अतः अब क(cid:26)Mीय सरकार, वाययु ान अिधिनयम क. धारा 5 7ारा ’दO शि<य& का ’योग करते Dए वायुयान िनयम,
1937 म(cid:26) और आगे सशं ोधन करने के िलए िनPिलिखत िनयम बनाती ह,ै अथाBत :—
1. (1) इन िनयम& का सिं /A नाम वायुयान (सातवा ंसशं ोधन) िनयम, 29 घ 2018 ह ै
(2) य ेसरकारी राजप1 म(cid:26) ’काशन क. तारीख को ’वृO ह&गे।
2. वायुयान िनयम, 1937 म(cid:26) (इसम(cid:26) इसके पTात उ< िनयम कहा जाए) म(cid:26), िनयम 29 घ म,(cid:26)--

(क) उप-िनयम (1) म(cid:26), --
(क) खंड (i) के Uथान पर, िनPिलिखत खंड को रखा जाए, अथाBत;--
‘(i) िनयम 134 या िनयम 134 क के अधीन जारी अनुसूिचत या गैर-अनुसिू चत ’चालक अनWु ा का धारक हो
और िवमान और/या हले ीकॉZटर, यथा िUथित, ’चालन म (cid:26)सलं \ हो’; या;
(ख) खंड (iv) म(cid:26), “वायुयान” शEद के Uथान पर, “िनयम 133 ख के अधीन अनमु ो(cid:1)दत वायुयान इंजन या ’ोपले र”

(ग) खंड (v) म(cid:26), “वायुयान” शEद के Uथान पर, “िनयम 133 ख के अधीन अनमु ो(cid:1)दत वायुयान इंजन या ’ोपेलर”

“(vi) िनयम 133 ख के अधीन अनमु ो(cid:1)दत अनुर/ण संगठन हो और िवमान या हले ीकॉZटर के अनुर/ण म (cid:26)

(ख) UपKीकरण म,(cid:26) मद (क) के Uथान पर, िनPिलिखत मद को रखा जाए, अथाBत:्-
“(क) सरु /ा ’बंधन ’णाली ’बं धक सुर/ा के उस सु;विUथत दिृKकोण से अिभ’ेत ह ै िजसके अंतगतB आव_यक
संगठना‘मक सरं चना, जवाबदहे ी, िज(cid:10)मेदारी, नीितया ंऔर ’(cid:1)aयाएं ह&,;”
(3) उ< िनयम के िनयम 82 म(cid:26), उप-िनयम (1) म(cid:26), “कोई ऐसा Uथान जहाँ पर पDचँ ना आव_यक हो, वहाँ सभी
युि<-संगत समय या अcतराल पर ’वेश कर सकेगा” शEद& के Uथान पर “अिनविd धत और असीिमत पDचँ कर
सकेगा” शEद& को रखा जाए;”।
(4) उ< िनयम के िनयम 134ख के Uथान पर, िनPिलिखत िनयम को रखा जाए, अथातB ् :-

परcत ु यह तब जब (cid:1)क कोई ऐसा ;ि< जो िनयम 134 क के उप-िनयम (2) के अधीन (cid:1)दया गया िविधमाcय
गैर-अनुसिू चत ’चालक अनWु ा का धारक ह,ै ऐसी अपे/ाe जो महािनदशे क 7ारा िविनJदKB क. गई ह&, का
अनुपालन करते Dए ऐसे ’ािधकार प1 के िबना हवाई कायB कर सकेगा।
(2) िविहत ’प1 म (cid:26) आवेदन ’ाA होन े पर और इस बात का समाधान’द हो जाने पर (cid:1)क इस संबंध म(cid:26) िविनJदKB
अपे/ाएं पूरी कर ली गई ह,ै महािनदशे क (cid:1)कसी ;ि< को हवाई कायB करने के िलए ’ािधकार प1 जारी कर
सक(cid:26)गे। ’ािधकार क. सतत ् िविधमाcयता ऐसी शत f जो महािनदेशक 7ारा िविनJदKB क. गई ह&, के अनपु ालन के
अधीन ह&गे।
(3) उप-िनयम (2) के अधीन (cid:1)दया गया ’ािधकार प1 दो वष B से अनिधक अविध िजसे एक बार दो वषB स े अनिधक
अविध के िलए नवीकृत (cid:1)कया जा सकेगा, के िलए, तब तक िविधमाcय होगा जब तक (cid:1)क वह िनलंिबत या रh न
कर (cid:1)दया गया हो।
(4) इस िनयम के अधीन ’ािधकार प1 दने े के िलए 50,000/- iपये और उसके नवीकरण के िलए 25,000/- iपय े
क. फ.स संदये होगी। यह फ.स महािनदशे क 7ारा िविनJदKB रीित म(cid:26) संदाय क. जा सकेगी।
(5) महािनदशे क का इस बात का समाधान’द हो जान ेपर (cid:1)क--
(i) ’ािधकार प1 के धारक 7ारा ’ािधकार प1 क. (cid:1)कcहI शतk म(cid:26) से (cid:1)कसी शत Bका अनुपालन नहI (cid:1)कया गया
ह,ै या
(ii) कोई सूचना िछपा कर या कोई गलत सूचना दके र ’ािधकार प1 ’ाA (cid:1)कया गया ह,ै या
(iii) भारत सरकार, गृह म1ं ालय 7ारा ’ािधकार प1 के धारक क. सुर/ा अनापिO वापस ल े ली गई ह ै या
इनकार कर दी गई ह,ै इस िनयम के अधीन जारी ’ािधकार प1 को ऐसी अविध िजस ेवह उिचत समझे, के

MINISTRY OF CIVIL AVIATION
NOTIFICATION
New Delhi, the 9th November, 2018
G.S.R. 1096(E).—Whereas the draft of certain rules further to amend the Aircraft Rules, 1937,
was published in the Gazette of India, as required by section 14 of the Aircraft Act, 1934 (XXII of 1934),
vide notification of the Government of India in the Ministry of Civil Aviation, number G.S.R. 864(E),
dated the 12th September, 2018, inviting objections and suggestions from all persons likely to be
affected thereby, before the expiry of a period of thirty days from the date on which copies of the
Gazette of India in which the said notification was published, were made available to public;
And whereas copies of the Gazette containing the said notification were made available to the
public on the 12th September, 2018;
And whereas no objections or suggestions have been received from the public in respect of the
draft rules within the period specified in the said notification;
Now, therefore, in exercise of the powers conferred by section 5 of the Aircraft Act,1934 (XXII of
1934), the Central Government hereby makes the following rules further to amend the Aircraft Rules,
1937, namely: ―
1. (1) These rules may be called the Aircraft (Seventh Amendment) Rules, 2018.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Aircraft Rules, 1937, (hereinafter referred to as the said rules), in rule 29D,—
(A) in sub-rule (1), ―
(a) for clause (i), the following clause shall be substituted, namely: ―
“(i) is holding a Scheduled or Non-Scheduled Operator’s Permit issued under
rule 134 or 134A and engaged in the operation of aeroplanes or helicopters, as
the case may be; or”;
(b) in clause (iv), for the word “aircraft”, the words “aircraft, engines or propellers
approved under rule 133B” shall be substituted;
(c) in clause (v), for the word “aircraft”, the words “aircraft, engines or propellers
approved under rule 133B” shall be substituted;
(d) for clause (vi), the following clause shall be substituted, namely:—
“(vi) is a maintenance organisation approved under rule 133B and engaged in
the maintenance of aeroplanes or helicopters; or”;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(B) in the Explanation, for item (a), the following item shall be substituted, namely:—
“(a) “Safety Management System” means a systematic approach to managing safety,
including the necessary organisational structures, accountability, responsibilities,
policies and procedures;”.
(3) In rule 82 of the said rules, in sub-rule (1), for the words “may, at all reasonable times or
intervals, enter any place to which access is necessary and”, the words “shall have unrestricted and
unlimited access” shall be substituted;
(4) For rule 134B of the said rules, the following rule shall be substituted, namely:—
“134B. Aerial Work. – (1) No person shall undertake any aerial work unless he holds an
authorisation issued by the Director-General:
Provided that any person holding a valid Non-Scheduled Operator’s Permit
granted under sub-rule (2) of rule 134A may undertake aerial work without holding such
authorisation, subject to compliance with such requirements as specified by the Director-
General.
(2) The Director-General shall issue an authorisation for undertaking aerial work to any
person on receipt of an application in prescribed format and on being satisfied that the
requirements as specified in this behalf have been met. The continued validity of the
authorisation shall be subject to compliance of such conditions as specified by the
Director-General.
(3) The authorisation granted under sub-rule (2) shall, unless suspended or cancelled,
remain valid for a period not exceeding two years, which shall be renewed for a period
not exceeding two years at a time.
(4) A fee of Rs. 50,000/- shall be payable for grant of authorisation under this rule and
Rs. 25,000/- for renewal thereof. The fee shall be paid in a manner specified by the
Director-General.
(5) The Director General, on being satisfied that —
(i) any of the conditions of the authorisation has not been complied with by
the holder of the authorisation, or
(ii) the authorisation was obtained by suppressing any information or by giving
wrong information, or
(iii) the security clearance of the holder of the authorisation has been
withdrawn or denied by the Central Government, Ministry of Home Affairs,
shall cancel or suspend the authorisation issued under this rule, for such period
as he thinks fit:
Provided that no such authorisation shall be cancelled or suspended without giving a
show cause notice, in writing, informing the holder of authorisation the ground on which
it is proposed to suspend or cancel the authorisation and giving him a reasonable
opportunity of making a representation in writing within such reasonable time as
specified in the notice and, if that person so desires, of being heard.
(6) Notwithstanding anything contained in sub-rule (5), if the Director-General is of the
opinion that in the interest of public safety or national security it is necessary so to do,
he may, for reasons to be recorded in writing, summarily suspend the authorisation till
the deficiencies are resolved to the satisfaction of Director-General.”
