की धारा 67 की उपधारा (1) द्वारा प्रदत्त िजियों का प्रयोग करत े हुए बनाने का प्रस्ट्ताव करती ह,ै िो भारत के रािपत्र,
असाधारण, भाग 2, खडं 3, उपखंड (i) में सा.का.जन.सं. 432(अ) तारीख 7 िुलाई, 2020 में संजहता की धारा 67 की
उपधारा (1) की अपेक्षानुसार उन सभी व्यजियों, जिनस े उससे प्रभाजवत होने की संभावना ह,ै से आक्षेप और सझु ाव
आमंजत्रत करत े हुए रािपत्र म ें उि अजधसूचना के प्रकािन की तारीख से पतैं ालीस ददन की अवजध की समाजि पर या उसस े

और उि प्रारूप में जनम्नजलजखत से संबंजधत प्रस्ट्ताजवत जनयम अतं र्ववष्ट ह ै–
(i) धारा 42 की उपधारा (1), उपधारा (2), उपधारा (3), उपधारा (10) और उपधारा (11) (िहां तक
उनका संबंध केन्द्रीय सलाहकार बोडच से ह)ैं ;

अत:, केंरीय सरकार, श्रम संजहता की धारा 67 की उपधारा (2) के खंड (ध) और खडं (न) (िहां तक उनका संबंध
केन्द्रीय सलाहकार बोडच स े ह)ैं द्वारा प्रदत्त िजियों का प्रयोग करते हुए और न्द्यनू तम मिदरू ी (केंरीय सलाहकार बोडच)
जनयम, 2011 तथा न्द्यूनतम मिदरू ी (केंरीय) जनयम, 1950 को, िहा ं तक वह धारा 7 और धारा 9 तथा न्द्यूनतम मिदरू ी
अजधजनयम, 1948 (1948 का 11) की धारा 8 स े संबंजधत ह,ैं का जसवाय ऐसी चीिों को, जिनको ऐसे अजधक्रमण स े पवू च
लोप दकया गया ह ैया करन े का लोप दकया गया ह,ै जनम्नजलजखत जनयम बनाती ह,ै अथाचत् :--
अध्याय 1
प्रारंजभक
1. सजं क्षि नाम, जवस्ट्तार और प्रारंभ—(1) इन जनयमों का संजक्षि नाम मिदरू ी संजहता (केंरीय सलाहकार बोडच) जनयम,
2021 ह ै।
(2) य ेरािपत्र में उनके प्रकािन की तारीख को प्रवृत्त होंग े।
2. पररभाषाए—ं िब तक इन जनयमों में संदभच स ेअन्द्यथा अपेजक्षत न हो,--
(क) “बोडच” से केंरीय सरकार द्वारा धारा 42 की उपधारा (1) के अधीन गरित केंरीय सलाहकार बोडच अजभप्रेत है;
(ख) “अध्यक्ष” से बोडच का अध्यक्ष अजभप्रेत ह;ै
(ग) “संजहता” से मिदरू ी संजहता, 2019 (2019 का 29) अजभप्रेत ह;ै
(घ) “सदस्ट्य” से बोडच सदस्ट्य अजभप्रते ह;ै
(ङ) “धारा” से संजहता की धारा अजभप्रेत ह;ै
(च) िब्द और पद, िो इन जनयमों में प्रयुि ह,ैं ककतु इन जनयमों में पररभाजषत नहीं ह,ै का क्रमि: वही अथच होगा,
िो उनका संजहता में ह ै।
अध्याय 2
केंरीय सलाहकार बोड च
क. धारा 42 की उपधारा (10) के अधीन केंरीय सलाहकार बोड चकी प्रदक्रया
3. बोड च का गिन—(1) बोडच धारा 42 की उपधारा (1) के खंड (क) और खडं (ख) में यथाजवजनर्ददष्ट जनयोिाओं और
कमचचाररयों का प्रजतजनजधत्व करने वाले केंरीय सरकार द्वारा नामजनर्ददष्ट व्यजियों स े और उस उपधारा के खडं (ग) और खडं
(घ) में यथाजवजनर्ददष्ट राज्य सरकार के प्रजतजनजधयों से जमलकर बनेगा ।
(2) धारा 42 की उपधारा (1) के खंड (क) में यथाजनर्ददष्ट जनयोिाओं का प्रजतजनजधत्व करन े वाले व्यजि 12 होंगे और उस
उपधारा के खडं (ख) में जनर्ददष्ट कमचचाररयों का प्रजतजनजधत्व करने वाल ेव्यजि भी 12 होंगे ।
(3) धारा 42 की उपधारा (1) के खंड (ग) में जवजनर्ददष्ट स्ट्वतंत्र व्यजियों को केंरीय सरकार द्वारा नामजनर्ददष्ट दकया िाएगा
और वह जनम्नजलजखत म ेंसे होंग,े अथाचत ् :--
(i) अध्यक्ष – राज्य मंत्री, स्ट्वतंत्र प्रभार, श्रम और रोिगार मंत्रालय, भारत सरकार ;
(ii) सजचव, भारत सरकार, श्रम और रोिगार मंत्रालय, भारत सरकार;
(iii) दो संसद ्सदस्ट्य;
(iv) चार सदस्ट्य, जिनम ेंसे प्रत्येक मिदरू ी और श्रम स ेसंबंजधत मुद्दों के क्षेत्र म ेंपेिेवर होगा;
(v) एक सदस्ट्य, िो औद्योजगक जववाद अजधजनयम, 1947 (1947 का 14) की धारा 7क के अधीन केंरीय सरकार
द्वारा गरित दकसी औद्योजगक अजधकरण का पीिासीन अजधकारी हो या रहा हो; और
(vi) दो सदस्ट्य, जिनमें से प्रत्येक धारा 42 की उपधारा (4) में जनर्ददष्ट ऐसे राज्य सलाहकार बोड च का यथासंभव
सदस्ट्य होगा, जिसे चक्रानुक्रम में राज्यों से जलया िाएगा ।
(4) धारा 42 के खंड (घ) में जनर्ददष्ट राज्य सरकारों के पांच प्रजतजनजध, जिनमें से प्रत्येक ऐसे राज्यों के राज्य श्रम जवभाग का
प्रधान सजचव या सजचव या आयुि होगा, िैसा दक केंरीय सरकार चक्रानुक्रम के आधार पर समय-समय पर अवधाररत करे।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3
(5) श्रम और रोिगार मंत्रालय के श्रम प्रभाग का भारसाधक सयं ुि सजचव बोडच का सदस्ट्य-सजचव होगा ।
(6) केंरीय सरकार बोड च के सदस्ट्यों को नामजनर्ददष्ट करते समय इस बात का ध्यान रखेगी दक उपजनयम (3) के अधीन स्ट्वतत्रं
सदस्ट्य बोडच के कुल सदस्ट्यों के एक-जतहाई से अनजधक होंगे और बोड चकी एक-जतहाई सदस्ट्य मजहलाएं होंगी ।
4. बोड चके अजतररि कृत्य—धारा 42 की उपधारा (3) में जवजनर्ददष्ट कृत्यों के अजतररि बोडच केंरीय सरकार के जनदेि पर उस
सरकार को जनम्नजलजखत के संबंध में न्द्यूनतम मिदरू ी को जनयम करन ेसे संबंजधत मद्दु ों पर परामिच देगा—
(i) श्रमिीवी पत्रकार और अन्द् य समाचारपत्र कमचचारी (सेवा की ित)ें और प्रकीणच उपबंध अजधजनयम, 1955
(1955 का 45) की धारा 2 के खंड (च) म ेंयथापररभाजषत श्रमिीवी पत्रकार; और
(ii) जवक्रय संवधचन कमचचारी (सेवा ित)च अजधजनयम, 1976 (1976 का 11) की धारा 2 के खंड (घ) म ें
यथापररभाजषत जवक्रय संवधचन कमचचारी ।
5. बोड च की बिै क—अध्यक्ष जनयम 32 के उपबंधों के अधीन रहते हुए दकसी भी समय, िब वह िीक समझ,े बोडच की बैिक
बुला सकेगा :
परंतु आधे से अजधक सदस्ट्यों की जलजखत अध्यपक्षे ा पर अध्यक्ष ऐसी अध्यपेक्षा की प्राजि की तारीख से 30 ददन के भीतर
बैिक बुलाएगा ।
6. बिै क की सचू ना—अध्यक्ष, प्रत्येक बैिक की तारीख, समय और स्ट्थान जनयत करेगा तथा पवू ोि जवजिजष्टयों के साथ ऐसी
बैिक में संचाजलत दकए िाने वाले कारबार की सूची को अंतर्ववष्ट करते हुए जलजखत सूचना प्रत्येक सदस्ट्य को रजिस्ट्रीकृत
डाक द्वारा और इलैक्ट्राजनकी रूप से ऐसी बैिक के जलए जनयत तारीख से कम स ेकम 15 ददन पूवच भेिी िाएगी :
परंत ु आकजस्ट्मक बैिक की दिा में प्रत्येक सदस्ट्य को कम से कम सात ददन की सूचना दी िाएगी ।
7. अध्यक्ष के कृत्य—अध्यक्ष,--
(i) बोड चकी बैिकों की अध्यक्षता करेगा :
परंतु दकसी बैिक में अध्यक्ष के अनुपजस्ट्थत होने पर सदस्ट्य स्ट्वयं में से मतों के बहुमत द्वारा दकसी सदस्ट्य का
चयन करेंग,े िो ऐसी बैिक की अध्यक्षता करेगा ;
(ii) बोडच की प्रत्येक बैिक म ेंएिेंडा का जवजनश्चय करेगा;
(iii) िहां बोडच की बैिक में दकसी मुद्दे का जवजनश्चय मतदान द्वारा दकया िाना ह,ै मतदान का संचालन करेगा और
बैिक में गोपनीय मतों की गणना करेगा या गणना करवाना काररत करेगा ।
8. गणपर्वू त--दकसी बैिक में दकसी कारबार का तब तक सव्यं वहार नहीं दकया िाएगा िब तक कम से कम एक-जतहाई
सदस्ट्य और जनयोिक तथा कमचचारी, दोनों मे से प्रत्येक का एक प्रजतजनजध उपजस्ट्थत नहीं होता ह ै:
परंत ु यदद दकसी बैिक में एक-जतहाई से कम सदस्ट्य उपजस्ट्थत ह,ैं अध्यक्ष मलू बैिक की तारीख से सात ददन से अन्द्यून के
जलए बैिक को स्ट्थजगत कर सकेगा और तत्पश्चात ् ऐसी स्ट्थजगत बैिक म ें उपजस्ट्थत सदस्ट्यों की दकसी संख्या के होत े हुए भी
कारबार का जनपटान करना जवजधपूवचक होगा :
परंत ु यह और दक ऐसी स्ट्थजगत बैिक की तारीख, समय और स्ट्थान स े सदस्ट्यों को इलैक्ट्राजनकी रूप से या रजिस्ट्रीकृत डाक
से संसूजचत दकया िाएगा ।
9. बोड च के कारबार का जनपटान—बोडच के सभी कारबार पर बोडच की बैिक में जवचार दकया िाएगा और उसका जवजनश्चय
उपजस्ट्थत और मत दने े वाले सदस्ट्यों के बहुमत द्वारा दकया िाएगा तथा मतों के बराबर होने की दिा में अध्यक्ष का
जनणाचयक मत होगा :
परंत ु अध्यक्ष यदद उपयुि समझे तो यह जनदेि दे सकेगा दक दकसी मामले का जवजनश्चय आवश्यक कागि-पत्रों के पररचालन
द्वारा और सदस्ट्यों की जलजखत राय प्राि करन ेके माध्यम से दकया िाएगा :
परंत ु यह और दक पूवचवती परंतकु के अधीन दकसी मामल े का जवजनश्चय तब तक नहीं दकया िाएगा िब तक उसको सदस्ट्यों

10. मत दने े की जवजध—बोडच में साधारणतया मतदान हाथ उिाकर दकया िाएगा ककतु यदद कोई सदस्ट्य मतपत्र द्वारा मत
देने के जलए कहता ह ै या अध्यक्ष इस प्रकार का जवजनश्चय करता ह ै तो मतदान गोपनीय मतपत्र द्वारा दकया िाएगा और
ऐसी रीजत में दकया िाएगा िैसा अध्यक्ष जवजनश्चय करे ।
11. बिै क की कायवच ाही—(1) बोडच की प्रत्येक बैिक की कायचवाजहयां, जिनमें अन्द्य बातों के साथ, उनम ें उपजस्ट्थत सदस्ट्यों के
नाम को उपदर्वित करत े हुए प्रत्येक सदस्ट्य को और केंरीय सरकार को बैिक के तुरंत यथािीघ्र पश्चात ्और दकसी भी दिा म ें
अगली बैिक स ेसात ददन से पवू च अग्रेजषत दकया िाएगा ।
(2) बोडच की प्रत्येक बैिक की कायचवाजहयों की ऐसे उपांतरणों के साथ, यदद कोई हों, जिन पर अगली बैिक म ें जवचार करना
आवश्यक हो, पूजष्ट की िाएगी ।
12. साक्ष्यों को समन करना और दस्ट्ताविे ों को प्रस्ट्ततु करना--(1) अध्यक्ष, यदद उसके कतचव्यों के जनवचहन के प्रक्रम में अपेक्षा
करे तो दकसी भी व्यजि को साक्षी के रूप म ें उपजस्ट्थत होन े के जलए समन कर सकेगा और दकसी व्यजि से दकसी दस्ट्तावेि
को प्रस्ट्तुत करन े की अपेक्षा कर सकेगा ।
(2) प्रत्येक व्यजि, जिसे समन दकया िाता ह ै और िो साक्षी के रूप म ें बोडच के समक्ष उपजस्ट्थत होता ह,ै तत्समय प्रवृत्त स्ट्केल
के अनुसार उसके द्वारा उपगत व्ययों के जलए भत्ते का और साजक्षयों को जसजवल न्द्यायालय के समक्ष साक्षी के रूप में
उपजस्ट्थत होने के जलए ऐस ेभत्ते का संदाय दकए िाने का हकदार होगा ।
ख. धारा 42 की उपधारा (11) के अधीन बोड चके सदस्ट्यों की पदावजध
13. बोड च के सदस्ट्यों की पदावजध--(1) इन जनयमों के उपबंधों के अधीन रहते हुए दकसी िासकीय सदस्ट्य से जभन्न दकसी
सदस्ट्य की पदावजध सामान्द्यत: धारा 42 की उपधारा (1) के अधीन, यथाजस्ट्थजत, उसकी जनयुजि या नामजनदेिन की
तारीख से प्रारंभ होकर दो वषच के जलए होगी :
परंत ु ऐसा सदस्ट्य दो वष च की उि अवजध के अवसान के होत े हुए भी तब तक पद पर रहगे ा िब तक, यथाजस्ट्थजत, उसके
उत्तरवती की जनयुजि या नामजनदेिन नहीं कर ददया िाता ह।ै
(2) जनयोिाओं या कमचचाररयों या बोडच के स्ट्वतंत्र व्यजियों का प्रजतजनजधत्व करन े वाला सदस्ट्य, जिसे आकजस्ट्मक ररजि को
भरने के जलए नामजनदेजित दकया िाता ह,ै उस सदस्ट्य, जिसके स्ट्थान पर उसको नामजनर्ददष्ट दकया िाता ह,ै की िेष
पदावजध के जलए पद धारण करेगा ।
(3) बोड च का िासकीय सदस्ट्य तब तक अपना पद धारण करेगा िब तक उसे उसके स्ट्थान पर जनयुि िासकीय सदस्ट्यों द्वारा
प्रजतस्ट्थाजपत नहीं कर ददया िाता ह ै।
(4) यदद बोड च का कोई सदस्ट्य बोडच की बैिक म ें भाग लेन े म ें असमथच रहता है, तो केंरीय सरकार या जनकाय, जिसने उसे
नामजनर्ददष्ट दकया ह,ै उसके जनजमत्त जलजखत हस्ट्ताक्षररत और ऐसे सदस्ट्य द्वारा बोड च के अध्यक्ष को नामजनर्ददष्ट सूचना द्वारा
उसके स्ट्थान पर उस बैिक म ें भाग लेन े के जलए उसके स्ट्थानापन को नामजनर्ददष्ट कर सकेगी । ऐसा स्ट्थानापन्न सदस्ट्य को उस
सदस्ट्य के ऐसी बैिक के संबंध म ेंसभी अजधकार होंगे ।
(5) उपजनयम (1), उपजनयम (2) और उपजनयम (3) म ें अंतर्ववष्ट दकसी बात के होते हुए भी बोडच के सदस्ट्य, केंरीय सरकार
के प्रसादपयंत पद धारण करेंगे ।
14. यात्रा भत्ता--(1) बोडच के िासकीय सदस्ट्य का यात्रा भत्ता उसे उसके द्वारा िासकीय कतव्यच ों के पालन में की गई यात्रा
के जलए लाग ूजनयमों द्वारा िाजसत होगा और उसको उसका वेतन संदाय करने वाले प्राजधकारी द्वारा संदत्त दकया िाएगा ।
(2) जनयम 3 के उपजनयम (3)(iii) के अधीन नामजनर्ददष्ट सदस्ट्य ऐस े यात्रा और दैजनक भत्तों का हकदार होगा, िो उस े
केंरीय सरकार द्वारा गरित सजमजत और आयोगों म ेंसंसद ्सदस्ट्य के रूप म ेंजनयुि होने पर अनज्ञु ेय होंग े।
(3) बोड च का गैर-िासकीय सदस्ट्य उसके द्वारा बोड च के ऐसे सदस्ट्य के रूप म ें की गई यात्राओं और जनष्पाददत कतव्यच ों के जलए
यात्रा और िहराव भत्ता ऐसी दरों पर और व्यय जवभाग, जवत्त मंत्रालय, भारत सरकार के अनुदेिों म ें जवजनर्ददष्ट ितों और
पररमाण तक आहररत करन े का हकदार होगा ।
15. अजधकारी और कमचच ाररवदृं —केंरीय सरकार बोड च को उतने अजधकाररयों और कमचचाररयों को उपलब्ध कराएगी, िो

16. बोड चके सदस्ट्यों की पनु : नामजनदिे न के जलए पात्रता—बोडच का जनवृत्त होने वाला सदस्ट्य बोडच की सदस्ट्य के जलए तीन स े
अनजधक पदावजधयों के जलए पात्र होगा ।
17. बोड च के सदस्ट्यों का त्याग-पत्र--(1) िासकीय सदस्ट्य से जभन्न बोडच का सदस्ट्य अध्यक्ष को जलजखत सूचना द्वारा अपनी
सदस्ट्यता से त्याग-पत्र दे सकेगा ।
(2) त्याग-पत्र उसकी स्ट्वीकृजत की संसूचना से या त्याग-पत्र की तारीख से 30 ददन के अवसान पर, इनमें से िो भी पूवचत्तर
हो, प्रभावी होगा ।
(3) िब बोड च की सदस्ट्यता म ें कोई ररजि उत्पन्न होती ह ै या उत्पन्न होन े की संभावना होती ह ै तो केंरीय सरकार ररजि को
भरने के जलए संजहता के उपबंधों के अनुसार कदम उिाएगी ।
18. सदस्ट्यता का समाि होना—यदद बोडच का कोई सदस्ट्य अध्यक्ष को पूवच संसूचना के जबना तीन लगातार बैिकों में भाग
लेन े में असफल रहता ह ैतो वह बोडच का सदस्ट्य नहीं रहगे ा ।
19. जनरहतच ा--(1) कोई व्यजि, बोडच के सदस्ट्य के रूप में नामजनर्ददष्ट दकए िाने के जलए या सदस्ट्य होने के जलए जनरर्वहत
होगा--
(i) यदद उसे सक्षम न्द्यायालय द्वारा जवकृतजचत्त घोजषत दकया िाता है; या
(ii) वह अननुमोजचत ददवाजलया ह;ै या
(iii) यदद उसे इस संजहता के प्रारंभ होने से पूव च या पश्चात ् दकसी नजै तक अधमता को अंतवचजलत करन े वाले अपराध
के जलए दोषजसद्ध िहराया गया ह ै ।
(2) यदद कोई प्रश्न उदभूत होता ह ै दक उपजनयम (1) के अधीन कोई जनरहतच ा उपगत कर ली गई ह ै तो केंरीय सरकार का
जवजनश्चय अंजतम होगा ।

NOTIFICATION
New Delhi, the 1st March, 2021
G.S.R. 143(E).—Whereas the draft of certain rules which the Central Government proposes to
make, in exercise of the powers conferred by sub-section (1) of section 67 of the Code on Wages, 2019 (29
of 2019) were published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i), vide
number G.S.R. 432(E), dated 07th July, 2020 as required by sub-section (1) of section 67 of the Code,
inviting objections and suggestions from all persons likely to be affected thereby on or before the expiry of
a period of forty-five days from the date of publication of the said notification in the Official Gazette;
And whereas, the said draft contains the proposed rules relating to –
(i) sub-sections (1), (2), (3), (10) and (11) of section 42 (to the extent they relate to the Central
Advisory Board);
(ii) clause (s) and (t) of sub-section (2) of section 67 (to the extent they relate to the Central
Advisory Board);
(iii) section 69 [to the extent it relates to sections 7 and 9 (to the extent they relate to the Central
Government) and section 8 of the Minimum Wages Act, 1948 (11 of 1948)];
And whereas, the objections and suggestions received from the persons likely to be affected, before
the expiry of the said forty-five days have been considered by the Central Government;
Now, therefore, in exercise of the powers conferred by clauses (s) and (t) of sub-section (2) of
section 67 (to the extent they relate to the Central Advisory Board) of the Code on Wages, 2019 (29 of
2019) and in supersession of the Minimum Wages (Central Advisory Board) Rules, 2011, and the6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
provisions of the Minimum Wages (Central) Rules, 1950 in so far as they relate to sections 7 and 9 (to the
extent they relate to the Central Government) and section 8 of Minimum Wages Act, 1948 (11 of 1948),
except as respects things done or omitted to be done before such supersession, the Central Government
hereby makes the following rules, namely:-
CHAPTER-I
PRELIMINARY
1. Short title, extent and commencement, - (1) These rules may be called the Code on Wages (Central
Advisory Board) Rules, 2021.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions. – In these rules, unless the context otherwise requires, -
(a) ―Board‖ means the Central Advisory Board constituted by the Central Government under sub-
section (1) of section 42;
(b) ―Chairperson‖ means the Chairperson of the Board;
(c) ―Code‖ means the Code on Wages, 2019 (29 of 2019);
(d) ―member‖ means a member of the Board;
(e) ―section‖ means a section of the Code;
(f) Words and expressions used in these rules and not defined in these rules shall have the meanings
respectively assigned to them in the Code.
CHAPTER-II
Central Advisory Board
A. Procedure of Central Advisory Board under sub-section (10) of section 42
3. Constitution of the Board. - (1) The Board shall consist of the persons to be nominated by the Central
Government representing employers and employees as specified in clauses (a) and (b) of sub-section (1) of
section 42 and the independent persons and representatives of the State Governments as specified in clauses
(c) and (d) of that sub-section.
(2) The persons representing employers as referred to in clause (a) of sub-section (1) of section 42 shall be
twelve and the persons representing employees referred to in clause (b) of that sub-section shall also be
twelve.
(3) The independent persons specified in clause (c) of sub-section (1) of section 42 to be nominated by the
Central Government shall consist of the following, namely:-
(i) the Chairperson – Minister of State, Independent Charge, Ministry of Labour and Employment,
Government of India;
(ii) Secretary to the Government of India, Ministry of Labour and Employment;
(iii) two Members of Parliament;
(iv) four members each of whom, shall be a professional in the field of wages and labour related
issues;
(v) one member who is or has been a presiding officer of an Industrial Tribunal constituted by the
Central Government under section 7A of the Industrial Disputes Act, 1947 (14 of 1947); and
(vi) two members, each of whom shall be the Chairperson of such State Advisory Board referred to
in sub-section (4) of section 42, to the extent possible, to be taken in rotation from the States.
(4) five representatives of the State Governments referred to in clause (d) of section 42 shall each be the
Principal Secretary or Secretary or Commissioner of the State Labour Department of such States as the

(5) Joint Secretary in-charge of the Wage Division, in the Ministry of Labour and Employment,
Government of India shall be the Member Secretary to the Board.
(6) The Central Government shall, while nominating the members of the Board, take into account that the
independent members under sub-rule (3) shall not exceed one-third of the total members of the Board and
one-third of the members of the Board shall be women.
4. Additional functions of the Board. - In addition to the functions specified in sub-section (3) of section
42, the Board on reference by the Central Government advise that Government on the issue relating to the
fixation of minimum wages in respect of-
(i) working journalists as defined in clause (f) of section 2 of the Working Journalists and other
Newspaper Employees (Conditions of Service) and Miscellaneous Provisions Act,1955 (45 of
1955); and
(ii) sales promotion employees as defined in clause (d) of section 2 of the Sales Promotion Employees
(Conditions of Service) Act, 1976 (11 of 1976).
5. Meeting of the Board. - The Chairperson may, subject to the provisions of rule 32, call a meeting of the
Board, at any time he thinks fit:
Provided that on requisition in writing from not less than one half of the members, the Chairperson
shall call a meeting within thirty days from the date of the receipt of such requisition.
6. Notice of meetings. - The Chairperson shall fix the date, time and place of every meeting and a notice in
writing containing the aforesaid particulars along with a list of business to be conducted at the meeting
shall be sent to each member by registered post and electronically at least fifteen days before the date fixed
for such meeting:
Provided that in the case of an emergent meeting, at least seven days notice may be given to every
member.
7. Functions of Chairperson.– The Chairperson shall,-
(i) preside at the meetings of the Board:
Provided that in the absence of the Chairperson at any meeting, the members shall elect
from amongst themselves by a majority of votes, a member who shall preside at such meeting;
(ii) decide agenda of each meeting of the Board;
(iii) where in the meeting of the Board, if any issue has to be decided by voting, conduct the voting
and count or cause to be counted the secret voting in the meeting.
8. Quorum. - No business shall be transacted at any meeting unless at least one-third of the members and
at least one representative member each of both the employers and an employee are present:
Provided that, if at any meeting less than one-third of the members are present, the Chairperson
may adjourn the meeting to a date not later than seven days from the date of the original meeting and it
shall thereupon be lawful to dispose of the business at such adjourned meeting irrespective of the number
of members present:
Provided further that the date, time and place of such adjourned meeting shall be intimated to all
the members electronically or by a registered post.
9. Disposal of business of the Board.- All business of the Board shall be considered at a meeting of the
Board, and shall be decided by a majority of the votes of members present and voting and in the event of an
equality of votes, the Chairperson shall have a casting vote:
Provided that the Chairperson may, if he thinks fit, direct that any matter shall be decided by the
circulation of necessary papers and by securing written opinion of the members:
Provided further that no decision on any matter under the preceding proviso shall be taken, unless
supported by not less than two-thirds majority of the members.
10. Method of voting.- Voting in the Board shall ordinarily be by show of hands, but if any member asks
for voting by ballot, or if the Chairperson so decides, the voting shall be by secret ballot and shall be held in

11. Proceedings of the meetings.- (1) The proceedings of each meeting of the Board showing, inter alia,
the names of the members present thereat shall be forwarded to each member and to the Central
Government as soon as possible immediately after the meeting, and in any case, not less than seven days
before the next meeting.
(2) The proceedings of each meeting of the Board shall be confirmed with such modification, if any, as
may be considered necessary at the next meeting.
12. Summoning of witnesses and production of documents. - (1) The Chairperson may summon any
person to appear as a witness if required in the course of the discharge of his duty and require any person to
produce any document.
(2) Every person who is summoned and appears as a witness before the Board shall be entitled to an
allowance for expenses incurred by him in accordance with the scale for the time being in force for
payment of such allowance to witnesses appearing before a Civil Court.
B. Terms of office of members of the Board under sub-section (11) of section 42
13. Term of office of members of the Board.- (1) Subject to the provisions of these rules, the term of
office of a member, other than an official member, shall be normally two years commencing from the date
of his appointment or nomination, as the case may be, under sub-section (1) of section 42:
Provided that such a member shall, notwithstanding the expiry of the said period of two years,
continue to hold office until his successor is appointed or nominated, as the case may be.
(2) A member representing employers or employees or independent persons of the Board nominated to fill
a casual vacancy shall hold office for the remaining period of the term of office of the member in whose
place he is nominated.
(3) The official members of the Board shall hold office till they are replaced by the other official members
appointed in their place.
(4) If a member of the Board is unable to attend a meeting of the Board, the Central Government or the
body which nominated him may, by notice in writing signed on its behalf and by such member and
addressed to the Chairperson of the Board, nominate a substitute in his place to attend that meeting. Such a
substitute member shall have all the rights of a member in respect of the meeting.
(5) Notwithstanding anything contained in sub-rules (1), (2), and (3), the members of the Board shall hold
office during the pleasure of the Central Government.
14. Travelling allowance.- (1) The travelling allowance of an official member of the Board shall be
governed by the rules applicable to him for journey performed by him on official duties and shall be paid
by the authority paying his salary.
(2) A member nominated under sub-rule (3)(iii) of rule 3 shall be entitled to such travelling and daily
allowances as may be admissible to him as Member of Parliament appointed in Committees and
Commissions set up by the Central Government.
(3) A non-official member of the Board shall be entitled to draw travelling and halting allowance for any
journey performed by him in connection with his duties as such member of the Board at the rates and
subject to the conditions specified in the extant instructions of Department of Expenditure, Ministry of
Finance, Government of India.
15. Officers and Staff.- The Central Government may provide officers and staff to the Board, as it may
think necessary for the functioning of the Board.
16. Eligibility for re-nomination of the members of the Board.- An outgoing non-official member shall
be eligible for re-nomination for the membership of the Board for not more than total three terms.
17. Resignation of members of the Board.- (1) A member of the Board, other than official members, may,
by giving notice in writing to the Chairperson, resign his membership.
(2) A resignation shall take effect from the date of communication of its acceptance or on the expiry of
thirty days from the date of resignation, whichever is earlier.
(3) When a vacancy occurs or is likely to occur in the membership of the Board, the Central Government
shall take steps to fill the vacancy in accordance with the provisions of the Code.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9
18. Cessation of membership.- If a member of the Board, fails to attend three consecutive meetings,
without prior intimation to the Chairperson, he shall, cease to be a member thereof.
19. Disqualification.- (1) A person shall be disqualified for being nominated as, and for being a member of
the Board–
(i) if he is declared to be of unsound mind by a competent court; or
(ii) if he is an un-discharged insolvent; or
(iii) if before or after the commencement of the Code, he has been convicted of an offence involving
moral turpitude.
(2) If any question arises whether a disqualification has been incurred under sub-rule (1), the decision of the
Central Government thereon shall be final.
