प्रारुप िायुयान अविवनयम, 1934 (1934 का XXII) की िारा 14 की अपेक्षानसु ार भारि सरकार नागर विमानन
मंत्रालय की िारीख 2 जून, 2017 की अविसचू ना सं. सा.का.वन 559(अ) के द्वारा भारि के राजपत्र, असािारण,
भाग-II, खंड 3, उप-खंड (i) में प्रकावशि दकए गए, वजस े ऐसे सभी व्यवियों वजनके उससे प्रभाविि होन े की संभािना
ह,ै से राजपत्र में इस अविसूचना के प्रकावशि होन े के िीस दिन की अिवि की समावि स े पूिव आक्षेप और सुझाि
आमंवत्रि करि े हुए भारि के राजपत्र की प्रवियां सािवजवनक रूप से उपलब्ि कराई गई;
और चूंदक उि अविसूचना में प्रकावशि राजपत्र की प्रवियां 07 जनू , 2017 को सािवजवनक रूप से उपलब्ि
करा िी गई थी;
और चूंदक उि अविसूचना में विवनर्िष्टव अिवि के अंिर प्रारूप वनयमों के बाबि जनिा से कोई आक्षेप या
सुझाि प्राि नहीं हुए ह;ैं
अिः, अब, केंद्रीय सरकार उि िायुयान अविवनयम की िारा 5 द्वारा प्रित्त शवियों का प्रयोग करि े हुए,
िायुयान वनयम, 1937 में और आगे संशोिन करन े के वलए वनम्नवलवखि वनयम बनािी ह,ै अथाविः-
1. (1) इन वनयमों का संवक्षि नाम िायुयान (आठिा ाँ संशोिन) वनयम, 2017 ह।ै
(2) ये सरकारी राजपत्र में अंविम प्रकाशन की िारीख को प्रिृत्त होंगे।

2. िायुयान वनयम, 1937 में, अनुसूची II में, खंड ड, में पैरा (6) के स्थान, पर वनम्नवलवखि को प्रविस्थावपि
दकया जाए, अथािव ः-
“6. विशषे ाविकार.- अनुज्ञवि में पृष्ांकनों और रेट ंगों की विविमान्यिा और इन वनयमों के वनयम 39ख,
वनयम 39ग और वनयम 42 के सुसंगि उपबंिों के अिीन रहिे हुए दकसी एयरलाइन पररिहन पायल
अनुज्ञवि के िारक के विशेषाविकार वनम्नवलवखि होंग-े
(क) दकसी िावणवययक पायल अनुज्ञवि और प्राइिे पायल अनुज्ञवि के विशेषाविकारों का प्रयोग
करना;
(ख) 5700 दकलोग्राम स े अविक संपूणव सिावविक भार िाले दकसी िायुयान म ें जो उसकी अनुज्ञवि के
िायुयान रेट ंग में िजव ह,ै वनम्नवलवखि शिों का अनुपालन करिे हुए समािशे क पायल के रूप
में कायव करनाः-
(i) उसने सह-पायल के रूप में एक सौ घं े से अन्यून का उडान काल उस प्रकार के विमान पर
पूरा दकया हो और उसके पश्चाि समािानप्रि रूप में िस लगािार मागव जांच दकया हो
वजसमें से पांच अन्यून जांच दकसी समािशे क पायल के किवव्यों और कृत्यों का वनष्पािन
करन े िाले दकसी जांच पायल के पयविेक्षण के अिीन राि में दकए गए हों और उसन े
महावनिशे क के समािानप्रि रूप में समािशे क पायल के रूप में उडान भरने की सक्षमिा
का प्रिशवन दकया हो;
परंिु यह दक 5700 दकलोग्राम से अविक संपूणव भार िाले दकसी पररिहन विमान के
समािशे क पायल के रूप म ें एक सौ घं े स े अन्यून का पूिव अनुभि होन े की िशा में, मागव
जांच की अपेवक्षि संख्या छह िक घ ाई जा सकिी ह ै वजसमें कम से कम िीन जाचं राि में
की गई हों।
(ii) उसने महावनिशे क द्वारा अपेवक्षि उस िायुयान की दकस्म की बाबि समुवचि प्रिीणिा जांच,
आशवयि उडान से पहले छह मास के भीिर समािानप्रि रूप में की हो।
(iii) दकसी आई एफ आर उडान के प्रचालन से पहले उसके पास चाल ू उपकरण रेट ंग होनी
चावहए।
परंिु यह दक 65 िषव की आयु होने पर, ऐसे विशेषाविकार खंड ङ. के अनुसरण में दकसी वनजी पायल
अनुज्ञवि (िायुयान) िक ही सीवमि होंगे।”

NOTIFICATION
New Delhi, the 28th July, 2017
G.S.R. 985(E).—Whereas the draft of certain rules further to amend the Aircraft Rules, 1937, was published, as
required by section 14 of the Aircraft Act, 1934 (XXII of 1934), vide notification of the Government of India in the
Ministry of Civil Aviation, published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i), vide
number G.S.R. 559(E), dated the 2nd June, 2017, for inviting objections and suggestions from all persons likely to beII (i) 3
affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette of India in
which the said notification was published, were made available to public;
And whereas copies of the Gazette in which the said notification was published were made available to the
public on the 7th June, 2017;
And whereas no objections or suggestions have been received from the public in respect of the draft rules within
the period specified in the said notification;
Now, therefore, in exercise of the powers conferred by section 5 of the said Aircraft Act, the Central
Government hereby makes the following rules further to amend the Aircraft Rules, 1937, namely: ─
1. (1) These rules may be called the Aircraft (Eighth Amendment) Rules, 2017.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Aircraft Rules, 1937, in Schedule II, Section M, for para (6), the following shall be substituted, namely:—
“6. Privileges.―Subject to the validity of endorsements and ratings in the licence and compliance with the
relevant provisions of Rules 39B, 39C and 42 of these rules, the privileges of the holder of an Airline Transport
Pilot’s Licence shall be—
(a) to exercise the privileges of a Commercial Pilot’s Licence and a Private Pilot’s Licence;
(b) to act as Pilot-in-Command of an aeroplane having an all-up weight exceeding 5700 Kgs., which is
entered in the aircraft rating of his licence, subject to his prior compliance with the following
conditions:-
(i) he shall have completed on that type of aeroplane not less than one hundred hours of flight time
as a Co-pilot, followed by ten consecutive satisfactory route checks, of which not less than five
shall be by night, under the supervision of a Check Pilot performing the duties and
responsibilities of a Pilot-in-Command, and demonstrated his competency to fly as a Pilot-in-
Command to the satisfaction of the Director-General:
Provided that in case of a pilot having previous experience of at least 100 hours as Pilot-in-
Command of transport aeroplanes having all-up weight exceeding 5700 Kgs., the required number
of route checks may be reduced to six out of which at least three shall be by night.
(ii) he shall have undergone satisfactorily within the preceding six months of the intended flight,
appropriate proficiency checks in respect of that type of aircraft as required by the Director-
General.
(iii) he shall be in possession of a current Instrument Rating before operating any IFR flight:
Provided that on the attainment of the age of sixty-five years, such privileges shall be restricted to that
of a Private Pilot’s Licence (Aeroplanes) in accordance with Section E.””
