(1) इन जवजनयतों का संजक्षि नात खाद्य सुरक्षा और तानक (आयात) संिोधन जवजनयत, 2020 । (2) ये इनके कायाटन्द्वयन की जतजथ से लागू ोंगे, िो दक प ली िनवरी अथवा प ली िलु ाई ोगी और य इनके रािपर तें अंजतत प्रकािन की जतजथ से न्द्यूनतत 180 दिन ोगी। 2. खाद्य सुरक्षा और तानक (आयात) जवजनयत, 2017, त,ें - (i) अध्याय – 13 के पश्चात जनम्नजलजखत को अतं ःस्ट्थाजपत दकया िायेगा, अथाटत, - “अध्याय XIV जविेिी खाद्य जनताटण सुजवधाओं का पंिीकरण और जनरीक्षण 18 (1) जविेिी खाद्य जनताटण सुजवधाओं का पंिीकरण- (क) खाद्य प्राजधकरण सतय-सतय पर िोजखत के आधार पर भारत को जनयाटत दकए िान े वाल े खाद्य उत्पािों की श्रेजणयों को जनर्िष्टट कर सकता , जिसके जलए खाद्य पिाथों की ऐसी श्रेजणयों का उत्पािन करन े वाल े जविेिी खाद्य जवजनताटण सुजवधाओं का जनरीक्षण या ऑजडर् अजनवायट ोगा। (ख) ऐसी श्रेजणयों के अंतगटत आने वाली जविेिी खाद्य जवजनताटण सुजवधाएं और भारत तें खाद्य पिाथों के जनयाटत के जलए भारत को जनयाटत करने से प ल े खाद्य प्राजधकरण के साथ पंिीकरण करना ोगा; (ग) जवििे ी खाद्य जवजनताटण सुजवधा सीधे या आयातक के ताध्यत से इन जवजनयतों के “फॉत ट 16” तें पंिीकरण के जलए अनुबंध -1 तें जनर्िष्टट िस्ट्तावेिों और खाद्य प्राजधकरण द्वारा जनर्िष्टट िल्ु क के साथ आवेिन कर सकती । (2) जवििे ी खाद्य जवजनताणट सजु वधाओं के पिं ीकरण के जलए आवेिन की प्रदिया - (क) यदि आवेिन की िााँच करन े पर खाद्य प्राजधकरण को दकसी आवेिन के संबंध तें दकसी अजतररो िानकारी की आवश्यकता ोती या यदि आवेिन अपणू ट , तो खाद्य प्राजधकरण इस तर के नोरर्स से 30 दिन के भीतर आवेिक को ऐसी अजतररो िानकारी प्रस्ट्ततु करने या आवेिन परू ा करने की सला िेगा, ि सा भी तातला ो । यदि आवेिक 30 दिनों के जनधाटररत सतय के भीतर आवश्यक िानकारी प्रस्ट्ततु करने त ें जवफल र ता , तो जविेिी खाद्य जवजनताटण सुजवधा पंिीकरण के जलए आवेिन अस्ट्वीकार कर दिया िाएगा; (ख) अजतररो िानकारी सज त, यदि तांगी गई ो एक पूण ट आवेिन प्राि ोन े पर, खाद्य प्राजधकरण आवेिन को जनरीक्षण और पंिीकरण िारी करने के जलए के या आवेिन की अस्ट्वीकृजत के जलए प्रदिया कर सकता । (3) जवििे ी खाद्य जनताणट सजु वधाओं का जनरीक्षण- (क) जविेिी खाद्य जवजनताटण सुजवधाओं के जनरीक्षण के उद्देश्य से एफएसएसएआई और संबंजधत तंरालय/ संगठन/जवभाग के अजधकाररयों को खाद्य प्राजधकरण द्वारा नाजतत दकया िाएगा; (ख) जविेिी खाद्य जवजनताटण सुजवधा का जनरीक्षण भारतीय खाद्य सुरक्षा और तानक प्राजधकरण द्वारा जनर्िष्टट तरीके से दकया िा सकता ; (ग) जवििे ी खाद्य जवजनताटण सुजवधा पंिीकरण के िारी ोन े के बाि भी जनरीक्षण दकया िा सकता , ि सा दक आवश्यक सतझा गया ो;[भाग III—खण् ड 4] भारत का रािपर : असाधारण 3 (4) पिं ीकरण िारी करना- (क) जविेिी खाद्य जवजनताटण सुजवधा एफएसएस अजधजनयत के और इसके त त बनाए गए जवजनयतन और जनयतों के अनपु ालन तें पाई िाती को जविेिी खाद्य जवजनताटण सुजवधाओं के रूप तें पांच साल की अवजध के जलए पंिीकृत दकया िाएगा और उनका पंिीकरण नंबर फॉतट 17 तें सूजचत दकया िाएगा; (ख) जविेिी खाद्य जवजनताटण सुजवधा िो एफएसएस अजधजनयत और उसके त त बनाए गए जवजनयतन और जनयतों के अनुपालन तें न ीं पाइ गई ो के पंिीकरण के जलए दकए गए आवेिन को अस्ट्वीकार कर दिया िाएगा; (ग) जविेिी खाद्य जवजनताटण सुजवधा जिसका आवेिन खाररि कर दिया गया , उपचारात्तक कारटवाई करन े के बाि दफर से तान्द्यता के जलए आवेिन कर सकत े ;ैं (घ) जविेिी खाद्य जवजनताटण सुजवधा के पंिीकरण का नवीनीकरण फॉतट 16 तें दकया िाएगा, िो पंिीकरण त ें ििाटई गई सताजि जतजथ से 30 दिन प ले के पश्चात न ीं। (5) जवििे ी खाद्य जनताणट सजु वधा की लखे ापरीक्षा – (क) जविेिी खाद्य जवजनताटण सुजवधा जिसके जलए अजनवायट ऑजडर् की आवश्यकता ोगी, फूड अथॉररर्ी द्वारा तान्द्यता प्राि ऑजडटर्ंग एिेंसी द्वारा उनकी सुजवधा का ऑजडर् कराएगा। सतय-सतय पर खाद्य प्राजधकरण द्वारा ऑजडर् की आवृजत श जनर्िष्टट की िाएगी। ऑजडटर्ंग एिेंसी द्वारा िारी ऑजडर् ररपोर् ट / प्रताण पर की प्रजत खाद्य प्राजधकरण को प्रस्ट्ततु की िाएगी। (6) पिं ीकरण को स्ट्थगन या रद्द करना - (क) यदि जविेिी खाद्य जवजनताटण सुजवधा या उनके खाद्य उत्पाि एफएसएस अजधजनयत के जनयतों और उसके त त बनाए गए जवजनयतन के अनुपालन त ें न ीं पाए िात े ैं, तो जविेिी खाद्य जनताटण सुजवधाओं के रूप त ें उनका पंिीकरण स्ट्थजगत या रद्द कर दिया िाएगा। ालााँदक, खाद्य प्राजधकरण सुनवाई के जलए अवसर िेन े के बाि उसी तर की सतीक्षा कर सकता , ि सा दक उपयुो ो।” (ii) प्रारूप – 15 के पश्चात जनम्नजलजखत को अंतःस्ट्थाजपत दकया िायेगा, अथाटत, - “प्रारूप – 16 [जवजनयत 18(1)(ख) िेख]े जविेिी खाद्य जवजनताटण सुजवधाओं के पंिीकरण / पंिीकरण के नवीनीकरण के जलए आवेिन 1. कंपनी/संगठन का नात ........................................................................................... 2. पंिीकृत कायाटलय का पता............................................................................................................... 3.पररसर का पता जिसके पंिीकरण के जलए आवेिन दकया िा र ा . ......................................................... 4. खाद्य जवजनताटण / प्रसस्ट्ं करण सुजवधा के जलए संबंजधत िेि के सरकारी प्राजधकरण द्वारा िारी लाइसेंस / पंिीकरण .............................................................................................................................. 5. ईतेल ............................................................................................................................ 6. संपकट नंबर.....................................................................................................................4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] 7. उत्पाि का जववरण ........................................................................................... 8. तेरे द्वारा य ां प्रस्ट्तुत सभी िानकारी और जववरण तेरे ज्ञान के अनुसार सवटश्रेष्ठ और स ी ।ैं दिनाकं …………. स्ट्ताक्षर और अजधकृत स्ट्ताक्षरकताट की तु र स्ट्थान………… नात और पता........…………………… अनलु ग्नक-1 जविेिी खाद्य जवजनताटण सुजवधाओं के पंिीकरण / पंिीकरण के नवीनीकरण के जलए आवेिन के साथ सलं ग्न दकए िान े वाल े िस्ट्तावेिों की सूची:- (1) खाद्य जनताटण / प्रसंस्ट्करण सुजवधा के जलए संबंजधत ििे के सरकारी प्राजधकरण द्वारा िारी लाइसेंस / पंिीकरण; No. 4067/MOC-Trade/Reg-FSSAI/2017(part-1).—The following draft of certain regulations further to amend the Food Safety and Standards (Food Import) Regulations, 2017, which the Food Safety and Standards Authority of India, with the previous approval of the Central Government, proposes to make, in exercise of powers conferred by clause (e) of sub-section (2) of section 92 of the Food Safety and Standards Act, 2006, (34 of 2006) is hereby published as required by sub-section (1) of section 92 of the said Act, for the information of persons likely to be affected thereby and notice is hereby given that the said draft regulations will be taken into consideration after the expiry of a period of sixty days from the date on which copies of the Official Gazette in which this notification is published are made available to the public; Objections and suggestions, if any, may be addressed to the Chief Executive Officer, Food Safety and Standards Authority of India, Food and Drug Administration Bhawan, Kotla Road, New Delhi – 110002, or may be sent through e-mail at regulation@fssai.gov.in; The objections or suggestions which may be received from any person with respect to said draft regulations, before the expiry of the period so specified above, will be considered by the Food Safety and Standards Authority of India. Draft regulations 1. (1) These regulations may be called the Food Safety and Standards (Import) Amendment Regulations, 2020. (2) They shall come into force with effective date for implementation to be either 1st January or 1st July subject to a minimum of 180 days from the date of their final publication in the official Gazette. 2. In the Food Safety and Standards (Import) Regulations, 2017,- (i) after “chapter XIII”, the following shall be inserted, namely,- “Chapter XIV Registration and inspection of Foreign Food manufacturing facilities 18 (1) Registration of Foreign Food manufacturing facilities- (a) The Food Authority may from time to time based on the risk specify the categories of food products to be exported to India, for which inspection or audit of Foreign Food manufacturing facilities producing such categories of foods shall be mandatory. (b) Foreign Food manufacturing facilities falling under such categories and desirous to export such article of food to India shall register with the Food Authority before exporting to India; (c) Foreign Food manufacturing facility either directly or through importer may apply for registration in “Form 16” of these regulations along with documents specified in Annexure-1 and fee as specified by the Food Authority. (2) Processing of application for Registration of Foreign Food manufacturing facilities- (a) If upon scrutiny of the application Food Authority requires any additional information with respect to an application or if the application is incomplete, the Food Authority shall advise the applicant, to furnish such additional information or complete the application, as the case may be, within 30 days from such notice. In case the applicant fails to furnish the required information within the stipulated time of 30 days, the application for Registration of Foreign Food Manufacturing Facility shall stand rejected; (b) On receipt of a complete application including the additional information if asked for, the Food Authority may process the application for inspection and issuance of registration or rejection of the application. (3) Inspection of Foreign Food manufacturing facilities- (a) Officials from FSSAI and relevant ministry/ organization/ department for the purpose of inspection of Foreign Food Manufacturing Facilities shall be nominated by the Food Authority;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (b) Foreign Food manufacturing facility (ies) may be inspected in a manner as specified by Food Safety and Standards Authority of India; (c) Foreign Food manufacturing facility(ies) may also be inspected after the issuance of registration, as deemed necessary; (4) Issuance of registration- (a) Foreign Food manufacturing facility found to be in compliance of FSS Act rules and regulation made there-under shall be registered as Foreign Food manufacturing facilities for a period of five years and their registration number shall be communicated in Form 17; (b) Foreign Food manufacturing facility found to not be in compliance of FSS Act rules and regulation made there-under, the application made for registration shall be rejected; (c) Foreign Food manufacturing facility whose application is rejected, after taking remedial action may apply for recognition again; (d) Renewal of registration of Foreign Food manufacturing facility shall be made in Form 16, not later than 30 days prior to the expiry date indicated in the registration. (5) Audit of Foreign Food manufacturing facility - (a) Foreign Food manufacturing facility which requires mandatory audit shall get their facility audited by the auditing agency recognized by the Food Authority. Frequency of audit shall be specified by the Food Authority from time to time. Copy of the audit report/certificate issued by the auditing agency shall be submitted to the Food Authority. (6) Suspension or cancellation of registration- (a) If Foreign Food manufacturing facility or their food products are found not to be in compliance of FSS Act rules and regulation made there-under, their registration as Foreign Food manufacturing facilities shall be suspended or cancelled. However, Food Authority may review the same after giving opportunity for hearing or clarification, as deemed fit.” (ii) after “Form 15”, the following form shall be inserted, namely,- “FORM – 16 [See regulation 18(1)(b)] Application for Registration/renewal of Registration of Foreign Food manufacturing facilities 1.
