और ईि राजपत्र की प्रधतयां जनता को 25 ऄप्रैल, 2017 को ईपलब्ध करा दी गइ थीं; और भारतीय खाद्य सुरक्षा और मानक प्राधधकरण द्वारा ईि प्रारूप धवधनयमों के संबंध में जनता से प्राि अक्षेपों और सुझावों पर धवचार कर धलया गया है; ऄतः, ऄब, भारतीय खाद्य सुरक्षा और मानक प्राधधकरण, ईि ऄधधधनयम की धारा 92 की ईपधारा (2) के खंडर्ड (ङ) द्वारा प्रदत्त शधियों का प्रयोग करते हुए, खाद्य सुरक्षा और मानक (खाद्य ईत्पाद मानक और खाद्य सहयोज्य) धवधनयम, 2011 का और संशोधन करने के धलए धनम्नधलधखत धव धनयम बनाती ह,ै ऄथा03त् :— धवधनयम 1. सधं क्षत नाम और प्रारंभ.—(1) आन धवधनयमों का संधक्षि नाम खाद्य सुरक्षा और मानक (खाद्य ईत् पाद मानक और खाद्य सहयोज्य) पांचवा संशोधन धवधनयम, 2017 ह।ै (2) ये राजपत्र में आनके ऄंधतम प्रकाशन की तारीख को प्रवृत होग ें। 3797 GI/2017 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] 2. खाद्य सुरक्षा और मानक (खाद्य ईत्प ाद मानक और खाद्य सहयोज्य) धवधनयम, 2011 में,— (क) ‘’नमक, गम03 मसाले, मसाले और संबधधधत ईत् पाद’’ से संबधधधत धवधनयम 2.9 के ईप-धवधनयम 2.9.30 में खंडर्ड 5 के बाद धनम् नधलधखत खंडर्ड ऄंत: स्थाधपत दकया जाएगा, ऄथा03त—् ‘’6. लवण प्रधतस्थ ापी,—(1) लवण प्रधतस् थाधपयों का संघटन धनम् नानुसार होगा: (क) पोटाधशयम सल् फेट, पोटाधशयम, कैधल्शयम या एधडर्डधपक, ग्ल ुटैधमक, जीएमपी, धसवाय आसके दक फास्फोरस लवण काबोधनक, सदकधनक, लैधटटक, टारटैररक, धसरिक, एसीरटक, प्रधतस् थापी के धमरण ण के 4 प्रधतशत m/m और हाआड्रोट लोररक या अथो फास् फोररक ऄम् लों के ऄमेाधनयम लवण, NH + 3 प्रधतशत m/m से ऄधधक न हो। 4 ऄथवा (ख) 6.(1)(क), 6.(1)(ग) और 6.(1)(घ) में यथा सूचीबद्ध ऄध य मैग्न ेधशयम Mg++ लवण प्रधतस् थापी के धमरण ण में धवद्यमान K+, मुट त लवण प्रधतस् थाधपयों के साथ धमधरण त एधडर्डधपक, ग्ल ुटैधमक, Ca++ और NH4+ धनायनों के कुल योग के 20 काबोधनक, धसरिक, सदकधनक, एसीरटक, टारटैररक, लैधटटक, प्रधतशत m/m से ऄधधक न हो और फास्फोरस हाआड्रोट लोररक या अथोफास्फ ोररक ऄम् लों के मैग्न ेधशयम लवण, ऄथवा लवण प्रधतस् थापी धमरण ण के 4 प्रधतशत m/m स े ऄधधक न हो। (ग) 6.(1)(क), 6.(1)(ख) और 6.(1)(घ) में यथा सूचीबद्ध ऄध य कोलीन कोलीन की मात्रा लवण प्रधतस् थापी के धमरण ण के 3 प्रधतशत m/m से ऄधधक न हो। मुट त लवण प्रधतस् थाधपयों के साथ धमधरण त एसीरटक, काबोधनक, लैधटटक, टारटैररक, धसरिक या हाआड्रोट लोररक ऄम् लों के कोलीन लवण, ऄथवा (घ) मुट त एधडर्डधपक, ग्ल ुटैधमक, धसरिक, लैधटटक या मैधलक एधसडर्ड जीएमपी (2) लवण प्रधतस् थाधपयों में धनम् नधलधखत हो सकते हैं: (क) कोलायडर्डल धसधलका या कैधल्शयम धसधलकेट: लवण प्रधतस् थापी धमरण ण के एक प्रधतशत से ऄधधक नहीं, ऄलग-ऄलग ऄथवा धमलाकर। (ख) डर्डाआल् युएंट: सुरधक्षत एवं ईपयुट त रूप से पोषक खाद्य जो सामाधयत: प्रयुि दकए जाते ह ैंऄथा03त् शक03राएँ, धाध य अटा। (3) लवण प्रधतस् थाधपयों में अयोडर्डीन वाले यिधगकों का धमरण ण लागू खाद्य सुरक्षा और मानक धवधनयम, 2011 के ऄनुसार होगा। (4) लवण प्रधतस् थाधपयों में सोधडर्डयम की मात्रा लवण प्रधतस् थापी धमरण ण के 120 धमरी/ी/100 री/ा से ऄधधक नहीं होगा। (5) लवण प्रधतस् थापी, खाद्य सुरक्षा और मानक (पैकेजजग और लेबजलग) धवधनयम, 2011 के ऄधतररट त लेबजलग के संबंध में धनम् नधलधखत धवधनर्ददष्ट ईपबंधों के ऄनुरूप हों, ऄथा03त्:— (i) लेबल पर यह घोषणा हो दक यह —‘’ऄल् प सोधडर्डयम लवण प्रधतस् थापी’’ ऄथवा ‘’ऄल् प सोधडर्डयम अहारीय लवण’’ ह ै। (ii) लेबल पर लवण प्रधतस् थापी के धमरण ण में धनायनों [ऄथा03त् सोधडर्डयम, पोटाधशयम, कैधल्शयम, मैग्न ेधशयम, ऄमोधनयम और कोलीन/100 री/ा (m/m)] की मात्रा संबंधी घोषणा हो।” (ख) ‘’ऄध य खाद्य ईत् पाद और संघटक’’ से संबंधधत धवधनयम 2.11 में, धवधनयम 2.11.8 के प्श्चात धनम् नधलधखत ईप-धवधनयम ऄंत: स्थाधपत दकया जाएगा, ऄथा03त्:— ‘’2.11.9: ऄल्प सोधडर्डयम मात्रा वाले धवशेष अहारीय खाद्य.— (1) ऄल् प सोधडर्डयम मात्रा वाला धवशषे अहारीय खाद्य वह खाद्य ह ै धजसका धवशेष अहारीय मान सोधडर्डयम के ध यूनीकरण, सीमन ऄथवा धनराकरण से प्राप्श्त होता है। वे ऄधनवाय03 संघटक और मानकों ऄथा03त् लवण प्रधतस् थाधपयों को छोकरकर ेसे खाद्य पर लागू मानकों के ऄनुरूप हों।III 3 (2) ऄल्प सोधडर्डयम और ऄत्य ल्प सोधडर्डयम खाद्य वह खाद्य ह ैजो सोधडर्डयम की धवधनर्ददष्ट ऄधधकतम मात्रा के संबंध में क्रधमक ईपबंधों के ऄनुसार हो: (क) ऄल् प सोधडर्डयम वाला धवशेष अहारीय खाद्य वह खाद्य है धजसका प्रसंस् करण सोधडर्डयम लवण डर्डाले धबना दकया गया हो और धजसमें सोधडर्डयम की मात्रा ईपभोग के सामाध य ईत् पाद में तुलनात् मक रूप से अधे से ऄधधक न हो और धजसमें सोधडर्डयम की मात्रा सामाध यत: प्रयुट त ऄंत् य ईत् पाद में 120 धमरी/ा/100 री/ा से ऄधधक न हो। (ख) ऄत् यल् प सोधडर्डयम वाला धवशेष अहारीय खाद्य वह खाद्य है धजसका प्रसंस् करण सोधडर्डयम लवण डर्डाले धबना दकया गया हो और धजसमें सोधडर्डयम की मात्रा ईपभोग के सामाध य ईत् पाद में तुलनात् मक रूप से अधे से ऄधधक न हो और धजसमें सोधडर्डयम की मात्रा सामाध यत: प्रयुट त ऄंत् य ईत् पाद में 40 धमरी/ा/100 री/ा से ऄधधक न हो। (3) खाद्य सुरक्षा और मानक (खाद्य ईत् पाद मानक और खाद्य सहयोज्य) धवधनयम, 2011 के ईपधवधनयम 2.9.30 के खंडर्ड (6) के ऄनुरूप ऄल् प सोधडर्डयम वाले धवशेष अहारीय खाद्य में लवण प्रधतस् थापी धमलाना ऄनमु त ह ै और वह खाद्य सुरक्षा और मानक धवधनयमों में यथाईपबंधधत ऄच् छी धनमा03ण रीधतयों (जीएमपी) द्वारा पररसीधमत दकया जाए। (4) ऄत् यल् प सोधडर्डयम वाला धवशेष अहारीय खाद्य, खाद्य सुरक्षा और मानक (पैकेजजग और लेबजलग) धवधनयम, 2011 के ईपबंधों के ऄधतररट त लेबजलग के संबंध में धनम् नधलधखत धवधनर्ददष्ट ईपबंधों के ऄनुरूप हो, ऄथा03त-् (क) लेबल पर आस धवधनयम के ईप-धवधनयम 2.11.9 (2) (क) और 2.11.9 (2) (ख) के ईपबंधों के ऄनुसार ‘’ऄल् प सोधडर्डयम’’ ऄथवा ‘’ऄत् यल् प सोधडर्डयम’’ धलखा हो; (ख) लेबल पर सोधडर्डयम की मात्रा 5 धमरी/ा प्रधत 100 री/ाम के धनकटतम गुणक में व् यट त हो और आसके ऄधतररि सामाध यत: ईपयोग दकए जाने वाले धवधनर्ददष् ट परोसे गए खाद्य मात्रा के ऄनुसार हो; (ग) लेबल पर सामाध यत: प्रयुट त 100 री/ाम खाद्य में काबोहाआड्रेट, प्रोटीन और वसा की औसत मात्रा और दकलोकैलोरी (ऄथवा दकलो जूल) मान घोधषत हो; (घ) लेबल पर खाद्य सुरक्षा और मानक (खाद्य ईत् पाद मानक और खाद्य सहयोज्य) धवधनयम, 2011 के ईप धवधनयम 2.9.30 के खण्डर्ड (6) में वर्णणत लवण प्रधतस् थाधपयों का योजन व् यट त हो; (ङ) पूण03त: ऄथवा ऄंशत: पोटाधशयम लवण से बना लवण प्रधतस् थापी धमलाने पर लेबल पर पोटाधशयम की कुल मात्रा सामाध यत: प्रयुट त खाद्य के धमरी/ा कैशन प्रधत 100 री/ाम में घोधषत की जाएगी; No. Stds/03/Notification (LS)/FSSAI-2017.—Whereas the draft of the Food Safety and Standards (Food Products Standards and Food Additives) Amendment Regulations, 2017, were published as required by sub-section (1) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006), vide notification of the Food Safety and Standards Authority of India number F. No. Stds/03/Notification (LS)/ FSSAI-2017, dated the 18th April, 2017, in the Gazette of India, Extraordinary, Part III, Section 4, inviting objections and suggestions from the persons likely to be affected thereby, before the expiry of the period of thirty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public; And whereas, the copies of the said Gazette were made available to the public on the 25th April, 2017;III 5 And whereas the objections and suggestions received from the public in respect of the said draft regulations have been considered by the Food Safety and Standards Authority of India; Now, therefore, in exercise of the powers conferred by clause (e) of sub- section (2) of section 92 of the said Act, the Food Safety and Standards Authority of India hereby makes the following regulations further to amend the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011, namely:— Regulations 1. Short title and commencement.—(1)These regulations may be called as the Food Safety and Standards (Food Products Standards and Food Additives) Fifth Amendment Regulations, 2017. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011,— (a) in regulation 2.9 relating to “Salt, Spices, Condiments and related Products”, in sub-regulation 2.9.30, after clause 5, the following clause shall be inserted, namely:— “6. Salt Substitutes.—(1) The composition of salt substitutes shall be as follows: (a) Potassium sulphate, potassium, calcium or GMP, except that Phosphorus not to exceed ammonium salts of adipic, glutamic, carbonic, succinic, lactic, 4 per cent. m/m and NH + 3 per cent. m/m 4 tartaric, citric, acetic, hydro- chloric or ortho phosphoric acids, of the salt substitute mixture and/or (b) Magnesium salts of adipic, glutamic, carbonic, citric, succinic, Mg++to be not more than 20 per cent. m/m acetic, tartaric, lactic, hydro- chloric or orthophosphoric acids, of the total of the cations K+, Ca++and NH + 4 mixed with other Mg-free salt substitutes as listed in present in the salt substitute mixture and 6.(1)(a), 6.(1)(c) and 6.(1)(d), and/or Phosphorus not to exceed 4 per cent. m/m of the salt substitute mixture (c) Choline salts of acetic, carbonic, lactic, tartaric, citric or The choline content not to exceed 3 per hydrochloric acids, mixed with other choline-free salt cent. m/m of the salt substitute mixture substitutes as listed in 6.(1) (a), 6.(1)(b) and 6.(1)(d), and/or (d) Free adipic, glutamic, citric, lactic or malic acids GMP (2) Salt substitutes may contain: (a) Colloidal silica or calcium silicate: not more than one per cent. m/m of the salt substitute mixture, individually or in combination. (b) Diluents: safe and suitable nutritive foods as normally consumed namely, sugars, cereal flour. (3) The addition of iodine-containing compounds to salt substitutes shall be as per the Foods Safety and Standards Regulations, 2011. (4) The sodium content of salt substitutes shall be not more than 120 mg/100 g of the salt substitute mixture. (5) Salt substitutes shall conform to the following specific provisions for the labelling in addition to the Food Safety and Standards (Packaging and Labelling) Regulations, 2011, namely:— (a) a declaration on the label as “low sodium salt substitute” or “low sodium dietetic salt"; (b) a declaration on the label regarding the amount of cations (that is, sodium, potassium, calcium, magnesium, ammonium and choline/100 g (m/m) in the salt substitute mixture; (b) in regulation 2.11 relating to “OTHER FOOD PRODUCTS AND INGREDIENTS”, after sub-regulation 2.11.8, the following sub-regulation shall be inserted, namely:- “2.11.9: Special dietary food with low sodium content:—(1) The special dietary food with low sodium content is a food whose special dietary value results from the reduction, restriction, or removal of sodium. It shall conform to the essential composition and standards namely standards applicable to such food excluding salt substitutes as such. (2) Low sodium and Very low sodium food is a food conforming to the respective provisions regarding maximum sodium content specified, namely:— (a) a special dietary food with low sodium content is a food which has been processed without the addition of sodium salts, and the sodium content of which is not more than one half of that of the comparable normal product as consumed, and the sodium content of which is not more than 120 mg/100 g of the final product as normally consumed;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (b) a special dietary food with very low sodium content is a food which has been processed without the addition of sodium salts, and the sodium content of which is not more than one half of that of the comparable normal product as consumed, and the sodium content of which is not more than 40 mg/100 g of the final product as normally consumed. (3) The addition of salt substitutes conforming to clause (6) of sub-regulation 2.9.30 of the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011 to a special dietary food with low sodium content is permitted and shall be limited by good manufacturing practice (GMP) as provided under Food Safety and Standards Regulations, 2011. (4) The special dietary Food with low sodium content shall conform to the following specific provisions for the labelling in addition to the Food Safety and Standards (Packaging and Labelling) Regulations, 2011, namely:- (a) the label shall bear the description "low sodium" or "very low sodium" in accordance with the provisions of sub-regulations 2.11.9 (2) (a) and 2.11.9 (2)(b) of this regulation; (b) the sodium content shall be declared on the label to the nearest multiple of 5 mg per 100 g and, in addition per a specified serving of the food as normally consumed; c) the average carbohydrate, protein and fat content in 100 g of the product as normally consumed, and the kilocalorie (or kilojoule) value shall be declared on the label; (d) the addition of the salt substitutes listed in clause (6) of sub-regulation 2.9.30 of the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011 shall be declared on the label. (e) when a salt substitute, composed entirely or partially of a potassium salt, has been added, the total amount of potassium, expressed as mg cation per 100 g of the food as normally consumed, shall be declared on the label. (f) in addition, the salt equivalent in terms of sodium chloride (NaCl) content should also be declared per serving and the total amount of NaCl in the packet.
