The Central Govt. in exercise of the executive power conferred on it under article 73 of the Constitution specifies that the FORM-I prescribed by the said amendment may also be used for furnishing return for the period 1st January, 2015 to 31st March, 2015 by the said employers for the purposes of sub-section (1) of section 4 of the Act.
This notification, S.O. 1124(E), issued by the Ministry of Labour and Employment on April 15, 2015, addresses amendments to the Labour Laws (Exemption from Furnishing Returns and Maintaining Registers by Certain Establishments) Act, 1988. These amendments, introduced by the Labour Laws (Exemption from Furnishing Returns and Maintaining Registers by Certain Establishments) Amendment Act, 2014, include the substitution of the Second Schedule to the Principal Act with a new Second Schedule providing a new FORMI.
The notification clarifies that the new FORMI, designed for annual returns covering the period from April 1st to March 31st of the following year, may also be used by small and very small establishments to furnish returns specifically for the period from January 1, 2015, to March 31, 2015. This specification is made under the executive power conferred by Article 73 of the Constitution, fulfilling the statutory obligation of these establishments under subsection 1 of section 4 of the Act.

NOTIFICATION
New Delhi, the 15th April, 2015
S.O. 1124(E).—Whereas the Labour Laws (Exemption from Furnishing Returns and Maintaining Registers by
Certain Establishments) Act, 1988 (51 of 1988) (hereinafter referred to as the Principal Act) has been amended by the
Labour Laws (Exemption from Furnishing Returns and Maintaining Registers by certain Establishments) Amendment
Act, 2014 (33 of 2014) (hereinafter referred to as the said amendment);
And, whereas, by the said amendment, the erstwhile Second Schedule to the Principal Act has been substituted
by the new Second Schedule providing a new FORM-I in place of erstwhile FORM-A. The annual return to be furnished
by the new FORM-I relates to the period from 1st April of a year and ending on 31st March of following year. The
return was required to be furnished for the period 1st January of a year and ending on 31st December of that year;
And, whereas, the said amendment has come into force w.e.f. 1st day of the January, 2015, the employers of
the small establishments or very small establishment have statutory obligation to furnish return for the period
commencing from 1st January, 2015 to 31st March, 2015.
Therefore, the Central Government in exercise of the executive power conferred on it under article 73 of the
Constitution specifies that the FORM-I prescribed by the said amendment may also be used for furnishing return for the
period 1st January, 2015 to 31st March, 2015 by the said employers for the purposes of sub-section (1) of section 4 of
the Act.
