कॉलेज क( )थापना िविनयमावली, 1999” को पुन: संशोिधत करने के िलए एतद ्Oारा िनWिलिखत िविनयम बनाता ह,ै नामत:
1. (i) ये िविनयम, “मिे डकल कॉलेज क( )थापना िविनयमावली (संशोधन), 2019” कह ेजाएगं े।
(ii) ये सरकारी राजप9 म(cid:31) इनके >काशन क( तारीख स े>वृ= ह0गे।
2. “मिे डकल कॉलेज क( )थापना िविनयमावली, 1999” म (cid:31) “प(cid:21)रभाषा” शीषक% के अंतग%त, खंड 2 म,(cid:31) “समुिचत सरकार” क(
प(cid:21)रभाषा के पYात िनWिलिखत प(cid:21)रभाषा जोड़ी जाएगी:
“कंसो(cid:17)शयम (सहायता-सघं )” से कम से कम दो और अिधक स े अिधक चार ऐस े पा9 संगठन0, नामत:
सोसाइटी/Rयास/कंपनी/िव^िव_ालय/मािनत िव^िव_ालय का एक समहू अिभ>ेत ह,E िजRह0ने कंसो(cid:17)शयम नते ा के ज(cid:21)रए कोई
मेिडकल कॉलेज )थािपत करन ेके िलए केRS सरकार/शासी बोड %क( अनमु ित >ा‘ करने हते ु एक पंजीकृत समझौता (cid:19)ापन/करार
(cid:4)कया ह।ै पा9 संगठन0 म (cid:31)स ेएक कंसो(cid:17)शयम नेता होगा, जब(cid:4)क अRय संगठन कंसो(cid:17)शयम सद)य होगा(ह0गे)।

उCेDय के िलए अनRय aप से उपयोग (cid:4)कए जाने के िलए 100 करोड़ aपये का Rयूनतम बजट िवशेष aप से आबं(cid:21)टत करने वाला
संगठन अिभ>ेत ह।ै
“कंसो(cid:17)शयम सद)य” से ऐसा/ऐसे संगठन अिभ>ेत ह/ैह,E िजRह0ने कोई नया मिे डकल )थािपत करन े और चलाने के
उCेDय0 के िलए कंसो(cid:17)शयम नेता के साथ पंजीकृत समझौता (cid:19)ापन/करार (cid:4)कया ह ैऔर इन संगठन0 म(cid:31) से >.यके का अलग-अलग,
िपछल ेिव=ीय वष% म (cid:31)कम से कम 100 करोड़ aपये का टन%ओवर ह ैऔर उRह0ने उP उCेDय के िलए अनRय aप से उपयोग करन े
के िलए Rयूनतम 50 करोड़ aपये का कारपोरेट बजट िवशषे aप से आबं(cid:21)टत (cid:4)कया ह।ै
“पंजीकृत समझौता (cid:19)ापन/करार” स,े समझौता (cid:19)ापन/करार क( शत c और िनबंधन तथा कंसो(cid:17)शयम के >.यके सद)य
क( अपनी-अपनी िजdमेदारी िविनeदf करने वाला कंसो(cid:17)शयम के नेता और कंसो(cid:17)शयम के सद)य0 के बीच िनgपा(cid:4)दत (cid:4)कया
गया और स/म >ािधकारी के पास पंजीकृत समझौता (cid:19)ापन/करार अिभ>ते ह।ै
3. “मेिडकल कॉलेज क( )थापना िविनयमावली, 1999” म,(cid:31) “पा9ता मापदडं ” शीषक% के अतं ग%त खंड-3(1) म,(cid:31) >िवf 7 के aप
म(cid:31) िनWिलिखत जोड़ा जाएगा:
“(7) कंसो(cid:17)शयम”
4. “मेिडकल कॉलेज क( )थापना िविनयमावली, 1999” म(cid:31) खडं 2(5) म(cid:31), खंड 2(5)(क) के aप म(cid:31) िनWिलिखत जोड़ा जाएगा:
“2.(5.क) (cid:4)कसी कंसो(cid:17)शयम को, िनWिलिखत शतi के अधीन, नया मिे डकल कॉलेज )थािपत करन े के िलए आवेदन करन े
क( अनमु ित >दान क( जाएगी:
i. कंसो(cid:17)शयम के सद)य0 क( संjया दो पा9 संगठन0 से कम और चार पा9 संगठन0 से अिधक नहk होगी।
ii. कंसो(cid:17)शयम के सद)य के सद)य एक पंजीकृत समझौता (cid:19)ापन/करार कर(cid:31)ग,े िजसम(cid:31) समझौता (cid:19)ापन/करार क(
शतc और िनबंधन तथा उनक( अपनी-अपनी िजdमेदा(cid:21)रयां िविनeदf क( गई ह0।
iii. कंसो(cid:17)शयम नते ा, केRS सरकार/शासी बोड/%राlय सरकार/संबmन िव^िव_ालय/प(cid:21)रषद ्को आवेदन करन ेका
हकदार होगा और ऐसा िविधक nिP होगा िजसके साथ केRS सरकार/शासी बोड/%राlय सरकार/संबmन
िव^िव_ालय िवचार-िवमश% करेगा।
iv. कंसो(cid:17)शयम नेता Oारा अशं दान क( गई इ(cid:4)oटी, 50% से कम नहk होनी चािहए, जब(cid:4)क कंसो(cid:17)शयम के अRय
सद)य0 क( इ(cid:4)oटी, अलग-अलग 10% स ेकम नहk होनी चािहए।
v. भिू म, कंसो(cid:17)शयम के सद)य0 म (cid:31) स े (cid:4)कसी एक के )वािम.व और कqजे म (cid:31) होनी चािहए और य(cid:4)द पrे पर ह ै तो
यह पrे के नवीकरण के उपबंध के साथ कम से कम तEतीस वष % क( अविध के िलए होनी चािहए। कंसो(cid:17)शयम
के सद)य, भिू म पर )पf )वािम.व वाल े होन े चािहए और यह सभी ऋणभार0 स े मPु होनी चािहए तथा
भिू म या उसके भाग के संबंध म (cid:31)(cid:4)कसी Rयायालय म (cid:31)कोई कानूनी मकु दमा लिं बत नहk होना चािहए।
vi. अ)पताल, कंसोिशयम% के सद)य0 म(cid:31) से (cid:4)कसी एक के )वािम.व और कqजे म(cid:31) हो सकता ह,ै तथािप, य(cid:4)द
मेिडकल कॉलेज क( )थापना के िलए अनुमित >दान क( जाती ह ै तो िनWिलिखत शतc, पजं ीकृत समझौता
(cid:19)ापन/करार का अिभt अंग होनी चािहए:
(1) (cid:4)क पंजीकृत समझौता (cid:19)ापन/करार म(cid:31) िवशेष aप से ऐसी दस वष% क( प(cid:21)रबंधन अविध का उपबंध (cid:4)कया जाना
चािहए, िजससे पहल ेकंसो(cid:17)शयम नेता और कंसो(cid:17)शयम सद)य कंसो(cid:17)शयम से िनगम% न नही कर सकते। य(cid:4)द दस वष% क(
अविध समा‘ होन े स े पहले कंसो(cid:17)शयम का कोई सद)य िनगम% न करता ह,ै तो ऐसा/ऐसे सद)य, पंजीकृत समझौता
(cid:19)ापन /करार के अंतग%त, कंसो(cid:17)शयम िनिध म(cid:31), उसके Oारा धा(cid:21)रत इ(cid:4)oटी के चार गुणा के समतु(cid:6)य रकम का भुगतान
करन े के िलए िजdमेदार होगा/ह0गे। कंसो(cid:17)शयम के (cid:4)कसी सद)य के पास यह िवक(cid:6)प होगा (cid:4)क वह दस वष %क( समाि‘
के पYात कंसो(cid:17)शयम स ेिनग%मन कर सके, तथािप, कंसो(cid:17)शयम के िनग%मन करना वाले सद)य का >ित)थापन, िनगम% न
करने वाले सद)य Oारा धा(cid:21)रत इ(cid:4)oटी के समतु(cid:6)य इ(cid:4)oटी लान ेवाल ेऔर िविनयमावली के अतं ग%त उपबंिधत अRय शत u
पूरी करने वाल े(cid:4)कसी अRय संगठन Oारा (cid:4)कया जाएगा।
(2) (cid:4)क पंजीकृत समझौता (cid:19)ापन/करार म (cid:31)िवशेष aप स ेयह उपबधं होना चािहए (cid:4)क मिे डकल कॉलेज म (cid:31)छा90 के अvययन
करते रहने के समय तक, कंसो(cid:17)शयम (cid:4)कसी भी प(cid:21)र)थित म(cid:31) िवघ(cid:21)टत नहk (cid:4)कया जा सकता। य(cid:4)द मिे डकल कॉलेज म (cid:31)¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 3
छा90 के अvययन करते रहने के समय कंसो(cid:17)शयम िवघ(cid:21)टत कर (cid:4)दया जाता ह ै या मिे डकल कॉलेज बंद कर (cid:4)दया जाता
ह ै तो कंसो(cid:17)शयम का >.यके सद)य या तो संयु्P aप स े या अलग-अलग, उस राlय सरकार, िजसके /े9ािधकार म (cid:31)
मेिडकल कॉलेज ि)थत ह,ै को शा)ती के aप म (cid:31)100 करोड़ aपये क( रकम का भुगतान करने के िलए िजdमेदार होगा।
(3) (cid:4)क (cid:4)कसी नय े मिे डकल कॉलजे क( )थापना के उCेDय के िलए सिृ जत पंजीकृत समझौता (cid:19)ापन/करार के अतं ग%त
कंसो(cid:17)शयम िनिध का मू(cid:6)य, 250 करोड़ aपय ेसे कम नहk होगा।
(4) (cid:4)क पंजीकृत समझौता (cid:19)ापन/करार म (cid:31) िवशेष aप स े यह उपबंध होना चािहए (cid:4)क कंसो(cid:17)शयम के >.यके सद)य को,
कंसो(cid:17)शयम म (cid:31) उसक( इ(cid:4)oटी के अनसु ार प(cid:21)रषद के प/ म (cid:31) अलग बकE गारंटी (गारं(cid:21)टयां) िनgपा(cid:4)दत करनी होगी और
बEक गारंटी क( कुल धनरािश, कुल िमलाकर 5 करोड़ aपये होगी। प(cid:21)रषद, दस वष %क( समाि‘ स े पहल,े (cid:4)कसी सद)य
के कंसो(cid:17)शयम से िनग%मन क( ि)थित म,(cid:31) इस ेभनु ाने क( हकदार होगी।
(5) (cid:4)क मिे डकल कॉलेज और अ)पताल, भूिम के एक एकल भूखंड पर होना चािहए। य(cid:4)द मेिडकल कॉलेज और अ)पताल
भिू म के दो टुकड़0 पर ह ै तो मिे डकल कॉलेज और अ)पताल के िलए भूिम के संबंध म (cid:31) िविनयम के अंतग%त िविनधा(cid:21)% रत
शत%, कंसो(cid:17)शयम Oारा परू ी क( जानी चािहए।
(6) (cid:4)क कंसो(cid:17)शयम के सद)य के )वािम.व वाला और के Oारा >बिं धत अ)पताल भिू म, िजसका /9े िनयमावली के अंतग%त
िविनधा%(cid:21)रत /े9 स े कम न हो, के भूखंड पर ि)थत एक अvयापन सं)थान म(cid:31) िवकिसत (cid:4)कए जान े म (cid:31) स/म आवDयक
अवसंरचना.मक सुिवधाx के साथ Rयूनतम 300 िब)तर0 वाला अ)पताल होना चािहए। यह मेिडकल कॉलेज, छा90
और )टाफ के िलए िन:शु(cid:6)क प(cid:21)रवहन सिु वधाए ं उपलqध कराएगा। उP अ)पताल, भूिम के एक टुकड़ े पर होगा और
पु)तकालय सिहत कालेज का भवन और छा90/इंटनi, zातको=र0/रेजीडट(cid:31) 0, नस{ के िलए हो)टल, भूिम के दो टुकड़0
म(cid:31) स े(cid:4)कसी एक पर रखा जा सकता ह।ै
(7) कंसो(cid:17)शयम यह सुिनिYत करेगा (cid:4)क 300 िब)तर0 वाल े अ)पताल का उपयोग अनRय aप स े छा90 के अvयापन और
>िश/ण के िलए (cid:4)कया जाए और अ)पताल का उtयन, िविनयमावली क( शतi के अनुसार (cid:4)कया जाए।
(8) नया मिे डकल कॉलेज आरंभ करन ेके िलए आवदे क Oारा आवेदन (cid:4)कए जान ेस ेपहले, अ)पताल को, समिु चत आशोधन0
के ज(cid:21)रए एक अvयापन अ)पताल म (cid:31) उपयPु ढंग स े प(cid:21)रव(cid:17)तत (cid:4)कया जाना चािहए, िवशेष aप से 300 िब)तर0 के,
श(cid:6)य िच(cid:4)क.सीय िवशेष(cid:19)ताx के िलए 120 िब)तर0, मिे डकल िवशेष(cid:19)ाताx के िलए 120 िब)तर0 और >सिू त एव ं
}ी रोग-िव(cid:19)ान के िलए 60 िब)तर0 के अलग-अलग िववरण के संदभ% म (cid:31) अपिे /त वाड % आकार, अvयापन और
>िश/ण )थान तथा िविनयिमत करन े वाले िविनयम0 के अनसु ार अRय िविनधा(cid:21)% रत शतi के साथ 30-30 िब)तर0 क(
नैदािनक इकाइया ंबनाने म (cid:31)भी स/म होना चािहए।
(9) अ)पताल म,(cid:31) 50/100/150/200/250, जैसा भी मामला हो, क( कॉलेज क( अनमु ित >ा‘ वा(cid:17)षक >वेश /मता के
संबंध म,(cid:31) िविनयिमत करन े वाली िविनयमावली Oारा यथा िविनधा(cid:21)% रत, िब)तर0 क( सjं या म(cid:31) विृ m और उतनी ही
अvय ापन इकाइय0 तथा अvय ापन अनुपरू ण सिहत इस के आविधक aप स ेउR नत (cid:4)कए जाने क( सभी ~ यवहायत% ा होनी
चािहए।
(10) नसi और िनdन वग(cid:127)य )ट ाफ सिहत उ4 त अ) पताल म (cid:31) काय%रत का(cid:17)मक0, तकनीिशयन0, पारा नैदािनक ) टाफ को
य(cid:4)द मेिडकल कॉलेज म(cid:31) )थ ानातं (cid:21)रत (cid:4)कया जाता ह ै तो ) थानातं (cid:21)रत (cid:4)कए जान े पर, यह सुिनिYत करत े Qए (cid:4)क (cid:4)कसी
>कार का कोई ‘दोहरा’ >शासिनक िनयं9ण न हो, वे मिे डकल कॉलेज के डीन के >शासिनक िनयं9णाधीन ह0गे।
(11) इस >कार के िवचा(cid:21)रत >शासिनक िनयं9ण म (cid:31)‘शैि/क’, ‘नैदािनक’ और ‘िव. तीय’ पहलु भी शािमल ह0गे।

AMENDMENT NOTIFICATION
New Delhi, the 13th May, 2019
No. MCI-34(41)/2019-Med./112859.—The Board of Governors in supersession of the Medical
Council of India have decided to make amendments in the Establishment of Medical College Regulations,
1999. These amendments are being made with the object of inviting greater participation from the private
sector to come forward for establishing medical colleges and imparting high quality medical education and
training facilities to the students aspiring to become doctors without compromising the standards of medical
education.
Accordingly, the Board of Governors in super-session of Medical Council of India in exercise of the
powers conferred by Section 33 of the Indian Medical Council Act, 1956 (102 of 1956), and with the previous
sanction of the Central Government, hereby makes the following Regulations to further amend the
“Establishment of Medical College Regulations, 1999”, namely: -
1. (i) These Regulations may be called the “Establishment of Medical College Regulations(Amendment),
2019”.
(ii) They shall come into force from the date of their publication in the Official Gazette.¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 5
2. In the “Establishment of Medical College Regulations, 1999’ under the Heading Definition in Clause 2
following definition shall be added after the definition of “Appropriate Government”:
“Consortium” means a group of not less than two eligible organizations, namely, Society / Trust /
Company / University / Deemed University, but not more than four such organizations, who have entered
into a Registered Memorandum of Understanding / Agreement for seeking permission of the Central
Government / Board of Governors for setting up a medical college through the Consortium Leader. One of
the eligible organization shall be the Consortium Leader while other organizations shall be Consortium
Member(s).
“Consortium Leader” means the organization entitled to make application to the Central Government /
Board of Governors for the purposes of establishment and running a new medical college with an annual
turnover of not less than Rs.500 crores in the preceding Financial Year and have specifically allocated a
minimum corporate budget of Rs.100 crores to be exclusively utilised for the said purpose.
“Consortium Member(s)” means the organization(s) who have entered into Registered Memorandum of
Understanding / Agreement with the Consortium Leader for the purposes of establishment and running of a
new medical college and each of such organisation(s) is individually having an annual turnover of not less
than Rs.100 crores in the preceding Financial Year and have specifically allocated a minimum corporate
budget of Rs.50 crores to be exclusively utilised for the said purpose.
“Registered Memorandum of Understanding / Agreement” means the Memorandum of Understanding /
Agreement executed between the Consortium Leader and Consortium Member(s) specifying the terms and
conditions of Memorandum of Understanding / Agreement and the respective responsibility of each of the
members of the Consortium and registered with the competent authority.
3. In the “Establishment of Medical College Regulations, 1999’ in Clause 3 (1) – under the Heading Eligibility
Criteria following shall be added as Entry 7:
“ (7) Consortium
4. In the “Establishment of Medical College Regulations, 1999’ in Clause 2 (5), the following shall be added
as Clause 2 (5) (A):
“2.(5.A) A Consortium shall be permitted to make an application for establishment of new medical college
subject to the following conditions:
(i) The number of Members of the Consortium shall not be less than two eligible organizations and not
more than four eligible organizations.
(ii) The Members of the Consortium shall enter into a Registered Memorandum of Understanding /
Agreement specifying the terms and conditions of Memorandum of Understanding / Agreement and
their respective responsibilities.
(iii) The Consortium Leader shall be entitled to make the application to the Central Government/Board of
Governors/State Government/Affiliating University / Council and shall be the legal person with which
the Central Government/Board of Governors/ State Government / Affiliating University / Council
shall interact.
(iv) The minimum equity contributed by the Consortium Leader should not beless than 50% while that of
the other members of the Consortium should not be less than 10% individually.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]
(v) The land should be owned and possessed by one of the Members of the Consortium and if on lease
should be for a period not less than thirty-three years, with provision for lease renewal. The
Member(s) of the Consortium should be having a clear title over the land and it should be free from all
encumbrances as also there should not be any legal proceeding pending in any Court of law in respect
of the land or part thereof
(vi) The Hospital can be owned and possessed by one of the Member of the Consortium, however, in case
permission for establishment of Medical College is granted following conditions, should form integral
part and parcel of the Registered Memorandum of Understanding / Agreement:-
(1) That the Registered Memorandum of Understanding / Agreement should specifically provide
for a lock in period of ten years before which the Consortium Leader and Consortium
Members cannot exit the Consortium. In the event, any member of the Consortium exits
before the expiry of ten years then such member(s) shall be liable to make payment of a sum
equivalent to four times of the equity held by it under the Registered Memorandum of
Understanding / Agreement in the Consortium Fund. It shall be open for any member of the
Consortium to exit Consortium after expiry of ten years, however, the exiting member of the
Consortium will have to be replaced by some other organization (s) bringing in the equivalent
equity held by the exiting member and fulfilling the other conditions provided under the
Regulations;
(2) That the Registered Memorandum of Understanding / Agreement should specifically provide
that the Consortium cannot be dissolved under any circumstance till the time the students are
studying in the medical college. In the event, the Consortium is dissolved while the students
are still studying in the medical college or the medical college is closed down then each
member of the Consortium, either jointly or severally, shall be liable to pay a sum of Rs. 100
crores as penalty to the State Government in whose jurisdiction the medical college is
situated.
(3) That the value of the Consortium Fund under the Registered Memorandum of Understanding /
Agreement created for thepurpose of establishment of a new medical college shall not be less
than 250 crores;
(4) That the Registered Memorandum of Understanding / Agreement should specifically provide
that each member of the Consortium has to execute in favour of the Council separate Bank
Guarantee(s) in accordance with their equity in the Consortium and the total amount of Bang
Guarantee taken together shall be for a sum of Rs. 5 crores. The Council shall be entitled to
encash in the event any of the members of the Consortium exits from the Consortium before
the expiry of ten years.
(5) That the Medical College and Hospital should be on one single plot of land. In case, the
Medical College and Hospital are on two pieces of land, then the requirement prescribed
under the Regulation regarding land for the Medical College and Hospital should be met by
the Consortium.
(6) That the hospital owned and managed by the Member of the Consortium should be minimum
300 bedded hospital with necessary infrastructural facilities capable of being developed into a
teaching institution situated on a plot of land having an area not less than prescribed under the
Regulations. The medical college shall provide free transportation facilities for students and¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 7
staff. The said hospital would be on one piece of the land and the building of the college
including library and hostel for the students/interns, PGs/Residents, nurses may be housed on
any of the two pieces of land.
(7) The Consortium shall ensure that the 300 bedded Hospital is utilized solely for the teaching and
training of students and that such Hospital is upgraded in accordance with the requirement of
Regulations.
(8) The hospital must be suitably altered through appropriate modifications into a teaching hospital
specially with reference to the break up of the 300 beds into 120 beds for Surgical Specialties, 120
for Medical Specialties and 60 for Obstetrics & Gynecology and also capable of forming clinical
units of 30 beds each with required ward size, teaching and training space and other prescribed
requirements as per the governing regulations before the application is made by the applicant for
starting the new medical college.
(9) The hospital should have all the feasibility for it being periodically upgraded including the
augmentation of the number of beds and commensurate teaching units and teaching compliment
as prescribed by the Governing Regulations with respect to the permitted annual intake for the
college of 50/100/150/200/250 as the case may be.
(10) The personnel working in the said hospital, technicians, para clinical staff including nurses and
the menial staff, if transferred to medical college, upon their transfer shall be under the
administrative control of the Dean of the Medical College ensuring that there is no “duality” of
administrative control of any type.
(11) The administrative control so envisaged would include “Academic”, “Clinical” and “Financial”
aspects as well.
(12) The clinical staff working at the said hospital other than those who conform to the prescribed
eligibility for being designated as Assistant Professor, Associate Professor, Professor of the
concerned subject, as the case may be prescribed by the Teachers’ Eligibility Qualification
Regulations will have to be replaced by the full time appointment of the requisite number of duly
qualified full time medical teachers, such replacement will not apply to non-teaching position like
Casualty Medical Officer, Hospital Administrators, etc. in accordance with the prescribed
requirements under the governing Regulations. In order to ensure that the binding operational
dictum that “teaching physician has to be the treating physician” meaning thereby that the
“treating” personnel would be the one who would be the “teaching” personnel.”
(vii) The Essentiality Certificate to be granted by the concerned State Government shall specify the
fulfilment of the conditions mention in sub-clause (vi)(1) to (3) above.
(viii) The Consortium granted LOP for establishment of Medical College shall not indulge in
commercialization of the medical college.
5. In the “Establishment of Medical College Regulations, 1999’ in Clause 2 (7), the following shall be added:
In addition to the Bank Guarantees to be submitted by the individual members of the Consortium to the
Council under the Registered Memorandum of Understanding / Agreement, the Consortium has to
submit a Performance Bank Guarantee of double the amount prescribed for a non-governmental entity

6. In the “Establishment of Medical College Regulations, 1999’ in Form-1, Format of Application for
Permission of the Central Government to Establish a New Medical College the term ‘Company”
&“Consortium” shall be added in entries no. 1, 4, 7 & 9,:
