NOTIFICATION
New Delhi, the 4th February, 2019
F.No. 11023/24/2017-QA.—The following draft of certain regulations, further to amend the Food Safety and
Standards (Laboratory and Sample Analysis) Regulations, 2011, which the Food Safety and Standards Authority of India
proposes to make with previous approval of the Central Government, in exercise of the powers conferred under section
92 of the Food Safety and Standards Act, 2006 (34 of 2006) is hereby published as required by the said sub-section (1) of
section 92 of the said Act for the information of all persons likely to be affected thereby and notice is hereby given that
the said draft regulations shall be taken into consideration after the expiry of the period of thirty days from the date on
which copies of the Official Gazette in which this notification is published are made available to the public.
Objections or suggestions, if any, may be addressed to the Chief Executive Officer, Food Safety and Standards
Authority of India, Food and Drug Administration Bhawan, Kotla Road, New Delhi- 110002 or sent on email at
regulation@fssai.gov.in.
Objections or suggestions, which may be received from any person with respect to the said draft regulations
before the expiry of period so specified, will be considered by the Food Authority.
Draft Regulations
1. Short title and commencement-(1) These regulations may be called the Food Safety and Standards (Laboratory
and Sample Analysis) Amendment Regulations, 2019.
(2) They shall come into force on the date of their final publication in the official Gazette.
2. In the Food Safety and Standards (Laboratory and Sample Analysis) Regulations, 2011,
(I) in regulation 2.1, for sub-regulation 2.1.1 and table thereunder, the following shall be substituted namely:-
“2.1.1 The sample of any imported article will be sent by the Authorized Officer for analysis to the Food
Analyst of any of the laboratories notified by Food Authority under section 43(1) of Food Safety and
Standards Act, 2006.”
(II) in regulation 2.2, for sub-regulation 2.2.2 along with table thereunder, the following shall be substituted
namely:-
“2.2.2 State/Union Territory of Referral Laboratory
The Food authority shall authorize laboratories to carry out function of referral laboratory that are
notified by Food Authority under section 43(2) of Food Safety and Standards Act, 2006.”¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 3
(III) in regulation 2.3, Clause 3 shall be substituted namely:-
“3. The fees payable for such test or analysis of sample of food shall be as prescribed by the Food
Authority from time to time.”.
