का (cid:22)(cid:11)ताव करती ह,ै िजसे उ$ अिधिनयम क(cid:31) धारा 14 क(cid:31) अपे/ानसु ार ऐसे 1ि$य(cid:18) क(cid:31) जानकारी के िलए, िजनके उनस े
(cid:22)भािवत होन े क(cid:31) सभं ावना ह,ै (cid:22)कािशत (cid:4)कया जाता ह ै और एत3ारा सूचना दी जाती ह ै (cid:4)क भारत के राजप6 म (cid:26) (cid:22)कािशत

1. (1) इन िनयम(cid:18) का संि/@ नाम वायुयान (.............संशोधन) िनयम, 2018 ह।ै
(2) ये सरकारी राजप6 म (cid:26)(cid:22)काशन क(cid:31) तारीख को (cid:22)वृ" ह(cid:18)ग।े
2. वायुयान िनयम, 1937 म,(cid:26)—
(क) िनयम 3 म,(cid:26)—
(क) खंड (10ख) के प9ात, िन(cid:20)िलिखत खंड को अंतः(cid:11)थािपत (cid:4)कया जाए, अथा7त:-

“(10खख) अनमु ो(cid:4)दत (cid:22)िश/ण संगठन से महािनदशे क, नागर िवमानन !ारा अनमु ो(cid:4)दत संगठन
अिभ(cid:22)ेत ह ै और जो अनुमो(cid:4)दत (cid:22)िश/ण िनNपा(cid:4)दत करने के िलए यथा अिधकिथत िनयम(cid:18) के अनसु ार
(cid:22)िश/ण संचािलत करता ह;ै”
(ख) खंड (12) के प9ात, िन(cid:20)िलिखत खंड को अतं ः(cid:11)थािपत (cid:4)कया जाए, अथा7त : —
“(12क) स/मता स ेवह कौशल, Pान और अिभवृि" का संयोजन अिभ(cid:22)ेत ह ैजो िविहत अप/े ा के
अनसु ार काय7 िनNपा(cid:4)दत करने के िलए अपिे /त ह;ै”;
(ख) िनयम 93 म,(cid:26) “वायुयान (……संशोधन) िनयम, 2012” श8द(cid:18) के (cid:11)थान पर, “वायुयान (चौथा सशं ोधन)
िनयम, 2018” श8द(cid:18) को रखा जाए;
(ग) िनयम 95 म,(cid:26) उप-िनयम (1) म,(cid:26) खंड (ज) का लोप (cid:4)कया जाए ;
(घ) िनयम 96 का लोप (cid:4)कया जाए;
(ङ) िनयम 97 म,(cid:26)
(क) उप-िनयम (1) के अधीन पर(cid:28)तुक के (cid:11)थान पर, िन(cid:20)िलिखत पर(cid:28)तुक को रखा जाए, अथा7त :-
“परंत ु यह (cid:4)क कोई छा6 िवमान यातायात िनयं6क अनुPि@ का धारक अपनी अनPु ि@ म (cid:26) ऐसी
रेTटंग के पृVाकं न हते ु अहक7 (cid:22)योजन(cid:18) के िलए ससु ंगत रेTटंग के िबना (cid:4)कसी ऐस े 1ि$ जो उस िविश?
िवमान यातायात सेवा यूिनट म (cid:26) रेTटंग का धारक ह ैऔर वह महािनदशे क या महािनदशे क !ारा िवशेष (cid:23)प
से (cid:22)ािधकृत (cid:4)कसी अ(cid:28)य संगठन !ारा अनुदशे क के (cid:23)प म(cid:26) काय7 करन ेके िलए (cid:22)ािधकृत ह,X के सीधे पय7वे/ण
म(cid:26) (cid:4)कसी िवशेष िवमान यातायात सेवा यूिनट म (cid:26)Yूटी िनNपा(cid:4)दत कर सकेगा।“;
(ख) उपिनयम- (3) के (cid:11)थान पर िन(cid:20)िलिखत उपअथा7त ,िनयम को रखा जाए-: —
“(3) उप-िनयम (1) म (cid:26)िनिहत (cid:4)कसी बात के होत े&ए, महािनदेशक (cid:22)ािधकृत कर सकते ह:X
(i) कोई िवमान यातायात अनुPि@ का धारक उस यूिनट िजस पर उसक(cid:31) अनुPि@ ह,ै के पृVाकं न के
िबना नई सं(cid:11)थािपत िवमान यातायात सेवा यिू नट म (cid:26) Yूटी िनNपा(cid:4)दत कर सकेगा यह तब जब (cid:4)क
उसने उ$ यूिनट म(cid:26) िसमलु ेशन (cid:22)िश/ण परू ा (cid:4)कया हो और महािनदेशक या महािनदेशक !ारा
िवशेष (cid:23)प स े इस (cid:22)योजन के िलए (cid:4)कसी अ(cid:28)य संगठन !ारा िविधवत (cid:22)ािधकृत स/म िनधा7रण
बोड 7!ारा ऐसी Yूटी जो उपय$ु हो, का िनधा7रण (cid:4)कया गया हो।
(cid:10)(cid:10)(cid:10)(cid:10)पपपप(cid:11)(cid:11)(cid:11)(cid:11)ीीीीककककररररणणणण::::———— इस िनयम के (cid:22)योजन के िलए “िसमलु शे न (cid:22)िश/ण” के अतं ग7त (cid:11)वतः/क[पयूटर
जिनत िवमान यातायात प\रवेश या साधारण अनदु शे क चािलत अ(cid:28)यो(cid:28)याि]त भिू मका का
िनव7हन हो सकता ह।ै
(ii) (cid:4)कसी िवमान यातायात िनयं6क क(cid:31) तैनाती (cid:4)कसी ऐस ेहवाई अ= ेपर िजस पर उसक(cid:31) अनुPि@ ह,ै
पृVांकन के िबना उस हवाई अ= े पर अ(cid:11)थाई (cid:23)प से िवमान यातायात िनयं6क क(cid:31) Yूटी
िनNपा(cid:4)दत कर सकेगा यह तब जब(cid:4)क उ^तर िवमान यातायात सघनता वाले (cid:4)कसी अ(cid:28)य हवाई
अ= े पर समान रेTटंग का धारक ह ै और उसका (cid:4)कसी िवमान यातायात िनयं6क िजसके पास
अ(cid:11)थाई Yूटी वाल ेहवाई अ= ेक(cid:31) रेTटंग हो, !ारा ऐसी Yूटी जो उपय$ु हो, िनधा7रण (cid:4)कया गया
ह।ै ”;
(च) िनयम 98 म,(cid:26) िन(cid:20)िलिखत को रखा जाए: —
“98. रेTटंग (cid:22)िश/ण िनदिa शका: (cid:22)bयके िवमान यातायात सेवा क(cid:26)(cid:29) म (cid:26)एक रेTटंग (cid:22)िश/ण िनदिa शका होगी
िजसम (cid:26) ऐसी रेTटंग जो महािनदशे क !ारा िविधवत अनमु ो(cid:4)दत अनसु ूची-III म(cid:26) यथािविन>द?7 ह,ै क(cid:31) अपे/ा
को परू ा करन ेके िलए ऑन-द जॉब dेeनंग, परी/ा और (cid:22)(cid:4)fया के 8यौरे ह(cid:18)गे।”¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3
(छ) िनयम 99 म,(cid:26) —
(क) उप-िनयम 3 के (cid:11)थान पर, िन(cid:20)िलिखत उप िनयम-को रखा जाए, अथात7 ः-
‘’(3) फ(cid:31)स का सदं ाय उस रीित जो महािनदशे क !ारा िविन>द?7 क(cid:31) जाए, म (cid:26)(cid:4)कया जाएगा।”;
(ख) उप-िनयम (4) का लोप (cid:4)कया जाए;
(ज) िनयम 104 म(cid:26),—
(क) उप-िनयम (1) के (cid:11)थान पर, िन(cid:20)िलिखत उप-िनयम को रखा जाए, अथा7त:-
“(1) कोई छा6 िवमान यातायात िनयं6क अनुPि@ जारी करने क(cid:31) तारीख स े अिधकतम तीन वष7 क(cid:31)
अविध के िलए िविधमा(cid:28)य होगी और इसका नवीकरण महािनदशे क !ारा िविन>द7? शतk के अधीन अगल े
तीन वषk क(cid:31) अनिधक अविध के िलए (cid:4)कया जा सकेगा।”;
(ख) उप-िनयम (2) के (cid:11)थान पर, िन(cid:20)िलिखत उप-िनयम को रखा जाए, अथा7त:-
“ िवमान यातायात िनयं6क अनुPि@ क(cid:31) वैधता धारक के साठ वष7 क(cid:31) आयु (cid:22)ा@ करन ेतक होगी।“;
(ग) उप िनयम- (3) म,(cid:26) “दो” श8द के (cid:11)थान पर, “चार” श8द को रखा जाए;
(घ) उप-िनयम (3) के प9ात, िन(cid:20)िलिखत परंतकु को रखा जाए, अथात7 :-
“परंत ु य(cid:4)द महािनदशे क संतु? ह X (cid:4)क एक आपातकालीन ि(cid:11)थित उपि(cid:11)थत ह ै और वैध कारण ह X िजसके
कारण अनुPि@ धारक िच(cid:4)कbसा जांच कराने म (cid:26) असमथ7 ह,ै तब महािनदशे क िच(cid:4)कbसीय योmयता
िनधार7 ण क(cid:31) वैधता को अिधकतम पXतालीस (cid:4)दन(cid:18) क(cid:31) अविध तक बढा सकते ह|X”
(ड़) उप के (4) िनयम- (cid:11)थान पर ,िन(cid:20)िलिखत उप,िनयम को रखा जाए- अथा7तः -
‘‘(4) उप िनयम (3) म(cid:26) िविन>द?7 िच(cid:4)कbसीय योmयता क(cid:31) िविधमा(cid:28)यता क(cid:31) अविध अनुPि@ के धारक
क(cid:31) चालीस वष7 क(cid:31) आयु (cid:22)ा@ करने के प9ात दो वष 7 तक घटा दी जाएगी और अनPु ि@ के धारक क(cid:31)
पचास वष 7क(cid:31) आय ु(cid:22)ा@ करने प9ात एक वष7 और घटा दी जाएगी।”;
(च) उप-िनयम 6 म,(cid:26) खंड (ख) के (cid:11)थान पर, िन(cid:20)िलिखत खंड को रखा जाए, अथात7 : —
“(ख) नवीकरण क(cid:31) दशा म,(cid:26) नवीकरण क(cid:31) तारीख का िवचार (cid:4)कए िबना, पूव7वतo िच(cid:4)कbसीय योmयता
िनधार7 ण क(cid:31) समाि@ क(cid:31) तारीख क(cid:31) प9ात वाली तारीख स े िच(cid:4)कbसीय योmयता िनधा7रण क(cid:31)
िविधमा(cid:28)यता क(cid:31) अविध आरंभ होगी परंत ु यह तब जब (cid:4)क नवीकरण के िलए िच(cid:4)कbसीय परी/ा
िविधमा(cid:28)यता क(cid:31) अविध पूव7वतo पतX ालीस (cid:4)दन से अनिधक अविध के भीतर क(cid:31) गई ह।ै ”;
(झ) िनयम 107 म(cid:26), उप-िनयम (1) के (cid:11)थान पर, िन(cid:20)िलिखत को रखा जाए, अथा7तः-
“(1) कोई िवमान कोई िवमान यातायात िनयं6क अनुPि@ क(cid:31) धारक, अनPु ि@ के िवशषे ािधकार(cid:18) और
अनुPि@ पर पृVा(cid:4)ं कत रेTटंग का (cid:22)योग तब तक नहq कर जब तक (cid:4)क स/मता और अिभनवता क(cid:31) अप/े ा
क(cid:31) पूrत7 नहq करता और िवमान यातायात सेवा यूिनट म (cid:26) या उस सेsटर िजसम (cid:26) वह ऐसा काय7 करता ह,ै के
िलए िविधमा(cid:28)य रेTटंग नहq ह।ै ”
(ञ) िनयम 108 म (cid:26) “यूिनट या (cid:22)चालन ि(cid:11)थित” श8द(cid:18) के (cid:11)थान पर, “यूिनट” श8द को रखा जाए;
(ट) िनयम 109 म,(cid:26) उप-िनयम (2) म (cid:26)“अनुPि@” श8द के िलए पर, “अनPु ि@ या रेTटंग” श8द(cid:18) को रखा जाए;
(ठ) िनयम 112 म(cid:26), उप-िनयम (1) म(cid:26) “महािनदशे क” श8द(cid:18) के (cid:11)थान पर, “महािनदशे क या महािनदशे क !ारा
िविन>द?7 (cid:23)प स े(cid:22)ािधकृत कोई अ(cid:28)य संगठन” श8द(cid:18) को रखा जाए;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(ड) िनयम 114 म(cid:26), उप-िनयम (2), (3) और (4) के (cid:11)थान पर, िन(cid:20)िलिखत िनयम(cid:18) को रखा जाए, अथा7त: —
“(2) (cid:22)िश/ण संगठन, एक (cid:22)िश/ण और (cid:22)(cid:4)fया िनदिa शका तैयार करेगा िजसम (cid:26)महािनदशे क !ारा
िविन>द?7 सूचना िनिहत होगी और वह इसे महािनदशे क से अनुमो(cid:4)दत कराएगा।
(3) (cid:4)कसी (cid:22)िश/ण संगठन का अनमु ोदन पांच वषk से अनिधक अविध के िलए िविधमा(cid:28)य होगा
जब तक (cid:4)क उसका िनल[बन या रtकरण नहq हो जाता जब(cid:4)क इसका नवीकरण समय पर
महािनदशे क !ारा िविन>द?7 िनबंधन और शतk के अधीन पाँच वष7 स े अनिधक अविध के िलए
(cid:4)कया जा सकेगा।
(4) (क) अनमु ोदन (cid:22)दान करन े के िलए कोई (cid:22)िश/ण संगठन चार लाख (cid:23)पय े और नवीकरण या
(cid:22)bयके समय काय7/े6 म(cid:26) िव(cid:11)तार करन ेके िलए दो लाख vपये क(cid:31) फ(cid:31)स संदाय करेगा।
(ख) फ(cid:31)स का संदाय उस रीित जो महािनदेशक !ारा िविन>द?7 क(cid:31) जाए, म (cid:26)(cid:4)कया जाएगा।”;
(ढ) िनयम 118 क का लोप (cid:4)कया जाए;
(ण) अनसु ूची III म,(cid:26) अनुभाग क म,(cid:26) —
(क) पैरा 2 म,(cid:26) उप-पैरा (क) म,(cid:26) खडं (iv) के (cid:11)थान पर, िन(cid:20)िलिखत खंड को रखा जाए, अथा7त:—
“(iv) िविन>द?7 फ(cid:31)स का संदाय;”
(ख) पैरा 3 म,(cid:26) उप-पैरा (क) म,(cid:26) खडं (iii) के (cid:11)थान पर, िन(cid:20)िलिखत खंड को रखा जाए, अथा7त:—
“(iii) िविन>द?7 फ(cid:31)स का संदाय; और”
(ग) पैरा 6 म,(cid:26) —
(i) शीषक7 म(cid:26), “िनधार7 ण”, श8द के (cid:11)थान पर “अनभु व” श8द को रखा जाए;
(ii) उप-पैरा (ख) के (cid:11)थान पर, िन(cid:20)िलिखत उप-पैरा को रखा जाए, अथा7त:—
“वाछं ा क(cid:31) गई रेTटंग के िलए आवेदन क(cid:31) तारीख के ठीक पवू 7वतo छह मास क(cid:31) अविध के
भीतर अनुभाग घ,ड.,च,छ,ज, म (cid:26)िविन>द?7 अनभु व को परू ा करेगा।”;
(iii) उप-पैरा (ग) म,(cid:26) “या मू(cid:6)याकं न”, श8द का लोप (cid:4)कया जाए;
(घ) पैरा 7 म(cid:26), पहले पर(cid:28)तकु के प9ात, िन(cid:20)िलिखत पर(cid:28)तकु को अतं ः(cid:11)थािपत (cid:4)कया जाए, अथा7त:-
“पर(cid:28)त ु यह और (cid:4)क जब दो िवमान यातायात िनय6कं रेTटंग क(cid:31) समवतo (cid:23)प से मांग क(cid:31) जाए, तब
अनुPि@ धारक और अिधक मागं रेTटंग क(cid:31) अनभु व अपे/ाw क(cid:31) पrू त 7करेगा।”
(त) अनसु ूची III म,(cid:26) अनुभाग ख म,(cid:26)-
(क) पैरा 1 म,(cid:26)—
(i) खंड (ख) म(cid:26) “िवPान म(cid:26) िडxी या भौितक(cid:31) और गिणत सिहत समतु(cid:6)य परी/ा” श8द(cid:18) के (cid:11)थान पर

अनुPि@ का धारक अपनी अनPु ि@ पर ऐसी रेTटंग के पृVांकन हते ु अहक7 (cid:22)योजन के िलए ऑन-द-जॉब-
dेeनंग क(cid:31) अपे/ा को पूरा करन ेके िलए (cid:4)कसी िवशेष िवमान यातायात सेवा यिू नट म(cid:26) िवमान यातायात
िनयं6क के (cid:23)प म(cid:26) काय7 कर सकेगा:
पर(cid:28)त ुयह तब जब (cid:4)कः
(i) वह उस िवमान यातायात सेवा यिू नट म (cid:26) रे\टड (cid:22)ािधकृत अनुदशे क के पय7वे/ण म (cid:26) (cid:22)bयके समय
Yूटी िनNपा(cid:4)दत करेगा।
(ii) वह उस िवमान यातायात िनयं6क यिू नट म(cid:26) Yूटी िनNपा(cid:4)दत करेगा िजसके िलए उसने अनुमो(cid:4)दत
(cid:22)िश/ण पा}fम को सफलतापूव7क पूरा (cid:4)कया ह।ै
(cid:16)(cid:16)(cid:16)(cid:16)टटटट(cid:18)(cid:18)(cid:18)(cid:18)पपपपणणणणीीीी———— छा6 िवमान यातायात िनयं6क अनुPि@ इस बाबत िवशेष (cid:23)प से (cid:22)ािधकृत (cid:4)कसी
संगठन !ारा और ऐसी शतk के अधीन रहते &ए जो महािनदशे क !ारा अिधकिथत क(cid:31) जाए,ं जारी क(cid:31)
जा सकेगी।”;
(थ) अनसु ूची III म,(cid:26) अनुभाग ग म(cid:26), पैरा 1 म,(cid:26)—
a) खंड (ख) म,(cid:26) “िवPान म(cid:26) िडxी या भौितक(cid:31) और गिणत सिहत समतु(cid:6)य परी/ा” श8द(cid:18) के (cid:11)थान
पर, “भौितक(cid:31) और गिणत सिहत िवPान म (cid:26)िडxी या समतु(cid:6)य परी/ा” श8द(cid:18) को रखा जाए;

(द) अनसु ूची III म,(cid:26) अनुभाग घ म,(cid:26) पैरा 1 म,(cid:26)—
(क) खंड (क) म,(cid:26) उप-खंड (vi) म,(cid:26) “लXडमाsस7”, श8द(cid:18) के (cid:11)थान पर “लXडमाsस”7 श8द और उप-खंड (x) म,(cid:26)
“(cid:11)थान”, श8द के (cid:11)थान पर “ एटीएस यिू नट” श8द(cid:18) को रखा जाए;

NOTIFICATION
New Delhi, the 10th August, 2018
G.S.R. 770(E).─The following draft of certain rules further to amend the Aircraft Rules, 1937, which the Central
Government proposes to make in exercise of the powers conferred by section 5 of the Aircraft Act, 1934 (22 of 1934), is
hereby published as required by section 14 of the said Act, for information of all persons likely to be affected thereby;
and notice is hereby given that the said draft rules will be taken into consideration after a period of thirty days from the
date on which copies of the Gazette of India, in which this notification is published, are made available to the public;
Objections or suggestions, if any, may be addressed to the Director-General of Civil Aviation, Opposite
Safdarjung Airport, New Delhi-110003 or mailed to dgoffice.dgca@nic.in;
Any objection or suggestion which may be received from any person with respect to the said draft rules before
the expiry of the period specified above will be considered by the Central Government.
Draft Rules
1. (1) These rules may be called the Aircraft (……. Amendment) Rules, 2018.
(2) They shall come into force on the date of their final publication in the Official Gazette
2. In the Aircraft Rules, 1937,—
(i) in rule 3,—
(a) after clause (10B), the following clause shall be inserted, namely:-8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
“(10BB) Approved training organization means an organization approved by the Director-General
and operating in accordance with the laid down rules to perform approved training;”
(b) after clause (12), the following clause shall be inserted, namely: —
“(12A) Competency means a combination of skills, knowledge and attitudes required to
perform a task to the prescribed requirement;”;
(B) in rule 93, for the words “Aircraft (……Amendment) Rules, 2012”, the words “Aircraft (4th
Amendment) Rules, 2018” shall be substituted;
(C) in rule 95, in sub-rule (1), clause (h) shall be omitted;
(D) rule 96 shall be omitted;
(E) in rule 97,
(a) for the proviso under sub-rule (1), the following proviso shall be substituted, namely:-
“Provided that the holder of a Student Air Traffic Controller’s or an Air Traffic Controller’s
Licence may perform duty in a particular air traffic services unit without the relevant rating, for the
purpose of qualifying for endorsement of such rating in his licence, under the direct supervision of a
person holding the rating for that particular air traffic services unit and authorised by the Director
General or by any other organisation specially authorised by the Director General, to act as an
instructor.”
(b) for sub-rule (3), the following sub-rule shall be substituted, namely: —
“(3) Notwithstanding anything contained in sub-rule (1), the Director-General may authorise;
(i) the holder of an Air Traffic Controller’s Licence to perform duty in a newly established air
traffic service unit without endorsement of that unit on his licence provided he has completed
simulation training for the said unit and has been assessed as fit for such duties by competent
assessment board duly authorized by the Director-General or by any other organization
specifically authorized by the Director-General for this purpose.
Explanation: — For the purpose of this rule ‘Simulation training’ may include an
automated/computer generated air traffic environment or a simple instructor-driven interactive
role play.
(ii) deployment of an air traffic controller to perform air traffic control duties temporarily at an
airport without endorsement of that airport on his licence, provided he holds similar ratings
for another airport with higher air traffic density and is assessed as fit for such duties by an air
traffic controller holding the rating for the airport of temporary duty.”;
(F) in Rule 98, the following shall be substituted: —
“98. Rating Training Manual: At each air traffic service station, there shall be a rating training manual
containing the syllabus for on the job training, examination and procedures to meet the requirements
for ratings as specified in Schedule III, duly approved by the Director-General.”
(G) in rule 99, —
(a) for sub-rule (3), the following sub-rule shall be substituted, namely: —
“(3) The fee shall be paid in the manner as specified by the Director-General.”;
(b) sub-rule (4) shall be omitted;
(H) in rule 104, —
(a) for sub-rule (1), the following sub-rule shall be substituted, namely: —
“(1) A Student Air Traffic Controller’s Licence shall remain valid for a maximum period of three
years from the date of issue and may be renewed for a further period not exceeding three years
subject to conditions specified by the Director-General.”;
(b) for sub-rule(2), the following sub-rule shall be substituted namely:-
“An Air Traffic Controller’s licence shall be valid until the holder attains the age of sixty years”
(c) in sub-rule (3), for the word “two”, the word “four” shall be substituted;
(d) after sub-rule (3), the following proviso shall be inserted, namely:-¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 9
“Provided that the Director-General may extend the validity of a medical fitness assessment by a
maximum period of forty-five days, if he is satisfied that an emergency situation exists and there are
valid reasons due to which the licence holder is unable to undergo a medical examination.”
(e) for sub-rule (4), the following sub-rule shall be substituted, namely: —
“(4) The period of validity of medical fitness specified in sub-rule (3), shall be reduced to two
years after the holder of the licence has attained the age of forty years which shall be further
reduced to one year after the holder of the licence has attained the age of fifty years.”;
(f) in sub-rule (6), for clause (b), the following clause shall be substituted, namely: —
“(b) In case of renewal, the period of validity of medical fitness assessment shall commence from the
date following the date of expiry of the previous medical fitness assessment, irrespective of the date of
renewal, provided the medical examination for renewal has been conducted within a period of not
more than forty five days preceding the date of expiry of the previous validity.”;
(I) in rule 107, for sub-rule (1) the following shall be substituted, namely —
“(1) The holder of an Air Traffic Controller's Licence shall not exercise the privileges of the licence
and the rating endorsed on the licence unless he meets the competency and recency requirements and
the rating is valid for the air traffic services unit at or the sector on which he so acts.”
(J) in rule 108, for the words “unit or operational position”, the words “unit” shall be substituted;
(K) in rule 109, in sub-rule (2), for the word “licence”, the words “licence or rating” shall be substituted;
(L) in rule 112, for sub-rule (1), for the words “Director-General”, the words “Director-General or any
other organization specifically authorized by the Director-General” shall be substituted;
(M) in rule 114, for sub-rules (2), (3) and (4), the following rules shall be substituted, namely: —
“(2) The training organisation shall prepare a Training and Procedures Manual containing the
information specified by the Director-General and get it approved by the Director-General.
(3) Approval of a training organisation shall, unless suspended or cancelled, remain valid for
a period not exceeding five years, which may be renewed for a period not exceeding five
years at a time subject to the terms and conditions specified by the Director-General.
(4) (a) For the grant of approval, a training organisation shall pay, a fee of four lakh rupees
and two lakh rupees for renewal or extension of scope on each occasion.
(b) The fee shall be paid in the manner as specified by the Director-General.”;
(N) rule 118A shall be omitted;
(O) in schedule III, in Section A, —
(a) in paragraph 2, in sub-paragraph (a), for clause (iv), the following clause shall be substituted,
namely:—
“(iv) payment of the specified fee;”
(b) in paragraph 3, in sub- paragraph (a), for clause (iii), the following clause shall be substituted,
namely: —
“(iii) payment of the specified fee; and”
(c) in paragraph 6, —
(i) in heading, the word “assessment”, the word “experience” shall be substituted;
(ii) for the sub-paragraph (b), the following sub-paragraph shall be substituted, namely: —
“The experience specified in Sections D, E, F, G, H, J shall be completed within the six-
month period immediately preceding the date of application for the rating sought.”;
(iii) sub-paragraph (c), the words “or assessment” shall be omitted;
(d) in paragraph 7, after the first proviso, the following proviso shall be inserted, namely: —
“Provided further that when two air traffic controller ratings are sought concurrently, the licence

(P) in schedule III, in Section B, —
(a) in paragraph 1, —
(i) in clause (b), for the words “degree in Science or an equivalent examination with Physics and
Mathematics”, the words “degree in Science with Physics and Mathematics or an equivalent
examination” shall be substituted;
(ii) in clause (d), in sub-clause (iii), for the words “power plants”, the word “engines” and in sub-
clause (vii), for the word “non-route”, the word “non-routine” shall be substituted;
(iii) in clause (e), the words “including simulator training” shall be omitted;
(b) for the paragraph 3, the following paragraphs shall be substituted , namely : —
“3. Renewal— The licence may be renewed for a period not exceeding three years from the date
of fresh medical examination as specified in para 1(C).
4. Privileges.– Subject to the validity of licence, the holder of a Student Air Traffic
Controller’s Licence may perform duty as an air traffic controller in a particular air traffic service
unit in order to complete the requirement of on-the-job-training for the purpose of qualifying for
endorsement of such rating on his licence:
Provided that:
(i) He shall perform duty at all times under the direct supervision of an authorized instructor rated
on that air traffic service unit,
(ii) He shall perform duty in an air traffic control unit for which he has successfully completed an
approved training course.
Note — The Student Air Traffic Controller Licence may be issued by an organization specifically
authorised in this regard and subject to the conditions as laid down by the Director-General.”;
(Q) in Schedule III, in Section C, in paragraph 1, —
(a) in clause (b), for the words “degree in Science or an equivalent examination with Physics and
Mathematics”, the words “degree in Science with Physics and Mathematics or an equivalent
examination” shall be substituted;
(b) for clause (e), the following clause shall be substituted: —
“(e) Experience.– He shall have completed not less than three months of satisfactory service
engaged in the actual control of air traffic under the supervision of an appropriately rated air traffic
controller which may be credited as part of the experience specified in Sections D, E, F, G, H, J.”;
(R) in schedule III, in Section D, in paragraph 1, —
(a) in clause (a), in sub-clause (vi), for the words “land marks”, the word “landmarks” and in sub-
clause (x), for the word “place”, the words “ ATS unit” shall be substituted;
(b) in the proviso under clause (b), for the words “other aerodrome”, the words “other aerodrome
or any other rating of that aerodrome” shall be substituted;
(c) for clause (c), the following clause shall be substituted, namely: —
“(c) Skill.– He shall have been assessed successful by a Board/examiner regarding his skill,
judgement and performance to provide a safe, orderly and expeditious aerodrome control service
including the recognition and management of threats and errors and the assessment shall be
conducted as soon as possible after the completion of on-the-job training requirement.”;
(S) in schedule III, in Section E, in paragraph 1, —
b) in clause (a), in sub-clause (v), for the words “land marks”, the word “landmarks” and in sub-
clause (ix), for the word “place”, the words “ ATS unit” shall be substituted;

(c) in the proviso under clause (b), for the words “air traffic services unit.”, the words “aerodrome or
any other rating of that aerodrome.” shall be substituted;
(c) for clause (c), the following clause shall be substituted, namely: —
“(c) Skill.– He shall have been assessed successful by a Board/examiner regarding his skill, judgement
and performance to provide a safe, orderly and expeditious air traffic control service including the
recognition and management of threats and errors in the Oceanic Control Center and the assessment
has to be conducted as soon as possible after the completion of on-the-job training requirement.”.
