MINISTRY OF HEALTH AND FAMILY WELFARE (Food Safety and Standards Authority of India) NOTIFICATION New Delhi, the 4th July, 2016 F.No. Stds/O&F/Notification(1)/FSSAI-2016.—The following draft of certain regulations, further to amend the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011, which the Food Safety and Standards Authority of India proposes to make with previous approval of the Central Government, in exercise of the powers conferred by clause (e) of sub-section (2) of section 92 read with section 16 of the Food Safety and Standards Act, 2006 (34 of 2006) is hereby published as required under the said sub-section (1) of section 92 of the said Act for the information of all persons likely to be affected thereby, and notice is hereby given that the said draft regulations shall be taken into consideration after the expiry of the period of thirty days from the date on which copies of the Official Gazette in which this notification is published are made available to the public. Objections or suggestions, if any, may be addressed to the Chief Executive Officer, Food Safety and Standards Authority of India, Food and Drug Administration Bhawan, Kotla Road, New Delhi- 110002 or sent on email at regulation@fssai.gov.in. Objections or suggestions which may be received from any person with respect to the said draft regulations before the expiry of period so specified, shall be considered by the Food Authority. DRAFT REGULATIONS 1. Short title and commencement. - (1) These regulations may be called the Food Safety and Standards (Food Products Standards and Food Additives) Amendment Regulations, 2016. (2) They shall come into force on the date of their final publication in the official Gazette. 2. In the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011 (hereinafter referred to as the said regulations),- (A) in regulation 1.2, in sub-regulation 18, in item (iv), after the words “citric acid”, the words “and any suitable food grade enzyme” shall be inserted; (B) In regulation 2.2 of the said regulations,- (i) in sub-regulation 2.2.1, (a) in clause 1, the portion starting with the words “Further, if the oil is obtained” and ending with the words “Hexane more than 5.00 ppm” shall be omitted; (b) after clause 24, the following clause shall be inserted, namely:- “25. Edible vegetable oils may be fortified with the following vitamins, namely:-6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] Range of nutrient per gram Nutrients Source of nutrient of Oil Retinyl acetate, Retinyl palmitate and Retinyl Vitamin A 22.5-27.5 IU propionate Vitamin D 3.96-4.84 IU Cholecalciferol, Ergocalciferol Range of vitamins shall be applicable at the time of packaging and shall show a positive test at the time of sale. Every package of fortified edible vegetable oil shall bear the declaration “Fortified with Vitamin A and D”. (i i) in sub-regulation 2.2.2,- (a) in the opening paragraph, for the “vegetable fat”, the words “vegetable fat/oil” shall be substituted; (b) clause (vi) shall be omitted; (C) in sub-regulation 2.4.6, after clause 16, the following clause shall be inserted, namely:- “17.OATS (1) Oats shall be dried mature grains of Avena sativa or Avena byzantina. The grains shall be sound, clean, wholesome, and free from toxic seeds, live insects and visible mold confirming to the following standards, namely:- S.No Characteristics Requirements (i) Moisture Not more than 14.0 per cent. by weight (ii) Not more than 1 per cent. by weight of which not more than 0.25 per cent. by Foreign matter(Extraneous matter) weight shall be mineral matter and not more than 0.10 per cent. by weight shall be impurities of animal origin. (iii) Other edible grains (grains other than oats) Not more than 3 per cent. by weight. (iv) Damaged grains ( including pieces of kernels Not more than 3 per cent. by weight. that show visible deterioration due to moisture, weather, disease, insects, mould, heating, fermentation, sprouting or other causes) (v) Weevilled grains Not more than 2 per cent. by count. (vi) Minimum test weight (weight of hundred litre Not less than 46 kg/hl volume of oats expressed as kilograms per hectolitre (kg/hl). (vii) Hull-less and broken kernels Not more than 3 per cent. by weight. (viii) Uric acid Not more than 100 mg per kg. (ix) Ergot Sclerotium of the fungus Claviceps purpurea 0.05 per cent. m/m max¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 7 (2) Food Additives The product shall contain food additives specified in Appendix A to these regulations. (3) Contaminants, Toxins and Residues The product contaminants, toxin and residues shall be in accordance with the Food Safety and Standards (Contaminants, Toxins and Residues) Regulations, 2011. (4) Food Hygiene (a) The product shall be prepared and handled in accordance with the guidelines provided in the Schedule 4 of the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, 2011. (b) The product shall conform to the microbiological requirement specified in Appendix B of these regulations. (5) Labelling The product shall be labelled in accordance with the Food Safety and Standards (Packaging and Labelling) Regulations, 2011. (6) Method of Sampling and Analysis As provided in the relevant FSSAI Manual of Method of Analysis of Food”; (D) in sub-regulation 2.4.10, for clause 1, the following clause shall be substituted, namely- “1. PASTA PRODUCTS: (a) (Macaroni, spaghetti, vermicelli) means the product obtained from either single or in combination of ingredients including suji , maida , rice flour , groundnut flour , tapioca flour , edible soy flour or flour of any other cereal referred to in sub- regulation 2.4 of regulations, with or without addition of ingredients milk powder and spices by kneading the dough and extending it. (b) It shall be free from added colour, dirt, insect’s larvae and impurities or any other extraneous matter. (c) It shall conform to the following standards:- Moisture Not more than 12.5 per cent. Total ash Not more than 1.0 per cent. On dry basis Ash insoluble in dilute HCl Not more than 0.1 per cent. (On dry basis) Nitrogen Not less than 1.7 per cent. on dry basis”.
