(ख) ‘’प्राजधकृत पैकर’’ से ऐसा ्‍ यजि या ्‍ यजियों का जनकाय अजभप्रेत ह ै जजसे इन जनयमों के अधीन जवजहत श्रेणी मानकों और जवजहत प्रकिया के अनुसार जचलगोजा का श्रेणीकरण करने और उसे जचहनांककत करने के जलए प्राजधकार प्रमाण-पत्र अनुदत् त ककया गया हो ; (ग) ‘’प्राजधकार प्रमाण पत्र’’ से साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 के उपबधं ों के अधीन जारी प्रमाण पत्र अजभप्रेत ह,ै जो ककसी व्यजि या व्यजियों के जनकाय को श्रेणी अजभधान जचहन द्वारा जचलगोजा के श्रेणीकरण और जचहनांकन का प्राजधकार दते ा ह ै; (घ) “साधारण श्रेणीकरण और जचहनांकन जनयम” से कृजि उपज (श्रेणीकरण और जचहनांकन) अजधजनयम 1937 (1937 का 1) की धारा 3 के अधीन बनाए गए साधारण श्रणे ीकरण और जचहनांकन जनयम, 1988 अजभप्रेत ह ै; (ङ) “श्रेणी अजभधान जचहन’’ से जनयम 3 में जनर्ददष्ट “एगमाकव प्रतीक” अजभप्रेत ह ै; (च) “जवजधक माप जवज्ञान” (पकै की गई वस्ट्तुएं) जनयम से जवजधक माप जवज्ञान अजधजनयम, 2009 (2010 का 1) के अंतगतव बनाए गए जवजधक माप जवज्ञान (पैक की गई वस्ट्तुएं) जनयम, 2011 अजभप्रते ह ै; और (छ) “अनुसूची” से इन जनयमों के साथ संलग्न अनुसूची अजभप्रेत ह ै। (2) इन जनयमों म ें प्रयुक्त िब्द और पद, जो पररभाजित नहीं ह ैं लेककन जजन्द्ह ें कृजि उपज (श्रेणीकरण और जचहनांकण) अजधजनयम, 1937 (1937 का 1) और साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 म ें पररभाजित ककया गया ह,ै के वही अथ वहोंगे जो उक्त अजधजनयम एवं जनयम म ेंह ैं; 3. श्रेणी अजभधान जचहन.- श्रणे ी अजभधान जचहन में प्राजधकार प्रमाण-पत्र संखयांक, “एगमाकव” िब्द, वस्ट्त ु का नाम और अनुसूची-। में यथारूप से कदए गए सदश्ृ य श्रणे ी अजभधान को सजम्मजलत करने वाले जडजाइन से जमलकर बना “एगमाकव प्रतीक” होगा । 4. श्रेणी अजभधान.- जचलगोजा की गुणवत्ता उपदर्वित करने के जलए श्रेणी अजभधान वह होगा जो अनुसूची-II के श्रेणी अजभधान हते ु जनधावररत ककया गया ह।ै 5. गुणवत्ता :- इन जनयमों के प्रयोजन के जलए जचलगोजा की गुणवत्ता अनुसूची-II में जनकदष्ट के अनुसार होगी । 6. पैककग करन े की जवजध : -(1) जचलगोजा की पैककग नए, स्ट्वच्छ कपडे के थलै ों, पॉलीवोवन थलै ों जजनकी आंतररक लाइननग फूड ग्रेड सामग्री की होगी या बायोजडग्रडे ेब्ल पेकेनजग सामग्री अथवा फूड् ग्रेड के पॉलीपैको या अन्द्य ऐसी ककसी पैककग सामग्री म ें की जाएगी जो सामान्द्य श्रेणीकरण और जचहनांकन जनयम के जनयम 11 के अंतगवत कृजि जवपणन सलाहकार या उसकी ओर स ेप्राजधकृत अजधकारी द्वारा अनुमोकदत की गई हो ;[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3 (2) पैकेनजग सामग्री कीट और फफूंदी के प्रभाव से मुि होगी और इससे उत्पाद में ककसी जविाि पदाथ,व अवांजछत गधं अथवा स्ट्वाद का असर अथवा रंग नहीं आना चाजहए ; (3) जचलगोजा की पैककग जवजधक माप जवज्ञान अजधजनयम, 2009 (2010 का 1) के अंतगवत बनाए गए जवजधक माप जवज्ञान (पैक की गईं वस्ट्तुएं) जनयम, 2011 के प्रावधानों के अनुसार पकै आकारों में होगी या कृजि जवपणन सलाहकार द्वारा समय- समय पर जारी अनुदेिों के अनसु ार की जाएगी ; (4) समान लॉट/ बैच और ग्रडे के छोटे पैक आकारों की श्रेणीकृत सामग्री की पैककग एक मास्ट्टर कंटेनर म ें की जाएगी और उस पर श्रेणी अजभधान जचहन सजहत पूरा ब्यौरा अंककत ककया जाएगा ; (5) प्रत् यके पैकेज म ेंसमान प्रकार का और समान श्रणे ी अजभधान का जचलगोजा होगा ; (6) प्रत् यके पैकेज उजचत और सरु जक्षत रूप स ेबंद और मुहरबंद ककया जाएगा, ताकक उसकी सामग्री बाहर न फैल सके । 7. जचहनांकन की जवजध.- (1) श्रेणी अजभधान जचहन प्रत् येक पकै ेज पर कृजि जवपणन सलाहकार या इस जनजमत उसके द्वारा प्राजधकृत ककसी अजधकारी द्वारा अनुमोकदत रीजत से साधारण श्रणे ीकरण और जचहनांकन जनयम के जनयम 11 के अनुसार सुरजक्षत रूप स ेजचपकाया या मुकरत ककया जाएगा ; (2) श्रेणी अजभधान जचहन के अजतररक्त , प्रत्येक पैकेज पर जनम्न जलजखत जववरण स्ट्पष्ट रूप स े और अजमट रूप स े अंककत ककया जाएगा, अथावत ्:- (क) वस्ट्तु का नाम; (ख) श्रेणी; (ग) ककस्ट्म या रेड नाम (वैकजल्पक) ; (घ) लॉट संखया ; (ङ) पैककग की तारीख; (च) फसल विव (वैकजल्पक); (छ) िुद्ध भार; (ज) पैकर का नाम और पता; (झ) अजधकतम खुदरा मल्ू य; (सभी करों सजहत) (ञ) ....माह....विव के पूवव उपयोग हते ु सवोत्तम; (ट) जवजधक माप जवज्ञान (पैक की गई वस्ट्तुए)ं जनयम अथवा खाद्य सुरक्षा और मानव अजधजनयम, 2006 (2006 का 34) अथवा ककसी समय लागू कोई अन्द्य कानून अथवा इस अजधजनयम के प्रावधान के तहत जारी ककए ककन्द्हीं अनुदेिों के अतं गतव जवजनर्ददष्ट कोई अन्द्य जववरण। (3) पैकेजों पर जचहनांकन के जलए प्रयोग की गई स्ट्याही से जचलगोजा को संदजू ित न करें । (4) प्राजधकृत पैकर कृजि जवपणन सलाहकार अथवा इस जनजमत्त उसके ओर से प्राजधकृत ककसी अजधकारी का पूव व अनुमोदन अजभप्राप् त करन े के पश् चात श्रणे ीकृत पैकेजों पर अपना प्राइवेट ्‍ यापार जचहन या ्‍ यापार रांांड जचहनांककत करेगा, परंतु वह इन जनयमों के अनुसार श्रणे ीकृत पैकेजों पर लगाए गए श्रणे ी अजभधान जचहन द्वारा उपदर्वित गुणवत्ता से जभन्द् न गुणवत्ता उपदर्वित नहीं करेगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 8. प्राजधकार प्रमाण पत्र की जविेि ित:ें - (1) साधारण श्रेणीकरण और जचहनांकन जनयम, 1988 के जनयम 3 के उपजनयम (8) म ें जवजनर्ददष्ट ितों के अजतररि प्रत्येक प्राजधकृत पैकर अजधजनयम के प्रावधानों के अंतगतव जारी ककए गए सभी अनुदेिों का पालन करेगा ; (2) जचलगोजा की गुणवत्ता का परीक्षण करन े के जलए प्राजधकृत पैकर जनधावररत मापदडं ों के अनुसार या तो अपनी स्ट्वयं की प्रयोगिाला स्ट्थाजपत करेगा या ककसी अनुमोकदत राज्य श्रेणीकरण प्रयोगिाला या सहकारी अथवा एसोजसएिन प्रयोगिाला या ऐसी प्राइवेट वाजणज्य प्रयोगिाला के साथ संपकव करेगा जजसका प्रबंधन सामान्द्य श्रेणीकरण जचहनांकन जनयम 1988 के जनयम 9 के अतं गवत कृजि जवपणन सलाहकार या इस जनजमत्त उनके द्वारा प्राजधकृत ककसी अजधकारी द्वारा अनुमोकदत योग्य रसायनज्ञ द्वारा ककया जा रहा हो ; (3) प्राजधकृत पैकर के पररसरों को समुजचत संवातन और प्रकाि सजहत स्ट्वास्ट््यप्रद और स्ट्वच्छता की दिाओं में रखा जाएगा और इन कायों में लगे हुए कार्वमकों का अच्छा स्ट्वास्ट््य होगा और वे ककसी संचारी, संसगी या संिामक रोग स े मुि होंगे। (4) प्राजधकृत पैकर के पररसरों में पक्क े फिव सजहत पयावप् त भंडारण सुजवधाएं होंगी और वह नमी, ककसी तरह की दरारों, कृंतकों और कीटों के उत् पीडन स ेमुक् त होगा। (5) प्राजधकृत पैकर और अनुमोकदत रसायनज्ञ, परीक्षण, श्रेणीकरण, पैककग, जचहनांकन, सीनलग और अजभलेखों के अनरु क्षण से संबंजधत ऐसे सभी अनुदेिों का पालन करेगा जो अजधजनयम के प्रावधानों के अंतगवत जारी ककए गए हों। अनसु चू ी-I (जनयम 3 देख)ें (एगमाकव प्रतीक का जडजाइन) No. A C वस्ट्तु का नाम………………………………………… श्रेणी……………………………………………………………… अनसु चू ी –II (जनयम 4 और 5 देखें) जचलगोजा का श्रणे ी अजभधान और उसकी गुणवत्तााः 1. जचलगोजा मानव खपत के प्रयोजनाथव पाइनस पीजनया एल., पी.वजल्लजचयाना एवं पी जजराजडयाना से प्राि ककया जाएगा। 2. न्द् यनू तम अपेक्षाए ं: (i) जचलगोजा– (क) साबुत, टूटफूट से रजहत, ठोस, पयावि रूप से िुष्क ककया हुआ और अच्छी बनावट वाला होगा;[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 5 (ख) आकार, आकृजत, रंग और दिा की दजृ ष्ट से एक समान होगा; (ग) लंबा, पतला और भरु े रंग का होगा; (घ) पयावि मात्रा म ेंप्राकृजतक सगु ंध सजहत जचलगोजा के जविेि गणु से यिु होगा; (ङ) कृजत्रम रंजक और पोजलनिग पदाथों, कृजत्रम सुगंध और ककसी भी तरह के अन्द्य रसायनों से मुि होगा; (च) ककसी तरह की दगु न्द्व ध और बासीपन से रजहत होगा; (छ) कृंतक के बालों, जवष्ठा, गंदगी, जीजवत कीटों, मतृ कीटों, कीटों के टुकडों, कुटकी या ककसी वस्ट्त ु के अविेिों और फफूंदी से मुि होंगा; (ज) ककसी भी तरह के नािीजीवों, चाह ेवे जवकजसत होने की ककसी भी अवस्ट्था म ेंहो, से मुि होगा; (झ) ककसी भी रालयुि पदाथ वसे मुि होगा। (ii) घरेल ू व्यापार के मामल े में यह धात ु संदिू ण, कीटनािी जीवों और नािकजीवमारों, संदिू ण सूक्ष्म अपेक्षाओं, फसल संदिू कों, प्राकृजतक रूप से पैदा होने वाले जविैले पदाथों के अवजिष्ट स्ट्तर के संबंध में जनबंधनों और खाद्य सुरक्षा और मानक (संदिू क, जीवजवि और अपजिष्ट) जवजनयम 2011 और खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक तथा खाद्य जमश्रण) जवजनयम, 2011 और खाद्य सरु क्षा और मानक अजधजनयम, 2006 के अधीन बनाए घरेल ू व्यापार हते ु अजधसूजचत अन्द्य जवजनयमों के अधीन यथा जवजनर्ददष्ट अन्द्य खाद्य सुरक्षा अपेक्षाओं का अनपु ालन करेगी; (iii) जनयावत के मामले म ें यह भारी धातओंु , कीटनािक जीवों की अपजिष्ट सीमाओं और कोडेक्स एजलमेंटेररयस आयोग द्वारा अजधकजथत अन्द्य खाद्य सुरक्षा मापदंडों जनयावत व्यापार् के जलए या आयातकताव देि की अपेक्षाओं का अनुपालन करेगी। 3. जचलगोजा के श्रणे ी अजभधान के जलए मापदंड; (ख) जजसे अपन ेगंतव्य स्ट्थान पर संतोिजनक ढंग से पहुचं ाया जा सके । (ii) जचलगोजे का भडं ारण सामान्द्य तापमान पर िुष्क और स्ट्वास्ट््यपरक दिा में ककया जाएगा। (iii) य े मानक ऐसे जचलगोजा पर लाग ू नहीं होते ह ैं जजन्द्ह ें लवणीकरण, जमजश्रकरण द्वारा अथवा जविेि स्ट्वाद के जलए ककसी वस्ट्तु को जमलाकर संिोजधत ककया जाता ह।ै [फा. स.ं क्य-ू 11047/10/जचलगोजा/2019-मानक] प्रसान्द्त कुमार स्ट्वाईं, संयुि सजचव (जवपणन) MINISTRY OF AGRICULTURE AND FARMERS WELFARE (Department of Agriculture, Co-operation & Farmers Welfare) NOTIFICATION New Delhi, the 1st February, 2021 G.S.R. 90(E).—The following draft of the Pine nut Grading and Marking Rules, 2021 which the Central Government proposes to make in exercise of the powers conferred by section 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937) is hereby published as required by the said section for information of all persons likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of forty-five days from the date on which the copies of the Gazette of India containing this notification are made available to the public. 2. Objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the above said period shall be taken into consideration by the Central Government. 3. Objections or suggestions, if any, in respect of the said draft rules, may forward to the Agricultural Marketing Adviser to the Government of India, Directorate of Marketing and Inspection, Head Office, CGO Complex, NH - IV, Faridabad (Haryana) 121001. DRAFT RULES 1. Short title, application and commencement. - (1) These rules shall be called the Pine nut Grading and Marking Rules, 2021. (2) They shall apply to Pine nut obtained from Pinus pinea L. , P. wallichiana and P. gerardiana intended for human consumption. (3) They shall come into force from the date of their final publication in the Official Gazette. 2. Definitions. - (1) In these rules, unless the context otherwise requires,- (a) "Agricultural Marketing Adviser" means the Agricultural Marketing Adviser to the Government of India;[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 7 (b) "Authorized packer" means a person or a body of persons who has been granted a certificate of authorization to grade and mark the Pine nut in accordance with the grade standards and procedure prescribed under these rules; (c) "Certificate of Authorization" means a certificate issued under the provisions of the General Grading and Marking Rules, 1988 authorizing a person or a body of persons to grade and mark Pine nut with the grade designation mark; (d) "General Grading and Marking Rules" means the General Grading and Marking Rules, 1988 made under section 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937); (e) "Grade designation mark" means ―Agmark insignia‖ referred to in rule 3 ; (f) ―Legal Metrology (Packaged Commodities) Rules‖ means the Legal Metrology (Packaged Commodities) Rules,2011, made under the Legal Metrology Act, 2009 (1 of 2010); and (g) "Schedule" means a schedule appended to these rules. (2) Words and expressions used in these rules and not defined but defined in the Agricultural Produce (Grading and Marking) Act,1937 and General Grading and Marking Rules,1988 shall have the same meaning as are assigned to them under the Act. 3. Grade designation mark. - The grade designation mark shall consist of ―AGMARK Insignia‖ as set out in schedule-I incorporating the certificate of authorization number, the word "AGMARK", name of the commodity and grade. 4. Grade designations. - The grade designations to indicate the quality of Pine nut including the criteria for grade designation shall be set out in schedule-II. 5. Quality. - For the purpose of these rules, the quality of Pine nut shall be as given in Schedule- II. 6. Method of packing. - (1) Pine nut shall be packed in paper bags or cloth bags or poly woven bags with inner lining of food grade material or any bio-degradable packaging materials or poly packs of food grade material or any other packaging material as approved by the Agricultural Marketing Adviser or the officer authorized by him under rule 11 of the General Grading and Marking Rules. (2) The packaging material shall be free from insect and fungal infestation and should not impart any toxic substance or undesirable odour or flavour to the product. (3) Pine nut shall be packed in pack sizes either in accordance with the provisions of the Legal Metrology (Packaged Commodities) Rules or as allowed by the Agricultural Marketing Adviser under rule 11 of the General Grading and Marking Rules. (4) Graded material of small pack sizes of the same lot or batch and grade may be packed in a master container with complete details thereon along with grade designation mark. (5) Each package shall contain Pine nut of the same type and of the same grade designation. (6) Each package shall be properly and securely closed and sealed so as to disallow spilling. 7. Method of Marking. - (1) The grade designation mark shall be securely affixed to or printed on each package in the manner approved by the Agricultural Marketing Adviser or the officer authorized by him under Rule 11 of the General Grading and Marking Rules. (2) In addition to the grade designation mark, following particulars shall be clearly and indelibly marked on each package, namely:- (a) name of the commodity; (b) grade; (c) variety or trade name (optional); (d) lot number; (e) date of packing; (f) crop year (optional);8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (g) net weight; (h) name and address of the authorized packer; (i) maximum retail price (inclusive of all taxes); (j) BEST BEFORE___________MONTH______YEAR; (k) any other particulars as may be specified under Legal Metrology (Packaged Commodities) Rules or under Food Safety and Standards (Packaging and Labelling) Regulations, 2011 or any other law for the time being in force or any instructions issued under provisions of the Act. (3) The ink used for marking on packages shall not contaminate the Pine nut (4) The authorized packer may after obtaining prior approval of the Agricultural Marketing Adviser or an officer authorized by him under Rules 11 of General Grading & Marking Rules mark his private trade mark or trade brand on the graded packages provided the same do not indicate quality other than that indicated by the grade designation mark affixed to the graded packages in accordance with these rules. 8. Special conditions of Certificate of Authorization. - (1) In addition to the conditions specified in sub-rule (8) of rule 3 of the General Grading and Marking Rules, every authorized packer shall follow all instructions issued under the provisions of the Act. (2) The authorized packer shall either set up his own laboratory as per prescribed norms or have access to an approved State Grading Laboratory or cooperative or association laboratory or a private commercial laboratory manned by a qualified chemist approved by the Agricultural Marketing Adviser or the officer authorized by him under rule 9 of the General Grading and Marking Rules, for testing the quality of Pine nut. (3) The premises of authorized packer shall be maintained in hygienic and sanitary conditions with proper ventilations and well lighted arrangement and the personnel engaged in these operations shall be in sound health and free from any infectious, contagious or communicable diseases. (4) The premises of the authorized packer shall have adequate storage facilities with pucca floor and free from dampness, any kind of cracks and crevices, rodent and insect infestation. (5) The authorized packer and the approved chemist shall observe all instructions regarding testing, grading, packing, marking, sealing and maintenance of records which may be issued under the provisions of the Act. Pine nut shall be obtained from mature fruits of Pinus pinea L., P. wallichiana and P. gerardiana. 2. Minimum requirement:[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 9 (i) Pine nut shall. – (a) be whole, intact, sound, well dried, well formed; (b) have uniform size, shape, color and condition; (c) be long, slender, brown in color;possess marked degrees of natural fragrance, characteristic of Pine nut; (d) be free from artificial coloring, polishing agents , artificial fragrances and any other chemicals ; (e) be free from obnoxious smell and mustiness; (f) be free from rodent hair and excreta, filth, moulds, live insects, dead insects, insect fragments, mites, debris or excreta and fungus; (g) be free from any pest, whatever their stage of development; (h) be free from resinous materials. (ii) for domestic trade, it shall comply with the restrictions in regard to residual levels of metal contaminants, insecticides and pesticides residues, microbial requirements, crop contaminants, naturally occurring toxic substances and other food safety requirements as specified under the Food Safety and Standards (Contaminants, Toxins and Residues) Regulations, 2011, the Food Safety and Standards (Food Product Standards and Food Additives) Regulations, 2011 and other regulations made for domestic trade under Food Safety and Standards Act, 2006 (34 of 2006). (iii) for export trade, it shall comply with the residual limits of heavy metals, pesticides and other food safety requirements as laid down by the Codex Alimentarius Commission or importing countries requirements for exports. 3. (ii) Pine nut shall be stored in dry & hygienic place at normal room temperature. (iii) These standard does not apply to pine nut that are processed by salting, sugaring and flavoring. [F.
