अन्यथा के परीक्षण के जलए 8 िलु ाई, 2013 को एक जविेिज्ञ सजमजत गरित की थी और सजमजत के अजधििे को जियासि कीिनािकों, िो अन्य ििे ों म ें प्रजतबंजधत या प्रजतजिद्ध या प्रत्याहृत ककए गए थे लेककन भारत में घरेलू उपयोग के जलए रजिस्ट्रीकृत ककए िा रह े थे, की समीक्षा के जलए 19 अगस्ट्त, 2013 को और जवस्ट्ताररत ककया था । और सजमजत ने जवस्ट्तृत परीक्षण के पश्चात ् केंद्रीय सरकार को 19 किसंबर, 2015 को अपनी ररपोिट प्रस्ट्तुत की थी, िो पंिीकरण सजमजत को जनर्िष्टट की गई थी और पंिीकरण सजमजत ने केंद्रीय सरकार को अपनी जसफाररिें प्रस्ट्ततु की थी ; और जवभाग ने पंिीकरण सजमजत की जसफाररिों के कियान्वयन के जलए अनुमोिन की सूचना िेते हुए, तारीख 14 अक्तूबर, 2016 को आिेि िारी ककया था ; और उक्त जविेिज्ञ सजमजत न े इस अजधसूचना की अनुसूची में यथा जवजनर्िटष्ट सताइस कीिनािकों के उपयोग को िारी रखन े की जसफाररि की थी और जसफाररि ककए गए अध्ययनों के पूरा होन े के पश्चात ् उसी की समीक्षा की थी, इस पर पंिीकरण सजमजत द्वारा जवचार ककया गया था और केंद्रीय सरकार को जसफाररिें प्रस्ट्तुत की गई थी ; और केंद्रीय सरकार को पंिीकरण सजमजत के साथ जवचार-जवमिट करन े और जसफाररि ककए गए अध्ययन, डािा और सरु क्षा संबंधी अनरु ोध की प्राजस्ट्थजत से संबंजधत उनकी ररपोिट पर सम्यक् जवचार-जवमिट करने के पश्चात् यह समाधान 6238 GI/2023 संबंध में तत्काल कारटवाई करन े हते ु समीचीन या आव‍यक कायटवाही की िाए ; केंद्रीय सरकार ने, कीिनािी अजधजनयम, 1968 (1968 का 46) की धारा 27 की उपधारा (2) द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए, एक प्रारूप आिेि, जिसे भारत के रािपत्र, असाधारण, भाग 2, खंड 3, उपखंड (ii) म ें अजधसूचना संखयांक का.आ. 1512(अ), तारीख 18 मई, 2020 द्वारा कीिनािकों को प्रजतबंजधत करने के जलए प्रकाजित ककया गया था और जिसमें उन सभी व्यजक्तयों से, जिनका इससे प्रभाजवत होना संभाव्य ह,ै उस तारीख से, जिसको उक्त अजधसूचना में अंतर्वटष्ट रािपत्र की प्रजतयां िनता को उपलब्ध करा िी गई थी, पैंतालीस किनों की अवजध के अवसान से पूव ट आक्षेप और सुझाव आमंजत्रत ककए गए थ े ; और, उक्त रािपत्र अजधसूचना की प्रजतयां 18 मई, 2020 को िनसाधारण को उपलब्ध करा िी गई थी ; और, उक्त प्रारूप आिेि के संबंध में प्राप्त ककए गए आक्षपे और सुझाव इस प्रयोिन के जलए गरित की गई जविेिज्ञ सजमजत को जनर्िटष्ट ककए गए थ,े जिस पर उक्त जविेिज्ञ सजमजत द्वारा सम्यक् जवचार-जवमिट ककया गया था ; और, केंद्रीय सरकार को, कीिनािी अजधजनयम, 1968 (1968 का 46) के अधीन गरित जविेिज्ञ सजमजत की ररपोिट पर जवचार-जवमि ट करन े के पश्चात ् और पंिीकरण सजमजत के साथ परामिट के पश्चात् यह समाधान हो गया ह ै कक तीन कीिनािकों के उपयोग से सुरक्षा और प्रभावोत्पािकता पर डािा के उपलब्ध न होन े के कारण मानवों और पिओंु के स्ट्वास्ट््य का पररसंकि और िोजखम िाजमल ह ै; और अजधसूचना सं. का.आ. 1512(अ), तारीख 28 मई, 2020 द्वारा प्रकाजित कीिनािी आिेि, 2020 को प्रजतबंजधत करने के जलए उक्त प्रारूप आििे को जवजभन्न उच्च न्यायालयों में चुनौती िी गई थी और माननीय रािस्ट्थान उच्च न्यायालय न े इस मामल े म ें अगल े आिेि तक कीिनािी को प्रजतबंजधत करन े स े संबंजधत तारीख 21 िुलाई, 2020 के अंतररम आििे द्वारा उक्त जनयम के कियान्वयन पर रोक लगा िी थी । और इसके पश्चात् माननीय रािस्ट्थान उच्च न्यायालय न े 18 िनवरी, 2023 के आििे के माध्यम से जनिेि िारी ककए, एस.बी. के मामल े में नारायण ससंह रािौर द्वारा फाइल की गई जसजवल ररि याजचका सं. 7474/2020 म ें 21 िलु ाई, 2020 के अतं ररम आििे को जनष्प्प्रभावी कर किया गया । और प्रारूप आििे जिसे केंद्रीय सरकार, कीिनािी अजधजनयम, 1968 की धारा 28 और धारा 36 की उपधारा (1) के साथ परित धारा 27 की उपधारा (2) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, बनाने का प्रस्ट्ताव करती ह,ै भारत सरकार के कृजि और ककसान कल्याण मंत्रालय (कृजि सहकारी और ककसान कल्याण जवभाग) की अजधसूचना सं. का.आ. 701(अ), तारीख 15 फरवरी, 2023 द्वारा प्रकाजित की गई थी जिसमें उन सभी व्यजक्तयों से जिनका इससे प्रभाजवत होना संभाव्य ह,ै उस तारीख स,े जिसको उक्त अजधसूचना अतं र्वटष्ट भारत के रािपत्र की प्रजतया ं िनता को उपलब्ध करा िी गई थीं, 30 किनों के अवसान स ेपूव टआक्षपे और सुझाव आमंजत्रत ककए गए थ े। और उक्त रािपत्र अजधसूचना की प्रजतयां 15 फरवरी, 2023 को िनसाधारण को उपलब्ध करा िी गई थी; और उक्त अजधसूचना के संबंध में प्राप्त ककए गए आक्षेप और सुझावों पर केंद्रीय सरकार ने सम्यक् रूप से जवचार कर जलया था । अतः, अब केंद्रीय सरकार, कीिनािी अजधजनयम, 1968 (1968 का 46) की धारा 28 के साथ परित धारा 27 द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, जविेिज्ञ सजमजत की जसफाररिों पर जवचार-जवमिट करने के पश्चात ् और पंिीकरण सजमजत की सलाह से जनम्नजलजखत आिेि करती ह,ै अथाटत:् - 1. सजं क्षप्त नाम और प्रारंभ- (1) इस आिेि का संजक्षप्त नाम कीिनािी (प्रजतजिद्ध) आिेि, 2023 ह;ै (2) यह रािपत्र में इसके प्रकािन की तारीख को प्रवृत्त होगा । 2. कजतपय कीिनािकों का प्रजतिेध- (1) अजधजनयम की धारा 9 के अधीन िारी ककए गए पंिीकरण के सभी प्रमाणपत्र रद्द हो िाएगं े और उन कीिनािकों का जविय, जवतरण या उपयोग िो इस आिेि की अनुसूची म ें जवजनर्िटष्ट ह,ैं उसके स्ट्तंभ (3) के अधीन उपबंजधत तारीख स ेप्रजतजिद्ध हो िाएगा । (2) पंिीकरण सजमजत, उक्त अनुसूची में जवजनर्िटष्ट कीिनाजियों के पंिीकरण के जलए अनुित्त प्रमाणपत्र को रद्द करेगी ।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 (3) यकि कोई ऐसा व्यजक्त, िो पंिीकरण प्रमाणपत्र धारक ह,ै वह खंड (2) के अधीन जनर्िष्टट पंिीकरण सजमजत को उक्त प्रमाणपत्र तीन मास की अवजध के भीतर वापस लौिान े म ें असफल रहता है, तो उक्त अजधजनयम म ें अंतर्वटष्ट उपबंधों के अधीन समुजचत कायटवाही की िाएगी । (4) अजधजनयम की धारा 9 के अधीन कीिनाजियों के जलए अनुित्त पंिीकरण प्रमाणपत्र, अनुसूची म ें यथाउपबंजधत, उक्त अनुसूची के स्ट्तंभ 3 के अधीन जवजनर्िटष्ट तारीख से जनरस्ट्त हुआ समझा िाएगा । (5) प्रत्येक राज्य सरकार, उक्त अजधजनयम और तद्धीन बनाए गए जनयमों के उपबंधों के अधीन ऐस े सभी उपाय करेगी, िो वह राज्य में इस आिेि के कायाटन्वयन के जलए आव‍यक समझे । अनसु चू ी [परै ा 2 िेजखए] प्रजतजिद्ध कीिनाजियों की सचू ी ि.स.ं कीिनािी का नाम केंद्रीय सरकार का जवजनश्चय 1. जडकोफोल पंिीकरण के सभी अनुित्त प्रमाणपत्र रद्द ककए िाते ह ैं और इस आिेि के प्रकािन की तारीख से जविय, जवतरण और उपयोग प्रजतजिद्ध ककया िाता ह ै। 2. जडनोकैप पंिीकरण के सभी अनुित्त प्रमाणपत्र रद्द ककए िाते ह ैं और इस आिेि के प्रकािन की तारीख से जविय, जवतरण और उपयोग प्रजतजिद्ध ककया िाता ह ै। 3. जमथोमाइल पंिीकरण के सभी अनुित्त प्रमाणपत्र रद्द ककए िाते ह ैं और इस आिेि के प्रकािन की तारीख से जविय, जवतरण और उपयोग प्रजतजिद्ध ककया िाता ह ै। 4. मोनोिोिोफोस 1) मोनोिोिोफोस-36% एसएल फॉमूटलिे न का उपयोग बिं ककया िाना ह ै और इस आिेि की प्रकािन की तारीख के पश्चात ् इसके जवजनमाटण के पंिीकरण हते ु कोई नया पंिीकरण प्रमाणपत्र िारी नहीं ककया िाएगा । 2) इस फॉमूटलिे न का जवकल्प उपलब्ध कराने के उद्द‍े य से, जिससे ककसानों को जवजिष्ट फसलों में कजतपय कीिनाजियों के प्रभावी जनयंत्रण के जलए इसकी अनुपलब्धता के कारण नुकसान न उिाना पड,े इस आििे के प्रकािन की तारीख से एक वि ट की अवजध के जलए मोनोिोिोफोस के अन्य फॉमूटलेिन के जलए लेबल के िावे बढाए िा सकेंगे। 3) इस अवजध के पश्चात् मोनोिोिोफोस-36% एसएल के पिं ीकरण के सभी प्रमाणपत्र रद्द हो िाएंग े । मोनोिोिोफोस-36% एसएल का जविय, जवतरण और उपयोग उसकी समाजप्त की अवजध तक केवल जवद्यमान स्ट्िॉक की जनकासी के जलए अनुज्ञात ककया िाएगा । 3. इसके अजतररक्त, केंद्रीय सरकार न े जविेिज्ञ सजमजत की जसफाररिों पर और पंिीकरण सजमजत के परामि ट से, अजधजनयम की धारा 27 की उपधारा (2) द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए, नीच े िी गई ताजलका के कॉलम (2) म ें उजल्लजखत जनम्नजलजखत कीिनािकों के लेबल और पत्रक से नीच े िी गई ताजलका के कॉलम (3) में उजल्लजखत फसलों को हिाने का जनणटय जलया ह,ै नामत: (1) प्रत्येक कीिनािी के सामने उजल्लजखत फसलों के जलए जनम्नजलजखत कीिनाजियों के लेबल िावे इस आिेि के प्रकािन की तारीख से िैव-प्रभावकाररता और अविेि डेिा की अनपु लब्धता के कारण अनुमोकित उपयोग स े लोप ककया िाएगा । सारणी ि.स.ं कीिनािी का नाम अनमु ोकित उपयोग स ेलोप की गई फसलों के नाम (1) (2) (3) 1. काबोफुरान काबोफुरान के सभी अन्य फॉमूटलेिन, 3% एनकैप्सुलेिेड ग्रेन्यूल (सीिी) काबोफुरान के जसवाय, फसल लेबल सजहत इसके उपयोग िूि, इलायची और ज्वार 4. मैंकोिेब अमरूि, ज्वार, िेजपओका 5. आक्सीफ्यूरोफेन आल,ू मगूं फली 6. जडमेथोएि उन फलों और सजब्ियों के लेबल हिाना, िो कच्च ेफलों के रूप में उपयोग ककए िात े ह ैं। 7. क्लोरजपरफोस बेर, साइरस और तंबाकू (2) सभी रजिस्ट्रीकताट, जिन्ह ेंउपरोक्त उजल्लजखत कीिनाजियों के संबंध में पंिीकरण प्रमाणपत्र अनुित्त ककया गया ह,ै इस आिेि के प्रकािन की तारीख से िह मास की अवजध के भीतर सजचव, केंद्रीय कीिनािी बोडट और पंिीकरण सजमजत, एनएच 4, फरीिाबाि को उपरोक्त उजल्लजखत फसलों में लेबल िावों को लेबल और पत्रकों से हिाने के जलए अपन ेप्रमाणपत्र, लेबल और पत्रक सजहत, प्रस्ट्तुत करेंगे । (3) पंिीकरण प्रमाणपत्र म ें गैर पष्ृ ांकन या सिं ोधन इस आिेि के उपबंधों के उल्लंघन म ें पंिीकरण के ऐस े प्रमाणपत्रों के प्रचालन को अनज्ञु ा या अनुमोिन के रूप में नहीं माना िाएगा । (4) प्रत्येक राज्य सरकार, इस अजधजनयम और तद्धीन बनाए गए जनयमों के अधीन ऐसे उपाय करेगी, िो राज्य म ेंइस आिेि के कायाटन्वयन के जलए यह आव‍यक समझे । [फा.स.ं 13035/15/2019-पीपी-I (वोल्यूम. i)] आिीि कुमार श्रीवास्ट्तव, संयक्तु सजचव (पीपी) MINISTRY OF AGRICULTURE AND FARMERS WELFARE (Department of Agriculture and Farmers Welfare) NOTIFICATION New Delhi, the 29th September, 2023 S.O. 4294(E).—Whereas, the Central Government in the erstwhile Ministry of Agriculture, Department of Agriculture and Cooperation constituted an Expert Committee on 8th July, 2013 to examine the continued use or otherwise of neo-nicotinoid insecticides registered in India and the mandate of the Committee was further expanded on 19th August, 2013, to review sixty-six insecticides which were banned or restricted or withdrawn in other countries but continue to be registered for domestic use in India. And whereas the Committee after detailed examination submitted its report to the Central Government on the 9th December, 2015; which was referred to the Registration Committee and the Registration Committee submitted their recommendations to the Central Government; And whereas, the Department issued Order dated 14th October 2016, conveying the approval for implementation of the recommendations of the Registration Committee; And whereas, the said Expert Committee had recommended continuing the use of the twenty seven insecticides as specified in the schedule to this notification and the same to be reviewed after completion of the recommended studies, this was considered by Registration Committee and submitted recommendations to the Central Government; And whereas, the Central Government, after consultation with the Registration Committee and duly considering their report with regard to status of submission of recommended studies, data and safety concerns, was satisfied that the use of twenty seven insecticides as specified in the schedule to this notification are likely to involve risk to human beings or animals as to render it expedient or necessary to take immediate action; And whereas, the Central Government, in exercise of the powers conferred by sub-section (2) of section 27 of the Insecticides Act, 1968 (46 of 1968) published a draft Order for Banning of Insecticides vide notification number S.O. 1512(E), dated 18th May, 2020, in the Gazette of India, Extraordinary, Part-II, Section-3, Sub-section (ii) and invited objections and suggestions from all persons likely to be affected thereby, before the expiry of the period of forty-five days from the date on which the copies of the Official Gazette in which the said notification was published were made available to the public;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 And whereas, copies of the said Gazette notification were made available to the public on the 18th May, 2020; And whereas, the objections or suggestions received in respect of the said draft Order were referred to an Expert Committee constituted for the purpose which were duly considered by the said Expert Committee; And whereas, the Central Government, after considering the report of the Expert Committee and after consultation with the Registration Committee, set up under the Insecticides Act, 1968 (46 of 1968), is satisfied that the use of three insecticides involves health hazards and risk to human beings and animals due to non-availability of data on safety and efficacy; And whereas, the said draft Order for Banning of Insecticides Order, 2020, published vide notification number S.O. 1512(E), dated 18th May, 2020, was challenged in various High Courts. And the Hon’ble High court of Rajasthan had stayed the implementation of the said rules vide interim Order dated 21st July, 2020, relating to Prohibition of Insecticides till further Order in the case. And whereas, thereafter, Hon’ble High Court of Rajasthan, has issued direction through an Order dated 18th January, 2023, in the matter of S.B. Civil Writ Petition No. 7474/2020 filed by Narayan Singh Rathore, that the interim Order dated 21st July, 2020, is vacated. And whereas, the Draft Order, which the Central Government proposes to make, in exercise of the powers conferred by sub-section (2) of section 27 read with section 28 and sub-section (1) of section 36 of the Insecticides Act, 1968 , was published vide notification of the Government of India in the Ministry of Agriculture and Farmers Welfare (Department of Agriculture, Cooperation and Farmers Welfare) vide number S.O. 701(E), dated 15th February, 2023, inviting objections or suggestions from all persons likely to be affected thereby, before the expiry of the period of thirty days from the date on which the copies of the Gazette of India containing the said notification were made available to the public; And whereas, the copies of the said Gazette notification were made available to the public on the 15th February, 2023; And whereas objections and suggestions received in respect of the said notification were duly considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 27 read with section 28 of the Insecticides Act, 1968 (46 of 1968) (herein referred to as the Act), the Central Government after considering the recommendations of the Expert Committee and in consultation with the Registration Committee hereby makes the following Order, namely:- 1. Short title and commencement – (1) This Order may be called the Insecticides (Prohibition) Order, 2023; (2) It shall come into force on the date of its publication in the Official Gazette. 2. Prohibition of certain insecticides - (1) All the certificates of registration granted under section 9 of the Act, stands cancelled and sale, distribution or use is prohibited of the insecticides as specified in the Schedule to this Order from the date provided under column (3) thereof. (2) The Registration Committee shall revoke the certificate of registration granted for the insecticides specified in the said Schedule. (3) If any person who holds the certificate of registration fails to return the said certificate to the Registration Committee, referred under clause (2) of this Order, within a period of three months, appropriate action shall be taken under the provisions contained in the said Act. (4) The certificate of registration for the insecticides, granted under section 9 of the Act, as provided in the Schedule shall be deemed to be cancelled from the date specified under column (3) of the said Schedule. (5) Every State Government shall take all such steps under the provisions of the Act and the rules framed thereunder, as it considers necessary for the implementation of this Order in the State.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] The Schedule [See paragraph 2] List of Prohibited Insecticides Sl. Dinocap All the certificates of registration granted stands cancelled and sale, distribution or use is prohibited from the date of publication of this Order. 3. Methomyl All the certificates of registration granted stands cancelled and sale, distribution or use is prohibited from the date of publication of this Order. 4. Monocrotophos 1) The use of Monocrotophos 36% SL formulation is to be discontinued and no new certificate of registration for its manufacture shall be issued after publication of this Order. 2) With an objective of providing alternatives of this formulation so that the farmers do not suffer losses due to non-availability of effective control against certain insect pests in specific crops, the label claims for other formulations of Monocrotophos may be extended in one year period from the date of publication of this Order. 3) After this period, all the certificates of registration of Monocrotophos 36% SL will stand cancelled. Sale, distribution or use of Monocrotophos 36% SL shall be allowed only for clearance of existing stock till its expiry period. 3. Further, the Central Government, on recommendations of the Expert Committee and in consultation with Registration Committee, in exercise of the power conferred by sub-section (2) of section 27 of the Act, has decided for omitting crops as mentioned in column (3) of the table below from the label and leaflets of the following insecticides mentioned in column (2) of the said table , namely :— (1) The label claim of the following insecticides for the crops mentioned against each insecticide shall be omitted from the approved use due to non-availability of bio-efficacy and residue data with effect from the date of publication of this Order: Table S. Name of Names of crops to be omitted from approved usage No. Insecticide (1) (2) (3) 1 Carbofuran All other formulations of Carbofuran except Carbofuran three percent Encapsulated granule (CG) along with the crop labels may be stopped from use. 2 Malathion Sorghum, Pea, Soybean, Castor, Sunflower, Bhindi, Brinjal, Cauliflower, Radish, Turnip, Tomato, Apple, Mango and Grape. 3. Quinalphos Jute, Cardamom and Sorghum. 4. Mancozeb Guava, Jowar and Tapioca. 5. Oxyfluorfen Potato and Groundnut. 6. Dimethoate Label deletion of fruits and vegetables that are consumed as raw food items. 7. Chlorpyriphos Ber, Citrus and Tobacco. (2) All registrants granted certificate of registration in respect of the above mentioned insecticides shall submit their certificate along with label and leaflet for deletion of label claims on the above mentioned crops to the Secretary, Central Insecticides Board and Registration Committee, NH-IV, Faridabad, within six[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 months from date of publication of this Order, failing which action to revoke licenses under section 14 of the Act, shall be initiated. (3) Non-endorsement or correction in the certificate of registration shall not be taken as permission or approval to operate upon such certificates of registration in contravention of the provisions of this Order. (4) Every State Government shall take such steps under the Act and the rules made thereunder, as it considers necessary, for the implementation of this Order in the State. [F.
