दौरान कायक(cid:8) ारी सद(cid:24)य के Kप म# िनय(cid:30)ु त कर सकती ह,O और ऐसे काय(cid:8)कारी सद(cid:24) य के पास इस (cid:27)कार से काय (cid:8) करते समय उस
सद(cid:24) य कL सभी शि(cid:30) तयां हBगी और वह उनके सभी कत(cid:8)Q यB का िनव(cid:8)हन कर#गे और उनकL सभी (ितपSू त के हकदार हBगे िजनके

जसै ा वह उिचत समझ।े ऐसे सभी अिधकारी और कमच(cid:8) ारी (cid:27)ािधकरण के एकल िनयं;ण म# हBगे ।
(ख) (cid:27)ािधकरण, क#9ीय सरकार के पूव(cid:8) अनुमोदन स े आवासीय िनवास, मकान +कराया भ0 ते, या;ा भ0 त,े दिै नक
भ0 त,े प(cid:18)रवहन भ0 त े और िच+क0स ा (cid:27)ितपूSत के संबंध म# ऐस े सभी अिधका(cid:18)रयB और कम(cid:8)चा(cid:18)रयB कL सेवा शतH
का िविनयमन करने के िलए िविनयमB को बना सकता ह।ै

(घ) (cid:27)ािधकरण, रा2 य सरकार के साथ (cid:27)ािधकरण म # पूणक(cid:8) ािलक रोजगार या (cid:27)ािधकरण के िलए +कसी काय(cid:8) या
सेवाW के िन7 पादन के िलए आं5 (cid:27)दशे और तेलंगाना कL रा2 य सरकारB म# तैनात Q यि(cid:30)त यB कL सेवाW को

(ङ) वे कमच(cid:8) ारी, जो (cid:27)ािधकरण कL अिधसचू ना के तुरंत पूव(cid:8) िनयिमत आधार पर पोलावरम प(cid:18)रयोजना पर काय(cid:8)
कर रह े थ,े अिधसचू ना के प$च ात् प(cid:18)रयोजना पर काय(cid:8) करना जारी रख#ग े और उ= ह # तब तक (cid:27)ािधकरण म #
(cid:27)ितिनयुि(cid:30) त पर माना जाएगा, जब तक +क (cid:27)ािधकरण कोई वैकि@ पक Qय व(cid:24) था न कर ल,े य+द ऐसा करना
आव$ यक समझा जाए ।
(च) (cid:27)ािधकरण के सभी पदB को (cid:27)ािधकरण म# िनयुि(cid:30) त के िलए तुरंत आमेलन के िनयम से छूट दी जाएगी ।

आव$ यक काय(cid:8) करने के िलए दािय0व ाधीन होगी, जो सभी अपेि(त िनबा(cid:8)धनB िजसके अंतग(cid:8)त पया(cid:8)वरण, वन और पुनवा(cid:8)स तथा
पुन(cid:8)Q यव(cid:24) थापन सिं नयमB और िविनयमB तथा पोलावरम िवकास प(cid:18)रयोजना भी को (cid:27)ा) त करना जो समिू चत और समीचीन
ह ै।
(2) शासी िनकाय कL शि(cid:30) तयB, कायH और कत(cid:8)Qय B म #िन. निलिखत शािमल हो सकेग# :
(क) पोलावरम प(cid:18)रयोजना (cid:27)ािधकरण कL काय(cid:8)(cid:27)णाली का पय(cid:8)वे(ण;

1. (cid:27)ािधकरण अिधमानत: संबंिधत रा2 य िवभाग और/या +कसी अ= य िवशषे ^ एजस# ी के मा/ यम से प(cid:18)रयोजना का
काया=(cid:8) वयन करेगा और सभी अपेि(त अनापिZया,ं िजसके अंतग(cid:8)त पया(cid:8)वरणीय, वन और iquZLFkkiuk और
iquZokl सिं नयम भी ह ै (cid:27)ा) त करेगा और उसके पास पोलावरम प(cid:18)रयोजना के िविनयमन और िवकास का
दािय0व स ेभा(cid:18)रत होगा ।
2. (cid:27)ािधकरण, पोलावरम प(cid:18)रयोजना के अंतग(cid:8)त आ) लािवत होने वाली सभं ािवत भिू म और सपं दाW के अिधJहण
और उ= ह # (cid:27)ािधकरण को उपलN ध करवाने के मामल े और उनके अधीन बेदखल +कए जान े वाले Q यि(cid:30) तयB कL
(ितपूSत और iquZokl के मामल े म # संबिं धत रा2य B Cारा समयबC पूण(cid:8) अनुपालन के िलए जहां कहV भी
आव$ यक हो उपयु(cid:30) त िनदशे जारी करेगा ।
3. (cid:27)ािधकरण संबिं धत रा2 य सरकार (सरकारB) या क#9ीय जल आयोग Cारा ऐसी न+दयB ((cid:24) _ीमB) और अ= य
(cid:24) वचािलत (cid:18)रकॉडर(cid:8) B से यु(cid:30) त ग3े जग (cid:24) टेशनB कL (cid:24)थ ापना, रख-रखाव और (cid:27)चालन कराएगा, जहां गोदावरी जल
िववाद अिधकरण के आदशे B के उपबंधB का काया(cid:8)= वयन करने के िलए और पोलावरम प(cid:18)रयोजना के संबंध म #
अपेि(त (cid:18)रकॉडH को (cid:27)ा) त करने के िलए समय-समय पर यथाव$ यक िन(cid:24) सरण, गाद, जल गुणवZा और
वा7प ीकरण (cid:27)(े ण क#9 और मापन (cid:27)णािलया ंमौजूद हB ।
4. (cid:27)ािधकरण गोदावरी जल िववाद अिधकरण के अवाड (cid:8) के काया=(cid:8) वयन और अनुपू(cid:18)रत करने के िलए जल-लखे ाW
के िनयमB को तैयार करेगा ।
5. (cid:27)ािधकरण िव>ुत मं;ालय Cारा अिधसचू ना के अनुसार पोलावरम प(cid:18)रयोजना से उ0 प=न िबजली का सबं ंिधत
रा2 यB के बीच आबंटन का िविनयमन करेगा।
6. (cid:27)ािधकरण, +कसी जल वष(cid:8) म #(+कसी वष(cid:8) के 1 जून से अगल ेवष(cid:8) के 31 मई तक) दस +दवसीय आधार पर (cid:27)0 यके
मु(cid:3) य / शाखा हडे वक(cid:8) Cारा भंडा(cid:18)रत जल के उपयोग कL मा;ा, पोलावरम जलाशय म #भंडारण +कए गए जल के

अनुसरण म # जल के उपयकु ् त (cid:27)बंधन िजसके अंतग(cid:8)त िवशेषतया पोलावरम जलाशय से जल कL िनकासी के
तरीके और N यौरे भी ह,O के िलए िनण(cid:8)य लेगा ।
9. (cid:27)ािधकरण बाढ़ पूवा(cid:8)नुमान और बाढ़ िनयं;ण कL एक (cid:27)भावी (cid:27)णाली कL (cid:24) थापन, अनुर(णऔर (cid:27)चालन िजसके
अ= तग(cid:8)त भारी वष(cid:8)ण और दरू संचार (cid:27)णाली (cid:18)रपोट (cid:8) करना भी ह,ै के िलए उपयु(cid:30)त िनदशे जारी करेगा ।

NOTIFICATION
New Delhi, the 28th May, 2014
F. No. 15/4/2014-E-IV.—Whereas the Andhra Pradesh Reorganisation Act, 2014 (6 of 2014-
hereinafter referred to as the Act) declares Polavaram Irrigation Project to be a national project [under
Sub-section (1) of Section 90] and it is expedient in the public interest that the Union should take under its
control the regulation and development of the Polavaram Irrigation Project for the purposes of irrigation [under
Sub-section (2) of Section 90];
And whereas under Sub-section (4) of Section 90 of the Act mandates that the Central Government
shall execute the project and obtain all requisite clearances including environmental, forests, and rehabilitation
and resettlement norms;
Now, therefore, in pursuance of said section and to carry out the purposes of the said provisions of the
Act, the Central Government hereby constitutes the Governing Body to Polavaram Project Authority and the
Polavaram Project Authority as follows;
I. Governing Body to Polavaram Project Authority
There shall be a Governing Body to the Polavaram Project Authority, which shall consist of the
following :
(i) The Secretary to the Government of India, Ministry of Water Resources - Chairperson
(ii) The Chief Secretary to the Government of Andhra Pradesh - Member
(iii) The Chief Secretary to the Government of Telangana - Member
(iv) The Secretaries to the Government of India, Ministries of Environment
and Forests, Finance (Dept. of Expenditure), Power and Tribal
Welfare (or their nominee(s) not below the rank of Joint Secretary) - Member
(v) The Chief Executive Officer, Polavaram Project Authority - Member
(vi) A representative of Planning Commission (not below the rank of
Joint Secretary) - Member
(vii) Member Secretary, Polavaram Project Authority - Member Secretary
II. Polavaram Project Authority
There shall be constitution of an Authority called the Polavaram Project Authority (hereinafter referred
to as the Authority);
2. The Authority shall consist of a Chief Executive Officer (CEO) and eleven Members, as under;
(i) The Chief Executive Officer - Chairman
(ii) The Principal Secretary or Secretary of Irrigation or Water
Resources Department of the successor State of Telangana - Member6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 1]
(iii) The Principal Secretary or Secretary of Irrigation or Water
Resources Department of the successor State of Andhra Pradesh - Member
(iv) Two Chief Engineers (Senior Administrative Grade), one each
from Central Water Engineering (Group ‘A’) Service and
Central Power Engineering (Group ‘A’) Service to be in-charge of
Planning and Design and Power Wing respectively - Members
(v) Three Chief Engineers to be deputed by the State Government
to be in-charge of the works for the Dam and appurtenant Structures,
Power House and associated works and Canal system - Members
(vi) Commissioner in-charge of Land Acquisition and Rehabilitation of
States of Andhra Pradesh and Telangana - Member
(vii) Financial Adviser, Ministry of Water Resources - Member
(viii) One Chief Engineer (Senior Administrative Grade) from Central
Water Engineering (Group ‘A’) Service -Member Secretary
3. The Chief Executive Officer and Members at serial numbers (iv), (v) and (viii) shall be posted to the
Authority on full time basis by the Central Government or the State Government, as the case may be.
4. The Chief Executive Officer shall be appointed by the Central Government from amongst Officers
empanelled for the post of Additional Secretary to the Government of India with a fixed tenure of at least three
years and he shall be in-charge of the Authority under the general supervision and control of the Governing
Body.
5. The Chief Executive Officer shall have all the administrative, financial and work powers as
available to the Head of the Department in the Central Government.
6. On any vacancy occurring in the Offices of Chief Executive Officer and the Members, the Central
Government or the State Government, as the case may be, shall post a person to such vacant office:
Provided that in case of illness or absence of a Member, the Central Government or the State
Government, as the case may be, may post a person, who is otherwise eligible to hold the appointment, as an
acting Member during such illness or absence and such acting Member shall, while so acting, have all the
powers and perform all the duties and be entitled to the indemnities of the Member, in whose place he/she so
acts.
7. Officers and servants of the Authority
(a) The Authority may from time to time appoint or employ such officers and employees as it
thinks fit. All such officers and employees shall be subject to the sole control of the Authority.
(b) The Authority may, with the previous approval of the Central Government, make regulations to
regulate conditions of service of all such officers and employees in respect of residential
accommodation, house rent allowance, travelling allowance, daily allowance, conveyance
allowance and medical reimbursement.
(c) The scales of pay, allowances (including project allowance) and other service conditions shall
be as applicable to Central Government employees.
(d) The Authority shall arrange with the State Governments to spare the services of the persons
employed in the State Governments of Andhra Pradesh and Telangana for whole-time
employment with the Authority, or for the performance of any work or services for the
Authority, and in that case, the scales of pay, allowances (including project allowance) and
other service conditions of such employees may be as applicable to concerned State
Government employees.
(e) The personnel, which immediately before the notification of the Authority, was working on the
Polavaram Project on regular basis, shall continue to work on the project after notification and¹Hkkx Iµ[k.M 1º Hkkjr dk jkti=k % vlk/kj.k 7
would be deemed to be on deputation to the Authority till the Authority makes alternate
arrangement, if so considered necessary.
(f) All the posts of the Authority shall be exempted from the rule of immediate absorption for
appointment in the Authority.
8. Powers, functions and duties of the Governing Body
(1) The Governing Body to the Polavaram Project Authority shall be charged with the power and
shall be under a duty to do any or all things necessary, sufficient and expedient for obtaining all
requisite clearances including environmental, forests, and rehabilitation and resettlement norms
and regulation and development of the Polavaram Project.
(2) The power, functions and duties of the Governing Body may include –
(a) supervision of the functioning of the Polavaram Project Authority;
(b) expediting the statutory clearances from the Ministry of Environment and Forests and
investment clearance from the Planning Commission;
(c) finalisation of phasing and construction programmes of the Polavaram Project with a view to
obtaining expeditiously optimum benefits during and after the completion of the construction
of the project in accordance with decision of Godavari Water Disputes Tribunal related to
Polavaram project and conditionality of statutory clearances;
(d) deciding about organizational structure of the Authority and delegation of powers to the
Chief Executive Officer and other Members and Officers of the Authority.
9. Powers, functions and duties of the Authority
(1) The Authority shall execute the project, preferably through the concerned State Departments
and/or any other expert agency, and obtain all requisite clearances including environmental,
forests, and rehabilitation and resettlement norms and shall be charged with the regulation and
development of the Polavaram Project.
(2) The Authority shall issue appropriate directions, whenever necessary for timely and full
compliance by the concerned States in the matter of acquisition for and making available to
Authority lands and properties likely to be submerged under the Polavaram Project and in the
matter of compensation and rehabilitation of oustees thereunder.
(3) The Authority shall cause to be established, maintained and operated by the State
Government(s) concerned or Central Water Commission, such stream and other gauging
stations, equipped with automatic recorders, where necessary, discharge, silt, water quality and
evaporation observation stations and measuring devices as may be necessary from time to time
for securing the records required to implement the provisions of the orders of the Godavari
Water Disputes Tribunal with regard to Polavaram Project.
(4) The Authority shall frame rules for water accounting to implement and supplement the
provisions of the Award of the Godavari Water Disputes Tribunal.
(5) The Authority shall regulate distribution of power generated from the Polavaram project
amongst the States, as notified by the Ministry of Power.
(6) The Authority shall determine the volume of water stored, flowing in and out of the Polavaram
reservoir, the volume of water utilized through each Main or Branch head works, evaporation
and seepage losses on ten daily basis in a water year (1stJune of a year to the 31stMay of next
year).
(7) The Authority or any of its duly authorized representatives shall have power to enter upon any
land and property upon which any work of gauging, evaporation or other hydrological station
or measuring device has been or is being constructed, operated or maintained by any State for8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 1]
the use of Polavaram water and each State through its appropriate departments shall render all
cooperation and assistance to the Authority and its authorized representatives in this behalf.
(8) The Authority shall meet as often as necessary and decide on a proper management of waters
including in particular the manner and details of withdrawals of waters from Polavaram
reservoir in accordance with the orders of the Godavari Water Disputes Tribunal.
(9) The Authority shall issue appropriate directions for establishment, maintenance and operation
of an effective system of flood forecasting and flood control including reporting of heavy
precipitation and telecommunication systems and the Authority shall publish annually and
make available to party States the data regarding operation of reservoirs during floods.
(10) The Authority shall also perform any other function as directed by the Governing Body and
the Central Government from time to time.
10. Annual Report of the Authority - The Authority shall prepare and transmit to the Central
Government as early as possible and in any case before the end of December, an Annual Report covering the
activities of the Authority for preceding financial year and to make available to the Government of each of the
Party States, on its request, any information within its possession any time and always provide access to its
records to the Central Government and their representatives.
11. Records of the Authority and their location –
(1) The Authority shall keep a record of all meetings and proceedings, maintain regular accounts,
and have suitable offices where documents, records, accounts and gauging data shall be kept
open for inspection by the Central Government or their representatives at such times and under
such regulations as the Authority may determine.
(2) The headquarters of the Authority shall be initially at Hyderabad – the common capital of
successor States of Andhra Pradesh and Telangana, till the Authority takes any decision in this
regard.
