सा.का.जन. 142(अ).—चूंदक िायुयान जनयम, 1937 म ें और आग े संिोधन करने के जलए कजतपय जनयमों का
प्रारूप िायुयान अजधजनयम, 1934 (1934 का 22) की धारा 14 की अपेक्षानुसार भारत सरकार, नागर जिमानन
मंत्रालय की तारीख 14 अगस्ट्त, 2019 की अजधसूचना स.ं सा.का.जन. 585(अ) के द्वारा भारत के रािपत्र, असाधारण म ें
प्रकाजित दकया गया था, जिसे ऐस े सभी व्यजियों जिनके उससे प्रभाजित होने की संभािना ह,ै स े रािपत्र म ें इस
अजधसूचना के प्रकाजित होने के तीस दिन की अिजध की समाजि स े पूिव आक्षेप और सुझाि आमंजत्रत करते हुए भारत के
रािपत्र की प्रजतयां सािविजनक रूप स े उपलब्ध कराई गईं;
और चूंदक उि अजधसूचना म ें प्रकाजित रािपत्र की प्रजतया ं दिनांक 21 अगस्ट्त, 2019 को सािविजनक रूप स े
उपलब्ध करा िी गई थीं;
और चूंदक उि अजधसूचना म ें जिजनर्िष्टव अिजध के अंिर प्रारूप जनयमों के बाबत िनता स े कोई आक्षेप या
सुझाि प्राि नही हुए ह ैं;
अतः, अब, केंद्रीय सरकार, िायुयान अजधजनयम, 1934 (1934 का 22) की धारा 5 द्वारा प्रित्त िजियों का
प्रयोग करते हुए, िायुयान जनयम, 1937 म ेंऔर आग े संिोधन करन े के जलए जनम्नजलजखत जनयम बनाती ह,ै अथावत:् —
1. संजक्षि नाम और प्रारंभ- (1) इन जनयमों का संजक्षि नाम िाययु ान (जद्वतीय संिोधन) जनयम, 2020 ह।ै
2. ये सरकारी रािपत्र म ेंप्रकािन की तारीख को प्रिृत्त होंगे।
3. िायुयान जनयम, 1937 म,ें जनयम 29 ख के स्ट्थान पर जनम्नजलजखत जनयम को प्रजतस्ट्थाजपत दकया िाएगा नामत:-

‘’29 ख. सिं हनीय इलक्टै र ाजनक उपकरणों के उपयोग पर प्रजतबधं – (1) कोई भी व् यजि उडान के िौरान िायुयान
के अंिर दकसी संिहनीय इलैक्टर ाजनक उपकरण का उपयोग नहीं करेगा और न प्रचालक या सकमान पायलट ऐस े
दकसी उपकरण के प्रचालन को अनुज्ञात करेगा:
परन्त ु पाइलट इन कमांड उस जस्ट्थजत को छोडकर िब कम िश्ृ य ता जस्ट्थजत म ें लैंडडंग करता ह ै िो समय-समय
पर महाजनिेिक द्वारा यथा जनधावररत की िाती ह,ै िायुयान की लैंडडंग के बाि और सदक्रय रनिे स े हटने के बाि
िायुयान के याजत्रयों द्वारा सेललु र टेलीफ़ोन के इस्ट्तेमाल की अनुमजत प्रिान कर सकता ह।ै
(2) उप-जनयम (1) के उपबंध संिहनीय िॉयस ररकाडवरों, जहयररंग एड्स, हाट व पेसमेकर, इलैजक्टरक िेिसव अथिा
अन् य ऐसे सिहनीय उपकरणों के जलए लागू नहीं होंगे िो प्रचालक के मतानुसार िायुयान के प्रचालन के संबंध म ें
दिक्टक चालन अथिा संचार व् यिस्ट् था के प्रजत दकसी प्रकार की बाधा उत् पन्न नहीं करत े ह ैं तथा जिसके संबंध म ें
प्रचालक द्वारा महाजनिेिक स ेअनुमोिन प्राप् त कर जलया गया ह।ै
(3) उप-जनयम (1) म ें दकसी बात के होते हुए भी मुख्य पायलट द्वारा उडान के िौरान िायुयान म ें सिार याजत्रयों
को फ्लाइट मोड अथिा एयरप्ल ेन मोड म ें उपयोग म ें लाए िा रह े लैपटाप, स्ट् माटवफोन, टेबलेट, स्ट् माटविॉच, ई-रीडर
अथिा प् िांइट ऑफ सेल उपकरण के जलए िायुयान में उपलब्ध िाई-फाई के माध् यम स े इंटरनटे सेिाओं को प्रयोग
करने की अनुमजत िी िा सकेगी;
परन् त ु महाजनिेिक द्वारा िायुयान को जनधावररत जिजनिेिों के अनुसार की गई प्रदक्रयाओं के अनुपालन की ित व
पर िाई-फाई के माध् यम स े िायुयान म ें इंटरनेट सेिाओं के उपयोग के जलए प्रमाजणत दकया िाएगा।

NOTIFICATION
New Delhi, the 21st February, 2020
G.S.R. 142(E).—Whereas, the draft of certain rules further to amend the Aircraft Rules,
1937, was published in the Gazette of India, Extraordinary, as required by section 14 of the Aircraft
Act, 1934 (22 of 1934), vide notification of the Government of India in the Ministry of Civil Aviation,
number G.S.R. 585(E), dated the 14th August, 2019, inviting objections and suggestions from all
persons likely to be affected thereby, before the expiry of a period of thirty days from the date on
which copies of the Gazette of India in which the said notification was published were made available
to public;
And whereas, copies of the Gazette containing the said notification were made available to
the public on the 21st August, 2019;
And whereas, no objections or suggestions have been received from the public in respect of
the draft rules within the period specified in the said notification;
Now, therefore, in exercise of the powers conferred by section 5 of the Aircraft Act, 1934 (22
of 1934) the Central Government hereby makes the following rules further to amend the Aircraft
Rules, 1937, namely: —
1. Short title and commencement.─(1) These rules may be called the Aircraft (Second
Amendment) Rules, 2020.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Aircraft Rules, 1937, for rule 29B, the following rule shall be substituted, namely:—
“29B. Prohibition on the use of portable electronic devices.─(1) No person shall operate, nor
shall the operator or the pilot-in-command of an aircraft allow the operation of any portable
electronic device on board an aircraft in flight:
Provided that the Pilot-in-Command may permit use of cellular telephone by the passengers
of a flight after the aircraft has landed and cleared active runway, except when the landing takes
place in low visibility conditions as may be determined by the Director-General from time to time.
(2) The provisions of sub-rule (1) shall not apply to portable voice recorders, hearing aids, heart
pacemaker, electric shavers or other portable electronic devices which, in the opinion of the
operator, do not cause interference with the navigation or communication system of the
aircraft on which it is to be operated and for which such operator has obtained the approval of
the Director-General.
(3) Notwithstanding anything contained in sub-rule (1), the Pilot-in-Command may permit the
access of internet services by passengers on board an aircraft in flight, through Wii-Fi on
board, when laptop, smartphone, tablet, smartwatch, e-reader or a point of sale device is used
in flight mode or airplane mode:
Provided that the Director-General shall certify the aircraft for usage of internet service in
flight through Wi-Fi on board subject to the procedures as specified in this behalf.
Explanation. ─ For the purposes of this rule, an aircraft shall be deemed to be in flight when all its
external doors are closed following embarkation until the moment when any such door is opened
for disembarkation.”.
