(1) इन िनयम* का संि(cid:17)A नाम वायुयान (सुर(cid:17)ा) संशोधन िनयम, 2019 ह।ै (2) य ेराजप. म7 उनके +काशन क" तारीख को +वतृ ह*ग।े 2. वायुयान (सरु (cid:17)ा) िनयम, 2011, (िजसम 7 इसके पNात उ: िनयम कहा गया ह)ै के खंड (ग) म7 +यPु त “आयुP त’’ श=द , जहां आता ह ैके Qथ ान पर “महािनदशे क’’ श= द रखा जाएगा। 3. उPत िनयम* के िनयम 2 म7 :— (i) खंड (ग) म 7 ‘’सुर(cid:17)ा आयुPत (नागर िवमानन), नागर िवमानन सुर(cid:17)ा = यूरो, नागर िवमानन म.ं ालय’’ श= द* के Qथ ान 1389 GI/2019 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] पर “महािनदशे क’’ श=द रख ेजाएंगे।” (ii) खंड (छ) के Qथान पर, िनSन िलिखत खंड रखा जाएगा अथा(cid:12)त:— “(छ) ‘महािनदशे क’ स ेअिभ+ेत महािनदशे क, नागर िवमानन सरु (cid:17)ा =यरू ो, नागर िवमानन मं.ालय ह,ै (iii) िनयम (यक), के पNात िनKिलिखत खंड अंतःQथािपत (cid:4)कया जाएगा अथात(cid:12) :— “(यकक), “अनसु िू चत भारतीय िवमान वाहक" से वह िवमान वाहक अिभ+ेत होगा, िजस े नागर िवमानन महािनदशे क स े(अनसु िू चत +चालक या.ी) वाय ु+चालक +माणप. +ाA ह।ै " 4. िनयम 4 म7 “केB> ीय सरकार’’ श=द * के Qथ ान पर “ऐसे आदेश के पाGरत होन े के पW चात ् से साठ (cid:4)दन क" अविध के भीतर नागर िवमानन मं.ालय म 7भारत सरकार के सिचव’’ श= द रख ेजाएंग।े 5. उPत िनयम के िनयम 6 म7 परंतकु के Qथान पर, िनS निलिखत परंतकु रखा जाएगा अथा(cid:12)त :् — “परंतु, तब जब(cid:4)क महािनदशे क सभं ािवत खतरे तथा (cid:4)कसी अBय कारण से दीवार या चारदीवारी अथवा बाड़ के िविनदशX * के संबंध म 7आदशे $ारा, उपांतGरत कर सक7गे।" 6. उ: िनयम* 26 म7 िनKिलिखत परंतुक अतं ःQथािपत (cid:4)कया जाएगा अथा(cid:12)त :् — “परंतु वायुयान ऑपरेटर $ारा सुर(cid:17)ा कृYय* के िनZ पादन के िलए भारतीय अनुसिू चत वाहक अथवा हवाईअ[ा ऑपरेटर के साथ संिवदा क" जा सकेगी और ऐसी सरु (cid:17)ा के कृYय* म 7 लग े ह,\ यथािQथित भारतीय अनुसिू चत वाहक अथवा हवाई ऑपरेटर, पणू (cid:12)कािलक सीधे कमच(cid:12) ाGरय* को इस िनयम म7 िविन_द‘(cid:12) परू ा करके +ाA क" जा सकेगी।" [फा. सं. एवी.11021/3/2015-एएस] उषा पाढ़ी, संयु: सिचव (cid:13)(cid:13)(cid:13)(cid:13)टटटट(cid:15)(cid:15)(cid:15)(cid:15)पपपपणणणण :::: मूल िनयम अिधसूचना स/ं या सा.का.िन. 34(अ), तारीख 19 जनवरी 2012 $ारा भारत के राजप., भाग II, खंड 3, उप खंड (i) म7 +कािशत (cid:4)कए गए थ।े MINISTRY OF CIVIL AVIATION NOTIFICATION New Delhi, the 1st March, 2019 G.S.R. 172(E).—Whereas the draft of certain rules further to amend the Aircraft (Security) Rules, 2011 were pre-published, as required by section 14 of the Aircraft Act, 1934 (22 of 1934), vide notifications of the Government of India in the Ministry of Civil Aviation Number G.S.R. 1184(E) dated 7th December, 2018 in the Gazette of India Extraordinary, Part II, Section 3, Sub-section (i), inviting objection and suggestion from all persons likely to be affected thereby, before the expiry of the period of fifteen days from the date on which copies of the Gazette of India, in which this notification is published are made available to the public; And whereas suggestions have been received from the public in respect of the draft rules, were considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 4, read with section 5, of the Aircraft Act, 1934 (22 of 1934), the Central Government hereby makes the following rules further to amend the Aircraft (Security) Rules, 2011, namely:— 1. (1) These rules may be called the Aircraft (Security) Amendment Rules, 2019. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Aircraft (Security) Rules, 2011, (hereinafter referred to as to the said rules), for the word “Commissioner” wherever it occurs, the word “Director General” shall be substituted.¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3 3. In rule 2 of the said rules,— (i) in clause (c), for the words and brackets, “Commissioner of Security (Civil Aviation), Bureau of Civil Aviation Security, Ministry of Civil Aviation”, the word “Director General” shall be substituted; (ii) for clause (g), the following clause shall be substituted, namely:— ‘(g) “Director General” means the Director General of the Bureau of Civil aviation Security in the Ministry of Civil Aviation;’ (iii) after clause (za), the following clause shall be inserted, namely:— ‘(zaa) “Scheduled Indian Air Carrier” means an air carrier which has received an Air Operator Certificate (Scheduled or Scheduled Commuter Operator) from the Directorate General of Civil Aviation;’. 4. In rule 4, for the words “the Central Government”, the words, “the Secretary to the Government of India in the Ministry of Civil Aviation, within a period of sixty days from the date on which such order is passed” shall be substituted. 5. In rule 6 of the said rules, for the proviso, the following proviso shall be substituted, namely:— “Provided that the Director General, keeping in view the threat or any other reason, may, by order, modify the specification of the perimeter wall or fence.”. 6. In rule 26 of the said rules, the following proviso shall be inserted, namely:— “Provided that an aircraft operator may enter into a contract with an Indian Scheduled Carrier or an Aerodrome Operator for performance of security functions and engage for such security functions, the whole time direct employees of the Indian Scheduled Carrier or the Aerodrome Operator, as the case may be, who meet the requirements specified in this rule”.
