## Report on Extension of the Employees State Insurance Act, 1948
**1. Executive Summary:**
This report analyzes a notification from the Ministry of Labour and Employment, Government of India, extending the provisions of the Employees State Insurance (ESI) Act, 1948 to certain establishments in the National Capital Territory of Delhi. The key finding is that the ESI Act is being extended to cover all casual and contractual employees in establishments employing ten or more persons within specified areas of Delhi, effective August 1st, 2021. This amendment broadens the social security net for vulnerable employees within the Delhi area.
**2. Introduction:**
This report aims to provide a detailed overview of a notification published in the Gazette of India on July 28, 2021, concerning the extension of the Employees State Insurance (ESI) Act, 1948. This analysis is based solely on the provided text of the notification.
**3. Policy Overview:**
* This notification concerns the extension of the existing Employees State Insurance Act, 1948.
* **Core Objective:** The core objective, as inferred from the text, is to extend the social security coverage provided by the ESI Act to a wider range of employees within specific establishments.
**4. Background and Rationale:**
This notification extends the coverage of an existing Act. The reason for extending the coverage to casual and contractual workers is likely due to a need to provide social security benefits to this segment of the workforce, which is often excluded from traditional employer-provided benefits. The "Whereas" clauses indicate that the government previously signaled this intention via a June 7, 2021 notification, sought public input, and received no objections. This suggests a pre-existing understanding and acceptance of the need for this extension.
**5. Key Provisions / Changes:**
This notification represents a change that impacts specific establishments and workers.
* **Specific Part of Original Policy Changed (Inferred):** The amendment expands the *scope* of establishments and employees covered by the ESI Act. While the original policy isn't provided, the text makes it clear that the ESI Act already exists and has defined parameters.
* **New Rule/Provision:** The key new provision is the extension of the ESI Act to "All casual and contractual employees" working in "The following establishments wherein ten or more persons are employed or were employed on any day of the preceding twelve months, namely : Municipal Corporations Council, established under Central State legislation" within "All the areas in the National Capital Territory of Delhi where Employees State Insurance Act, 1948 has already been brought into force under SubSection 3 of Section 1 of the Act."
* **Difference/Effect of Change:** The change now mandates that employers in the specified areas of Delhi must provide ESI benefits to their casual and contractual employees if the establishment has at least 10 employees. Previously, these categories of employees might have been excluded, leaving them without social security coverage for medical benefits, etc.
**6. Target Audience and Stakeholders:**
The primary target audience includes:
* **Employers:** Establishments in the National Capital Territory of Delhi employing ten or more persons, particularly those utilizing casual and contractual labor.
* **Employees:** All casual and contractual employees working in the aforementioned establishments within the specified areas of Delhi.
* **Employees State Insurance Corporation:** The ESIC is a key stakeholder as they are tasked with providing the benefits under this Act.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Ministry of Labour and Employment and the Employees State Insurance Corporation (ESIC) are the responsible bodies for implementing this extension. The ESIC would likely be responsible for registering covered establishments and employees, collecting contributions, and providing benefits.
* **Timelines:** The notification states that the extension is effective from August 1st, 2021.
* **Procedures:** Employers will need to register their establishments with the ESIC and ensure contributions are made for eligible employees. Casual and contractual employees will need to be registered with the ESIC to receive benefits. Further procedural details likely exist in the broader ESI Act framework.
**8. Expected Outcomes / Impact of Changes:**
The intended outcome of this change is to provide social security benefits to casual and contractual employees in the specified establishments in Delhi. This includes access to medical care, sickness benefits, and other benefits provided under the ESI Act. This expansion of coverage aims to improve the well-being and financial security of a vulnerable segment of the workforce. It may also encourage more formal employment practices.
**9. Conclusion:**
The notification extends the provisions of the Employees State Insurance Act, 1948 to cover casual and contractual employees in establishments with ten or more employees within specified areas of the National Capital Territory of Delhi, effective August 1st, 2021. This is a significant expansion of social security coverage that should provide essential benefits to a previously vulnerable population. It is important for affected employers to understand their obligations under this expanded coverage and for eligible employees to register with the ESIC to receive the benefits to which they are now entitled.
