जब(cid:4)क रा@पित न े सिं वधान के अनुAछेद 77 के खंड (3) >ारा (cid:27)दH शि0य4 को (cid:27)योग करत े Iए भारत सरकार (काय (cid:23) का आवटं न) तीन सौ और पचासवा ं संशोधन िनयम, 2019 बनाया और एक नया मं!ालय अथा(cid:23)त " जल शि0 मं!ालय सृिजत (cid:4)कया िजसको अKय बात4 के साथ-साथ, जल ससं ाधन, नदी िवकास और गंगा सरं :ण स े संबिं धत उन िवषय4 का आवंटन (cid:4)कया िजKह ेउ0 मं!ालय >ारा (cid:27)शािसत (cid:4)कया जाए ; और जब(cid:4)क, जल शि0 मं!ालय के सृजन के पLरणाम-वMप, क(cid:15)(cid:16)ीय सरकार >ारा उ0 अिधसूचना म (cid:15) और उसम (cid:15) अंतNव(cid:23)O गंगा नदी ( संर:ण, सरु :ा और (cid:27)बंधन) (cid:27)ािधकरण आदशे , 2016 म (cid:15)आवPयक पLरणामी संशोधन करने का िविन&य िलया गया ह ै; 4537 GI/2019 (1)THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अतः, अब, पया(cid:23)वरण (संर:ण) अिधिनयम, 1986 (1986 के 29) क(cid:30) धारा 3 क(cid:30) उप-धारा (2) और उपधारा (3) >ारा (cid:27)दH शि0य4 का (cid:27)योग करते Iए क(cid:15)(cid:16)ीय सरकार उ0 अिधसूचना म (cid:15) िनVिलिखत संशोधन करती ह ै और उसम (cid:15) अतं Nव(cid:23)O गंगा नदी (संर:ण, सरु :ा और (cid:27)बंधन) (cid:27)ािधकरण के आदशे , 2016 का और संशोधन करती ह,ै अथा(cid:23)त ; 1. संि:# नाम और (cid:27)ारंभ –– (1) इस आदेश का सिं :# नाम गंगा नदी ( सरं :ण, सुर:ा और (cid:27)बंधन) (cid:27)ािधकरण (दसू रा संशोधन) आदशे , 2019 ह ै। (2) यह, राजप! म,(cid:15) इसके (cid:27)काशन क(cid:30) तारीख को (cid:27)वHृ होगा। 2. उ0 अिधसूचना म,(cid:15) “जल संसाधन, नदी िवकास और गंगा संर:ण मं!ालय” शीषक(cid:23) के -थान पर “जल शि0 मं!ालय” शीषक(cid:23) रखा जाएगा। 3. गंगा नदी (सरं :ण, सरु :ा और (cid:27)बंधन) (cid:27)ािधकरण आदशे , 2016 म (cid:15)(िजसे इसम ेइसके प&ात उ0 आदशे कहा गया ह)ै , (cid:27)-तावना के अब, पया(cid:23)वरण (संर:ण) अिधिनयम, 1986 (1986 का 29) (इसके बाद उ0 अिधिनयम कहा गया ह)ै क(cid:30) धारा 3 तथा 4,5,9, 10, 11,19,20 और 23 क(cid:30) उपधारा (2) तथा (3) के अनुAछेद (i), (ii), (v), (vii), (viii), (ix), (x), (xii) तथा (xiii) के साथ उपधारा (i) >ारा दी गयी शि0य4 के (cid:27)योग करते Iए शXद4 के साथ (cid:27)ार(cid:12)भ होन ेवाले ह ैतथा “क(cid:15)(cid:16)ीय सरकार एतद>ारा” शXद4 के साथ समा# होन ेवाले पैरा म(cid:15) "जल संसाधन मं!ालय" शXद4 के -थान पर , "त8कालीन जल ससं ाधन मं!ालय" शXद रखे जाएंगे। 4. उ0 आदशे के परै ा 12 म,(cid:15) (क) उप-पैरा (1) के -थान पर िनVिलिखत रखा जाएगा: (1) रा@ीय गंगा पLरषद म (cid:15)िनVिलिखत सद-य ह4गे : क) (cid:27)धान मं!ी -अYय:, पदने ; And whereas, to achieve the aforesaid objective, the Central Governmentdecided to constitute various authorities at Central, State and District levels; And whereas, vide notification number S.O. 3187 (E), dated the 7th October, 2016 published in the Gazette of India, Part II, Section 3, Sub-section (ii), dated the 7th October, 2016, the Government of India in the erstwhile Ministry of Water Resources, River Development and Ganga Rejuvenation made the River Ganga (Rejuvenation, Protection and Management) Authorities Order, 2016; And whereas, in exercise of the Powers conferred by clause (3) of article 77 of the Constitution, the President made the Government of India (Allocation of Business) Three Hundred and Fiftieth Amendment Rules, 2019 and created a new Ministry, namely “Ministry of Jal Shakti (Jal Shakti (Mantralaya), inter alia,THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] allocating the subject matters relating to water resources, river development and Ganga rejuvenation to be administered by the said Ministry; And whereas, consequent upon the creation of the Ministry of Jal Shakti, it has been decided by the Central Government to make necessary consequential amendments in the said notification and in the River Ganga (Rejuvenation, Protection and Management) Authorities Order, 2016contained therein; Now, therefore, in exercise of the powers conferred by sub-sections (2) and (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby makes the following amendments in the said notification and furtheramendments in the River Ganga (Rejuvenation, Protection and Management) Authorities Order, 2016 contained therein, namely:–– 1. Short title and commencement.—(1) This Order may be called the River Ganga (Rejuvenation, Protection and Management) Authorities (Second Amendment) Order, 2019. (2) It shall come into force on the date of its publication in the Official Gazette. 2. In the said notification, for the heading “MINISTRY OF WATER RESOUCES, RIVER DEVELOPMENT, AND GANGA REJUVENATION”, the heading “THE MINISTRY OF JAL SHAKTI” shall be substituted. 3. In the River Ganga (Rejuvenation, Protection and Management) Authorities Order, 2016 (hereinafter referred to as the said Order), in the preamble, in the paragraph beginning with the words “Now, therefore, in exercise of the powers” and ending with the words “the Central Government hereby”, for the words “Ministry of Water Resources”, the words “erstwhile Ministry of Water Resource” shall be substituted. 4. In the said Order, in paragraph 12,–– (a) for sub-paragraph (1), the following shall be substituted, namely: –– “(1) The National Ganga Council shall consist of the following members, namely:–– (a) Prime Minister Chairperson, ex-officio; (b) Union Minister for Jal Shakti -Vice-Chairperson, ex-officio; (c) Union Minister for Environment, Forests and Climate -Member, ex-officio; Change (d) Union Minister for Finance -Member, ex-officio; (e) Union Minister for Housing and Urban Affairs -Member, ex-officio; (f) Union Minister for Power -Member, ex-officio; (g) Union Minister for Science and Technology -Member, ex-officio; (h) Union Minister for Rural Development -Member, ex-officio; (i) Union Minister for Shipping -Member, ex-officio; (j) Union Minister of State for Tourism -Member, ex-officio; (k) Vice Chairman, NITI Aayog -Member, ex-officio; (l) Chief Minister, Bihar -Member, ex-officio; (m) Chief Minister, Jharkhand -Member, ex-officio; (n) Chief Minister, Uttarakhand -Member, ex-officio; (o) Chief Minister, Uttar Pradesh -Member, ex-officio; (p) Chief Minister, West Bengal -Member, ex-officio; (q) Secretary, Department of Water Resources, River -Member ,ex-officio; Development and Ganga Rejuvenation (r) Secretary, Department of Drinking Water & Sanitation -Member, ex-officio;¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 (s) Secretary, Ministry of Housing and Urban Affairs -Member,ex-officio; (t) Secretary, Department of Agriculture and Farmers’ Welfare -Member,ex-officio; (u) Director General, National Mission for Clean Ganga -Member Secretary, ex-officio.”. (b) in sub-paragraph (7), for the words “the Ministry of Water Resources, River Development and Ganga Rejuvenation”, the words “the Ministry of Jal Shakti” shall be substituted. 5. In the said Order, in paragraph 17,–– (a) in sub-paragraph (2), for items (a), (b) and (c) and the entries relating thereto, the following shall be substituted, namely:–– “(a) Union Minister for Jal Shakti -Chairperson, ex-officio; (b) Union Minister of State for Jal Shakti -Vice-Chairperson, ex-officio (c) Secretary, Department of Water Resources, River -Member, ex-officio;”; Development and Ganga Rejuvenation (b) in sub-paragraph (5), for the words “the Ministry of Water Resources, River Development and Ganga Rejuvenation”, the words and brackets “the Ministry of Jal Shakti (Department of Water Resources, River Development and Ganga Rejuvenation)” shall be substituted. 6. In the said Order, in paragraph 35, in sub-paragraph (1), for items (b) and (c) and the entries relating thereto, the following shall be substituted, namely–– “(b) Joint Secretary, Department of Water -Member, ex-officio Resources, River Development and Ganga Rejuvenation (c) Joint Secretary, Ministry of Housing and Urban Affairs -Member, ex-officio”. 7. In the said Order, in paragraph 60, for the words “the Ministry of Water Resources, River Development and Ganga Rejuvenation”, the words “the Department of Water Resources, River Development and Ganga Rejuvenation” shall be substituted.
