L.-33004/99 vlk/kj.k EXTRAORDINARY Hkkx II—[k.M 3—mi&[k.M (i) PART II—Section 3—Sub-section (i) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la. 317] ubZ fnYyh] 'kqØokj] twu 13] 2014@T;s’ 23] 1936 No. 317] NEW DELHI, FRIDAY, JUNE 13, 2014/JYAISTHA 23, 1936 (cid:1)(cid:1)(cid:1)(cid:1)मममम औऔऔऔरररर ररररोोोोजजजजगगगगाााारररर मममम(cid:11)(cid:11)ंं(cid:11)(cid:11)ंं ााााललललयययय अअअअििििधधधधससससचचूूचचूू ननननाााा ubZ fnYyh] 11 twu] 2014 ससससाााा....ककककाााा....ििििनननन.... 444400001111((((अअअअ))))....—रा(cid:3) (cid:5)पित, संिवधान के अनु(cid:16)छ ेद 309 के पर(cid:19)त ुक (cid:21)ारा (cid:22)द(cid:24) शि(cid:26)त य(cid:28) का (cid:22)योग करते (cid:31)ए और क"#ीय %म सेवा िनयम, 2007 को उन बात(cid:28) के िसवाय अिध)ांत करते (cid:31)ए, िज(cid:19)ह " ऐसे अिध)मण से पहले .कया गया है या करने से लोप .कया गया ह,ै क"#ीय %म सेवा म" भत1 क2 प3ित का िविनयमन करने के िलए िन4न िलिखत िनयम बनाते ह,6 अथा8त ्:— 1111.... ससससििंंििंं(cid:16)(cid:16)(cid:16)(cid:16)(cid:17)(cid:17)(cid:17)(cid:17)तत तत ननननाााामममम औऔऔऔरररर (cid:20)(cid:20)(cid:20)(cid:20)ााााररररंंंंभभभभ –––– (1) इन िनयम(cid:28) का संि;<त नाम क"#ीय %म सेवा (समूह ‘क’) िनयम, 2014 ह ै। (2) ये राजप= म" (cid:22)काशन क2 तारीख को (cid:22)वृ(cid:24) ह(cid:28)गे । 2222.... पपपप(cid:23)(cid:23)(cid:23)(cid:23)ररररभभभभााााषषषषााााएएएएंं ंं –––– इन िनयम(cid:28) म" जब तक .क संदभ8 से अ(cid:19)य था अपेि;त न हो,— (क) ‘‘आयोग’’ से संघ लोक सेवा आयोग अिभ(cid:22)ेत ह ै; (ख) ‘‘िनयं=क (cid:22)ािधकारी’’ से भारत सरकार का %म और रोजगार मं=ालय अिभ(cid:22)ेत ह ै; (ग) ‘‘सिमित’’ से ऐसी िवभागीय (cid:22)ो(cid:19) नित सिमित या िवभागीय पुि(cid:3)ट करण सिमित या छानबीन सिमित अिभ(cid:22)ेत ह ै जो अनुसूची-IV म" यथािविनDद(cid:3) ट .कसी %ेणी म" अिधकाEरय(cid:28) क2 (cid:22)ो(cid:19)न ित, पुि(cid:3)ट करण और अकृिFय क उ(cid:19)न यन पर िवचार करने के िलए इन िनयम(cid:28) के अधीन गEठत क2 गई ह ै; (घ) ‘‘Iूटी पद’’ से ऐसा कोई पद अिभ(cid:22)ेत ह,ै चाहे वह Lथ ायी हो या अLथ ायी, जो अनुसूची- I म" सि4म िलत ह ै; (ड.) ‘‘%ेणी’’ से सेवा क2 कोई %ेणी अिभ(cid:22)ेत ह ै; (च) .कसी %ेणी के संबंध म," ‘‘िनयिमत सेवा’’ से .कसी %ेणी म" िनयिमत िनयिु (cid:26)त के िलए अनुसूची-III म" िविहत (cid:22).)या के अनुसार उस %ेणी म " चयन के पMच ात् क2 गई सेवा क2 अविध या अविधयां अिभ(cid:22)ेत ह 6 और इसम" वह अविध या अविधया ं सि4 मिलत ह 6— (i) िजस पर िनयम 5 के अनुसार िनयु(cid:26)त उन Nय ि(cid:26)त य(cid:28) क2 दशा म" Oय े(cid:3)ठ ता के (cid:22)योजन(cid:28) के िलए िवचार .कया जाएगा ; और (ii) िजसके दौरान कोई अिधकारी उस %ेणी म" M~;wटी पद धारण करता .क(cid:19)त ु जो छुPी पर रहने के कारण या अ(cid:19)य था उस पद को धारण करने के िलए उपलQ ध नहR था । 2433 GI/2014 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (छ) ‘‘अनुसूची’’ से इन िनयम(cid:28) से उपाब3 अनुसूची अिभ(cid:22)ेत ह ै; (ज) ‘‘अनुसूिचत जाित’’ और ‘‘अनुसूिचत जनजाितय(cid:28)’’ का )मश: वह अथ8 होगा जो उनका संिवधान के अनु(cid:16)छ ेद 366 के खंड (24) और खंड (25) म" है ; (झ) ‘‘सेवा’’ से िनयम 3 के अधीन गEठत क"#ीय %म सेवा (समूह ‘क’) अिभ(cid:22)ेत ह ै। 3333.... ससससववेेववेे ाााा ककककाााा गगगगठठठठनननन –––– (1) क"#ीय %म सेवा (समूह ‘क’) के Sप म" Tात एक सेवा का गठन .कया जाएगा िजसम" िनयम 5 और िनयम 7 के अधीन सेवा म" िनयु(cid:26) त सदL य ह(cid:28)गे । (2) सेवा म" सि4 मिलत सभी पद समूह ‘क’ पद ह(cid:28)गे । 4444.... ससससववेेववेे ाााा ककककेेेे ससससदददद(cid:30)(cid:30)(cid:30)(cid:30)यय यय ---- िन4 निलिखत N यि(cid:26) त सेवा के सदLय ह(cid:28)ग,े अथा8त् :-- 1.(क) ऐसे N यि(cid:26) त िज(cid:19) ह "िनयम 5 के अधीन M~;wटी पद(cid:28) पर िनयु(cid:26)त .कया समझा गया ह ै; और (ख) ऐसे N यि(cid:26) त िज(cid:19)ह" िनयम 7 के अधीन M~;wटी पद(cid:28) पर िनयु(cid:26)त .कया गया ह ै। 2. उपिनयम (1) के खंड (क) म" िनDद(cid:3) ट कोई Nय ि(cid:26)त उसक2 िनयुि(cid:26)त क2 तारीख से उसको लागू समुिचत %ेणी म" सेवा का सदL य होगा । 5555.... (cid:20)(cid:20)(cid:20)(cid:20)ााााररररंंंंििििभभभभकककक गगगगठठठठनननन—(1) इन िनयम(cid:28) के (cid:22)ारंभ क2 तारीख को ऐसे अिधकाEरय(cid:28) क2 सेवा को, जो अनुसूची-I म" यथािविनDद(cid:3)ट िविभ(cid:19)न %ेिणय(cid:28) म " क"#ीय %म सेवा िनयम, 2007 के अधीन िनयिमत आधार पर पहले ही िनयु(cid:26)त .कए जा चुके ह 6 और इस (cid:22)कार िनयु(cid:26) त अिधकारी, सेवा के (cid:22)ारंिभक गठन से संबंिधत %ेिणय(cid:28) म" िनयु(cid:26)त .कए गए समझे जाएंगे । (2) इन िनयम(cid:28) के (cid:22)काशन से पूव8 उपिनयम (1) म" दी गई संबंिधत तFस मान %ेिणय(cid:28) म" वVणत अिधकाEरय(cid:28) क2 िनयिमत सतत सेवा को O ये(cid:3) ठता, पुि(cid:3) ट, (cid:22)ो(cid:19) नित, अकृिF यक उ(cid:19) नयन और प"शन के (cid:22)योजन के िलए अहक8 सेवा के Sप म" संगिणत .कया जाएगा । 6666.... (cid:1)(cid:1)(cid:1)(cid:1)ििेेििेेणणणणययययाााा,,ंं,,ंं (cid:20)(cid:20)(cid:20)(cid:20)ााााििििधधधधककककृृृृतततत सससस..ंं..ंं औऔऔऔरररर उउउउससससककककाााा पपपपननुुननुु %%%%ववववललललोोोोककककनननन—(1) इन िनयम(cid:28) के (cid:22)ारंभ क2 तारीख को सेवा क2 िविभ(cid:19)न %ेिणय(cid:28) म" सि4म िलत M~;wटी पद उनक2 संW या और उनके वेतन ब6ड तथा Yेड वेतन या वेतनमान वे ह(cid:28)गे, जो अनुसूची-I म" िविनDद(cid:3)ट ह6 । (2) इन िनयम(cid:28) के (cid:22)ारंभ के पM चात् िविभ(cid:19) न %ेिणय(cid:28) म" M~;wटी पद(cid:28) क2 (cid:22)ािधकृत Lथ ायी संWय ा वह होगी, जो समय-समय पर, क"#ीय सरकार (cid:21)ारा अवधाEरत क2 जाएगी। (3) क"#ीय सरकार, िविभ(cid:19) न %ेिणय(cid:28) म" M~;wटी पद(cid:28) क2 संWय ा म" अLथ ायी वृि3 या कमी, जो समय-समय पर आवMय क समझी जाए, कर सकेगी। (4) क"#ीय सरकार, आयोग से परामश8 करके, अनुसूची-I म "सि4म िलत पद(cid:28) से िभ(cid:19)न .कसी पद को सेवा म" सि4म िलत कर सकेगी या उ(cid:26)त अनूसची म" सि4 मिलत .कसी पद को सेवा से अपवVजत कर सकेगी। (5) क"#ीय सरकार, आयोग से परामश8 करके, ऐसे अिधकारी को, िजसका पद उपिनयम (4) के अधीन सेवा म" सि4म िलत ह,ै .कसी अL थायी या अिध(cid:3) ठायी हिै सयत म," जो वह ठीक समझे, सेवा क2 समुिचत %ेणी म" िनयु(cid:26)त कर सकेगी और समय-समय पर सरकार (cid:21)ारा जारी .कए गए साधारण आदशे (cid:28) या अनुदशे (cid:28) के अनुसार उस %ेणी म" उसक2 Oय े(cid:3)ठ ता िनयत कर सकेगी । 7777.... ससससववेेववेे ाााा ककककाााा भभभभााााववववीीीी अअअअननननररुुररुु (cid:16)(cid:16)(cid:16)(cid:16)णणणण—अनुसूची-I म" िनDद(cid:3)ट .क(cid:19)ह R %ेिणय(cid:28) के पद, इस िनयम म" उपबंिधत रीित से भरे जाएंगे और इस (cid:22)कार िनयु(cid:26) त N यि(cid:26) त, ऐसी िनयुि(cid:26) त क2 तारीख से संबंिधत %ेिणय(cid:28) म" सेवा के सदLय ह(cid:28)गे । (क) सेवा के किन(cid:3) ठ काल-वेतनमान म" साठ (cid:22)ितशत पद, अनुसचू ी-II म" यथािविनDद(cid:3)ट शैि;d अहत8 ा और आय-ु सीमा के आधार पर आयोग के माZ यम से सीधी भत1 (cid:21)ारा भरे जाएंगे और शेष चालीस (cid:22)ितशत पद, अनुसूची-III म" यथािविनDद(cid:3)ट (cid:19) यूनतम अहक8 सेवा सिहत क\ याण (cid:22)शासक और %म अिधकाEरता अिधकारी (क"#ीय) के पद धारण करने वाले िन4न तर %ेणी के ऐसे अिधकाEरय(cid:28) म" स े(cid:22)ो(cid:19)न ित (cid:21)ारा भरे जाएंगे । (ख) O ये(cid:3) ठ काल-वेतनमान म" सभी पद और उससे उ(cid:16) च पद(cid:28) को अनुसूची-III म" यथािविनDद(cid:3)ट भत1 क2 प3ित, चयन का ;े= और (cid:19) यूनतम अहक8 सेवा के अनुसार भरा जाएगा । (ग) अिधकाEरय(cid:28) क2 (cid:22)ो(cid:19) नित, िन4 निलिखत दशा के िसवाय ‘चयन’ (cid:21)ारा क2 जाएगी, अथा8त् :-- उप मुW य %म आयु(cid:26) त (क"#ीय)/क\ याण आयु(cid:26)त /क\य ाण आयु(cid:26)त (मुWय ालय)/%म क\य ाण आयु(cid:26)त /िनदशे क ((cid:22)िश;ण) और सेवा क2 किन(cid:3) ठ (cid:22)शासिनक %ेणी म" समत\ु य को अकृिFय क चयन %ेणी, समय-समय पर क"#ीय सरकार (cid:21)ारा जारी माग8दश8क िस3ांत(cid:28) के अनुसार उनक2 उपयु(cid:26)त ता पर आधाEरत Oय े(cid:3) ठता के )म म" (cid:22)दान क2 जाएगी । (घ) सेवा के (cid:22)F येक पद पर (cid:22)ो(cid:19) नित (cid:21)ारा भत1, अनुसूची-IV म" यथािविनDद(cid:3)ट सिमित क2 िसफाEरश(cid:28) पर क2 जाएगी । 8888.... ((((यय यय ))ेे))ेे ठठ ठठ तततताााा—(1) िनयम 5 के अधीन सेवा के (cid:22)ारंिभक गठन के समय .कसी %ेणी म" िनयु(cid:26)त अिधकाEरय(cid:28) क2 सापे; Oय े(cid:3)ठ ता, इन िनयम(cid:28) के (cid:22)ारंभ क2 तारीख को अिभ(cid:22)ा< त अनुसार होगी :¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3 परंतु य.द .कसी ऐसे सदL य क2 O ये(cid:3) ठता उ(cid:26) त तारीख को िविनDद(cid:3)ट Sप से अवधाEरत नहR क2 गई थी तो वह Oय े(cid:3)ठ ता िनयतन को शािसत करने वाले उन िनयम(cid:28) के आधार पर अवधाEरत क2 जाएगी, जो इन िनयम(cid:28) के (cid:22)ारंभ से पूव8 सेवा के सदLय (cid:28) को लागू थे । (2) िनयम 5 के अधीन िनयु(cid:26) त N यि(cid:26) तय(cid:28) से िभ(cid:19)न सेवा म" भत1 अिधकाEरय(cid:28) क2 Oय े(cid:3)ठ ता का अवधारण, समय-समय पर क"#ीय सरकार (cid:21)ारा जारी .कए गए साधारण अनुदशे (cid:28) के अनुसार .कया जाएगा । (3) उन मामल(cid:28) म" जहां अिधकारी उपिनयम (1) और उपिनयम (2) के अंतग8त नहR आते ह,6 वहां Oय े(cid:3) ठता का अवधारण, क"#ीय सरकार (cid:21)ारा आयोग के परामश8 से .कया जाएगा । 9999.... पपपप(cid:23)(cid:23)(cid:23)(cid:23)ररररववववीीीी(cid:16)(cid:16)(cid:16)(cid:16)ाााा—(1) सेवा के किन(cid:3) ठ काल-वेतनमान के पद पर िनयु(cid:26) त (cid:22)Fय के अिधकारी, दो वष8 क2 अविध के िलए पEरवी;ा पर होगा : परंतु िनयं=ण (cid:22)ािधकारी, सरकार (cid:21)ारा इस िनिम(cid:24) समय-समय पर जारी .कए गए अनुदशे (cid:28) के अनुसार पEरवी;ा क2 अविध को बढा सकेगा : परंतु यह और .क पEरवी;ा क2 अविध, बढाने का कोई िविनMच य, पEरवी;ा क2 (cid:22)ारंिभक अविध क2 समाि<त के पM चात् तुरंत .कया जाएगा और साधारणतया आठ स<त ाह के भीतर तथा संब3 अिधकारी को ऐसा करने के कारण(cid:28) के साथ िलिखत Sप म" उ(cid:26) त अविध के भीतर संसूिचत .कया जाएगा । (2) पEरवी;ा क2 अविध पूरी होने पर या उसके .कसी िवLतार पर, य.द अिधकाEरय(cid:28) को Lथ ायी िनयिु (cid:26)त के उपयु(cid:26)त समझा जाता ह ैतो सेवा म" उनक2 पुि(cid:3) ट कर दी जाएगी । (3) य.द, यथािL थित, पEरवी;ा क2 अविध या उसके .कसी िवLत ार के दौरान, िनयं=ण (cid:22)ािधकारी क2 यह राय ह ै .क कोई अिधकारी L थायी िनयुि(cid:26) त के िलए उपयु(cid:26) त नहR ह ैतो िनयं=ण (cid:22)ािधकारी, यथािLथ ित, उसे सेवो(cid:19)म ु(cid:26)त कर सकेगा या उसे सेवा म" उसक2 िनयिु (cid:26)त के पूव8 उसके (cid:21)ारा धाEरत पद पर (cid:22)ितवVतत कर सकेगा । (4) पEरवी;ा क2 अविध या उसके .कसी िवL तार के दौरान, .कसी अिधकारी से िनयं=ण (cid:22)ािधकारी (cid:21)ारा ऐसे पाB~;Øम(cid:28) म" (cid:22)िश;ण और अनुदशे (cid:28) को (cid:22)ा< त करने या ऐसी परी;ाएं या परी;ण (िजनम" िह(cid:19)द ी म" परी;ा भी सि4म िलत ह)ै उ(cid:24)ीण8 करने क2 अपे;ा क2 जा सकेगी जो िनयं=ण (cid:22)ािधकारी, पEरवी;ा के संतोष(cid:22)द Sप से पूरी करने क2 शत8 के Sप म" ठीक समझे । (5) पEरवी;ा से संबंिधत अ(cid:19) य ऐसे मामले के संबंध म," जो इन िनयम(cid:28) के अंतग8त नहR आते ह,6 सेवा के सदLय , क"#ीय सरकार (cid:21)ारा समय- समय पर इस संबंध म" जारी .कए गए आदशे (cid:28), अनुदशे (cid:28) (cid:21)ारा शािसत ह(cid:28)गे । 11110000.... भभभभााााररररतततत ककककेेेे ****ककककससससीीीी भभभभीीीी भभभभाााागगगग मममम ++ ++ससससववववेेेे ाााा ककककाााा ददददाााािििियययय,,,,वव वव औऔऔऔरररर ससससववेेववेे ाााा कककक---- अअअअ....यय यय शशशशतततत 00 00–––– (1) सेवा म" िनयु(cid:26)त अिधकारी, भारत म" कहR भी या भारत स े बाहर सेवा करने के दाियF व के अधीन ह(cid:28)गे । (2) सेवा म" िनयु(cid:26) त कोई अिधकारी, य.द इस (cid:22)कार अपे;ा क2 जाए, तो चार वष8 से अ(cid:19)य ून क2 अविध के िलए, िजसम" (cid:22)िश;ण म" N यतीत अविध भी सि4 मिलत ह,ै य.द कोई ह,ै .कसी र;ा सेवा म" या भारत क2 र;ा से संबंिधत .कसी पद पर सेवा करने के दाियFव के अधीन होगा : परंतु ऐसे अिधकारी से— (क) सेवा म" उसक2 िनयुि(cid:26) त क2 तारीख से दस वष_ क2 समाि<त के पMच ात् यथापूव‘(cid:26)त सेवा करने क2 अपे;ा नहR क2 जाएगी; (ख) य.द वह चालीस वष8 क2 आयु (cid:22)ाa कर चुका ह ैतो सामा(cid:19)य तया उससे यथापूव‘(cid:26)त सेवा करने क2 अपे;ा नहR क2 जाएगी । (3) उन िवषय(cid:28) क2 बाबत, िजनके िलए इन िनयम(cid:28) म" कोई िविश(cid:3)ट उपबंध नहR .कया गया है, सेवा के सदLय (cid:28) क2 सेवा शतb वही ह(cid:28)गी जो क"#ीय िसिवल सेवा के समूह ‘क’ अिधकाEरय(cid:28) को समय-समय पर लागू होती ह 6। 11111111.... ििििननननररररहहहहतत22तत22 ाााा—वह N यि(cid:26) त— (क) िजसने ऐसे N यि(cid:26) त से िजसका पित या पFन ी जीिवत ह,ै िववाह .कया ह ै; Short title and commencement.—(1) These rules may be called the Central Labour Service (Group ‘A’) Rules, 2014. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions.—In these rules, unless the context otherwise requires.— (a) “Commission” means the Union Public Service Commission; (b) “Controlling Authority” means the Central Government in the Ministry of Labour and Employment; (c) “Committee” means the Departmental Promotion Committee or Departmental Confirmation Committee or Screening Committee constituted under these rules to consider promotion, confirmation and Non- functional Up-gradation of officers in any grade as specified in Schedule-IV; (d) “duty post” means any post, whether permanent or temporary included in Schedule-I; (e) “grade” means a grade of the Service; (f) “regular service” in relation to any grade means the period or periods of service in that grade rendered after appointment to a grade according to the procedure prescribed in Schedule-III, for regular appointment to that grade and includes any period or periods— (i) taken into account for the purposes for seniority in the case of those appointed as per rule 5; (ii) during which an officer would have held a duty post in that grade but for being on leave or otherwise not being available for holding such posts; (g) “Schedule” means a Schedule appended to these rules; (h) “Scheduled Caste” and “Scheduled Tribes” shall have the same meanings as assigned to them in clauses (24) and (25) respectively of article 366 of the Constitution; (i) “Service” means the Central Labour Service (Group ‘A’) constituted under rule 3. 3. Constitution of the Service.—(1) There shall be constituted a Service known as the Central Labour Service (Group ‘A’) consisting of members appointed to the Service under rules 5 and 7. (2) All the posts included in the Service shall be Group ‘A’ posts. 4. Members of the Service. —The following persons shall be members of the Service, namely:- 1. (a) persons deemed to have been appointed to duty posts under rule 5; and (b) persons appointed to duty posts under rule 7. 2. A person referred to in clause (a) of sub-rule (1) shall be member of the Service in the appropriate grade applicable to him from the date of his appointment. 5. Initial Constitution. — (1) The Service shall on the date of commencement of these rules consists of officers who have already been appointed on a regular basis under the Central Labour Service Rules 2007 in various grades as specified in Schedule-I and the officers so appointed shall be deemed to have been appointed to the respective grades at the initial constitution of the Service. (2) The regular continuous service of officers mentioned in sub-rule (1) in the respective corresponding grades rendered prior to the publication of these rules shall count as qualifying service for the purpose of seniority, confirmation, promotion, Non-functional up-gradation and pension. 6. Grades, authorised strength and its review.– (1) The duty posts included in the various grades of the Service, their numbers and Pay band and Grade Pay or pay scale, on the date of commencement of these rules, shall be as specified in Schedule-I. (2) After the commencement of these rules, the authorised permanent strength of the duty posts in various grades shall be such as may, from time to time, be determined by the Central Government.8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (3) The Central Government may make temporary additions or deletions to the strength of the duty posts in various grades as deemed necessary from time to time. (4) The Central Government may, in consultation with the Commission, include in the service any post other than those included in the Schedule-I or exclude from the service a post included in the said Schedule. (5) The Central Government may, in consultation with the Commission appoint an officer whose post is included in the Service under sub-rule (4) to the appropriate grade in a temporary capacity or in a substantive capacity, as may be deemed fit and fix his seniority in that grade in accordance with the general orders or instructions of the Government issued from time to time. 7. Future maintenance of service.—The posts in any of the grades referred to in Schedule-I shall be filled in the manner hereinafter provided in this rule, and the persons so appointed shall be the members of the Service in the respective grades from the date of such appointment. (a) Sixty per cent of the posts in the Junior Time Scale of the Service shall be filled by direct recruitment through the Commission on the basis of the educational qualifications and age limit as specified in Schedule-II, and the remaining forty per cent of the posts shall be filled by promotion amongst officers in the lower grade holding the post of Welfare Administrator and Labour Enforcement Officer (Central) with minimum qualifying service as specified in Schedule-III. (b) All the post in the Senior Time Scale and above shall be filled in accordance with the method of recruitment, field of selection and minimum qualifying service as specified in Schedule-III. (c) The promotion of officers shall be made by ‘Selection’ except in the following case namely:- Grant of Non-Functional Selection Grade to the Deputy Chief Labour Commissioner(Central)/Welfare Commissioner/ Welfare Commissioner (Headquarters)/Labour Welfare Commissioner/Director (Training) and equivalent in the Junior Administrative Grade of the Service shall be in the order of seniority based on their suitability in accordance with the guidelines issued by the Central Government from time to time. (d) Recruitment by promotion to every post of the Service shall be made on the recommendations of the Committee as specified in Schedule-IV. 8. Seniority.- (1) The relative seniority of the officers appointed to a grade at the time of initial constitution of the Service under rule 5 shall be as obtaining on the date of commencement of these rules: Provided that if the seniority of any such member had not been specifically determined on the said date, the same shall be determined on the basis of rules governing the fixation of seniority as was applicable to the members of the Service prior to the commencement of these rules. (2) The seniority of officers recruited to the Service other than appointed under rule 5 shall be determined in accordance with the general instructions issued by the Central Government from time to time. (3) In case of the officers not covered under sub-rule (1) and (2), seniority shall be determined by the Central Government in consultation with the Commission. 9. Probation.- (1) Every officer appointed to the post of Junior Time Scale of the Service shall be on probation for a period of two years: Provided that the Controlling Authority may extend the period of probation in accordance with the instructions issued by the Government from time to time in this behalf: Provided further that any decision for extension of period of probation shall be taken immediately after the expiry of the initial period of probation and ordinarily within eight weeks and communicated in writing to the concerned officer together with the reasons for doing so within the said period. (2) On completion of the period of probation or any extension thereof, the officers, if considered fit for permanent appointment, shall be confirmed in the Service. (3) If, during the period of probation or any extension thereof, as the case may be, the Controlling Authority is of the opinion that an officer is not fit for permanent appointment, he may discharge or revert the officer to the post held by him prior to his appointment in the Service, as the case may be. (4) During the period of probation or any extension thereof, an officer may be required by Controlling Authority to undergo such course of training and instructions or to pass such examinations and tests (including examination in Hindi) as the Controlling Authority may deem fit, as a condition to the satisfactory completion of probation. (5) As regards other matters relating to probation, not covered by these rules, the members of the Service shall be governed by the orders, instructions issued in this regard by the Central Government from time to time. 10. Liability for service in any part of India and other conditions of service.- (1) The officers appointed to the Service shall be liable to serve anywhere in India or abroad. (2) Any officer appointed to the Service, if so required, shall be liable to serve in any Defence Service or post connected with the defence of India, for a period not less than four years, including the period spent on training, if any:¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 9 Provided that such officers- (a) shall not be required to serve as aforesaid after expiry of ten years from the date of his appointment to the Service; (b) shall not ordinarily be required to serve as aforesaid if he has attained the age of forty years. (3) The conditions of service of the members of the Service in respect of matters for which no specific provision is made in these rules, shall be the same as are applicable, from time to time, to Group ‘A’ officers of Central Civil Service. 11. Disqualification.—No person.— (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living has entered into or contracted a marriage with any person, shall be eligible for appointment to the Service: Provided that the Central Government may, if satisfied, that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 12. Power to relax.—Where the Central Government is of the opinion, that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Commission, relax any of the provisions of these rules with respect to any class or category of persons. 13. Savings.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the persons belonging to the Scheduled Castes, the Scheduled Tribes and other categories of persons in accordance with the orders issued by the Central Government from time to time in this regard. 14. Interpretation.—If any question relating to the interpretation of these rules arises, it shall be decided by the Central Government in consultation with the Commission. There will be no increase in the overall strength of the cadre and the number of posts to be operated in the ‘non-functional selection grade’ shall not exceed the number of posts available in the Junior Administrative Grade.10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] SCHEDULE-II [See rule 7 (a)] Educational qualification, experience and age limits for direct recruitment to the posts in Junior Time Scale of Central Labour Service (Group ‘A’) shall be as under:- Essential:- (i) Degree of a recognised University; (ii) Diploma in Social Work or Labour Welfare or Industrial Relations or Personnel Management or Labour Law from a recognised University or Institution. Desirable: Degree in Law from a recognised university. Note 1: Qualification(s) are relaxable at the discretion of the Commission in case of candidates otherwise well qualified. Note 2: The qualification (s) regarding experience is/are relaxable at the discretion of the Commission in case of candidates belonging to Schedule Castes or the Scheduled Tribes, if at any stage of selection the Commission is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the posts reserved for them. Age limit: No exceeding 35 years. Note 1: Relaxable for Government servants up to five years in accordance with the instructions or orders issued by the Central Government. Note 2: The crucial date for determining the age-limit shall be the closing date for receipt of applications from candidates except the closing date prescribed for those in Assam, Meghalaya, Arunachal Pradesh, Mizoram, Manipur, Nagaland, Tripura, Sikkim, Ladakh Division of Jammu and Kashmir, Lahaul and Spiti District and Pangi Sub-Division of Chamba District of Himachal Pradesh, Andaman and Nicobar Islands and Lakshdweep).
