(ग) ‘’प्राजधकार प्रमाण पत्र’’ स े साधारण श्रणे ीकरण और जिहनाकं न जनयम, 1988 के उपबंधों के अधीन िारी प्रमाण पत्र अजभप्रेत ह,ै िो ककसी व्यजि या व्यजियों के जनकाय को श्रेणी अजभधान जिहन द्वारा कुल्थी दाल के श्रेणीकरण और जिहनांकन का प्राजधकार देता ह;ै (घ) “साधारण श्रणे ीकरण और जिहनांकन जनयम” स े कृजि उपि (श्रेणीकरण और जिहनांकन) अजधजनयम 1937 (1937 का 1) की धारा 3 के अधीन बनाए गए साधारण श्रणे ीकरण और जिहनांकन जनयम, 1988 अजभप्रेत ह;ै (ड.) “श्रेणी अजभधान जिहन” स े जनयम 3 म ें जनर्ददष्ट “एगमाकव प्रतीक” अजभप्रेत ह;ै (ि) “जवजधक माप (पैक की गई वस्ट्तुए)ं जनयमों स े जवजधक माप अजधजनयम, 2009 (2010 का 1) के अतं गतव बनाए गए जवजधक माप जवज्ञान (पैक की गई वस्ट्तुए)ं जनयम, 2011 अजभप्रेत ह;ै और (छ) “अनुसूिी” स े इन जनयमों के साथ संलग्न अनुसूिी अजभप्रेत ह ै। (2) इन जनयमों म ें प्रयुक्त िब्द और पद, िो पररभाजित नहीं ह ैं लेककन जिन्द्ह ें कृजि उपि (श्रणे ीकरण और जिहनांकण) अजधजनयम, 1937 (1937 का 1) और साधारण श्रणे ीकरण और जिहनांकन जनयम, 1988 म ें पररभाजित ककया गया ह,ै के वही अथ व होंगे िो उक्त अजधजनयम एव ं जनयम म ेंह;ैं 3. श्रणे ी अजभधान जिहन.- श्रेणी अजभधान जिहन म ें प्राजधकार प्रमाण-पत्र संखयांक, “एगमाकव” िब्द, वस्ट्तु का नाम और अनुसूिी-। म ें यथारूप स े कदए गए सदश्ृ य श्रेणी अजभधान को सजम्पमजलत करन े वाल े जडिाइन स े जमलकर बना “एगमाकव प्रतीक” होगा। 4. श्रणे ी अजभधान.- कुल्थी दाल की गुणवत्ता उपदर्वित करन े के जलए श्रणे ी अजभधान वह होगा िो अनुसूिी-II के श्रेणी अजभधान हते ु जनधावररत ककए गए मापदंड के कॉलम एक म ें वर्वणत ककया गया ह।ै 5. गणु वत्ता.- इन जनयमों के प्रयोिन के जलए कुल्थी दाल की गणु वत्ता अनुसूिी-II म ें कदय ेगए अनुसार होगी ।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 6. पकै कग करन े की जवजध.- (1) कुल्थी दाल की पैककग नए, स्ट्वच्छ और िुष्क िूट के थलै ों, कपडे के थैलों, पॉलीवोवन थैलों जिनकी आंतररक लाइननग फूड ग्रेड सामग्री की होगी या बायोजडग्रेडेब्ल पेकेनिग सामग्री अथवा फूड ग्रेड के पॉलीपैकों या अन्द्य ऐसी ककसी पैककग सामग्री म ें की िाएगी िो सामान्द्य श्रेणीकरण और जिहनांकन जनयम के जनयम 11 के अंतगवत कृजि जवपणऩ सलाहकार या उसकी ओर स ेप्राजधकृत अजधकारी द्वारा अनुमोकदत की गई हो; (2) पैकेनिग सामग्री कीट और फफूंदी के प्रभाव स े मुि होगी और इससे उत्पाद म ें ककसी जविाि पदाथ,व अवांजछत गंध अथवा स्ट्वाद का असर अथवा रंग नहीं आना िाजहए; (3) कुल्थी दाल की पैककग जवजधक माप जवज्ञान अजधजनयम, 2009 (2010 का 1) के अंतगवत बनाए गए जवजधक माप जवज्ञान (पैक की गई वस्ट्तएु )ाँ जनयम 2011 के प्रावधानों के अनुसार पैक आकारो म ें और कृजि जवपणन सलाहकार द्वारा समय-समय पर िारी अनुदिे ों के अनुसार की िाएगी; (4) समान लॉट/ बैि और ग्रडे के छोटे पैक आकारों की श्रेणीकृत सामग्री की पैककग एक मास्ट्टर कंटेनर म ें की िाएगी और उस पर श्रेणी अजभधान जिहन सजहत पूरा ब्यौरा अंककत ककया िाएगा; (5) प्रत् यके पैकेि म ें समान प्रकार का और समान श्रणे ी अजभधान की कुल्थी दाल होगी; (6) प्रत् यके पैकेि उजित और सुरजक्षत रूप स े बंद और मुहरबंद ककया िाएगा, ताकक उसकी सामग्री बाहर न फैल सके। 7. जिहनाकं न की जवजध.- (1) श्रेणी अजभधान जिहन प्रत्येक पैकेि पर कृजि जवपणन सलाहकार या इस जनजमत उसके द्वारा प्राजधकृत ककसी अजधकारी द्वारा अनुमोकदत रीजत स े साधारण श्रणे ीकरण और जिहनांकन जनयम 1988 के जनयम 11 के अनुसार सुरजक्षत रूप स े जिपकाया या मुकरत ककया िाएगा; (2) श्रेणी अजभधान जिहन के अजतररक्त प्रत्येक पैकेि पर जनम्पन जलजखत जववरण स्ट्पष्ट रूप स े और अजमट रूप स े अंककत ककया िाएगा, अथावत:- (क) वस्ट् तु का नाम; (ख) श्रेणी; (ग) ककस्ट्म या रेड नाम (वैकजल्पक); (घ) लॉट संखया; (ड.) पैककग की तारीख; (ि) फसल वि व (वैकजल्पक); (छ) िुद्ध भार; (ि) पैकर का नाम और पता; (झ) अजधकतम खुदरा मल्ू य (सभी करों सजहत); (ञ) ...............माह..............वि वके पूवव उपयोग हते ु सवोत्तम; (ट) कोई अन्द्य जववरण िो जवजधक माप जवज्ञान (पैक की गई वस्ट्तएु )ाँ जनयम अथवा खाद्य सुरक्षा और मानक अजधजनयम, 2006 (2006 का 34) अथवा ककसी समय लागू कोई अन्द्य कानून अथवा इस4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] अजधजनयम के प्रावधान के तहत िारी ककए गए ककन्द्हीं अनुदिे ों के अंतगवत जवर्वनकदष्ट कोई अन्द्य जववरण। (3) पैकेिों पर जिहनांकन के जलए प्रयोग की गई स्ट्याही से कुल्थी दाल को संदजू ित न करे। (4) प्राजधकृत पैकर कृजि जवपणन सलाहकार अथवा इस जनजमत्त उसके ओर स े प्राजधकृत ककसी अजधकारी का पूवव अनुमोदन अजभप्रा् त करने के पश् िात श्रेणीकृत पैकेिों पर अपना प्राइवेट व् यापार जिहन या व् यापार ब्ांड जिहनांककत करेगा, परंत ु वह इन जनयमों के अनुसार श्रेणीकृत पैकेिों पर लगाए गए श्रणे ी अजभधान जिहन द्वारा उपदर्वित गणु वत्ता स े जभन्द्न गुणवत्ता उपदर्वित नहीं करेगा। 8. प्राजधकार प्रमाण पत्र की जवििे ित.ें-(1) साधारण श्रणे ीकरण और जिहनांकन जनयम 1988 के जनयम 3 के उपजनयम (8) म ें जवजनर्ददष्ट ितों के अजतररि प्रत्येक प्राजधकृत पकै र अजधजनयम के प्रावधानों के अंतगतव िारी ककए गए सभी अनुदेिों का पालन करेगा; (2) कुल्थी दाल की गुणवत्ता का परीक्षण करन े के जलए प्राजधकृत पैकर जनधावररत मापदडं ों के अनुसार या तो अपनी स्ट्वय ं की प्रयोगिाला स्ट्थाजपत करेगा या ककसी अनुमोकदत राज्य श्रेणीकरण प्रयोगिाला या सहकारी अथवा एसोजसएिन प्रयोगिाला या ऐसी प्राइवेट वाजणज्य प्रयोगिाला के साथ संपकव करेगा जिसका प्रबंधन सामान्द्य श्रणे ीकरण जिहनांकन जनयम 1988 के जनयम 9 के अतं गतव कृजि जवपणन सलाहकार या इस जनजमत्त उनके द्वारा प्राजधकृत ककसी अजधकारी द्वारा अनुमोकदत योग्य रसायनज्ञ द्वारा ककया िा रहा हो; (3) प्राजधकृत पैकर के पररसरों को समुजित संवातन और प्रकाि सजहत स्ट्वास्ट््यप्रद और स्ट्वच्छाता की दिाओं म ें रखा िाएगा और इन कायों म ें लग े हुए कार्वमकों का अच्छा स्ट्वास्ट््य होगा और वे ककसी संिारी, संसगी या संक्रामक रोग स े मिु होंगे। (4) प्राजधकृत पैकर के पररसरों म ें पक्क े फि व सजहत पयाव् त भडं ारण सुजवधाएं होंगी और वह नमी, ककसी तरह की दरारों, कृंतकों और कीटों के उत् पीडन स ेमुक् त होगा । (5) प्राजधकृत पैकर और अनुमोकदत रसायनज्ञ, परीक्षण, श्रेणीकरण, पैककग, जिहनांकन, सीनलग और अजभलेखों के अनुरक्षण स े संबंजधत ऐसे सभी अनुदेिों का पालन करेगा िो अजधजनयम के प्रावधानों के अंतगवत िारी ककए गए हों । अनसु िू ी-I (जनयम 3 देखें) (एगमाकव प्रतीक का जडिाइन) No. A C वस्ट्तु का नाम………………………………………… श्रेणी………………………………………………… अनसु िू ी –II (जनयम 4 और 5 देख)ें[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 कुल्थी दाल का श्रेणी अजभधान और उसकी क्वाजलटी 1. कुल्थी दाल डोजलकोस बाइफ्लोरस और मैक्रोटायलोमा यूजनफ्लोरम पौध े से प्राि की िाएगी। 2. न्द्यूनतम अपेक्षाए ाँ(i) कुल्थी दाल.- (क) स्ट्वाद एवं गधं म ेंरूजिकर होगा और रंग एक समान होगा; (ख) ठोस, अच्छी तरह साफ की हुई, धलु ी हुई, िुष्क, साबुत और कुल्थी दाल की ककस्ट्म की जविेिता से युि होगी ; (ग) बाह्य पदाथों िैसे कंकड-पत्थर, गंदगी और धूल-जमट्टी आकद से मुि होगी; (घ) ककसी भी जविातीय स्ट्वाद, गंध और ककण्वन स ेमुि होगी ; (ड.) िीजवत कीटों, मृत कीटों, कीटों के टुकडों, माइट्स, कृंतक संदिू ण और फफूंदी से मिु होगी; (ि) ककसी भी अन्द्य योजित रंिक पदाथव से मिु होगी । (ii) घरेलू व्यापार के मामल े म ें यह धात ु संदिू ण, कीट नािी िीवों और नािकिीवमारों, संदिू ण सूक्ष्म अपेक्षाओं, फसल संदिू कों, प्राकृजतक रूप से पैदा होने वाले जविलै े पदाथों के अवजिष्ट स्ट्तर के संबंध म ें जनबंधनों और खाद्य सुरक्षा और मानक (संदिू क, िीव-जवि और अपजिष्ट) जवजनयम 2011 और खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक तथा खाद्य जमश्रण) जवजनयम, 2011 और खाद्य सुरक्षा और मानक अजधजनयम, 2006 के अधीन बनाए घरेलू व्यापार हते ु अजधसूजित अन्द्य जवजनयमों के अधीन यथा जवजनर्ददष्ट अन्द्य खाद्य सरु क्षा अपेक्षाओं का अनुपालन करेगी। (iii) जनयावत के मामल े म ें यह भारी धातओंु , कीटनािी िीवों की अपजिष्ट सीमाओं और कोडेक्स एजलमेटेररयस आयोग द्वारा अजधकजथत अन्द्य खाद्य सुरक्षा मापदंडों जनयावत व्यापार के जलए या आयातकता व देि की अपेक्षाओं का अनुपालन करेगी। 3. कुल्थी दाल के श्रणे ी अजभधान के जलए मापदडं : ताजलका श्रेणी सहनीयता की अजधकतम सीमा (भार द्वारा प्रजतित) घुन लगा यूररक अम्पल अजभधान अनाि, नमी जविातीय अन्द्य अन्द्य खराब अनाि बदरंग बीि गणना के (अजधकतम ) पदाथव खाद्य ककस्ट्मों गंभीर हल्का दोि जहसाब से अनाि का दोि प्रजतित जमश्रण (अजधकतम) (1) (2) (3) (4) (5) (6) (7) (8) (9) (10) जविेि 8.0 0.25 1.0 1.0 0.5 इसमें से 3% टूटी हुई 1.0 1.0 दाल की मात्रा 0.5% से अजधक नहीं होनी 100 िाजहए जमलीग्राम मानक 9.0 0.75 1.5 2.0 1.0 इसमें से 5% टूटी हुई 2.0 2.0 प्रजत दाल की मात्रा 1.5% ककलोग्राम से अजधक नहीं होनी िाजहए साधारण 11.0 1.0* 2.0 4.0 1.0 इसमें से 7% टूटी हुई 3.0 5.0 दाल की मात्रा 3% से अजधक नहीं होनी िाजहए6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] *रट्पणी: जिसम ें मात्रा के 0.25 प्रजतित स े अजधक खजनि पदाथव नहीं होंगे और मात्रा के 0.10 प्रजतित स े अजधक प्राणी मूल की अिुजद्धयााँ नहीं होगी। स्ट्पष्टीकरण - इस ताजलका के प्रयोिनों के जलए, - (1) “जविातीय पदाथव” में अकाबवजनक एवं काबवजनक पदाथव िाजमल ह।ै अकाबवजनक पदाथों म ें रेत, बिरी, गंदगी, कंकड, पत्थर, कांि और धातु के टुकडे, जमट्टी के ढेले, और कीिड िाजमल होंगे। काबवजनक पदाथों म ें भूसी, जतनके, खरपतवार और अन्द्य अखाद्य अनाि िाजमल होंग े । (2) "अन्द्य खाद्य/खाद्यान्नों" का आिय जविाराथव अनािों को छोडकर अन्द्य खाद्यान्नों (जतलहन सजहत) ह।ै (3) “अन्द्य ककस्ट्मों का जमश्रण” जविाराथ व वेरायटी को छोडकर एक ही तरह के अनाि की वरे ायटी की उपजस्ट्थजत स े ह ै। (4) “गंभीर दोि वाले अनाि” आिय ऐसे अनाि से ह ैजिनके कौरटलेडन्द्स नािकिीवों द्वारा प्रभाजवत ककए गए हों या उन पर आघात ककया गया हो; और ऐसे अनािों से ह ै जिनमें फफूंद के बहुत हल्के जनिान मौिूद हों अथवा मामूली रूप से क्षजतग्रस्ट्त हों अथवा कौरटलेडन्द्स के हल्के धब्ब ेमौिूद हों । (5) हल्के दोियिु अनािों" का आिय ऐस े अनाि स े ह ै जिनम ें अनाि जवकास की सामान्द्य अवस्ट्था म ें न पहुिं े हों, ऐसे बीि जिनमें कौरटलेडन प्रभाजवत हुए जबना अनाि आवरण पर व्यापक रूप से धब्बे पड गए हों, अनाि जिनके आवरण झुरीदार हों, अथवा वे मुडे हुए अथवा टूटे हुए हों । (6) "घुन लगे अनािों" का आिय ऐसे अनािों/बीररयों स े ह ै जिन्द्ह ें अनाि के जलए हाजनकारक कीटों द्वारा आंजिक रूप से या पूरी तरह से जछकरत कर कदया गया हो लेककन इनमें कीटाणुओं द्वारा खाए गए अनाि और अडं े के धब्बे वाल ेअनाि िाजमल नहीं ह ैं। 4. अन्द्य अपक्षे ाएाँ.- (i) कुल्थी दाल की जस्ट्थजत ऐसी होगी कक वह.- (क) यातायात और हडैं नलग की जस्ट्थजत का सामना कर सके; Objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the above said period shall be taken into consideration by the Central Government. 3. DRAFT RULES 1. Short title, application and commencement.—(1) These rules may be called Horse Gram Grading and Marking Rules, 2020. (2) They shall apply to Horse Gram obtained from the plant Dolichos biflorus and Macrotyloma uniflorum. It is commonly known as Kulthi beans, Hurali, Madras gram. (3) They shall come into force from the date of their final publication in the Official Gazette. 2. Definitions.-(1) In these rules, unless the context otherwise requires,- (a) "Agricultural Marketing Adviser" means the Agricultural Marketing Adviser to the Government of India. (b) "Authorized packer" means a person or a body of persons who has been granted a certificate of authorization to grade and mark Horse Gram in accordance with the grade standards and procedure prescribed under these rules; (c) "Certificate of Authorization" means a certificate issued under the provisions of the General Grading and Marking Rules, 1988 authorizing a person or a body of persons to grade and mark Horse Gram with the grade designation mark; (d) "General Grading and Marking Rules" means the General Grading and Marking Rules, 1988 made under section 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937); (e) "Grade designation mark" means the "Agmark Insignia" referred to in rule 3. (f) “Legal Metrology (Packed Commodities) Rules” means the Legal Metrology (Packaged Commodities) Rules, 2011, made under the Legal Metrology Act, 2009 (1 of 2010); and (g) "Schedule" means a Schedule appended to these rules. (2) Words and expressions used in these rules and not defined but defined in the Agricultural Produce (Grading and Marking) Act, 1937 and General Grading and Marking Rules, 1988 shall have the same meaning as are assigned to them under the Act. 3. Grade designation mark.- The grade designation mark shall consist of "AGMARK Insignia" consisting of a design incorporating the certificate of authorisation number, the word "AGMARK", name of commodity and grade designation resembling the design as set out in Schedule- I. 4. Grade designations.-The grade designations to indicate the quality of Horse Gram shall be as set out in column-I of criteria for grade designation of Schedule-II. 5. Quality.- For the purpose of these rules, the quality of Horse Gram shall be as given in Schedule-II. 6. Method of packing.- (1) Horse Gram shall be packed in new clean and dry jute bags or paper bags or cloth bags or poly woven bags with inner lining of food grade material or any bio-degradable packaging materials or poly packs of food grade material or any other packaging material as approved by the Agricultural Marketing Adviser or the officer authorised by him under rule 11 of the General Grading and Marking Rules. (2) The packing material shall be free from insect and fungal infestation and should not impart any toxic substance or undesirable odour or flavour to the product. (3) Horse Gram shall be packed in pack sizes in accordance with the provisions of the Legal Metrology (Packaged Commodities) Rules or as may be allowed by the Agricultural Marketing Adviser under rule 11 of the General Grading Marking Rules. (4) Graded material of small pack sizes of the same lot/batch and grade may be packed in a master container with complete details thereon along with grade designation mark.8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (5) Each package shall contain Horse Gram of the same type and of the same grade designation. (6) Each package shall be properly and securely closed and sealed so as to disallow spilling. 7. Method of Marking.-(1) The grade designation mark shall be securely affixed to or printed on each package in the manner approved by the Agricultural Marketing Adviser or the officer authorised by him under Rule 11 of the General Grading and Marking Rules. (2) In addition to the grade designation mark, following particulars shall be clearly and indelibly marked on each package. (a) name of the commodity; (b) grade; (c) variety or trade name; (optional) (d) lot no.; (e) date of packing; (f) crop year(optional); (g) net weight; (h) name and address of the packer; (i) maximum retail price (inclusive of all taxes); (j) BEST BEFORE__________MONTH______YEAR; (k) any other particulars as may be specified under Legal Metrology (Packaged Commodities) Rules or under Food Safety and Standards Act, 2006 (34 of 2006) or any other law for the time being in force or any instructions issued under provision of the Act. (3) The ink used for marking on packages shall not contaminate the Horse Gram. (4) The authorized packer may after obtaining prior approval of the Agricultural Marketing Adviser or an officer authorized by him in this behalf, mark his private trade mark or trade brand on the graded packages provided that the same do not indicate quality other than that indicated by the grade designation mark affixed to the graded packages in accordance with these rules. 8. Special conditions of Certificate of Authorization.-(1) In addition to the conditions specified in sub-rule (8) of rule 3 of the General Grading and Marking Rules every authorised packer shall follow all instructions issued under the provisions of the Act (2) The authorised packer shall either set up his own laboratory as per prescribed norms or have access to an approved state grading laboratory or cooperative or association laboratory or a Private Commercial laboratory manned by a qualified chemist approved by the Agricultural Marketing Adviser or the officer authorized by him under rule 9 of the General Grading and Marking Rules, for testing the quality of Horse Gram. (3) The premises of authorized packer shall be maintained in hygienic and sanitary conditions with proper ventilations and well lighted arrangement and the personnel engaged in these operations shall be in sound health and free from any infectious, contagious or communicable diseases. (4) The premises of the authorised packer shall have adequate storage facilities with pucca floor and free from dampness, any kind of cracks and crevices, rodent and insect infestation. Horse Gram shall be obtained from the plant Dolichos bifloru and Macrotyloma uniflorum. 2. Minimum Requirements: (i) Horse Gram shall.- (a) have pleasant taste, flavour and uniform color; (b) be sound, properly cleaned, washed, dried, wholesome and characteristic to the variety; (c) be free from extraneous matter such as stones, dirt, clay etc. (d) be free from any foreign taste, odour and evidence of fermentation; (e) be free from living insects, dead insects, insect fragments, mites, rodent contamination and mould growth; (f) be free from any added colouring matter. (ii) for domestic trade it shall comply with the restrictions in regard to residual levels of metal contaminants, insecticides and pesticides residues, microbial requirements, crop contaminants, naturally occurring toxic substances and other food safety requirements as specified under the Food Safety and Standards (Contaminants, Toxins and Residues) Regulations, 2011, the Food Safety and Standards (Food Product Standards and Food Additives) Regulations, 2011 and other regulations made for domestic trade under Food Safety & Standards Act-2006. (iii) for export trade it shall comply with the residual limits of heavy metals, pesticides and other food safety requirements as laid down by the Codex Alimentarius Commission, or importing countries requirements for exports. 3. Organic matter shall include husk, chaff, straw, weed seeds and other inedible grains (2) “Other Edible/food Grains” means edible grains (including oil seeds) grains other than the grain under consideration. (3) “Admixture means” the presence of a variety of the same grain other than the variety in consideration. (4) “Serious defects seeds” means in which the cotyledons have been affected or attacked by pest; seeds with very slight traces of mould or decay, or slight cotyledon staining. (5) “Slight defects seeds” means in which seed not reached normal development, seeds with extensive seed coat staining, without the cotyledon being affected, seeds in which the seed coat is wrinkled, with pronounced folding or broken pulses. (6) “Weeviled Grains” means are grain/kernels that are partially or wholly bored by insects injurious to grain but do not include germ-eaten grains and egg-spotted grains. 4. Other requirements.- (i) The condition of the Horse Gram shall be such as to enable it- (a) to withstand transport and handling; (b) to arrive in satisfactory condition at the place of destination.
