NOTIFICATION
New Delhi, the 1st May, 2019
G.S.R. 362(E).—The following draft of certain rules further to amend the Aircraft Rules, 1937, which the Central
Government proposes to make in exercise of the powers conferred by section 5 of the Aircraft Act, 1934 (22 of 1934), is
hereby published as required by section 14 of the said Act, for information of all persons likely to be affected thereby; and
notice is hereby given that the said draft rules will be taken into consideration after a period of thirty days from the date on
which copies of the Gazette of India, in which this notification is published, are made available to the public;
Objections or suggestions, if any, may be addressed to the Director-General of Civil Aviation, Opposite Safdarjung
Airport, New Delhi-110003 or mailed to dgoffice.dgca@nic.in;
Any objection or suggestion which may be received from any person with respect to the said draft rules before the

Draft Rules
1. (1) These rules may be called the Aircraft (……Amendment) Rules, 2019.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Aircraft Rules, 1937, —
(A) in rule 93, —
(i) after sub-rule (1), the following proviso shall be inserted, namely:—
“Provided that any person already engaged in the provision of air traffic services before the
commencement of the Aircraft (Sixth Amendment) Rules, 2018, may continue to provide such
services in accordance with the procedure specified by the Director-General till such person obtains
the licence or till a date to be notified by the Central Government, whichever is earlier.”;
(ii) the proviso under sub-rule (2) shall be omitted;
(B) in rule 112, in sub-rule (3), for clause (a), the following shall be substituted, namely: —
“(a) The Director-General, or any organisation under the control of Government specifically authorised by
the Director-General, may appoint examiners for carrying out examinations and assessment required under
Schedule III and may also appoint a Board to conduct examinations and assessment, wherever necessary.
The organisation so authorised shall appoint examiners or board subject to conditions as specified by the
Director-General.”;
(C) in Schedule III, in Section A, for paragraph 5, the following paragraph shall be substituted, namely: —
“5. Assessment by the examiner or board.— For getting an endorsement, the holder of a Student Air
Traffic Controller’s Licence or an Air Traffic Controller’s Licence shall be assessed by an examiner or by a
board, duly authorised by the Director-General or by an organisation under the control of Government
specifically authorised by the Director-General. The organisation so authorized shall appoint examiners or
board subject to conditions specified by the Director-General.”.
