"अल्कोहाजलक पीने के जलए तैयार पेय " का अथा ह ै सुवासयुि पेय पिाथा जिनमें 0.5 से 15.0% तक अल्कोहल की मात्रा होती ह,ै िो जस्ट्पररट या जस्ट्पररट के जमश्रण या ककसी भी अल्कोहाजलक पेय को आधार के रूप में प्राकृजतक या समान प्रकृजत वाले या कृजत्रम सुवास और खाद्य सुरक्षा और मानक (खाद्य उत्पाि मानक और सहयोज्य) जवजनयम, 2011 के अधीन अनुमत खाद्य सहयोिकों, या उनके संयोिन, और फल या सब्िी के रस या िडी-बूरटयों या मसालों, या उनके संयोिन को जमलाकर, चीनी या कैलोरीयिु मीठाकारक या नमक से या उसके जबना, और काबोनेिन करके या उसके जबना बनाए िाते ह।ैं काबोनेटेड अल्कोहाजलक पीने के जलए तैयार पेय पिाथों के मामल े में उन्ह ें काबान डाइऑक्साइड के साथ काबोनेट ककया िाए, जिसमें काबान डाइऑक्साइड की न्यूनतम एक मात्रा होगी और वह सारणी -4 की आवश्यकताओं के अनुरूप होगी। (ख) जवजनयम 1.3 म,ें उप-जवजनयम 1.3.9 म,ें परंतुक के पश्चात, " 8.0 प्रजत ित स े अनजधक एल्कोहजलक वाल े एल्कोहलीय पेय" से िरूु होन ेवाले और "सारणी-4 की अपेक्षाओं के अनरूु प हों" के साथ समाप्त होने वाले िब्िों के स्ट्थान पर जनम्नजलजखत िब्ि रखें िायेंगे, अथाात्¬ - 0.5 प्रजतित एबीवी से 15.0 प्रजतित एबीवी तक युि अल्कोहाजलक पेय को अल्कोहजलक पीन े के जलए तैयार पेय कहा िाएगा और यह जवजनयम 1.2 के अधीन उपबंजधत पररभाषा और सारणी -4 की आवश्यकताओं के अनुरूप होगा। (2) भाग 2 म,ें जवजनयम 2.2 के स्ट्थान पर जनम्नजलजखत जवजनयमन प्रजतस्ट्थाजपत ककया िाएगा, अथाात्: - "2.2 ििे ी िराब या भारतीय िराब: ििे ी िराब या भारतीय िराब या जस्ट्पररट कृजष स्त्रोतों के ककन्वीय काबोहाइड्रेट के आसवन से प्राप्त अल्कोहाजलक पेय पिाथ ा ह।ैं िेिी िराब या भारत म ें जनर्मात िराब जनम्नजलजखत प्रकार की भी हो सकती ह,ैं अथाात्: - 2.2.1 साधारण िेिी िराब या साधारण भारतीय िराब: साधारण िेिी िराब या साधारण भारतीय िराब ककजण्वत गुड, गडु , अनाि का मैि, आल,ू कसावा, फल, नाररयल और ताड के पेडों का रस या अका, महुआ के फूल या कृजष स्त्रोतों के ककसी अन्य काबोहाइड्रेट से प्राप्त अल्कोहाजलक आसव (जडजस्ट्टलेट) से बनाई िाए। 2.2.2 सजमजश्रत िेिी िराब या सजमजश्रत भारतीय िराब: सजमजश्रत िेिी िराब या सजमजश्रत भारतीय िराब एक अल्कोहाजलक आसव, पररिोजधत जस्ट्पररट या न्यूरल जस्ट्पररट का सजमश्रण ह।ै[भाग III—खण्‍ड 4] भारत का रािपत्र : असाधारण 3 नोट: िेिी िराब या भारतीय िराब भाग 1 म ें जनर्िष्टा सामान्य अपेक्षाओं और सारणी - 1 म ेंजवजनर्िाष्ट अपेक्षाओं के अनुरूप हो। उत्पाि का नाम और ऐसे उत्पािों के जलए संघटक या कच्ची सामजियााँ इन जवजनयमों के अनुलग्नक-1 में जनर्िष्टा ह ैं और व े संपूणा नहीं ह।ैं " (3) भाग-3 म,ें जवजनयम 3.1 म,ें - (क) उप-जवजनयम 3.1.4 म,ें - (i) " अंगरू ों से जभन्न अन्य फलों की वाईन " िीषाक के जलए, जनम्नजलजखत िीषाक रखा िायेगा, अथाात:् - "फ्रूट वाइन (अगं ूर से बनी वाइन के जसवाय) िहि से बनी वाइन सजहत"; (ii) खंड 3.1.4.3 के पश्चात, जनम्नजलजखत खडं अंतःस्ट्थाजपत ककया िाए, अथाात:् - "3.1.4.4 िहि की वाइन या मीड: िहि की वाइन या मीड िहि के िलीय घोल के खमीर द्वारा ककण्वन से उत्पाकित एक वाइन ह,ै जिसमें ककसी अन्य काबोहाइड्रेट स्रोत को नहीं जमलाया िाता ह।ै इसमें िडी-बूरटयााँ, मसाले या प्राकृजतक सुवास हो सकते ह ैं और जसवाय एजथल अल्कोहल के य े सारणी -2 के अधीन उपबंजधत अपेक्षाओं के अनुरूप होन े चाजहए, िो 4% स े 15.5% के बीच होगी" (ख) उप-जवजनयम 3.1.5 म,ें "रस" िब्ि के पश्चात, "या साबुत अनाि" िब्ि अतं ःस्ट्थाजपत ककए िायेंगे; (ग) उप-जवजनयम 3.1.6 म,ें " उपयोग की िाने वाली खुराक को छोडकर" िब्िों के पश्चात, "वाइन आधाररत पेय काबोनेटेड हो भी सकते ह ैंऔर नहीं भी" िब्ि अंतःस्ट्थाजपत ककए िायेंगे।" (4) भाग 4 म,ें जवजनयम 4.2 म,ें उप-जवजनयम 4.2 (1) के पश्चात, जनम्नजलजखत उप-जवजनयमन डाला िाएगा, अथाात:् - "4.2 (1) (i) नाइरो क्राफ्ट बीयर- नाइरो क्राफ्ट बीयर क्राफ्ट बीयर ह ै जिसमें CO2 और N2 गैस का जमश्रण होता ह।ै " (5) (1) सारणी -1 म,ें - (क) स्ट्तंभ 5 में िीषाक के स्ट्थान पर जनम्नजलजखत िीषाक रखा िायेगा, अथाात:् - "िेिी िराब, भारतीय िराब, साधारण िेिी िराब या साधारण भारतीय िराब"; (ख) स्ट्तंभ 6 में िीषाक के स्ट्थान पर जनम्नजलजखत िीषाक रखा िायेगा, अथाात:् - "सजममजश्रत िेिी िराब या सजममजश्रत भारतीय िराब"; (ग) पािलेख म ें "कम अल्कोहाल वाल े पेयों" िब्िों के स्ट्थान पर, "पीने के जलए तैयार अल्कोहाजलक पेय" िब्ि रख े िायेंगे; (6) सारणी -2 म,ें - (क) स्ट्तंभ 7 म,ें िीषाक म,ें "फ्रूट वाइन (अंगरू वाइन के अलावा फलों की वाइन)" िब्िों के पश्चात, "िहि से बनी वाइन सजहत" िब्ि अंतःस्ट्थाजपत ककए िायेंग;े (ख) पािलेख में, "के जलए" िब्िों के स्ट्थान पर, "जविेषता को छोडकर" िब्ि रख ेिायेंगे। (7) सारणी -3 म,ें - (क) स्ट्तंभ 2 म,ें4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (i) क्रमांक संखया 3 के सामने, "काबान डाइऑक्साइड, v/v, न्यूनतम" िब्िों के स्ट्थान पर, "CO2 या CO2 और N2 गैस का जमश्रण, v/v, न्यूनतम***" िब्ि रखे िायेंग;े (ii) क्रमांक संखया 10 के सामन,े "टोटल प्लेट काउंट, cfu प्रजत जम. जल" िब्िों के स्ट्थान पर, " टोटल प्लेट काउंट, सी. एफ. य ू प्रजत जम. जल ****" िब्ि रख ेिायेंगे। (ख) स्ट्तंभ (7) के पश्चात, जनम्नजलजखत स्ट्तंभ अंतःस्ट्थाजपत ककया िाए, अथाात:् क्राफ्ट बीयर स्ट्रांग (8) 5.0 से लेकर 8.0 तक 3.3-4.8 1.8-3.6 50.0 2.0 5.0 0.2 0.25 0.1 <100 अनुपजस्ट्थत अनुपजस्ट्थत * (ग) जवद्यमान पािलेखों के पश्चात, जनम्नजलजखत पािलेख अतं ःस्ट्थाजपत ककए िायगें े, अथाात्: - "*** CO2 और N2 गैस का जमश्रण क्राफ्ट बीयर के जलए लागू ह।ै **** इसम ें ब्रुअर का खमीर सजममजलत नहीं ह।ै " (8) सारणी 4 म,ें -[भाग III—खण्‍ड 4] भारत का रािपत्र : असाधारण 5 (क) मौिूिा िीषाक के स्ट्थान पर, "अल्कोहाजलक पीन े के जलए तैयार पेय पिाथों के जलए आवश्यकताएाँ" िीषाक प्रजतस्ट्थाजपत ककया िायेगा; (ख) क्रमांक संखया 1 के सामने, स्ट्तंभ (3) म,ें प्रजवजष्ट '>0.5 स े 8.0' के स्ट्थान पर, प्रजवजष्ट '>0.5 स े <15.0' प्रजतस्ट्थाजपत की िाए। (9) सारणी 4 के पश्चात, जनम्नजलजखत उपाबंध अंतःस्ट्थाजपत ककया िायेगा, अथाात:् - " उपाबधं -1 सारणी I: भारतीय िराब की सूची (आसुत िराब) क्रम संखया अल्कोहाजलक उत्पाि कच्ची सामिी और स्ट्टाटार अनुपालन के जलए उत्पाि श्रणे ी 1 अछम चावल, चमरी सारणी 1 (5) 2 अका अथवा आरा िौ, सेब, िगं ली खुबानी सारणी 1 (5) 3 अराक अथवा होर-अलंक चावल, थाप सारणी 1 (5) 4 आरा अनाि, पा, पी सारणी 1 (5) 5 बासी चावल सारणी 1 (5) 6 बट्टा सराय जविुद्ध आसुत िराब; No. STD/SP-21/T(Alcohol-6).- Whereas the draft Food Safety and Standards (Alcoholic Beverages) Amendment Regulations, 2023 were published as required by sub-section (1) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006), vide notification of the Food Safety and Standards Authority of India number, F. No. STD/SP-21/T(Alcohol-6), dated the 11th May, 2023, in the Gazette of India, Extraordinary, Part III, Section 4, inviting objections and suggestions from the persons likely to be affected thereby, before the expiry of the period of sixty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public; And whereas, the copies of the said Gazette were made available to the public on the 19th May, 2023; And whereas, objections and suggestions received from the public in respect of the said draft regulations have been considered by the Food Safety and Standards Authority of India; Now, therefore, in exercise of the powers conferred by clause (v) of sub-section (2) of section 92 of the said Act, the Food Safety and Standards Authority of India hereby makes the following regulations further to amend the Food Safety and Standards (Alcoholic Beverages) Regulations, 2018, namely: - 1. These regulations may be called the Food Safety and Standards (Alcoholic Beverages) first Amendment Regulations, 2025. 2. They shall come into force on 01st January, 2026. 3. In the Food Safety and Standards (Alcoholic Beverages) Regulations, 2018, – (1) in PART-1, (a) in regulation 1.2 relating to ‘Definitions’, after sub-regulation 1.2.4, the following shall be inserted, namely: - ‘1.2.4a. “alcoholic ready-to–drink beverages” means, flavored beverages having more than 0.5 and up to 15.0% of alcohol by volume, made from spirit or the mixture of spirit or any alcoholic beverage as base by adding natural or nature identical or artificial flavors and food additives permitted under the Food Safety and Standards (Food Product Standards and Food Additives) Regulations, 2011, or a combination thereof, and fruit or vegetable juice or herbs or spices, or a combination thereof, with or without added sugar or caloric sweeteners or salt and with or without carbonation. In case of carbonated alcoholic ready-to-drink beverages, they shall be carbonated with carbon dioxide, which shall have a minimum of one volume of carbon dioxide and shall conform to the requirements of TABLE-4.]’. (b) in regulation 1.3, in sub-regulation 1.3.9, after the proviso, for the words beginning with “Alcoholic beverage containing” and ending with “the requirements of TABLE-4”, the following shall be substituted, namely: - “Alcoholic beverage containing more than 0.5 per cent abv and up to 15.0 per cent abv shall be called as Alcoholic ready-to–drink beverage and it shall conform to the definition provided under regulation 1.2 and the requirements of TABLE-4,”; (2) in PART 2, for regulation 2.2, the following regulation shall be substituted, namely: - “2.2 Country liquors or Indian Liquors: Country liquors or Indian Liquors or spirits are alcoholic beverages obtained from distillation of fermentable carbohydrates of agricultural origin. Country liquors or Indian made Liquors may also be of the following types, namely: - 2.2.1 Plain country liquor or Plain Indian liquor: Plain country liquor or Plain Indian liquor shall be made from alcoholic distillate obtained from fermented molasses, jaggery (Gur), mash of cereals, potato, cassava, fruits, juice or sap of coconut and palm trees, mahua flowers or any other carbohydrates of agricultural origin. 2.2.2 Blended country liquor or Blended Indian liquor: Blended country liquor or Blended Indian liquor is a blend of an alcoholic distillate, rectified spirit or neutral spirit. Note: Country liquor or Indian liquor shall also conform to the general requirement specified in PART 1 and requirements specified in TABLE – 1. Product name and ingredients or raw materials for such products are specified in Annexure-1 of these regulations and the same are not exhaustive.”.[भाग III—खण्‍ड 4] भारत का रािपत्र : असाधारण 9 (3) in PART-3, in regulation 3.1, - (a) in sub-regulation 3.1.4, - (i) for the heading “Wine from fruits other than grapes”, the following heading shall be substituted, namely: - “Fruit Wine (other than grape wine) along with Honey wine”; (ii) after clause 3.1.4.3, the following clause shall be inserted, namely: - “3.1.4.4 Honey wine or Mead: Honey wine or Mead is a wine produced from the fermentation of an aqueous solution of honey by yeasts without addition of any other carbohydrate source. It may contain herbs, spices or natural flavourings and shall conform to the requirements provided under Table-2 except ethyl alcohol content which may vary between 4% to 15.5%.”; (b) in sub-regulation 3.1.5, after the words “juice or sap”, the words “or whole grains” shall be inserted; (c) in sub-regulation 3.1.6, after the words “or any other approved substance”, the words “Wine Based Beverages may or may not be carbonated.” shall be inserted, (4) in PART 4, in regulation 4.2, after sub-regulation 4.2 (1), the following sub-regulation shall be inserted, namely: - “4.2 (1) (i) Nitro Craft Beer- Nitro Craft Beer is the craft beer having the mixture of CO2 and N2 gas.” (5) in TABLE-1, - (a) for the heading in column 5, the following heading shall be substituted, namely: - “Country Liquor, Indian Liquor, Plain Country Liquor or Plain Indian Liquor”; (b) for the heading in column 6, the following heading shall be substituted, namely: - “Blended Country Liquors or Blended Indian Liquors”; (c) in the footnote, for the words “low alcoholic beverages”, the words “Ready to Drink Alcoholic Beverage” shall be substituted; (6) in TABLE-2, - (a) in column 7, in the heading, after the words “Fruit Wine (other than grape wine)”, the words “along with Honey wine” shall be inserted; (b) in the foot note, for the words “in accordance with their”, the words “except the characteristic”, shall be substituted. (7) in TABLE-3, - (a) in Column 2, (i) against serial number 3, for the words “Carbon dioxide, v/v, Min”, the words “CO2 or Mixture of CO2 and N2 gas, v/v, Min***” shall be substituted; (ii) against serial number 10, for the words “Total plate count, cfu per ml”, the words, “Total plate count, cfu per ml **** ” shall be substituted.
