The following draft rule further to amend the Insecticides Rules, 1971, which the Central Government proposes to make in exercise of the powers conferred by section
## Policy Analysis Report: Insecticides Fourth Amendment Rules, 2021
**1. Executive Summary:**
This report analyzes the Insecticides Fourth Amendment Rules, 2021, as published in the Gazette of India. The core purpose of this amendment is to extend a deadline within the Insecticides Rules, 1971. Specifically, it substitutes "31st December, 2021" with "31st December, 2022" in rule 10, subrule 1A, first proviso. This report details this change, its potential rationale, target audience, and expected impact based solely on the provided text. The key finding is that this amendment provides a one-year extension to a previously established deadline related to the Insecticides Rules, 1971.
**2. Introduction:**
This report aims to provide an informative overview of the Insecticides Fourth Amendment Rules, 2021, based solely on the text published in the Gazette of India. The report analyzes the purpose, key provisions, and potential impact of the amendment, focusing on the specific changes introduced and their implications for affected parties.
**3. Policy Overview:**
This document is an *amendment* to the Insecticides Rules, 1971.
The core objective of the original Insecticides Rules, 1971, while not explicitly stated in the provided text, can be inferred as regulating the use of insecticides. The amendment itself does not alter this objective.
**4. Background and Rationale:**
The rationale for this specific amendment appears to be to extend the validity or applicability of a specific provision within the Insecticides Rules, 1971. The extension from December 31, 2021, to December 31, 2022, suggests that the previously set deadline might have required adjustment, potentially due to unforeseen circumstances or the need for additional time to comply with the existing rule. The provided text does not explicitly detail the reason, but the nature of the change points towards a timing-related issue concerning the original provision.
**5. Key Provisions / Changes:**
This document solely introduces an *amendment*.
* **Specific Part of Original Policy Changed:** The amendment directly alters rule 10, subrule 1A, in the first proviso of the Insecticides Rules, 1971.
* **New Rule/Provision:** The change substitutes the date "31st December, 2021" with "31st December, 2022."
* **Effect of the Change:** This effectively grants an additional year for compliance, application, or some other action related to the provision in rule 10, subrule 1A, first proviso. The nature of the action related to this date is *not* detailed in the amendment text, limiting further analysis.
**6. Target Audience and Stakeholders:**
The target audience and stakeholders likely include manufacturers, distributors, users of insecticides, and regulatory bodies responsible for enforcing the Insecticides Rules, 1971. Specifically, those entities affected by rule 10, subrule 1A, first proviso are directly impacted by this amendment, as the extension provides additional time for compliance or action related to that specific provision.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Department of Agriculture and Farmers Welfare, specifically the Joint Secretary Plant Protection, is indicated as the point of contact for objections and suggestions regarding the draft rule, suggesting their involvement in the implementation process.
* **Timelines or Procedures:** The amendment indicates that it will come into force on the date of its final publication in the Official Gazette. There is also a notice period of fifteen days for public feedback, after which the Central Government will consider the draft rule. The enforcement of the rule ultimately resides with the regulatory bodies, likely the same ones that enforced the original provision.
* **Amendment-Specific Implementation:** No specific implementation mechanisms are outlined for *just* the amendment, the original rule is likely enforced in a similar way.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcome of this amendment is to provide those affected by rule 10, subrule 1A, first proviso of the Insecticides Rules, 1971, with additional time. This extension could prevent potential disruptions or non-compliance that might have occurred if the original deadline was maintained. It may also allow for better planning, resource allocation, or adaptation to regulatory requirements. This directly affects the industries that require the usage of insecticides, as they now have increased flexibility with the rules.
**9. Conclusion:**
The Insecticides Fourth Amendment Rules, 2021, constitutes a minor, yet significant, adjustment to the Insecticides Rules, 1971. By extending the deadline in rule 10, subrule 1A, first proviso, the amendment allows additional time for relevant parties to comply with the underlying requirements of that rule. While the specific context of the extended deadline remains unclear from the provided text alone, the change highlights the government's responsiveness to potential challenges faced by stakeholders in adhering to existing regulations.
