(1) इन िनयम, को (cid:10)ाचीन सं(cid:15)मारक तथा परु ात(cid:21)वीय (cid:15)थल और अवशेष (िवरासत उपिविधया ं और स(cid:30)म (cid:10)ािधकारी के अ+य कृ(cid:21)य, को िवरिचत करना) िनयम, 2018 कहा जाएगा; 27 GI/2019 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) ये उनके शासक(cid:25)य राजप म )(cid:10)कािशत होन ेक(cid:25) तारीख स े(cid:10)वृ8 ह,गे I 2. (cid:10)ाचीन सं(cid:15)मारक तथा परु ात(cid:21)वीय (cid:15)थल और अवशेष (िवरासत उपिविधयां और स(cid:30)म (cid:10)ािधकारी के अ+य कृ(cid:21)य, को िवरिचत करना) िनयम, 2011 (इसम )इसके बाद (cid:10)धान िनयम के -प म) संदDभत) के िनयम 4 म;) (i) उप-िनयम (6) म), “वेबसाइट िवकिसत करेगा” श6द, के बाद, “और ऐसी सूचना वेबसाइट पर उपल6ध करने के िलए (cid:10)ािधकरण को भी (cid:10)दान करेगा” श6द अंतः (cid:15)थािपत (cid:1)कए जाएंग;े और (ii) उप-िनयम (7) म,) “(cid:10)ािधकरण” श6द के बाद, “और महािनदशे क” श6द अंतः (cid:15)थािपत (cid:1)कए जाएंगे I 3. (cid:10)धान िनयम, के, िनयम 20 म,) उप-िनयम (1) म,) “इस (cid:10)कार क(cid:25) जानकारी उपल6ध कराएगा” श6द, के बाद, “और एसी जानकारी वबे साइट पर उपल6ध करने के िलए (cid:10)ािधकरण को भी (cid:10)दान करेगा” श6द अतं ः(cid:15)थािपत (cid:1)कए जाएंगे I 4. (cid:10)धान िनयम, के, िनयम 21 म ): (i) उप-िनयम (1) म,) “पांच वष$” श6द, के (cid:15)थान पर, “दस वष$” श6द (cid:15)थािपत (cid:1)कए जाय)गे; (ii) उप-िनयम (7) के (cid:15)थान पर, िनBिलिखत िनयम (cid:15)थािपत (cid:1)कया जाएगा; “(7) संरि(cid:30)त सं(cid:15)मारक और संरि(cid:30)त (cid:30)े के मानिच ण म ) -परेखाG के रेखाकं न म) (cid:10)(cid:21)यके (cid:30)े , संरचना, रा(cid:15)ते, लHड(cid:15)केप भभु ाग, खुली जगह, वृ(cid:30), अ+य सरं चनाए जसै े तालाब, कुआ, तटबंध, (cid:1)कलेबदं ी, (cid:10)ाचीन संरचनाG के अवशेष और गफु ाG और शैलाKय, के साथ ऐसी अ+य संरचनाए जो वह ठीक समझ,े जो संरि(cid:30)त (cid:30)े के सां(cid:15)कृितक प3रदLृ य के भाग ह,, आ(cid:1)द, को सि(cid:7)मिलत (cid:1)कया जाएगा”; (iii) उप-िनयम (8) के (cid:15)थान पर, िनBिलिखत िनयम (cid:15)थािपत (cid:1)कया जाएगा; “(8) िव(cid:15)तृत (cid:15)थल योजना म )खुली जगह का वत$मान उपयोग सि(cid:7)मिलत (cid:1)कया जाएगा”; (iv) उप-िनयम (9) म,) “और चलिच ” श6द का लोप (cid:1)कया जाएगा I 5. (cid:10)धान िनयम, म,) पहली अनसु चू ी के (cid:15)थान पर, िनBिलिखत को (cid:15)थािपत (cid:1)कया जाएगा, नामतः --- ““““पपपपहहहहललललीीीी अअअअननननससससुुुु चचूूचचूू ीीीी [िनयम 21 (1) दखे )] (cid:3)(cid:3)(cid:3)(cid:3)थथथथलललल ििििवववव(cid:15)(cid:15)(cid:15)(cid:15)ययययाााासससस ततततययैैययैै ाााारररर ककककररररनननन ेे ेेककककेेेे ममममााााननननददददडडंंडडंं :::: संरि(cid:30)त (cid:30)े , (cid:10)ितिषN और िविनयिमत (cid:30)े के िलए (cid:15)थल िव+यास तैयार करन े के दौरान िनBिलिखत मानदडं , का पालन (cid:1)कया जाएगा और उ+ह )सि(cid:7)मिलत (cid:1)कया जाएगा : (i) संरि(cid:30)त (cid:30)े म) ि(cid:15)थत सभी सरं चनाG का मानिच ण; (ii) संरि(cid:30)त (cid:30)े के बाहर, भारतीय पुरात(cid:21)व सव!(cid:30)ण के अधीन (cid:30)े म ) और अिधOिहत (cid:30) े म ) ि(cid:15)थत सभी संरचनाG का मानिच ण; (iii) भारतीय पुरात(cid:21)व सव!(cid:30)ण के अधीन (cid:30)े , सरं ि(cid:30)त (cid:30)े और अिधOिहत (cid:30)े या (cid:15)थानंत3रत (cid:30)े का (cid:15)प: -प से अकं न; (iv) (cid:15)थल िव+यास म) (cid:10)ितिषN और िविनयिमत (cid:30)े ि(cid:15)थत सभी संरचनाG का मानिच ण; (v) अ+य संरचनाए जसै े तालाब, तटबंध, िमPी क(cid:25) (cid:1)कलाबंदी, (cid:10)ाचीन सरं चनाG के अवशेष, आ(cid:1)द को दशान$ ा;¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3 (vi) सड़के और रा(cid:15)ते; (vii) खुला (cid:30)े ; (viii) मलिनकासी पाइप लाइन, एक मीटर स ेQयादा चौडाई वाली बड़ी खुली नाली, नहर), आ(cid:1)द; (ix) जलापूDत लाइन,) जल सरं चानाएं, आ(cid:1)द I” [फा. स ं1/28/2016-एम] उषा शमा,$ महािनदशे क (cid:16)(cid:16)(cid:16)(cid:16)टटटट(cid:18)(cid:18)(cid:18)(cid:18)पपपपणणणणीीीी : (cid:10)धान िनयम (cid:1)दनाकं 23 अग(cid:15)त, 2011 क(cid:25) अिधसचू ना सा.का.िन. 636(अ) के (cid:26)ारा भारत का राजप म ) (cid:10)कािशत >ए थ ेI MINISTRY OF CULTURE (ARCHAEOLOGICAL SURVEY OF INDIA) NOTIFICATION New Delhi, the 27th December, 2018 G.S.R. 3(E).—Whereas draft rules to amend the Ancient Monuments and Archaeological Sites and Remains (Framing of Heritage Bye-laws and Other Functions of the Competent Authority) Rules, 2011 were published vide Notification of the Government of India, Ministry of Culture (Archaeological Survey of India), number G.S.R. 322(E) dated 21st March, 2018 in the Gazette of India, Part-II, Section 3, Sub-section (i) as required by sub-section (1) of section 38 of the Ancient Monuments and Archaeological Sites and Remains Act, 1958 (24 of 1958) inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which the copies of the said Gazette notification are made available to the public; And whereas, the said Gazette was made available to the public on 2nd April, 2018; And whereas, no objections or suggestions were received from any person before the date so specified; Now, therefore, in exercise of the powers conferred by clauses (cb), (cc), (cd) and (ce) of sub-section 2 of section 38 of the Ancient Monuments and Archaeological Sites and Remains Act, 1958 (24 of 1958), the Central Government hereby makes the following rules to amend the Ancient Monuments and Archaeological Sites and Remains (Framing of Heritage Bye-laws and Other Functions of the Competent Authority) Rules, 2011, 1. (1) These Rules may be called the Ancient Monuments and Archaeological Sites and Remains (Framing of Heritage Bye-laws and Other Functions of the Competent Authority) Amendments Rules, 2018. (2) They shall come into the force on the date of their publication in the Official Gazette. 2. In rule 4 of the Ancient Monuments and Archaeological Sites and Remains (Framing of Heritage Bye-laws and other Functions of the Competent Authority) Rules, 2011 (hereinafter referred to as the principal rules),- (i) in the sub-rule (6), after the words “publish its activities”, the words “and provide such information to the Authority for hosting the same on its website” shall be inserted; and (ii) in the sub-rule (7), after the words “interaction with the Authority”, the words “and the Director-General” shall be inserted. 3. In the principal rules, in rule 20, in the sub-rule (1), for the words “Director General, Archaeological Survey of India”, the words “Director General and the Authority” shall be substituted. 4. In the principal rules, in rule 21,- (i) in the sub-rule (1), for the words “five years”, the words “ten years” shall be substituted; (ii) for sub-rule (7), the following sub-rule shall be substituted, namely:- “(7) The mapping of protected monument and protected area shall comprise of plan and section of each structure, pathways, landscaped area, open spaces, trees, other features like tank, well, embankments,4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] fortifications, remnants of ancient structures and such other features including caves and rock-shelters as may be deemed fit that form part of cultural landscape of the protected area.”; (iii) for sub-rule (8), the following sub-rule shall be substituted, namely:- “(8) The open space in the detailed site plan shall indicate present usage of area.”; (iv) in the sub-rule (9), the words “and video” shall be omitted. 5. In the principal rules, for the First Schedule, the following shall be substituted, namely:- “FIRST SCHEDULE [See rule 21(1)] Parameters for preparation of site plans : While preparing a site plan for the protected area, prohibited and regulated areas, the following parameters shall be adhered to and incorporated: (i) mapping of all structures in the protected area; (ii) mapping of all structures in the area under control of the Archaeological Survey of India and acquired area; and structures outside the protected area; (iii) clearly indicating protected area and area acquired or transferred to Archaeological Survey of India; (iv) mapping of all structures in prohibited and regulated area on plan; (v) other features like tank, embankment, mud fortification, remnants of ancient structures, etc., be shown; (vi) roads and pathways; (vii) open area; (viii) sewerage pipe lines, big open drains with more than one meter width, canals, etc.; (ix) water supply lines, water works, etc.” [F.No.1/28/2016-M] USHA SHARMA, Director General Note : The principal rules were published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (1), vide notification number G.S.
