L.-33004/99 xxxGIDHxxx सी.जी.-डी.एxxलxG.-IअDE.-x0xx5 042023-244934 CG-DL-E-05042023-244934 असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 209] नई दिल्ली, बुधवार, अप्रलै 5, 2023/चत्रै 15, 1945 No. 209] NEW DELHI, WEDNESDAY, APRIL 5, 2023/CHAITRA 15, 1945 स्ट्वास्ट््य और पररवार कल्याण मत्रं ालय (स्ट्वास्ट््य अनसु धं ान जवभाग) (राष्ट्रीय सहायताप्राप्त िननीय प्रौद्योजगकी और सरोगसे ी बोडड) अजधसचू ना नई दिल्ली, 5 अप्रैल, 2023 सा.का.जन. 270(अ).—सरोगेसी (जवजनयमन) अजधजनयम 2021 (2021 का 47) की धारा 51 द्वारा प्रित्त िजियों का प्रयोग करते हुए, राष्ट्रीय सहायताप्राप्त िननीय प्रौद्योजगकी और सरोगेसी बोडड (राष्ट्रीय बोडड) इसके द्वारा जनम्नजलजखत जवजनयम बनाता ह,ै अर्ातड ्:- 1. सजं िप्त िीर्कड और प्रारंभ– (1) इन जवजनयमों को सरोगेसी जवजनयम 2023 कहा िाएगा। (2) ये रािपत्र म ें इनके प्रकािन की तारीख स ेप्रवृत्त होंगे। 2. अन्य ितों की पर्ू त डजिसके अतं गतड धारा 4 के खडं (iii) के उप-खडं (ग) के अधीन उपयिु प्राजधकारी द्वारा पात्रता प्रमाण पत्र िारी दकया िाना ह-ै यदि उपयुि प्राजधकारी की राय ह ै दक सरोगेसी के जलए पात्रता ितड अजधजनयम म ें उजल्लजखत ितों के अजतररि ह,ै तो पात्रता प्रमाण पत्र िारी करने स े पहले उसे जवचार और अनुमोिन के जलए राष्ट्रीय बोड ड के पास भेिा िा सकता ह।ै 3. राष्ट्रीय बोडड की बठै क का समय और स्ट्र्ान तर्ा ऐसी बठै क म ें काय ड सचं ालन के जलए अपनाई िान े वाली प्रदिया तर्ा धारा 19 की उपधारा (1) के अधीन गणपर्ू तड बनान े वाल े सिस्ट्यों की सख्ं या-(1) राष्ट्रीय बोडड की छह माह में कम से कम एक बार बैठक होगी और पचास प्रजतित सिस्ट्य गणपूर्तड का गठन करेंगे। 2269 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) यदि राष्ट्रीय बोडड की दकसी बैठक म ें गणपूर्त ड नहीं है, तो बठै क स्ट्र्जगत कर िी िाएगी और ऐसी स्ट्र्जगत बैठक का कायड उस बैठक में दकया िाएगा िो िो घंटे के बाि जनधाडररत की िा सकती है, लेदकन सात दिनों से अजधक नहीं, चाह े गणपूर्त ड हो या नहीं। (3) राष्ट्रीय बोडड की बैठक बोड ड के अध्यि द्वारा जवजनधाडररत ऐसी जतजर्, स्ट्र्ान और स्ट्र्ल पर आभासी या भौजतक रूप से आयोजित की िा सकेगी। (4) (क) राष्ट्रीय बोड ड का सिस्ट्य सजचव बोडड के प्रत्येक सिस्ट्य को बैठक की तारीख से कम से कम पंद्रह दिन पहल े राष्ट्रीय बोडड की प्रत्येक बैठक की सूचना िारी करेगा। (ख) सिस्ट्य सजचव बैठक की सचू ना के सार् एक कायडसूची िारी करेगा जिसमें जनधाडररत बठै क में राष्ट्रीय बोड ड के समि लाए िान े वाले कायड पर बल दिया िाएगा: बिते दक असाधारण पररजस्ट्र्जत में, राष्ट्रीय बोडड का अध्यि बोडड की बैठक के जलए जनर्िष्टड अवजध से पहले नोरटस की आवश्यकता को समाप्त कर सकता ह।ै (5) कोई सिस्ट्य िो राष्ट्रीय बोडड के सिस्ट्य सजचव द्वारा इस प्रकार पररचाजलत कायडसूची में िाजमल न दकए गए दकसी प्रस्ट्ताव को प्रस्ट्तुत करना चाहता ह,ै उसे बैठक से कम स ेकम सात दिन पहल े िाजमल करन े के जलए नोरटस िेगा। 4. वह तरीका जिसम ें कोई व्यजि धारा 22 की उप-धारा (1) के तहत राष्ट्रीय बोडड के सार् अस्ट्र्ायी रूप स े सबं द्ध हो सकता ह ै - राष्ट्रीय बोडड दकसी व्यजि को दकसी भी बैठक में भाग लने े या आवश्यकता के अनुसार अस्ट्र्ायी रूप से राष्ट्रीय बोडड के सार् संबद्ध करन े का सह-जवकल्प चुन सकता ह।ै 5. राज्य बोड ड की बठै कों का समय और स्ट्र्ान तर्ा ऐसी बठै कों म ें काय ड सचं ालन के जलए अपनाई िान े वाली प्रदिया तर्ा धारा 29 की उपधारा (1) के अधीन गणपर्ू त ड बनान े वाल े सिस्ट्यों की सख्ं या- (1) राज्य बोडड की छह माह में कम से कम एक बार बैठक होगी और पचास प्रजतित सिस्ट्य गणपूर्तड का गठन करेंगे। (2) यदि राज्य बोडड की दकसी बैठक में गणपूर्त ड नहीं ह,ै तो बठै क स्ट्र्जगत कर िी िाएगी और ऐसी स्ट्र्जगत बैठक का कायड उस बैठक म ें दकया िाएगा, िो िो घंटे के बाि जनधाडररत की िा सकती है, लेदकन सात दिनों से अजधक नहीं, चाह े गणपूर्त ड हो या नहीं। (3) राज्य बोडड की बैठक बोडड के अध्यि द्वारा जवजनधाडररत ऐसी जतजर्, स्ट्र्ान और स्ट्र्ल पर आभासी या भौजतक रूप स े आयोजित की िा सकेगी। (4) (क) राज्य बोड ड का सिस्ट्य सजचव बोडड के प्रत्येक सिस्ट्य को बैठक की तारीख से कम से कम पंद्रह दिन पहले राज्य बोडड की प्रत्येक बैठक की सूचना िारी करेगा। (ख) सिस्ट्य सजचव बैठक की सचू ना के सार् एक कायडसूची िारी करेगा जिसमें जनधाडररत बैठक म ें राज्य बोडड के समि लाए िान े वाल ेकायड िाजमल होंगे: बिते दक असाधारण पररजस्ट्र्जत में, राज्य बोडड का अध्यि बोडड की बैठक के जलए जनधाडररत अवजध से पहले नोरटस की आवश्यकता को समाप्त कर सकता ह।ै (5) कोई सिस्ट्य िो राज्य बोडड के सिस्ट्य सजचव द्वारा इस प्रकार पररचाजलत कायडसूची म ें िाजमल न दकए गए दकसी प्रस्ट्ताव को प्रस्ट्तुत करना चाहता ह,ै उसे बैठक से कम स ेकम सात दिन पहल े िाजमल करन े के जलए नोरटस िेगा। 6. वह तरीका जिसम ें कोई व्यजि धारा 32 की उपधारा (1) के अधीन अस्ट्र्ायी रूप स े राज्य बोडड स े सबं द्ध हो सकता है- राज्य बोडड दकसी व्यजि को दकसी बैठक में भाग लेन े या आवश्यकता के अनुसार अस्ट्र्ायी रूप से राज्य बोड ड के सार् संबद्ध करने का सह-जवकल्प चुन सकता ह।ै [फा. स.ं यू.11019/30/2022-एचआर(भाग-I)] गीता नारायण, संयक्ु त सजचव[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 MINISTRY OF HEALTH AND FAMILY WELFARE (Department of Health Research) (NATIONAL ASSISTED REPRODUCTIVE TECHNOLOGY AND SURROGACY BOARD) NOTIFICATION New Delhi, the 5th April, 2023 G.S.R. 270(E).—In exercise of the powers conferred by section 51 of the Surrogacy (Regulation) Act, 2021 (47 of 2021), the National Assisted Reproductive Technology and Surrogacy Board (National Board) hereby makes the following regulations, namely:- 1. Short title and commencement. – (1) These regulations may be called the Surrogacy Regulations, 2023. (2) They shall come into force from the date of their publication in the Official Gazette. 2. The fulfillment of other condition under which eligibility certificate to be issued by the appropriate authority under sub-clause (c) of clause (iii) of section 4.- If the appropriate authority is of opinion that the eligibility condition for surrogacy other than those mentioned in the Act, the same may be sent to the National Board for consideration and approval before issuing the eligibility certificate. 3. The time and place of the meeting of the National Board and the procedure to be followed for the transaction of business at such meeting and the number of Members which shall form the quorum under sub- section (1) of section 19.- (1) The National Board shall meet at least once in six months and fifty percent of the members shall constitute the quorum. (2) If there is no quorum at any meeting of the National Board, the meeting shall be adjourned and the business of such adjourned meeting shall be transacted in the meeting which may be scheduled after two hours, but not beyond seven days, irrespective of there being a quorum or not. (3) The meeting of the National Board may conduct virtually or physically on such date, place and venue as decided by the Chairperson of the Board. (4) (a) The Member Secretary of the National Board shall issue notice of every meeting of the National Board to every Member of the Board not less than fifteen days before the date of meeting. (b) The Member Secretary shall issue, with the notice of the meeting an agenda emphasising the business to be brought before the National Board in the scheduled meeting: Provided that in exceptional circumstance, the Chairperson of the National Board may dispense with the requirement of notice before the specified period for meeting of the Board. (5) A Member who desires to move any motion not included in the agenda so circulated by the Member Secretary of the National Board shall give notice for inclusion of the same at least seven days before the meeting. 4. The manner in which a person may be temporarily associated with the National Board under sub-section (1) of section 22.- The National Board may co-opt a person to attend any meeting, or to temporarily associate with the National Board as per the requirement. 5. The time and place of the meetings of the State Board and the procedure to be followed for the transaction of business at such meetings and the number of Members which shall form the quorum under sub-section (1) of section 29.- (1) The State Board shall meet at least once in six months and fifty percent of the members shall constitute the quorum.
