CORRIGENDUM
Tamil Nadu, the 7th December, 2022
No. AF/M/63/2/2022-23.—This is a corrigendum to the Office Order No. AF/M/63
dated 01/06/2022 issued by the Auroville Foundation in order to clarify and add the source of statutory
power in the preamble to the original Office Order No. AF/M/63 dated 01/06/2022.
Preamble to the Office Order No. AF/M/63 dated 01/06/2022 tracing the source of statutory power
shall be read as follows:[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3
“Whereas the Mother had envisaged Auroville as a universal township dedicated to human unity
and international understanding and as further described by her in “A Dream” (1954), the Auroville Charter
(1968), the message “To be a True Aurovilian” (1970) and the Mother’s numerous other messages and
writings on Auroville;
Whereas a Five-Judge Constitution Bench of the Hon’ble Supreme Court of India, in the case of SP
Mittal vs Union of India (1983) 1 SCC 51, in paragraphs numbers 148, 149, 154, 155, 156, 160, 162, 164,
had taken cognizance of the alarming situation in Auroville leading to an acute law and order crisis, held
that the only way to put the “management on the wheels was to take over the management of the institution
by the Government of India.”
Whereas the Auroville Foundation is autonomous body under the Ministry of Human Resource
Development (Department of Higher Education), established by the Auroville Foundation Act 1988
hereinafter referred to as “the Act”;
Whereas as per Section 16(I) of the Act “The Governing Board may appoint such committees as
may be necessary for the efficient discharge of its duties and performance of its functions under this Act”,
Whereas as per Section 32(I) of the Act “Power to make regulations. — (1) The Governing Board
may make regulations, not inconsistent with this Act and the rules made thereunder, for enabling it to
discharge its functions under this Act.”
Whereas as per Section 11(3) of the Act, “The general superintendence, direction and management
of the affairs of the Foundation shall vest in the Governing Board which may exercise all the powers and
discharge all the functions which may be exercised or discharged by the Foundation”;
Whereas as per Section 6(1) of the Act “6. Power of Central Government to direct vesting of the
undertakings in the Foundation.—(1) Notwithstanding anything contained in sections 3 and 4, the Central
Government shall, as soon as may be after the appointed day, direct, by notification, that the undertakings
and the right, title and interest of the Society, trust or body in relation to such undertakings which had
vested in the Central Government under section 3, shall, instead of continuing to vest in the Central
Government, vest in the Foundation either on the date of publication of the notification or on such earlier or
later date as may be specified in the notification”
Whereas as per Section 7(1)(a) of the Act, “The general superintendence, direction, control and
management of the affairs of the undertakings, the right, title and interest in relation to which have vested
in the Central Government under section 3, shall, (a) where a direction has been made by the Central
Government under sub-section (1) of section 6, vest in the Foundation;”
Whereas section 17(e) of the Auroville Foundation Act, empowers and mandates the Governing
Board to prepare, in consultation with the Residents’ Assembly, the Master Plan for the international
cultural township of Auroville (hereinafter referred to as “the Auroville Township”) and ensure its
development as so planned;
Whereas the Governing Board, in terms of Section 17(e) of the Auroville Foundation Act already
approved the Auroville Universal Township Master Plan (Perspective 2025) in 2001, formulated by the
Residents’ Assembly, hereinafter referred to as “the Auroville Master Plan”, which is based on the “Galaxy
Plan”, which was approved by the Mother;
Whereas the above mentioned Auroville Master Plan was approved by the Central Government,
vide Government of India, Ministry of Human Resource Development (Department of Higher Education)
letter No.F.27-3/2000-UU dated 12th April 2001, and was notified by Auroville Foundation, with the
approval of the Central Government, in the Gazette of India (Part III) on 16th August 2010;
Whereas the Auroville Master Plan prescribes the “Town Development Council” as the body for
implementing the Auroville Master Plan with an organizational structure as in Appendix V of the Auroville
Master Plan;
Whereas the Governing Board re-constituted the Auroville Town Development Council
(hereinafter referred to as the “Council”), for the purpose of planning, developing and implementing the
Auroville Township in accordance with its Master Plan, and the Governing Board is empowered to do so as4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
per the powers vested in the Governing Board of the Auroville Foundation, under Sections 16, 32, 11(3)
6(1) and 7(1)(a) and 17 of the Auroville Foundation Act r/w revised Standing Order No. 01/2022 dated
01/06/2022.”
This corrigendum dated 07/12/2022 to the Office Order No. AF/M/63 dated 1st June 2022 is issued
under the direct authority of the Chairman of the Governing Board, Auroville Foundation, and shall come
into force with immediate effect. Needless to state, this shall form part and parcel of the original Office
Order No. AF/M/63 dated 01/06/2022 and shall be treated as one.
