NOTIFICATION
New Delhi, the 6th February, 2019
G.S.R. 118(E).—The following draft of certain rules further to amend the Aircraft Rules, 1937,
which the Central Government proposes to make in exercise of the powers conferred by section 5 of the
Aircraft Act, 1934 (22 of 1934), is hereby published as required by section 14 of the said Act, for information
of all persons likely to be affected thereby; and notice is hereby given that the said draft rules will be taken
into consideration after a period of thirty days from the date on which copies of the Gazette of India, in which
this notification is published, are made available to the public;
Objections or suggestions, if any, may be addressed to the Secretary, Ministry of Civil Aviation,
Rajiv Gandhi Bhawan, Safdarjung Airport, New Delhi-110003 or mailed to secy.moca@nic.in;
Any objection or suggestion which may be received from any person with respect to the said draft
rules before the expiry of the period specified above will be considered by the Central Government.
1. (1) These rules may be called the Aircraft (First Amendment) Rules, 2019.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Aircraft Rules, 1937, for rule 32A, the following shall be substituted, namely:—
“32A. Export of Aircraft.—The Central Government shall, consequent upon cancellation of
registration of an aircraft under sub-rule (7) of rule 30, if an application is made by the IDERA Holder
for export of the same aircraft, take action within five working days of such application to facilitate the
export and physical transfer of the aircraft, along with spare engine, if any, subject to: —
(i) The payment of outstanding dues as specified in proviso to sub-rule (7) of rule 30 in respect of
the aircraft; and
(ii) The compliance of the rules and regulations relating to safety of the aircraft operation.”
