और के(cid:7008)(cid:7076)ीय सरकार ने औषिध और (cid:7079)साधन साम(cid:7061)ी अिधिनयम, 1940(1940 का 23) क(cid:7409) धारा 26ख (cid:7367)ारा (cid:7079)द(cid:7275) शि(cid:7334)य(cid:7298) का (cid:7079)योग करते (cid:7263)ए, भारत के राजप(cid:7074), असाधारण, भाग II, खंड 3, उपखंड (i) म(cid:7286) (cid:7079)कािशत अिधसूचना सं(cid:6990)यांक सा.का.िन. 677(अ), तारीख 15 िसत(cid:7013)बर, 2009 (cid:7367)ारा यह िनदशे (cid:7408)दया था (cid:7408)क कोई (cid:7390)ि(cid:7334) ‘ओसेलटािमवीर फासफेट’ और ‘जनिमवीर’ औषिध वाली (cid:7408)कसी िन(cid:7414)मित का, उ(cid:7334) अिधसूचना म(cid:7286) िविन(cid:7416)द(cid:7397) रीित के िसवाय, िव(cid:7059)य या िवतरण के िलए िविनमा(cid:6981)ण नह(cid:7277) करेगा या उसका िव(cid:7059)य या (cid:7021)टाक नह(cid:7277) करेगा या िव(cid:7059)य के िलए सं(cid:7079)द(cid:7414)शत या (cid:7079)(cid:7021)थािपत नह(cid:7277) करेगा या िवत(cid:7407)रत नह(cid:7277) करेगा; और औषिध तकनीक(cid:7409) सलाहकार बोड (cid:6981) न े औषिध और (cid:7079)साधन साम(cid:7061)ी िनयम, 1945 क(cid:7409) अनुसूची भ म(cid:7286) िन(cid:7416)द(cid:7397) औषिधय(cid:7298) के सम(cid:7272)प ‘ओसेलटािमवीर फासफेट’ और ‘जनिमवीर’ औषिधय(cid:7298) के िव(cid:7059)य को िनब(cid:7304)िधत करन े के (cid:7079)(cid:7396) पर तारीख 15 नव(cid:7013)बर, 2016 को िवचार (cid:7408)कया और यह िसफा(cid:7407)रश क(cid:7409) (cid:7408)क तारीख 15 िसत(cid:7013)बर, 2009 क(cid:7409) अिधसूचना सा. का. िन. 677(अ) वापस ले ली जाएगी और उ(cid:7334) औषिधय(cid:7298) को उ(cid:7334) िनयम(cid:7298) क(cid:7409) अनुसूची ज1 म (cid:7286) िन(cid:7416)द(cid:7397) औषिधय(cid:7298) के समान िव(cid:7059)य के िलए अनु(cid:6980)ात (cid:7408)कया जाएगा; (ख) उ(cid:7334) अिधिनयम के अधीन बनाए गए औषिध और (cid:7079)साधन साम(cid:7061)ी िनयम, 1945 म(cid:7286) उन िनयम(cid:7298) क(cid:7409) अनुसूची ज1 म (cid:7286) िविन(cid:7416)द(cid:7397) औषिधय(cid:7298) क(cid:7409) बाबत िविन(cid:7416)द(cid:7397) शत(cid:7288) ‘ओसेलटािमवीर फासफेट’ और ‘जनिमवीर’ औषिधय(cid:7298) या उन पर आधा(cid:7407)रत (cid:7408)कसी िन(cid:7414)मित को लागू ह(cid:7298)गी: पर(cid:7008)तु औषध िनयं(cid:7074)क(भारत) ‘ओसेलटािमवीर फासफेट’ और ‘जनिमवीर’ औषिध या उन पर आधा(cid:7407)रत (cid:7408)कसी िविन(cid:7414)मित का िनया(cid:6981)त, उन कारण(cid:7298) से, जो लेखब(cid:7373) (cid:7408)कए जाए ं और के(cid:7008)(cid:7076)ीय सरकार के परामश(cid:6981) स े अनु(cid:6980)ात कर सकेगा; (ग) ‘ओसेलटािमवीर फासफेट’ और ‘जनिमवीर’ औषिध या उन पर आधा(cid:7407)रत (cid:7408)कसी िविन(cid:7414)मित का (cid:7079)(cid:7004)येक िविनमा(cid:6981)ता, औषध िनयं(cid:7074)क (भारत) को एक ऐसी मािसक िववरणी (cid:7079)(cid:7021)तुत करेगा, िजसम(cid:7286) उनके (cid:7367)ारा िवतरक(cid:7298), (cid:7021)टा(cid:7408)क(cid:7021)ट(cid:7298), (cid:7390)वहा(cid:7407)रय(cid:7298) को (cid:7079)(cid:7004)येक मास के अंत तक (cid:7079)दाय क(cid:7409) गई ऐसी औषिधय(cid:7298) क(cid:7409) मा(cid:7074)ा अंत(cid:7414)व(cid:7397) हो । (घ) ऐसा (cid:7079)(cid:7004)येक िवतरक, (cid:7021)टा(cid:7408)क(cid:7021)ट और (cid:7390)वहारी, जो ‘ओसेलटािमवीर फासफेट’ और ‘जनिमवीर’ औषिध या उन पर आधा(cid:7407)रत (cid:7408)कसी िविन(cid:7414)मित का (cid:7021)टाक रखता ह,ै यथाि(cid:7021)थित, रा(cid:6996)य या संघ-रा(cid:6996)य(cid:6979)े(cid:7074) म(cid:7286) संबंिधत अनु(cid:6980)ापन (cid:7079)ािधकारी को ऐसी मािसक िववरणी (cid:7079)(cid:7021)ततु करेगा, िजसम(cid:7286) (cid:7079)(cid:7004)येक मास के अंत तक उनके पास उपल(cid:7011)ध ऐसी ओषिधय(cid:7298) क(cid:7409) मा(cid:7074)ा अंत(cid:7414)व(cid:7397) हो; 2. यह अिधसूचना राजप(cid:7074) म(cid:7286) इसके (cid:7079)काशन क(cid:7409) तारीख से (cid:7079)वृ(cid:7275) होगी । [फा. सं. ए(cid:6989)स.11014/10/2016-डी.आर.एस.] कु(cid:7008)दन लाल शमा(cid:6981),संयु(cid:7334) सिचव (cid:7407)ट(cid:7009)पण: मूल अिधसूचना, भारत के राजप(cid:7074), असाधारण, भाग II, खंड 3, उपखंड (i) म(cid:7286) अिधसूचना सं(cid:6990)यांक सा. का.िन. 677(अ), तारीख 15 िसत(cid:7013)बर, 2009 (cid:7367)ारा (cid:7079)कािशत क(cid:7409) गई थी । MINISTRY OF HEALTH AND FAMILY WELFARE (Department of Health and Family Welfare) NOTIFICATION New Delhi, the 17th February, 2017 G.S.R. 144(E).—Whereas the Central Government was satisfied that the drugs ‘Oseltamivir Phosphate’ and ‘Zanamivir’ were essential to meet the requirements of emergency arising due to epidemic and in public interest, and it was necessary and expedient to regulate and restrict the manufacture, sale and distribution of the said drugs and preparations based thereon for preventing their misuse;¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3 And Whereas the Central Government in exercise of the powers conferred by section 26B of the Drugs and Cosmetics Act, 1940 (23 of 1940), (cid:118)(cid:100)(cid:105)(cid:101) notification published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), number G.S.R. 677(E), dated the 15th September, 2009, directed that no person shall manufacture for sale or distribution, or sell or stock, or exhibit or offer for sale, or distribute any preparation containing the drug ‘Oseltamivir Phosphate’ or ‘Zanamivir’ except in the manner specified in the said notification; And Whereas, the Drugs Technical Advisory Board considered the issue of restriction of sale of the drugs ‘Oseltamivir Phosphate’ and ‘Zanamivir’ similar to the drugs referred to in the Schedule X of the Drugs and Cosmetics Rules, 1945 on 15th November, 2016 and recommended that the notification G.S.R. 677(E), dated the 15th September, 2009 shall be withdrawn and the said drugs be permitted for sale similar to the drugs referred to in the Schedule H1 of the said rules; Now, therefore, in exercise of the powers conferred by section 26B of the Drugs and Cosmetics Act, 1940 (23 of 1940) and on the basis of the recommendations of the Drugs Technical Advisory Board, the Central Government hereby and in supersession of the notification of the Government of India, Ministry of Health and Family Welfare (Department of Health) published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide number G.S.R. 677(E) dated the 15th September, 2009 except as respects things done or omitted to be done before such supersession directs that no person shall manufacture for sale or for distribution or sale or stock or exhibit or offer for sale or distribute any preparation containing the drug ‘Oseltamivir Phosphate’ or ‘Zanamivir’ except in the following manner, namely:- (a)(cid:32) no person shall himself or by any other person on his behalf manufacture for sale or for distribution without the prior approval in writing from the Drugs Controller General (India). (b)(cid:32) the conditions specified in the Drugs and Cosmetics Rules, 1945 in respect of the drugs specified under Schedule H1 to that rules shall apply to the drugs ‘Oseltamivir Phosphate’ and ‘Zanamivir‘ or any preparation based thereon. Provided that the Drugs Controller General (India) may allow export of the drug ‘Oseltamivir Phosphate’ and ‘Zanamivir’ or any preparation based thereon for reasons to be recorded in writing and in consultation with the Central Government. (c)(cid:32) every manufacturer of the drug ‘Oseltamivir Phosphate’ and ‘Zanamivir’ or any preparation based thereon shall submit to the Drugs Controller General (India) a monthly statement, containing therein the quantity of such drugs supplied by them to distributors, stockists, dealers by the end of every month. (d)(cid:32) every distributor, stockist and dealer holding stocks of ‘Oseltamivir Phosphate’ and ‘Zanamivir’ or any preparation based thereon shall submit to the concerned licensing authority in the State or Union territory, as the case may be, a monthly statement, containing therein the quantity of such drugs available with them, by the end of every month. 2.
