(क) इन िनयम(cid:18) का संि0B नाम वायुयान (खतरनाक माल का वहन) संशोधन िनयम, 2016 ह।ै (ख) ये सरकारी राजप7 म (cid:25) (cid:22)काशन क(cid:28) तारीख को (cid:22)व(cid:30)ृ ह(cid:18)गे। 2. वायुयान (खतरनाक माल का वहन) िनयम, 2003 म,(cid:25) - (क) िनयम 2 म,(cid:25) - (i) खंड (16क)के +थान पर,िन(cid:20)िलिखत खंड (cid:22)ित+थािपत (cid:4)कये जाए,ं अथात8 ः- 23 GI/2016 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] “(16क)‘’उIम राJय’’ से वह राJय अिभ(cid:22)ेत ह ै िजसके राJय 0े7 म(cid:25) वायुयान म(cid:25) पहली बार खतरनाक माल लादा जाना ह”ै ; “(16ख) “गंत2 राJय स े वह राJय अिभ(cid:22)ेत ह ै िजसके राJय 07े म(cid:25) वायुयान से अKततः खतरनाक माल उतारा जाना ह”ै ; (ii) खंड (19) के +थान पर िन(cid:20)िलिखत खंड को (cid:22)ित+थािपत (cid:4)कया जाए, अथा8तः- ‘’(19) ‘’यू.एन. संLया (cid:4)कसी व+त ु या पदाथ8 या व+तुM या पदाथN के िविशA समूह क(cid:28) पहचान करने के िलए खतरनाक माल के पOरवहन और वैिPक आधार पर संगत (cid:22)णाली के वगRकरण तथा रसायन(cid:18) पर लेबल लगाने के संबंध म(cid:25) संयु राSीय िवशेषU सिमित (cid:29)ारा समनदु िे शत चार अंक(cid:28)य संLया से अिभ(cid:22)ेत ह‘ै’; (ख) िनयम 10 क म,(cid:25) - (i) उप-िनयम (1) के +थान पर िन(cid:20)िलिखत पाठ को (cid:22)ित+थािपत (cid:4)कया जाए, अथा8तः- ‘’(1) महािनदशे क या उनक(cid:28) ओर से क(cid:25)(cid:26)ीय सरकार (cid:29)ारा (cid:22)ािधकृत कोई अKय अिधकारी िलिखत 9प म,(cid:25) साधारण या िवशेष आदशे (cid:29)ारा (cid:4)कसी उपयु समय म(cid:25), (cid:4)कसी ऐसे +थान म(cid:25) (cid:22)वेश कर सकेगा जहां जाकर इन िनयम(cid:18) के उपबंध(cid:18) का अनुपालन सुिनि;त करने क(cid:28) दिृ A स े (cid:4)कKहX सवे ाM, उप+कर(cid:18), द+तावेज तथा अिभलेख(cid:18) क(cid:28) जांच करना आवYयक ह।ै ‘’ (ii) उप-िनयम (2) के प;ात, िन(cid:20)िलिखतउप-िनयम को अKतः +थािपत (cid:4)कया जाए, अथात8 ः- “(3) महािनदशे क या उप-िनयम (1) के अधीन (cid:22)ािधकृत कोई अKय अिधकारी इन िनयम(cid:18) के अKतगत8 कोई कृZय करने वाली कंपनी (cid:29)ारा किथत 9प से (cid:4)कये गए उ(cid:6)लंघन(cid:18) क(cid:28) जांच कर सक(cid:25)गे और (cid:22)ािधकृत अिधकारी ऐसी जांच के िलए उप-िनयम (1) के अधीन शि का (cid:22)योग कर सकेगा।” [फा. सं. ए वी.11012/143/2015-ए] अ9ण कुमार, सयं ु सिचव (cid:16)(cid:16)(cid:16)(cid:16)टटटट(cid:18)(cid:18)(cid:18)(cid:18)पपपपणणणणःःःः---- मूल िनयम तारीख 5 माच,8 2003 क(cid:28) अिधसूचना स.ं सा.का.िन. 206 (अ) (cid:29)ारा भारत के राजप7 म (cid:25) (cid:22)कािशत (cid:4)कए गए थ े और अंितम संशोधन तारीख 16 अ(cid:22)ैल, 2015 को भारत के राजप7 भाग-II, खंड 3, उप-खंड (i) म(cid:25) (cid:22)कािशत सा.का.िन. 296 (अ) (cid:29)ारा 17 अ(cid:22)ैल, 2015 को (cid:4)कए गए।¹Hkkx IIµ[k.M 3 (i)º Hkkjr dk jkti=k % vlk/kj.k 3 MINISTRY OF CIVIL AVIATION NOTIFICATION New Delhi, the 23rd December, 2015 G.S.R. 3(E).─The following draft of certain rules further to amend the Aircraft (Carriage of Dangerous Goods) Rules, 2003, which the Central Government proposes to make in exercise of the powers conferred by section 5 of the Aircraft Act, 1934 (22 of 1934), is hereby published as required by section 14 of the said Act, for information of all persons likely to be affected thereby, and notice is hereby given that the said draft will be taken into consideration after a period of thirty days from the date on which copies of the Gazette of India in which this notification is published, are made available to the public; Objections or suggestions, if any, may be addressed to the Director-General of Civil Aviation, Opposite Safdarjung Airport, New Delhi-110003; Any objection or suggestion which may be received from any person with respect to the said draft rules before the expiry of the period specified above, will be considered by the Central Government. Draft Rules 1. (a) These rules may be called the Aircraft (Carriage of Dangerous Goods) Amendment Rules, 2016. (b) These shall come into force on the date of their final publication in the Official Gazette. 2. In the Aircraft (Carriage of Dangerous Goods) Rules, 2003, — (a) in rule 2,─ (i) for clause (16A), the following clauses may be substituted, namely: - “(16A) “State of origin” means the State in the territory of which the consignment of dangerous goods is first to be loaded on an aircraft; (16B) “State of destination” means the State in the territory of which the consignment of dangerous goods is finally to be unloaded from an aircraft”; (ii) for clause (19), the following clause shall be substituted, namely:- “(19) “UN number” means the four digit number assigned by the United Nations Committee of Experts on the Transport of Dangerous Goods and on the Globally Harmonised System of Classification and labeling of Chemicals to identify an article or substance or a particular group of articles or substances;”; (b) in rule 10A,- (i) for sub-rule (1), the following shall be substituted, namely:- “(1) The Director-General, or any other officer authorised by the Central Government in this behalf by general or special order in writing, may, at any reasonable time, enter any place to which access is necessary and inspect any services, equipment, documents and records with a view to ensuring compliance with the provisions of these rules.”; (ii) after sub-rule (2), the following sub-rule shall be inserted, namely:- “(3) The Director-General, or any other officer authorised under sub-rule (1), may carry out investigation into alleged violations by an entity performing any function4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] under these rules and for such investigation, the authorised officer may exercise the power under sub-rule (1).” [F.
