NOTIFICATION
New Delhi, the 13th November, 2014.
S.O. 2908(E).—Whereas, the Mahadayi Water Disputes Tribunal (hereinafter called the said Tribunal) was
constituted on the 16th November, 2010 vide notification number S.O.2786 (E), dated the 16th November, 2010 under
section 4 of the Inter-State River Water Disputes, Act, 1956 (33 of 1956) (hereinafter called the said Act) for the
adjudication of the water disputes regarding Inter-State river Mahadayi and river valley thereof;
And Whereas, the said Tribunal was required to submit its report and decision under sub-section (2) of Section
5 of the said Act within a period of three years, on or before the 15th November, 2013 ;
And Whereas, the said Tribunal had requested to extend the period of submission of report and decision for a
further period of one year with effect from 16th November, 2013 ;
And Whereas, the Central Government vide notification number S.O. 3404 (E), dated the 8th November, 2013,
had extended the period of submission of report and decision for a further period of one year upto 15th November,
2014 ;
And Whereas, the said Tribunal has requested the Central Government to reckon the effective date of its
functioning, i.e. 21st August, 2013 to be the date its constitution for the propose of sub section (2) of Section 5 of the
said Act;
And Whereas, the Hon’ble Supreme Court vide its order dated 17th December, 2008 passed in Writ Petition
(C) No. 408 of 2008 between the State of Karnataka Vs Union of India directed the Central Government to treat
effective date of the constitution of the Krishna Water Dispute Tribunal under section 3 of the said Act as 1st February,
2006 instead of 2nd April, 2004 when the said Tribunal was constituted;¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 3
And Whereas, the Hon’ble Supreme Court vide its order dated 13th December, 2013 passed in Interlocutory
Application No.8 of 2013 in Writ Petition (C) No. 443 of 2006 between State of Orissa Vs Government of India directed
the Central Government to consider the 17th September, 2012 as the effective date of the constitution of Vansadhara
Water Dispute Tribunal for the purpose of calculating the period of three years provided under sub-section (2) of
Section 5 of the said Act instead of 24th February, 2010 when the said Tribunal was constituted;
Now, therefore, the Central Government, having regard to the decision taken by the Hon’ble Supreme Court in similar
matters as stated above, has decided that the effective date of constitution of said Tribunal shall be 21st August, 2013,
and accordingly, the said Tribunal shall forward its report to the Central Government under the provisions of
sub-section (2) of Section 5 of the said Act, within a period of three years therefrom, i.e. on or before the
20th August, 2016.
