(2)‍‍उन‍सभी‍अन्य‍कब्द ‍और‍पद ‍के‍,‍जो‍इसमें‍प्रयुक्‍त‍है‍‍और‍पररभाधषत‍नह ‍है,‍दकन्तु‍अधधधनयम‍या‍उसके‍अधीन‍बने‍धनयम ‍ या‍धवधनयम ‍में‍पररभाधषत‍ह,ै‍वाही‍अथफ‍होगे‍जो‍उस‍अधधधनयम,‍धनयम ‍अथवा‍धवधनयम ,‍रम मकः,‍में‍ह।ैंIII 3 अध्य‍ाय‍2 जैव‍खाद्य‍ ेबल ग‍और‍प्रमाणन 3. कोई‍व्‍यधतिय‍दकसी‍ऐसे‍जैव‍खाद्य‍का‍धनमाफण,‍पैककग,‍धवरम य,‍धवरम य‍के‍ध स‍प्रस्‍ताव,‍धवपणन‍या‍अन्‍यथा‍धवतरण‍या‍‍2यात‍ नह ‍करेगा,‍जो‍इन‍धवधनयम ‍में‍धनधाफररत‍अपेक्षाओं क‍का‍अनुपा न‍नह ‍करता।‍ 4. ‘’जैव‍खाद्य’’‍के‍रूप‍में‍धबरम ी‍के‍ध स‍प्रस्‍ताधवत‍या‍‍समर्तथत‍खाद्य‍धनम्‍नध धखत‍में‍से‍दकसी‍सक‍प्रणा ी‍के‍सभी‍ ागू‍उपब्ध ‍ का‍अनुपा न‍करेगे,‍अथाफत्:-‍ (i) रा‍‍रीय‍जैव‍उत्‍पादन‍कायफरम म‍(सन.पी. .पी); (ii) भारत‍के‍ध स‍प्रत्याभूधत‍प्रणा ी’‍(पी.जी.सस-इ्धडया); (iii) खाद्य‍प्राधधकरण‍द्वारा‍समय-समय‍पर‍यथा‍अधधसूधचत‍अन्‍य‍कोई‍प्रणा ी‍या‍‍मानक। 5. मू ‍उत्‍पादक‍या‍उत्‍पादक‍स्गठन‍द्वारा‍अ्त्‍य‍उपभोक्‍ता‍को‍सीधे‍धबरम ी‍के‍ध स‍धवपणन‍हते ु‍जैव‍खाद्य‍को‍अनुपा न‍के‍प्रमाणन‍ की‍2व‍‍यकता‍से‍छूट‍ह‍ैऔर‍यह‍छूट‍प्रस्स्‍कृत‍जैव‍खाद्य‍उत्‍पाद ‍पर‍ ागू‍नह ‍ह।ै ‍ 6. ेबल ग‍पर‍उत्‍पाद‍की‍जैवीय‍धस्थधत‍के‍बारे‍में‍पूरी‍और‍सही-सही‍जानकारी‍होगी‍।‍ऐसे‍उत्‍पाद‍पर‍भारतीय‍खाद्य‍सुरक्षा‍और‍ मानक‍प्राधधकरण‍के‍‘प्रतीक’‍के‍अधतररक्‍त‍धवधनयम‍4‍में‍उधल् धखत‍प्रणाध य ‍में‍से‍दकसी‍सक‍प्रणा ी‍का‍गुणविा‍2‍‍वासन‍प्रमाणन‍या‍‍ उसकी‍मुहर‍होगी।‍ 7. सभी‍जैव‍खाद्य‍धवधनयम‍4‍में‍उधल् धखत‍प्रणाध य ‍में‍से‍ ागू‍दकसी‍सक‍प्रणा ी‍की‍ ेबल ग‍अपेक्षाओं क‍के‍अधतररक्‍त‍खाद्य‍ सुरक्षा‍और‍मानक‍(पैकेजब्दी‍और‍ ेबल ग)‍धवधनयम,‍2011‍में‍धवधनर्दद‍‍ट‍पैकेजब्दी‍और‍ ेबल ग‍अपेक्षाओं क‍का‍अनुपा न‍करेंगे।‍ 8. उत्‍पाद‍की‍खोज‍धवधनयम‍4‍में‍उधल् धखत‍प्रणाध य ‍के‍अधीन‍‍ ागू‍उत्‍पादक‍स्‍तर‍तक‍होगी‍और‍खाद्य‍उत्‍पाद‍की‍जैधवक‍ पूणफता‍को‍बनास‍रखने‍के‍ध स‍उत्‍पाद‍में‍खाद्य‍प्राधधकरण‍द्वारा‍धवधहत‍‍कोई‍अन्‍य‍अपेक्षा‍सधम्मध त‍होगी।‍ 9. सभी‍जैव‍खाद्य‍इन‍धवधनयम ‍के‍उपब्ध ‍पर‍प्रधतकू ‍प्रभाव‍डा े‍धबना‍खाद्य‍सुरक्षा‍और‍मानक‍(खाद्य‍उत्पायद‍मानक‍सव्‍ खाद्य‍सहयोज्य)‍धवधनयम, 2011,‍खाद्य‍सुरक्षा‍और‍मानक‍(स्दषू क, अधवष‍तथा‍अवधकष्ट)‍धवनयम, 2011,‍अधधधनयम‍और‍उसके‍अधीन‍‍ बने‍धनयम ‍और‍धवधनयम ‍यथा‍‍ ागू‍‍उपब्ध ‍का‍अनुपा न‍करेंगे।‍ 10. जैव‍खाद्य‍के‍सभी‍धवरम ेता‍या‍तो‍अके े,‍या‍‍अपने‍खुदरा‍कारोबार‍के‍अ्ग‍‍रूप‍में,‍‍ऐसे‍खाद्य‍को‍पार्पररक‍खाद्य‍के‍प्रदकफन‍से‍ स्‍प‍‍टत:‍अ ग‍रीती‍‍से‍प्रदर्तकत‍करेंगे।‍ 11. इन‍धवधनयम ‍के‍उपब्ध ‍का‍अपा न‍अधधधनयम‍के‍अधीन‍‍दड् ात्म‍ क‍उपब्ध‍2कर्तषत‍करेंगे‍और‍झूठे,‍भ्रामक‍या‍कपटपूणफ‍दावे‍ के‍ध स‍दायी‍ह गे।‍‍ अध्य‍ाय‍3 2यात‍और‍धवधनमय‍ 12. रा‍‍रीय‍जैव‍उत्‍पादन‍कायफरम म‍और‍स्ब्धधत‍धनयाफतक‍दके ‍के‍जैव‍मानक ‍की‍समतुल्‍यता‍के‍2धार‍पर‍ुस‍धद्वपक्षीय‍या‍ बुपक्षीय‍समझौत ‍के‍अधीन‍‍जैव‍खाद्य ‍के‍भारत‍में‍2यात‍के‍ध स‍पुन:‍प्रमाणन‍अधधधनयम‍तथा‍उसके‍अ्तगफत‍बने‍धनयम ‍और‍ धवधनयम ‍के‍उपब्ध ‍का‍अनुपा न‍के‍अध्यधीन‍अपेधक्षत‍नह ‍होगा।‍ 13. धवधनयम‍12‍के‍अनुसार,‍सभी‍‍जैधवक‍‍खाद्य‍परेषनो‍के‍‍साथ‍समतुल्य‍करार‍के‍धनब्धनो‍के‍अ्तगफत‍2ने‍वा े‍प्रत्याधयत‍ प्रमाणन‍धनकाय‍द्वारा‍स्व्यवहार‍प्रमाणपराल‍स् ग्न‍होगा।‍4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] अध्य‍ाय‍4 साधारण‍ 14. खाद्य‍प्राधधकरण‍इन‍धवधनयम ‍के‍कायाफन्वयन‍‍और‍दके ‍में‍प्रामाधणक‍जैव‍खाद्य‍के‍स्वधफन‍के‍ध स‍कोई‍उपयुक्‍त‍स्स्‍थागत‍ प्रणा ी‍स्थ‍ ाधपत‍कर‍सकेगा।‍ पवन‍अोवा ,‍मुख्य‍ ‍कायफकारी‍अधधकारी [foKkiu-III@4@vlk-@111@17] MINISTRY OF HEALTH AND FAMILY WELFARE (Food Safety and Standards Authority of India) Notification New Delhi, the 19th June, 2017. Definitions- (1) In these regulations, unless the context otherwise requires,- (a) ―Act‖ means the Food Safety and Standards Act, 2006 (34 of 2006); (b) ―Accreditation Body‖ means any agency recognised as such by the Food Authority or recognised under the National Programme for Organic Production for accreditation of certification bodies;III 5 (c) ―Accredited Certification Body‖ means an organisation duly accredited by an Accreditation body for certification of organic products and for granting the right to use the certification mark to the food business operators on behalf of the Accreditation Body; (d) ―Claim‖ means any representation which states, suggests or implies that a food has particular qualities relating to its origin, nutritional properties, nature, processing and composition; (e) ―Food Authority‖ means the Food Safety and Standards Authority of India established under section 4 of the Food Safety and Standards Act, 2006; (f) ―National Programme for Organic Production‖ means a programme of the Government of India which provides an institutional mechanism for implementation of the National Standards for Organic Production with a third-party certification control system as notified by the Director General of Foreign Trade under the Foreign Trade (Development and Regulation) Act, 1992; (g) ‖Standards for Organic Production‖ means any standards recognised by the Food Authority or the National Standards for Organic Production or Participatory Guarantee System for India to be followed in cultivation or harvest or production or storage or processing or trading of organic food products and Inputs; (h) ―Organic agriculture‖ means a system of farm design and management to create an eco system of agriculture production without the use of synthetic external inputs such as chemicals, fertilizers, pesticides and synthetic hormones or Genetically Modified Organisms; (i) ―Organic farm produce‖ means the produce obtained from organic agriculture; (j) ―Organic food‖ means food products that have been produced in accordance with specified standards for organic production; (k) ―Participatory Guarantee System for India‖ means a quality assurance initiative for organic production operated by the Ministry of Agriculture and Farmer‘s Welfare outside the framework of third party certification which emphasizes the the participation of producers, consumers and other stakeholder. (2) All the other words and expressions used herein and not defined but defined in the Act, or rules or regulations made thereunder shall have the meanings assigned to the same in the Act, rules or regulations respectively. CHAPTER II Organic Food Labelling and Certification 3. No person shall manufacture, pack, sell, offer for sale, market or otherwise distribute or import any organic foods unless they comply with the requirements laid down under these regulations. 4. Any food offered or promoted for sale as ‗organic food‘ shall comply with all the applicable provisions of one of the following, namely:- (I) National Programme for Organic Production (NPOP); (II) Participatory Guarantee System for India (PGS-India); (III) Any other system or standards as may be notified by the Food Authority from time to time.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] 5. The Organic food that is marketed through direct sales by the original producer or producer organisation to the end consumer is exempt from the need of verification of compliance and this exemption does not apply to processed organic food products. 6. Labelling shall convey full and accurate information on the organic status of the product. Such product shall carry a certification or quality assurance mark of one of the systems mentioned in regulation 4 in addition to the Food Safety and Standard Authority of India logo. 7. All organic foods shall comply with the packaging and labelling requirements specified under the Food Safety and Standards (Packaging and Labelling) Regulations, 2011 in addition to the labelling requirements under one of the applicable system mentioned in regulation 4. 8. Traceability shall be established upto the producer level as applicable under the systems mentioned in regulation 4 and it shall include any other requirements prescribed by the Food Authority to maintain the organic integrity of the food product. 9. Without prejudice to the provisions of these regulations, all organic food shall comply with the relevant provisions, as applicable, under the Food Safety and Standards (Food Product Standards and Food Additives) Regulations, 2011, the Food Safety and Standards (Contaminants, Toxins and Residues) Regulations, 2011, under the Act and the rules and regulations made thereunder. 10. Any seller of organic food either exclusively or as part of their retail merchandise shall display such food in a manner distinguishable from the display of conventional food. 11. Non- compliance of the provisions of these regulations shall attract penal provisions under the Act, and be liable for action as a false, misleading or deceptive claim. CHAPTER III Imports and Reciprocity 12. Organic food imports under bilateral or multilateral agreements on the basis of equivalence of standards between National Programme for Organic Production and the organic standards of the respective exporting countries shall not be required to be re-certified on import to India subject to their compliance with the provision of the Act and the rules and regulation made thereunder. 13. All organic food consignments as per regulation 12 shall be accompanied by a transaction certificate issued by an Accredited Certification Body covered under the terms of the equivalence agreement. CHAPTER IV General 13. The Food Authority may establish appropriate institutional mechanism to implement these regulations and promote authentic organic food in the country.
