अत: अब क(cid:7286)(cid:7076)ीय सरकार, उक् त वायुयान अिधिनयम की धारा 5 (cid:7367)ारा (cid:7079)दत् त शिक् तय(cid:7298) का (cid:7079)योग करत ेहुए वायुयान िनयम 1937
म(cid:7286) और आग ेसंशोधन करने के िलए िनम् निलिखत िनयम बनाती ह,ै अथार्त् :—
1. (1) इन िनयम(cid:7298) का संिक्ष(cid:7385) नाम वायुयान (ि(cid:7367)तीय संशोधन) िनयम, 2017 ह।ै
(2) य ेसरकारी राजप(cid:7074) म(cid:7286) अंितम (cid:7079)काशन की तारीख को (cid:7079)वृ(cid:7275) ह(cid:7298)गे।
2. वायुयान िनयम, 1937 म(cid:7286),
(i) िनयम 30 के उप-िनयम (7) म(cid:7286) “केपटाउन कन्वेशन म(cid:7286) जैसा उपबिंधत ह”ै शब्द(cid:7298) के स्थान पर “पाँच कायर् िदवस के भीतर”
शब्द(cid:7298) को (cid:7079)ितस्थािपत िकया जाए;
(ii) िनयम 32 के प(cid:7391)ात, िन(cid:7388)िलिखत िनयम अतः स्थिपत िकया जाए, अथार्त् :—
“32 क. वाययु ान का िनयातर् .―िनयम 30 के परंतकु पर कोई (cid:7079)ितकूल (cid:7079)भाव डाल ेिबना, िनयम 30 के उप-िनयम (7) के
अधीन िकसी वायुयान के रिजस्(cid:7069)ीकरण के र(cid:7374) होन े के िरथित म(cid:7286), यिद आई डी ई आर ए धारक (cid:7367)ारा उसी वायुयान के
िनयार्त के िलए आवेदन िकया जाता ह,ै तो केन्(cid:7076) सरकार पाच ं कायर् िदवस(cid:7298) के भीतर उस िवमान के (cid:7079)चालन से सबंिधत

NOTIFICATION
New Delhi, the 23rd March, 2017
G.S.R. 295(E).─ Whereas the draft of certain rules further to amend the Aircraft Rules, 1937, was published, as
required by section 14 of the Aircraft Act, 1934 (XXII of 1934), vide notification of the Government of India in the
Ministry of Civil Aviation, published in the Gazette of India, Extraordinary Part-II, Section 3, sub-section (i), vide
number G.S.R. 933(E), dated 20th October, 2016, for inviting objections and suggestions from all persons likely to be
affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette of India in
which the said notification was published, were made available to public;
And whereas copies of the Gazette in which the said notification was published were made available to the
public on the 21st October, 2016;
And whereas objections or suggestions received in respect of the draft rules within the period specified have
been taken into consideration;
Now, therefore, in exercise of the powers conferred by Section 5 of the said Aircraft Act, the Central
Government hereby makes the following rules further to amend the Aircraft Rules, 1937, namely: ─
1. (1) These rules may be called the Aircraft (Second Amendment) Rules, 2017.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Aircraft Rules, 1937,—
(i) In rule 3, in clause (28A), for the word “requested,”, the word “request” shall be substituted;
(ii) in rule 30, in sub-rule (7), for the words “as provided in the Cape Town Convention”, the words “within
five working days” shall be substituted;
(iii) after rule 32, the following rule shall be inserted, namely: —
“32A. Export of aircraft.—Without prejudice to the proviso to rule 30, the Central Government shall,
consequent upon cancellation of registration of an aircraft under sub-rule (7) of rule 30, if an application is
made by IDERA Holder for export of the same aircraft, take action within five working days to facilitate
the export and physical transfer of the aircraft, along with spare engine, if any, subject to compliance with
applicable safety rules and regulations relating to that aircraft operation.”.
