ऄब, ऄतः के्रीय सरकार, िायुयान ऄजधजनयम, 1934 (1934 का 22) की धारा 4, 5, 7 तथा 10 द्वारा प्रदत् त
िजयय का प्रयोग करते हुए, िायुयान (दघु चटनाओं रर घटनाओं का ऄ् िेषण)ण) जनयम, 2017 का रर संिोधन करने के
जलए जनम् नजलजखत जनयम बनाती ह,ै ऄथाचत -
1. संजक्षप्त नाम रर प्रारंभ - (1) आन जनयम का संजक्षप् त नाम िायुयान (दघु चटनाओं रर घटनाओं का ऄ्ि ेषण)ण)
जनयम, 2021 ह।ै
(2) ये जनयम रािपत्र में आनके ऄंजतम प्रकािन की तारीख को प्रिृत ह गे।

2. िायुयान (दघु चटनाओं रर घटनाओं का ऄ्ि ेषण)ण) जनयम, 2017 (जिसे आसमें आसके पश्चात जनयम कहा गया ह)ै के,
जनयम 2 में –
(i) खंड (1), ईपखंड (ग) में, टटप्पण 2 के पश् चात, जनम् नजलजखत टटप्पण, ऄ्तः स्ट्थाजपत दकया िाएगा, ऄथाचत:-
“टटप्पण 3. दकसी जिमान को लापता मान जलया िाएगा, िब अजधकाटरक रूप से खोि बंद की िा चुकी हो रर
मलबे का पता नहीं लगाया िा सका हो।”
(ii) खण्ड (3) में, ‘‘ईसे दिे द्वारा नाम जनर्ददष् ट दकया गया हो रर िहां दिे ने कोइ दघु चटना ऄ् िेषण)ण प्राजधकरण
स्ट्थ ाजपत दकया हो, तो ना जनर्ददष्ट प्रत्य ाजपत प्रजतजनजध ईस प्राजधकरण से जलया िा सकता है” िब्द के स्ट्थान पर "दिे
रर प्रत्य ाजयत प्रजतजनजध, सामा्यताः दिे के दघु चटना ऄ्िेषण)ण प्राजधकरण से ह गे" िब्द रखे िाएंगे।
(iii) ईप-खंड (27) के पश्च ात, जनम् नजलजखत ईप-जनयम ऄंत:स्ट्थ ाजपत दकया िाएगा, ऄथाचत:–
“(27क) “िैजिक प्रजतष् ठान की संरक्षा जसराटरि (एसअरिीसी)” पुनरािृजतिय की संभािना िाली
प्रणालीगत खामी के संबंध में, िैजिक स्ट् तर पर ईल् लखे नीय पटरणाम सजहत, संरक्षा जसराटरि रर
जिसके जलए संरक्षा में सुधार लाने के जलए समयबद्ध कारचिाइ ऄपेजक्षत ह।ै ”
(iv) ईप-खंड (30) में, ‘‘दघु चटना’’ िब् द के स्ट्थान पर ‘‘घटना’’ िब्द रखा िाएगा।
(v) ईप-खंड (36) के पश्च ात, जनम् नजलजखत ईप-जनयम ऄंत:स्ट् थाजपत दकया िाएगा, ऄथाचत:–
“(37) “यूटीसी” से सािचभौजमक समय समज्ित ऄजभप्रेत ह।ै ”
3. ईक् त जनयम में, खंड 4 में, ईप-जनयम (2) में,–
i. खंड (क) में, ‘‘घटनाओं के जलए अइएनसीअइडी’’ िब्द के पश्च ात, ‘‘गंभीर घटनाओं के जलए एसअइएनसीअइडी’’
िब् द ऄंत:स्ट् थाजपत दकए िाएंगे।
ii. खंड (ङ) में, ‘‘तारीख रर समय’’ िब् द के पश् चात ‘‘(स्ट्थ ानीय समय या यूटीसी)’’ िब्द ऄंत:स्ट्थ ाजपत दकए िाएंगे।
4. ईक् त जनयम में, जनयम 5 में,-
i. ईप-जनयम (1), खंड (घ) में, ‘‘दघु चटना’’ िब् द के स्ट्थ ान पर ‘‘घटना’’ िब्द रखा िाएगा।
ii. ईप- जनयम (2) में, ‘‘दकसी भी पटरजस्ट्थजत’’ िब् द के पश्च ात ‘‘घटना या एक’’ िब्द तथा ‘‘की पटरजस्ट्थजतय ’’ िब्द
के पश्च ात ‘‘एक घटना या’’ िब् द का लोप दकया िाएगा।
5. ईक् त जनयम में, खंड 7 में, ईप-खंड (3) म,ें -
i. ‘‘आन जनयम के ऄधीन’’ िब्द के पश्च ात ‘‘जनदिे िारी करना’’ िब् द ऄंत:स्ट् थाजपत दकए िाएंगे।
ii. ईपबंध (ग) के पश्च ात, जनम् नजलजखत ईपबंध ऄंत:स्ट् थाजपत दकया िाएगा, ऄथाचत -
"(घ) दकसी ईपयुक् त स्ट्थ ान की व्य िस्ट् था करना रर ेसे स्ट्थ ान तक मलबे के पटरिहन का सुगमीकरण।"
6. ईक् त जनयम में, जनयम 8 में, ईप-खंड (3) में,–
(i) ईपबंध (ि) में, ‘‘आसका’’ िब् द के पश् चात ‘‘रर’’ िब्द का लोप दकया िाएगा।
(ii) ईपबंध (ि) के पश्च ात, जनम् नजलजखत ईपबंध ऄंत:स्ट् थाजपत दकया िाएगा, ऄथाचत-
“(िक) आकाओ को िैजिक प्रजतष् ठान की संरक्षा जसराटरि (एसअरिीसी) िारी करने के बारे में सूजचत
करना रर जतजथबद्ध पत्र-व्य िहार में ईसके प्रत्य ुत्त र, िब एसअरिीसी आकाओ को संबोजधत न हो तब भी; रर”
7. ईक् त जनयम में, जनयम 11 में, ईप-जनयम (5) के पश्च ात, जनम् नजलजखत ईप-जनयम ऄंत:स्ट् थाजपत दकया िाएगा, ऄथाचत
“(6) डीिी, एएअइबी प्रभारी ऄ् िेषण)क की टरपोटच स्ट्ि ीकार करेंगे रर स्ट्ि ीकृजत के पश्च ात, डीिी, एएअइ द्वारा,
ईस टरपोटच को ेसी रीजत से, िैसा िह ईजचत समाे, सािचिजनक दकया िाएगा।”[भाग II—खण् ड 3(i)] भारत का रािपत्र : ऄसाधारण 3
8. ईक् त जनयम में, जनयम 23 का लोप करने के पश्च ात, जनम् नजलजखत जनयम ऄंत:स्ट् थाजपत दकया िाएगा, ऄथाचत -
“24. एएअइबी बलु ेटटन – (1) डीिी, एएअइबी, एएअइबी िीषण)चक िाले बुलेटटन के प्रकािन / माध् यम से,
भारत में या भारत के उपर ईडान भरने िाले जिमान या भारत के रजिस्ट्री जिमान की दघु चटनाओं रर गंभीर
घटनाओं के ऄ् िेषण)ण के संबंध में ेसी सूचना िारी कर सकता है, िो िायुयान ऄजधजनयम, 1934 (1934 का
22) रर आन जनयम से ऄसंगत न ह ।”
9. ईक् त जनयम में, ऄनुसूची क में -
(i) ईपबंध (क) के पश्चात, जनम्न जलजखत टटप् पण को ऄंत:स्ट्थ ाजपत दकया िाएगा, ऄथाचत:–
“टटप् पण: आकाओ दस्ट् तािेि 4444 में यथा ईजल्लजखत ‘‘टकराि का िोजखम’’ रर ‘‘बीमाकृत नहीं की गइ संरक्षा’’
तीव्रता के साथ िगीकृत ‘लगभग टकराि’ को गंभीर घटना के रूप में िगीकृत दकया िाएगा।”
(ii) खंड (च) में, ‘‘टैक् सीिे या ऄनािंटटत रनिे’’ िब्द के स्ट्थान पर ‘‘टैक् सीिे, ऄनािंटटत रनिे या ऄनाजभप्रेत ऄिजस्ट्थजतयां
िैसे रोडिेि’’ िब् द को रखा िाएगा।
(iii) खंड (ठ) के पश्च ात, जनम् नजलजखत खंड रखा िाएगा, ऄथाचत -
“(ठ) ईडान के दौरान ईडान कमीदल का ऄक्षम हो िाना;
(i) टरमोट पायलट सजहत एकल पायलट प्रचालन के जलए;
(ii) बहु-पायलट प्रचालन के जलए, जिसके जलए िेषण) कमीदल के कायचभार में ऄत्य जधक िृजद्ध के कारण ईडान
संरक्षा से समाौता दकया गया।”
(iv) खंड (त) ‘‘जिरलताओं’’ िब् द के पश् चात ‘‘पॉिर या थ्रस्ट् ट की कमी सजहत’’ िब्द ऄंत:स्ट् थाजपत दकए िाएंगे।
(v) खंड (त) में पश्चात, जनम्नजलजखत ईपबंध ऄंत:स्ट् थाजपत दकया िाएगा, ऄथाचत:-
“(ध) ऄितरण (लैंडडग) गीयर लैग का प्रत्य ाहार (टररेक् िन) या पजहय के ईपर होने की जस्ट्थजत के साथ ऄितरण
(व्ह ील्स-ऄप लैंडडग) जिसे दघु चटना के रूप में िगीकृत न दकया गया हो।”
(vi) खंड (ध) के पश्चात, जनम्नजलजखत खंड ऄंत:स्ट्थ ाजपत दकया िाएगा, ऄथाचत:–
“(न) दकसी डिग टटप, दकसी आंजिन पॉड या जिमान के दकसी ऄ्य जहस्ट् स े का ऄितरण के दौरान जघसट िाना
(ड्रैडगग), िब आसे एक दघु चटना के रूप में िगीकृत न दकया गया हो।”
10. ईक् त जनयम में, ऄनुसूची ख में -
1. ‘‘ऄनुसूची ख’’ के ऄधीन ‘‘2(क)’’ िगच कोष् ठक में ऄंक ‘‘2(क)’’ के स्ट्थ ान पर ‘‘2(1)’’ ऄंक को रखा िाएगा।
2. खंड 9 में, ‘‘जिमान ऄथाचत ऄ् यथा’’ िब्द के स्ट्थ ान पर, ‘‘जिमान ने ऄ्य था’’ को रखा िाएगा।

NOTIFICATION
New Delhi, the 30th March, 2021
G.S.R. 222(E).—Whereas, the draft of rules, were published, as required under section 14 of the
Aircraft Act, 1934 (22 of 1934), vide notification of the Government of India in the Ministry of Civil
Aviation, in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide number G.S.R. 761
(E), dated the 15th December, 2020, inviting objections and suggestions from persons likely to be affected,
before the expiry of a period of thirty days from the date on which copies of the Gazette of India in which
the said notification was published were made available to the public;
And whereas, copies of the said Gazette notification were made available to the public on the 15th
December, 2020;
And whereas, the objections and suggestions received from the public in respect of the draft
amendment rules have been considered by the Central Government;
Now, therefore, in exercise of the powers conferred by section 4, 5, 7 and 10 of the Aircraft Act,
1934 (22 of 1934), the Central Government hereby makes the following rules further to amend the Aircraft
(Investigation of Accidents and Incidents) Rules, 2017, namely:—
1. Short title and commencement - (1) These rules may be called as the Aircraft (Investigation of Accidents
and Incidents) Amendment Rules, 2021.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Aircraft (Investigation of Accidents and Incidents) Rules, 2017 (hereinafter referred to as the said
rules), in rule 2, —
(i) in clause (1), sub-clause (c), after Note 2, the following Note shall be inserted, namely :—
―Note3. An aircraft shall be considered as missing when the official search has been terminated and
the wreckage has not been located.‖
(ii) in clause (3), for the words ―State and where the State has established an accident investigation
authority, the designated accredited representative would normally be from that authority‖, the words
―State, and the accredited representative would normally be from the state’s accident investigation
authority‖ shall be substituted;
(iii) after sub-clause (27), the following clause shall be inserted, namely :—
―(27A) ―Safety recommendation of global concern (SRGC) – A safety recommendation regarding a
systemic deficiency having a probability of recurrence, with significant consequences at a global level,
and requiring timely action to improve safety;‖;
(iv) in sub-clause (30), for the word ―accident‖, the word ―occurrence‖ shall be substituted;
(v) after sub-clause (36), the following clause shall be inserted, namely :—
―(37) ―UTC‖ means Universal Time Co-ordinated.‖
3. In the said rules, in rule 4, in sub-rule (2), —
(i) in clause (a), after the words and letters ―for incidents INCID‖, the words ―for serious incidents
SINCID,‖ shall be inserted.
(ii) in clause (e), after the words ―date and time‖, the words, brackets and letters ―(local time or UTC)‖
shall be inserted.
4. In the said rules, in rule 5, —
(i) in sub-rule (1), in clause (d), for the word, ―accident‖, the word ―occurrence‖ shall be substituted;
(ii) in sub-rule (2), the words ―incident or a‖ after the words ―circumstances of any‖ and the words ―an

5. In the said rules, in rule 7, in sub-rule (3), —
(i) the words "issue directions" shall be inserted after the words " under these rules,";
(ii) after clause (c), the following clause shall be inserted, namely : —
"(d) for arranging a suitable place and facilitation of transportation of wreckage to such a place."
6. In the said rules, in rule 8, sub-rule (3), —
(i) in clause (h), the word ―and‖ after the words "of the same;" shall be deleted.
(ii) after clause (h), the following clause shall be inserted, namely : —
―(ha) to inform ICAO of the issuance of a Safety Recommendation of Global Concern (SRGC)
and its responses in dated transmittal correspondence, even when the SRGC is not addressed to
ICAO; and‖.
7. In the said rules, in rule 11, after sub-rule (5), the following sub-rule shall be inserted, namely : —
―(6) The DG, AAIB shall accept the report of the Investigator-in-Charge and after acceptance,
the same shall be made public by the DG, AAIB in a manner he deems fit.‖
8. In the said rules, after omitted rule 23, the following rule shall be inserted, namely : —
―24. AAIB Bulletins. – (1) The DG, AAIB may, through publication entitled AAIB Bulletins,
issue information not inconsistent with the Aircraft Act, 1934 (22 of 1934) and these rules,
relating to the investigation of accidents and serious incidents of aircraft flying in or over India or
of aircraft registered in India.‖
9. In the said rules, in schedule A, —
(i) after clause (a), the following note shall be inserted, namely : —
―Note: Near collision classified with severity ―Risk of Collision‖ and ―Safety not assured‖ as in
ICAO Doc 4444 shall be classified as serious incident.‖
(ii) in Clause (f), for the words ―taxiway or unassigned runway‖, the words ―taxiway, unassigned
runway or unintended landing locations such as roadways‖ shall be substituted.
(iii) For the clause (l), the following clause shall be substituted, namely : —
―(l) Flight crew incapacitation in flight;
(i) for single pilot operations including remote pilot; ;
(ii) for multi-pilot operations for which flight safety was compromised because of a
significant increase in workload for the remaining crew.‖
(iv) in clause (p), the words ―including loss of power or thrust‖ shall be inserted after the word
―failures‖;
(v) after clause (p), the following clause shall be inserted, namely : —
―(s) retraction of a landing gear leg or wheels-up landing not classified as an accident.‖
(vi) after clause (s), the following clause shall be inserted, namely : —
―(t) dragging during landing of a wing tip, an engine pod or any other part of the aircraft, when

10. In the said rules, in Schedule B, —
(i) in the square brackets under ―Schedule B‖, the characters ―2(1)‖ shall be substituted for the
characters ―2(a)‖;
(ii) in the clause 9, for the words ―aircraft as otherwise‖, the words ―aircraft has otherwise‖ shall be
substituted.
