अत:, अब, भारतीय खा(cid:15) सुर(cid:17)ा और मानक )ािधकरण, उ5 अिधिनयम क(cid:21) धारा 21 के साथ पCठत धारा 92 क(cid:21)
उप-धारा (2) के खंड (झ) और खंड (ञ) 3ारा )दG शि5य( का )योग करत ेHए खा(cid:15) सुर(cid:17)ा और मानक )ािधकरण (संदषू क,
आिवष और अविश%) िविनयम, 2011 का और संशोधन करन ेके िलए िनIिलिखत िविनयम बनाता ह,ै अथा:त :-

1. सिं (cid:17)? नाम और )ारंभ.—(1) इन िविनयम( का सिं (cid:17)? नाम खा(cid:15) सरु (cid:17)ा और मानक (संदषू क, अिवष तथा अविश% )
ततृ ीय संशोधन िविनयम 2018 ह।ै
(2) य े राजप- म. उनके )काशन क(cid:21) तारीख को )वृत होग।े
2. खा(cid:15) सुर(cid:17)ा और मानक (संदषू क, अिवष तथा अविश% ) िविनयम 2011 म., िविनयम 2.3, म . उपिविनयम 2.3.1 के
Qथान पर, िन(cid:10)म िलिखत को रखा जाएगा, अथा:त :-
‘2.3.1. क(cid:21)टनाशक( के उपयोग पर िनबRधन:
(1) "क(cid:21)टनाशक" अिभ4ि5 का वही अथ: होगा जो क(cid:21)टनाशी अिधिनयम 1968(1968 का 46) म. इसका अथ: (cid:4)दया गया
ह।ै
(2) खंड (3) के उपबंध( के अधीन रहत ेHए, खा(cid:15) पदाथT पर (cid:4)कसी क(cid:21)टनाशी का सीधे )योग नहU (cid:4)कया जाएगा:
परVतु इस िविनयम (cid:4)क कोई भी उन धूमको पर लागू नहU होगी जो क(cid:21)टनाशी अिधिनयम, 1968 (1968 का 46)
क(cid:21) धारा 5 के अधीन गCठत पंजीकरण सिमित 3ारा खा(cid:15) पदाथW पर उस Bप म . )योग के िलए पंजीकृत और
अनुशिं सत ह।X
(3) सारणी के कॉलम संZय ा (2) म. उ(cid:6)ल िे खत क(cid:21)टनाशक( क(cid:21) मा-ा कॉलम सZं य ा (3) म. उ(cid:6) लिे ख त खा(cid:15) वQ तु के िलए

No. 1-SP(PAR)- Notification-pesticide/stds-FSSAI/2017.—Whereas the draft of certain regulations further to
amend the Food Safety and Standards (Contaminants, toxins and Residues) Regulations, 2011, was published as required
under sub-section (1) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006) in the Gazette of India,
Extraordinary, Part III, section 4 vide notification of the Food Safety and Standards Authority of India number F.No. 1-
SP(PAR)- Notification-pesticide/stds-FSSAI/2017, dated the 27th December, 2017, inviting objections or suggestions
from the persons likely to be affected thereby, before the expiry of the period of thirty days from the date on which the
copies of the Official Gazette containing the said notification were made available to the public;
And whereas the copies of the said Official Gazette were made available to the public on the 8th January, 2018;
And whereas the objections and suggestions received from the public in respect of the said draft regulations have
been considered by the Food safety and Standards Authority of India;
Now, therefore, in exercise of the powers conferred by clause (i) and clause (j) of sub- section (2) of section 92
read with section 21 of the said Act, the Food Safety and Standards Authority of India hereby makes the following
regulations further to amend the Food Safety and Standards (Contaminants, toxins and Residues) Regulations, 2011,
namely:-
1. Short title and commencement.- (1) These regulations may be called the Food Safety and Standards (Contaminants,
toxins and Residues) Third Amendment Regulations, 2018.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Food Safety and Standards (Contaminants, toxins and Residues) Regulations, 2011, in regulation 2.3, for sub-
regulation 2.3.1, the following sub-regulation shall be substituted, namely:-
‘2.3.1. Restriction on the use of insecticides:
(1) The expression “insecticide” shall have the meaning assigned to it in the Insecticide Act, 1968 (46 of 1968).
(2) Subject to the provisions of clause (3), no insecticides shall be used directly on articles of food:¹ PART III—SEC. 4º Hkkjr dk jkti=k % vlk/kj.k 31
Provided that nothing in this regulation shall apply to the fumigants which are registered and recommended
for use as such on articles of food by the Registration Committee, constituted under section 5 of the Insecticides
Act, 1968 (46 of 1968).
(3) The insecticide specified in column (2) of the table shall not exceed the Maximum Residue Limits (MRL)
prescribed in column (4), for the article of food specified in column (3) of the said table, namely:-
