
“OOOOtttthhhheeeerrrr EEEEddddiiiibbbblllleeee////ffffoooooooodddd GGGGrrrraaaaiiiinnnnssss”: Edible/Food grains other than the grain under consideration.
““““IIIImmmmmmmmaaaattttuuuurrrreeee””””:::: Kernels or pieces of grain kernels that are not fully developed.
“FFFFoooorrrreeeeiiiiggggnnnn mmmmaaaatttttttteeeerrrr”: Includes inorganic and organic matter. The inorganic matter shall include
sand, gravel, dirt, pebbles, stones, glass and metallic pieces, lumps of earth, clay and mud.
Organic matter shall include husk, chaff, straw, weed seeds and other inedible grains.
