अिधिनयम, 1934 (1934 का XXII) क(cid:20) धारा 14 क(cid:20) अपे(cid:23)ानुसार भारत सरकार, नागर िवमानन मं(cid:27)ालय क(cid:20) तारीख 05 फ़रवरी,
2016 क(cid:20) अिधसूचना सं. सा.का.िन. 157(अ) के (cid:28)ारा (cid:17)कािशत (cid:1)कए गए, िजसे ऐसे यि" तय(cid:16) िजनके उनसे (cid:17)भािवत होने क(cid:20) संभावना ह,ै
से राजप(cid:27) म& इस अिधसूचना के (cid:17)कािशत होने के तीस (cid:1)दन क(cid:20) अविध क(cid:20) समाि’ त से पूव(cid:9) आ(cid:23)ेप और सुझाव आमंि(cid:27)त करते )ए भारत के
राजप(cid:27) क(cid:20) (cid:17)ितयां साव(cid:9)जिनक (cid:18)प से उपल+ ध कराई गई;
और चूं(cid:1)क उ" त अिधसूचना क(cid:20) (cid:17)ितयां 10 फ़रवरी, 2016 को साव(cid:9)जिनक (cid:18)प से उपल+ ध करा दी गई थ.;
और चूं(cid:1)क उ"त अिधसूचना म& िविन/द0ट अविध के अंदर (cid:17)ा(cid:18)प िनयम(cid:16) के संबंध म& (cid:1)कसी यि" त से कोई आ(cid:23)ेप या सुझाव (cid:17)ा’ त
नह. )ए ह;3
अत:, अब, क&4ीय सरकार, उ"त वायुयान अिधिनयम क(cid:20) धारा 5 (cid:28)ारा (cid:17)द5त शि" तय(cid:16) का (cid:17)योग करते )ए वायुयान िनयम,
1937 म& और आगे संशोधन करने के िलए िन8न िलिखत िनयम बनाती ह,ै अथा(cid:9)त्:-
(क) इन िनयम(cid:16) का संि(cid:23): नाम वायुयान ((cid:17)थम संशोधन) िनयम, 2016 ह।ै
(ख) ये सरकारी राजप(cid:27) म& (cid:17)काशन क(cid:20) तारीख को (cid:17)वृ< ह(cid:16)गे।
1. वायुयान िनयम, 1937 म& (इसम& इसके पEात् उF िनयम कहा गया ह)ै,
अनुसूची II म&,________
(क) अनुभाग ञ म&, ________
(i) पैरा 5 के पEात् , िनKिलिखत पैरा को अMतः Oथािपत (cid:1)कया जाए, अथात(cid:9) ् :-
“5क. (cid:17)वीणता जांच________

(क) पQरवहन िवमान िजसका संपूण(cid:9) सवा(cid:9)िधक भार पांच हजार सात सौ (cid:1)कलोSाम से अिधक है,
के सह-िवमान चालक के (cid:18)प म& काय(cid:9) करने के िलए अनुTि: धारक से अपे(cid:23)ा क(cid:20) जाती ह ै(cid:1)क
वह उड़ान (cid:1)कए जाने वाले टाइप िवमान के बाबत समुिचत (cid:17)वीणता जो महािनदशे क (cid:28)ारा
िविन/दW क(cid:20) जाए, क(cid:20) जांच कराए।
(ख) पैरा (क) के अनुसार क(cid:20) गई (cid:17)वीणता जांच उस जांच क(cid:20) तारीख से छह मास क(cid:20) अविध के
िलए िविधमाMय होगी और इसका नवीकरण छह मास क(cid:20) और अविध के िलए (cid:1)कया जा
सकेगा।
(ग) नवीकरण क(cid:20) दशा म&, िविधमाMयता क(cid:20) अविध पूव(cid:9)वत[ िविधमाMयता क(cid:20) समाि: क(cid:20) तारीख
से आरंभ होगी परंतु यह तब जब (cid:1)क यह जांच उसक(cid:20) समाि: क(cid:20) तारीख से पूव(cid:9)वत[ दो मास
के भीतर क(cid:20) गई हो।”
(ii) पैरा 6 के दसू रे परंतुक का लोप (cid:1)कया जाए।
(ख) अनुभाग ट म&,________
(i) पैरा 5 के पEात् , िनKिलिखत पैरा को अंतः Oथािपत (cid:1)कया जाए, अथा(cid:9)तः-
“5क. (cid:17)वीणता जांच________
(क) पQरवहन हले ीकॉ’टर पर समादशे क िवमान चालक या सह िवमान चालक के (cid:18)प म& काय(cid:9)
करने के िलए अनुTि: धारक से अपे(cid:23)ा क(cid:20) गई है (cid:1)क वह उड़ान (cid:1)कए जान े वाले टाइप
हले ीकॉ’टर के बाबत समुिचत (cid:17)वीणता जो महािनदशे क (cid:28)ारा िविन/दW क(cid:20) जाए, क(cid:20) जांच
कराए।
(ख) पैरा (क) के अनुसार क(cid:20) गई (cid:17)वीणता जांच उस जांच क(cid:20) तारीख से छह मास क(cid:20) अविध के
िलए िविधमाMय होगी और इसका नवीकरण छह मास क(cid:20) और अविध के िलए (cid:1)कया जा
सकेगा।

(i) पैरा 4 के उप-पैरा (घ) के Oथान पर, िनKिलिखत उप-पैरा को (cid:17)ितOथािपत (cid:1)कया जाए, अथात(cid:9) ् :-
“(घ) उपकरण रे‘टग________
अनुTि: म& कोई पृथक उपकरण रे‘टग उपबंिधत नह. ह।ै उपकरण रे‘टग के िवशेषािधकार इस
अनुTि: के िवशेषािधकार म& सि8मिलत ह 3 परंतु यह तब जब (cid:1)क उपकरण रे‘टग उड़ान परी(cid:23)ण
महािनदशे क के समाधान (cid:17)द (cid:18)प म& (cid:1)कए गए ह(cid:16)। उपकरण रे‘टग क(cid:20) िविधमाMयता और नवीकरण
क(cid:20) शतb इस अनुसूची के अनुभाग ण म& िविहत क(cid:20) जाए।ं ”
(ii) पैरा 5 के पEात् , िनKिलिखत पैरा को अंतः Oथािपत (cid:1)कया जाए,

(घ) अनुभाग ड म&—
(i) पैरा 4 के उप-पैरा(ग) के Oथान पर, िनKिलिखत उप-पैरा को (cid:17)ितOथािपत (cid:1)कया जाए, अथात(cid:9) ् :-
“(ग) उपकरण रे‘टग________
अनुTि: म& कोई पृथक उपकरण रे‘टग उपबंिधत नह. ह।ै उपकरण रे‘टग के
िवशेषािधकार इस अनुTि: के िवशेषािधकार म& सि8मिलत ह 3 परंतु यह तब जब (cid:1)क
उपकरण रे‘टग उड़ान परी(cid:23)ण महािनदशे क के समाधान (cid:17)द (cid:18)प म& (cid:1)कए गए ह(cid:16)।
उपकरण रे‘टग क(cid:20) िविधमाMयता और नवीकरण क(cid:20) शतb इस अनुसूची के अनुभाग ण म&
िविहत क(cid:20) जाएं।”
(ii) पैरा 5 के पEात् , िनKिलिखत पैरा को अंतः Oथािपत (cid:1)कया जाए, अथात(cid:9) ् :-
“5क. (cid:17)वीणता जांच________
(क) पQरवहन िवमान िजसका संपूण(cid:9) सवा(cid:9)िधक भार पांच हजार सात सौ (cid:1)कलोSाम से अिधक है,
के समादेशक िवमान चालक या सह-िवमान चालक के (cid:18)प म& काय(cid:9) करने के िलए अनुTि:

(cid:17)वीणता जो महािनदशे क (cid:28)ारा िविन/दW क(cid:20) जाए, क(cid:20) जांच कराए।
(ख) पैरा (क) के अनुसार क(cid:20) गई (cid:17)वीणता जांच उस जांच क(cid:20) तारीख से छह मास क(cid:20) अविध के
िलए िविधमाMय होगी और इसका नवीकरण छह मास क(cid:20) और अविध के िलए (cid:1)कया जा
सकेगा।
(ग) नवीकरण क(cid:20) दशा म&, िविधमाMयता क(cid:20) अविध पूव(cid:9)वत[ िविधमाMयता क(cid:20) समाि: क(cid:20) तारीख
से आरंभ होगी परंतु यह तब जब(cid:1)क यह जांच उसक(cid:20) समाि: क(cid:20) तारीख से पूव(cid:9)वत[ दो मास
के भीतर क(cid:20) गई हो।”
(iii) पैरा 6 के दसू रे परंतुक का लोप (cid:1)कया जाए।
(ड.) अनुभाग ढ़ म&________
(i) पैरा 5 के पEात् , िनKिलिखत पैरा को अंतः Oथािपत (cid:1)कया जाए, अथात(cid:9) ् :-
‘’5क. (cid:17)वीणता जांच,________
(क) पQरवहन हले ीकॉ’टर पर समादशे क िवमान चालक या सह िवमान चालक के (cid:18)प म& काय(cid:9)
करने के िलए अनुTि: धारक से अपे(cid:23)ा क(cid:20) जाती ह ै (cid:1)क वह उड़ान (cid:1)कए जाने वाले टाइप
हले ीकॉ’टर के बाबत समुिचत (cid:17)वीणता जो महािनदशे क (cid:28)ारा िविहत क(cid:20) जाए, क(cid:20) जांच
कराए।
(ख) पैरा (क) के अनुसार क(cid:20) गई (cid:17)वीणता जांच उस जांच क(cid:20) तारीख से छह मास क(cid:20) अविध के
िलए िविधमाMय होगी और इसका नवीकरण छह मास क(cid:20) और अविध के िलए (cid:1)कया जा
सकेगा।
(ग) नवीकरण क(cid:20) दशा म&, िविधमाMयता क(cid:20) अविध जांच पूव(cid:9)वत[ िविधमाMयता क(cid:20) समाि: क(cid:20)
तारीख से आरंभ होगी परंतु यह तब जब(cid:1)क यह जांच उसक(cid:20) समाि: क(cid:20) तारीख से पूव(cid:9)वत[
दो मास के भीतर क(cid:20)गई हो।”
(ii) पैरा 6 के दसू रे परंतुक का लोप (cid:1)कया जाए।
(च) अनुभागण म&, पैरा 2 के Oथान पर, िनKिलिखत को (cid:17)ितOथािपत (cid:1)कया जाए, अथात(cid:9) ् :-
“2. िविधमाMयता________(क) यह रे‘टग उपकरण रे‘टग उड़ान परी(cid:23)ण क(cid:20) तारीख से बारह मास
क(cid:20) अविध के िलए िविधमाMय होगी।
(ख) इसका नवीकरण समाि: क(cid:20) तारीख से बारह मास क(cid:20) और अविध के िलए (cid:1)कया जा सकेगा
परंतु यह तब जब (cid:1)क उपकरण रे‘टग के परी(cid:23)ण समाि: क(cid:20) तारीख से पूव(cid:9)वत[ दो मास के भीतर
(cid:1)कया गया हो और नवीकरण के िलए अMय अपे(cid:23)ाएं पूरी क(cid:20) गई ह(cid:16)।
(ग) अMय दशाg म&, रे‘टग के नवीकरण क(cid:20) िविधमाMयता उसके परी(cid:23)ण क(cid:20) तारीख से आरंभ
होगी।”
(छ) अनुभाग त म&, पैरा 2 के Oथान पर, िनKिलिखत को (cid:17)ितOथािपत (cid:1)कया जाए, अथात(cid:9) ् :-4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
‘’2. िविधमाMयता________(क) यह रे‘टग उपकरण रे‘टग उड़ान परी(cid:23)ण क(cid:20) तारीख से बारह मास
क(cid:20) अविध के िलए िविधमाMय होगी।
(ख) इसका नवीकरण समाि: क(cid:20) तारीख से बारह मास क(cid:20) और अविध के िलए (cid:1)कया जा सकेगा
परंतु यह तब जब(cid:1)क उपकरण रे‘टग के परी(cid:23)ण समाि: क(cid:20) तारीख से पूव(cid:9)वत[ दो मास के भीतर
(cid:1)कया गया हो और नवीकरण के िलए अMय अपे(cid:23)ाएं पूरी क(cid:20) गई ह(cid:16)।
(ग) अMय दशाg म&, रे‘टग के नवीकरण क(cid:20) िविधमाMयता उसके परी(cid:23)ण क(cid:20)तारीख से आरंभ
होगी।”

MINISTRY OF CIVIL AVIATION
NOTIFICATION
New Delhi, the 31st March, 2016
G.S.R. 399(E).─Whereas the draft of certain rules further to amend the Aircraft Rules, 1937, was published, as
required by section 14 of the Aircraft Act, 1934 (XXII of 1934), vide notification of the Government of India in the
Ministry of Civil Aviation, published in the Gazette of India, Extraordinary Part-II, Section 3, sub-section (i), vide
number G.S.R. 157(E), dated 5th February, 2016, for inviting objections and suggestions from all persons likely to be
affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette of India in
which the said notification was published, were made available to public;
And whereas copies of the Gazette in which the said notification was published were made available to the
public on the 10th February, 2016;
And whereas no objections or suggestions have been received from the public in respect of the draft rules
within the period specified in the said notification;
Now, therefore, in exercise of the powers conferred by Section 5 of the said Aircraft Act, the Central
Government hereby makes the following rules further to amend the Aircraft Rules, 1937, namely: ─
1. (1) These rules may be called the Aircraft (First Amendment) Rules, 2016.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Aircraft Rules, 1937 (hereinafter referred to as the said rules), in Schedule II,—
(A) in Section J,─
(i) after para 5, the following para shall be inserted, namely:-
“5A.Proficiency Check―
(a) In order to act as a co-pilot of transport aeroplanes having an all-up weight exceeding five
thousand seven hundred kilograms, the licenceholder shall be required to undergo an
appropriate proficiency check as specified by the Director-General, in respect of the type of
aircraft to be flown.
(b) The proficiency check carried out as per para (a) shall be valid for a period of six months from
the date of the check and shall be renewed for a further period of six months at a time.
(c) In the case of renewal, the period of validity shall commence from the date of expiry of the
previous validity provided that the check has been carried out within two months preceding the
date of expiry.”
(ii) the second proviso to para 6 shall be omitted.
(B) In Section K,─
(i) after para 5, the following para shall be inserted, namely:-
“5A.Proficiency Check―¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 5
(a) In order to act as a pilot-in-command or co-pilot on transport helicopters, the licence holder
shall be required to undergo an appropriate proficiency check as specified by the Director-
General, in respect of the type of helicopter to be flown.
(b) The proficiency check carried out as per para (a) shall be valid for a period of six months from
the date of the check and shall be renewed for a further period of six months at a time.
(c) In the case of renewal, the period of validity shall commence from the date of expiry of the
previous validity provided that the check has been carried out within two months preceding the
date of expiry.”
(ii) the third proviso to para 6 shall be omitted.
(C) in Section L, ―
(i) forsub-para (d) of para 4, the following sub-para shall be substituted, namely:-
“ (d) Instrument Rating―
No separate Instrument Rating is provided in the licence. The privileges of instrument rating are
included in the privileges of this licence provided that the instrument rating flying tests have been
carried out as per the conditions laid down by the Director-General. Conditions for validity and
renewal of instrument rating shall be as are laid down in Section O of this Schedule.”
(ii) After para 5, the following para shall be inserted, namely:-
“5A.Proficiency Check―
(a) In order to act as a co-pilot of transport aeroplanes having an all-up weight exceeding five
thousand seven hundred kilograms, the licenceholder shall be required to undergo an appropriate
proficiency check as specified by the Director-General, in respect of the type of aircraft to be
flown.
(b) The proficiency check carried out as per para (a) shall be valid for a period of six months from the
date of the check and shall be renewed for a further period of six months at a time.
(c) In the case of renewal, the period of validity shall commence from the date of expiry of the
previous validity provided that the check has been carried out within two months preceding the
date of expiry.”
(iii) the second proviso to para 6 shall be omitted.
(D) in Section M,―
(i) for sub-para (c) of para 4, the following sub-para shall be substituted, namely:-
“(c) Instrument Rating―No separate Instrument Rating is provided in the licence. The privileges
of instrument rating are included in the privileges of the licence providedthat the instrument rating
flying tests have been carried out as per the conditions laid down by the Director-
General.Conditions for validity and renewal of instrument rating shall be as are laid down in
Section O of this Schedule.”
(ii) after para 5, the following para shall be inserted, namely:-
“5A.Proficiency Check―
(a) In order to act as a pilot-in-command or co-pilot of transport aeroplanes having an all-up
weight exceeding five thousand seven hundred kilograms, the licence holder shall be
required to undergo an appropriate proficiency check as specified by the Director-General, in
respect of the type of aircraft to be flown.

(E) In Section N, ─

“5A.Proficiency Check―
(a) In order to act as a pilot-in-command or co-pilot on transport helicopters, the licence holder shall
be required to undergo an appropriate proficiency check as specified by the Director-General, in
respect of the type of helicopter to be flown.
(b) The proficiency check carried out as per para (a) shall be valid for a period of six months from
the date of the check and shall be renewed for a further period of six months at a time.
(c) In the case of renewal, the period of validity shall commence from the date of expiry of the
previous validity provided that the check has been carried out within two months preceding the
date of expiry.”

(F) in Section O, for para 2, the following shall be substituted, namely: —
“2.Validity―(a) The rating shall be valid for a period of twelve months from the date of the instrument
rating flying test.
(b) It shall be renewed for a further period of twelve months at a time from the date of expiry
provided that the instrument rating flying test has been carried out within two months
preceding the date of expiry and all other requirements for renewal are met.
(c) In other cases, the validity of renewal of the rating shall commence from the date of the test.”
(G) in Section P, for para 2 the following shall be substituted, namely:-
“2.Validity―(a) The instrument rating shall be valid for a period of twelve months from the date of the
instrument rating flying test.
(b) It shall be renewed for a further period of twelve months at a time from the date of expiry
provided that the instrument rating flying test has been carried out within two months
preceding the date of expiry and all other requirements for renewal are met.
(c) In other cases, the validity of renewal of the rating shall commence from the date of the test.”
