1.(cid:32) (1) इन िनयम(cid:7298) का संि(cid:6979)(cid:7385) नाम वायुयान (.......संशोधन) िनयम, 2016 है।
(2) ये सरकारी राजप(cid:7074) म(cid:7286) अंितम (cid:7079)काशन क(cid:7409) तारीख को (cid:7079)वृ(cid:7275) ह(cid:7298)गे।
2.(cid:32) वायुयान िनयम, 1937 म(cid:7286),-
(I)(cid:32) िनयम 3 ख म(cid:7286), “आदशे क(cid:7409) तारीख’’ श(cid:7011)द(cid:7298) के प(cid:7391)ात िन(cid:7388)िलिखत श(cid:7011)द(cid:7298) को अ(cid:7008)तः-(cid:7021)थािपत (cid:7408)कया जाए, अथा(cid:6981)तः-
इस शत(cid:6981) के अधीन रहते (cid:7263)ए (cid:7408)क (cid:7408)कसी एक मामले म(cid:7286) दो से अिधक अपील(cid:7286) दायर नह(cid:7277) क(cid:7409) जा सकेगी”;

(क) उड़ान भरने और उतरने के दौरान फश(cid:6981) तल के िनकास (cid:7367)ार के यथासंभव

(ख) (cid:7408)कसी अ(cid:7008)य समय पर, आपात िन(cid:7020)(cid:7059)मण क(cid:7409) दशा म(cid:7286) याि(cid:7074)य(cid:7298) के अिधकतम (cid:7079)भावी (cid:7272)प से िनकास क(cid:7409) (cid:7390)व(cid:7021)था
करने के िलए वायुयान म(cid:7286) (cid:7408)कसी उपयु(cid:7334) (cid:7021)थान पर, अवि(cid:7021)थत रह(cid:7286)गे।
(4) (cid:7079)चालक यह सुिनि(cid:7391)त करेगा (cid:7408)क केिबन कम(cid:7278)दल का (cid:7079)(cid:7004)येक सद(cid:7021)य महािनदशे क (cid:7367)ारा समय पर यथा िविन(cid:7416)द(cid:7397) आयु,
अहत(cid:6981) ा, (cid:7079)िश(cid:6979)ण तथा िच(cid:7408)क(cid:7004)सीय िनधा(cid:6981)रण क(cid:7409) अपे(cid:6979)ाएं पूरी कर(cid:7286)।
(5) केिबन कम(cid:7278)दल का (cid:7079)(cid:7004)येक सद(cid:7021)य, वायुयान म(cid:7286) (cid:7357)ूटी पर जाने से पूव(cid:6981), (cid:7079)िश(cid:6979)ण का अनुमो(cid:7408)दत पा(cid:7353)(cid:7059)म सफलतापूव(cid:6981)क
पूरा करेगा और उसके आपात उप(cid:7021)कर के उपयोग प(cid:7391)ात िनकासी (cid:7079)(cid:7408)(cid:7059)या अव(cid:7021)थान और उससे संबंिधत आविधक पुन(cid:7391)या (cid:6981)
पा(cid:7353)(cid:7059)म और कोई अ(cid:7008)य अपे(cid:6979)ा जो महािनदशे क (cid:7367)ारा िविन(cid:7416)द(cid:7397) क(cid:7409) जाए, को पूरा करेगा।
(6) जब भी (cid:7408)कसी उड़ान पर दो या अिधक केिबन कम(cid:7278)दल सद(cid:7021)य समनु(cid:7408)द(cid:7397) (cid:7408)कए जाएं, (cid:7079)चालक केिबन कम(cid:7278)दल के एक
अनुभवी सद(cid:7021)य को केिबन कम(cid:7278)दल के (cid:6996)ये(cid:7399) सद(cid:7021)य के (cid:7272)प म(cid:7286) नामिनदि(cid:7287) शत करेगा जो (cid:7408)क केिबन क(cid:7409) सुर(cid:6979)ा और (cid:7079)चालन
िनदि(cid:7287) शका म(cid:7286) िविन(cid:7416)द(cid:7397) आपात (cid:7079)(cid:7408)(cid:7059)या(cid:7312) के संचालन और सम(cid:7008)वयन के िलए समनुदशे क िवमान चालक के (cid:7079)ित उ(cid:7275)रदायी
होगा;
परंतु केिबन कम(cid:7278)दल के (cid:6996)ये(cid:7399) सद(cid:7021)य के पास केिबन कम(cid:7278)दल के (cid:7272)प म(cid:7286) (cid:7008)यूनतम एक वष(cid:6981) का अनुभव होना चािहए और
महािनदशे क (cid:7367)ारा अपेि(cid:6979)त (cid:7079)िश(cid:6979)ण सफलतापूव(cid:6981)क (cid:7079)ा(cid:7385) (cid:7408)कया (cid:7263)आ होना चािहए।
(7) (cid:7079)चालक, उपिनयम (5) के अधीन (cid:7079)िश(cid:6979)ण के पूरा होन े के प(cid:7391)ात, (cid:7079)(cid:7004)येक केिबन कम(cid:7278)दल (cid:7367)ारा सुर(cid:6979)ा और आपात
कत(cid:6981)(cid:7390)(cid:7298) का पालन करने म(cid:7286) (cid:7079)वीणता क(cid:7409) जांच कारयेगा और ऐसी जांच महािनदशे क (cid:7367)ारा अनुमो(cid:7408)दत और िविन(cid:7416)द(cid:7397) अहत(cid:6981) ाएं
रखने वाले अनुदशे क(cid:7298) (cid:7367)ारा क(cid:7409) जाएगी।
(8) कोई भी केिबन कम(cid:7278)दल तीन (cid:7408)क(cid:7021)म के वायुयान(cid:7298) से अिधक पर (cid:7357)ूटी नह(cid:7277) करेगा।
(cid:7021)प(cid:7397)ीकरण,- इस उपिनयम के (cid:7079)योजन(cid:7298) के िलए वायुयान(cid:7298) क(cid:7409) (cid:7408)क(cid:7021)म(cid:7286) िभ(cid:7382) (cid:7079)कार क(cid:7409) (cid:7408)क(cid:7021)म(cid:7286) मानी जाएगी य(cid:7408)द वे िन(cid:7388)िलिखत
पहलु(cid:7312) से िब(cid:7016)कुल एक जैसी नह(cid:7277) ह,(cid:7289) अथा(cid:6981)तः-
(क)(cid:32) आपात िनकास सं(cid:7408)(cid:7059)याः
(ख)(cid:32) सुर(cid:6979)ा उप(cid:7021)कर क(cid:7409) अवि(cid:7021)थित और उनक(cid:7409) (cid:7408)क(cid:7021)म; और
(ग)(cid:32) आपात (cid:7079)(cid:7408)(cid:7059)याएं।
(9) महािनदशे क, य(cid:7408)द उसक(cid:7409) यह राय ह ै(cid:7408)क ऐसा करना समीचीन ह ैतो, आदशे (cid:7367)ारा और उन कारण(cid:7298) से जो लेखब(cid:7373) (cid:7408)कए
जाएंगे, उपिनयम (1) क(cid:7409) अपे(cid:6979)ा(cid:7312) का पूण(cid:6981)तः या भागतः अिध(cid:7004)यजन कर सकेगा।
(XII)(cid:32) िनयम 41 म(cid:7286), पहले परंतुक म(cid:7286) ‘’भारतीय थलसेना का िवमान (cid:7079)चालन (cid:7021)कंध’’श(cid:7011)द(cid:7298) के (cid:7021)थान पर ‘’भारतीय थलसेना या भारतीय
तटर(cid:6979)क बल’’ श(cid:7011)द(cid:7298) को (cid:7079)ित(cid:7021)थािपत (cid:7408)कया जाए;
(XIII)(cid:32) िनयम 41 क म(cid:7286),-
(क)(cid:32) उप-िनयम (3) म(cid:7286) ‘(cid:7079)वीणता जांच’ तथा ‘(cid:7079)वीणता’ श(cid:7011)द(cid:7298) के (cid:7021)थान पर (cid:7059)मशः कौशल परी(cid:6979)ण तथा ‘’कौशल’’ श(cid:7011)द(cid:7298) को
(cid:7079)ित(cid:7021)थािपत (cid:7408)कया जाए;
(ख)(cid:32) उप-िनयम (5) के िलए िन(cid:7388)िलिखत उप-िनयम (cid:7079)ित(cid:7021)थािपत (cid:7408)कया जाए अथा(cid:6981)तः-
‘’(5) महािनदशे क (cid:7408)कसी परी(cid:6979)ण पायलट परी(cid:6979)क या बोड(cid:6981) (cid:7367)ारा संचािलत (cid:7408)कसी उ(cid:7355)यन परी(cid:6979)ण या परी(cid:6979)ा को अकृत
और शू(cid:7008)य घोिषत कर सकेगा य(cid:7408)द महािनदशे क क(cid:7409) राय म(cid:7286) वह परी(cid:6979)ण या परी(cid:6979)ा उसको समाधान(cid:7079)द (cid:7272)प से पूरी नह(cid:7277)
क(cid:7409) गई ह,ै और वह यह अपे(cid:6979)ा कर सकेगा (cid:7408)क वह परी(cid:6979)ण या परी(cid:6979)ा (cid:7408)फर से अ(cid:7008)य परी(cid:6979)ण-पायलट परी(cid:6979)क या बोड(cid:6981)
(cid:7367)ारा क(cid:7409) जाए। महािनदशे क परी(cid:6979)ण-पायलट या परी(cid:6979)क के िव(cid:7272)(cid:7373) ऐसी कार(cid:6981)वाई भी कर सकेगा जैसी वह िनयम 19
के अधीन ठीक समझता है’’;

NOTIFICATION
New Delhi, the 29th November, 2016
G.S.R. 1117(E) .─ The following draft of certain rules further to amend the Aircraft Rules, 1937, which the
Central Government proposes to make in exercise of the powers conferred by section 5 of the Aircraft Act, 1934 (22 of
1934), is hereby published as required under section 14 of the said Act, for information of all persons likely to be
affected thereby; and notice is hereby given that the said draft will be taken into consideration after a period of thirty
days from the date on which copies of the Gazette containing this notification are made available to the public;
Objections or suggestions, if any, may be addressed to the Director-General of Civil Aviation, Opposite
Safdarjung Airport, New Delhi-110003;
Any objection or suggestion which may be received from any person with respect to the said draft rules before
the expiry of the period specified above will be considered by the Central Government.
Draft Rules
1. (1) These rules may be called the Aircraft (........Amendment) Rules, 2016.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Aircraft Rules, 1937, ─
(I) in rule 3B, after the words “the date of the order”, the following words shall be inserted, namely: ─
“subject to the condition that not more than two appeals shall be filed in any one case.”;
(II) in rule 6, the second and third provisos shall be omitted;
(III) rule 8A shall be omitted;
(IV) in rule 14, in the proviso, the words “or by notification in the Official Gazette” shall be omitted;
(V) for rule 16, the following rule shall be substituted, namely: ─
“16. Rules of Air. ─ Every person shall comply with the Rules of the Air issued by the Director-General in
accordance with Annex 2 to the Convention as may be applicable to that person.”;
(VI) in rule 17, for the words “any police officer above the rank of constable, any Customs officer, any
commissioned officer of the Naval, Military or Air Force of the Union, any gazetted officer of the Civil
Aviation Department”, the following shall be substituted, namely:-¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 5
“any police officer above the rank of sub-inspector, any Customs officer, any commissioned officer of the
Naval, Military or Air Force of the Union, any gazetted officer of the Civil Aviation Department in Government
of India”;
(VII) in rule 25A, in sub-rule (1), for the words and figures, “the Petroleum Rules, 1937”, the words and figures, “the
Petroleum Rules, 2002” shall be substituted;
(VIII) in rule 32, ─
(a)(cid:32) for the words “the local Aerodrome Officer”, the words “the Director-General” shall be substituted;
(b)(cid:32) the proviso shall be omitted;
(IX) in rule 38, sub-rule (2) shall be omitted;
(X) in rule 38A, in sub-rule (1), ─
(i)(cid:32) in clause (a), in the proviso, in clause (iii), for the words “Night Rating”, the words “Instrument Rating”
shall be substituted;
(ii)(cid:32) in clause (b), the words “Senior Commercial” shall be omitted;
(XI) for rule 38B, the following rule shall be substituted; namely:-
“38B. Carriage of cabin crew – (1) No aircraft registered in India shall be operated for public transport of
passengers unless the following minimum number of cabin crew are on board the aircraft for the purpose of
performing such duties as may be assigned in the interest of the safety of passengers, by the operator or the Pilot-
in-Command of the aircraft, namely:-
(a) For an aeroplane or a helicopter having a seating One cabin crew
capacity of not less than 20 and not more than 50
passengers.
(b) For an aeroplane or a helicopter having a seating Two cabin crew plus one cabin
capacity of more than 50 passengers. crew for each unit(or part of unit)
of 50 passenger seats above a
seating capacity of 99 passengers
(2) Notwithstanding anything contained in sub-rule (1), if any higher number is specified by the aircraft
manufacturer for the type of aircraft being used, then that minimum number of crew members shall be carried
on-board:
Provided that in case of multi-aisles (single or multi-deck) at least one crew member for each floor
level exit and for the purpose of certification, if any higher number of crew member is required to conduct
emergency evacuation demonstration then that number of crew member shall be carried on board.
(3) The cabin crew shall be located–
(a) during take-off and landing as near as possible to the floor level exits; and
(b) at any other time, at a suitable place in the aircraft, so as to provide the most effective exit of
passengers in the event of emergency evacuation.
(4) An operator shall ensure that every member of cabin crew meets the requirements of age, qualification,
training and medical assessment as specified by the Director-General from time to time
(5) Every member of cabin crew shall, before being detailed for duty on board the aircraft, successfully
complete an approved course of training followed by periodical approved refresher course concerning
evacuation procedure, location and use of emergency equipment and any other requirement as specified by the
Director-General.
(6) Whenever two or more cabin crew members are assigned to a flight, the operator shall nominate an
experienced cabin crew member as a senior cabin crew member who shall be responsible to the Pilot-in-Command
for the conduct and coordination of cabin safety and emergency procedure specified in the Operations Manual:
Provided that the senior cabin crew member has a minimum of one year’s experience as cabin crew and
has successfully undergone the training as specified by the Director-General.
(7) The operator shall cause checks of proficiency in carrying out safety and emergency duties by each cabin
crew after completion of training as per sub-rule (5) and the checks shall be conducted by the Instructors approved,
and having qualifications specified, by the Director-General.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(8) No cabin crew shall perform duties on more than three types of aircraft.
Explanation.- For the purposes of this sub-rule, types of aircrafts shall be considered to be different types
if they are not similar in all the following aspects, namely:-
(a)(cid:32) emergency exit operation;
(b)(cid:32) location and type of safety equipment; and
(c)(cid:32) emergency procedures.
(9) The Director-General may, if he is of the opinion that it is expedient so to do, by order and for reasons to
be recorded in writing, waive fully or partially, the requirement of sub-rule (1).”;
(XII) in rule 41, in the first proviso, for the words “or Air Operational Wing of the Indian Army”, the words, “Indian
Army or Indian Coast Guard” shall be substituted;
(XIII) in rule 41A, ─
(a)(cid:32) in sub-rule (3), for the words “proficiency checks” and “proficiency”, the words “skill tests” and “skill”
shall respectively be substituted;
(b)(cid:32) for sub-rule (5), the following sub-rule shall be substituted, namely:-
“(5) The Director-General may declare any flying test or examination conducted by an examiner or a
Board, null and void, if in the opinion of the Director-General, the test or examination has not been
carried out to his satisfaction, and require the test or the examination to be carried out again by another
Examiner or Board and the Director-General may also take such action against the Examiner as he may
deem fit under rule 19.”;
(XIV) for rule 45, the following rule shall be substituted, namely:-
“45. Validation of foreign licences.- When a licence has been granted by the competent authority in a foreign
State and is for the time being in force, the Central Government may, subject to such conditions and limitations
and for such periods as it shall think fit, render such licence valid by an authorisation for flying aircraft
registered in India and a licence so validated shall be subject to the provisions of rule 19 and such validation of a
licence shall cease if the licence is revoked or suspended.
Note:- For the purpose of this rule, foreign aircraft falling under sub-rule (3) of rule 1 shall be deemed
as aircraft registered in India and Indian aircraft falling under sub-rule (4) of rule 1 shall be deemed as aircraft
not registered in India.”
(XV) rule 64 shall be omitted;
(XVI) in rule 67A,
(i) in sub-rule (4),-
(a)(cid:32) in clause (a), for the words, “Company or Corporation”, the words, “Air Transport Undertaking” shall
be substituted;
(b)(cid:32) in clause (b), for the word, “Club”, the words, “Flying Training Organisation” shall be substituted;
(ii) in sub-rule (9), the words, “Senior Commercial” shall be omitted;
(iii) in sub-rule (13), the words, “or Check Pilot” shall be omitted.
