सहयो(cid:6996)य) तेरहवाँ संशोधन िविनयम, 2016 ह ै।
(2) य े राजप(cid:7074) म (cid:7286) इनके (cid:7079)काशन क(cid:7409) तारीख को (cid:7079)वृ(cid:7275) ह(cid:7298)गे तथा खा(cid:7378) कारोबार (cid:7079)चालक(cid:7298) को 1 जलु ाई, 2017 से इन
िविनयम(cid:7298) के सभी (cid:7079)ावधान(cid:7298) का अनपु ालन करना होगा ।
2 खा(cid:7378) सुर(cid:6979)ा और मानक (खा(cid:7378) उ(cid:7004)पाद मानक और खा(cid:7378) सहयो(cid:6996)य) िविनयम, 2011, के
(क) िविनयम 2.10 के उप-िविनयम 2.10.6 “गरै ए(cid:7016)कोहालीई काब(cid:6981)नीकृत” से संबि(cid:7008)धत के खंड 1 के बाद िन(cid:7388)िलिखत
खंड अतं : (cid:7021)थािपत (cid:7408)कया जाएगा, अथा(cid:6981)त्:-
“2. कै(cid:7408)फनयु(cid:7334) पेय. –
कै(cid:7408)फनयु(cid:7334) पेय के िलए िन(cid:7388)िलिखत मानक ह:(cid:7289) -
(I)(cid:32) कै(cid:7408)फनयु(cid:7334) पेय को तैयार करने के िलए (cid:7079)योग होन े वाला जल खा(cid:7378) सुर(cid:6979)ा और मानक (खा(cid:7378) उ(cid:7004)पाद मानक
और खा(cid:7378) सहयो(cid:6996)य) िविनयम 2011, के िविनयम 2.10.8 म(cid:7286) िनिहत पैकेज बंद पेय जल के मानक(cid:7298) के अनु(cid:7272)प
होना चािहए।
(II)(cid:32) आव(cid:7019)यक सि(cid:7013)म(cid:7088)ण:- उ(cid:7004)पाद क(cid:7409) िविनिमत(cid:7278) म(cid:7286) कुल कैफ(cid:7409)न (cid:7079)ित लीटर 145 िम(cid:7061)ा से कम और 300 िम(cid:7061)ा से
अिधक नह(cid:7277) होगी चाह े (cid:7408)कसी भी (cid:7403)ोत से (cid:7390)ु(cid:7004)पप(cid:7382) क(cid:7409) जाए।
(III)(cid:32) वकै ि(cid:7016)पक साम(cid:7061)ीः इसम(cid:7286) िन(cid:7388)िलिखत हो सकत ेह:(cid:7289)
नीचे दी गई सारणी के (cid:7021)त(cid:7013)भ (1) म(cid:7286) सूचीब(cid:7373) उपादान म(cid:7286) स े कोई परंत ु सारणी के (cid:7021)त (cid:7013) भ (2) म (cid:7286) उस उपादान स े

(iii) जहां िन(cid:7388)िलिखत सारणी के (cid:7021)त(cid:7013)भ (1) म(cid:7286) (cid:7408)दया गया कोई भी उपादान, (cid:7021)त(cid:7013)भ (2) म(cid:7286) (cid:7408)दए गए उ(cid:7340)तम

NOTIFICATION
New Delhi, the 2nd December, 2016.
F. No. P.15025/93/2011-PFA/FSSAI.—Whereas the draft of the Food Safety and Standards (Food
Products Standards and Food Additives) Amendment Regulations, 2013 were published as required under
sub- section (1) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006), vide notification of the
Food Safety and Standards Authority of India number F.No. 5/15015/30/2011 dated the 18th April, 2013 in the
Gazette of India, Extraordinary, Part III, Section 4, inviting objections and suggestions from the persons likely¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 5
to be affected thereby, before the expiry of the period of thirty days from the date on which the copies of the
Official Gazette containing the said notification were made available to the public;
And whereas the copies of the said Gazette were made available to the public on the 18th April, 2013;
And whereas the objections and suggestions received from the public in respect of the said draft
regulations have been considered by the Central Government;
Now, therefore, in exercise of the powers conferred by clause (e) of sub - section (2) of section 92
read with section 16 of the said Act, the Food Safety and Standards Authority of India hereby makes the
following regulations further to amend the Food Safety and Standards (Food Products Standards and Food
Additives) Regulations, 2011, namely.
Regulations
2.(cid:32) Short title and commencement.—(1) These regulations may be called the Food Safety and Standards
(Food Products Standards and Food Additives) Thirteenth Amendment Regulations, 2016.
(2) They shall come into force on the date of their publication in the Official Gazette and Food Business
Operator shall comply with all the provisions of these regulations by 1st July, 2017.
3.(cid:32) In the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011,-
a)(cid:32) In regulation 2.10, in sub-regulation 2.10.6, relating to “BEVERAGES NON –ALCOHOLIC -
CARBONATED”, after clause 1, the following clause shall be inserted, namely: -
“2. Caffeinated Beverage. -
The following are the standards for caffeinated beverages:
(I)(cid:32) Water used in preparation of caffeinated beverages should conform to the standards of packaged
drinking water as prescribed in regulation 2.10.8 of the Food Safety and Standards (Food
Products Standards and Food Additives) Regulations, 2011.
(II)(cid:32) Essential Composition: It shall contain not less than 145mg per liter and not more than 300
mg per liter total caffeine from whatever sources it may be derived in the formulation of the product.
(III)(cid:32) Optional ingredients: It may contain the following:
Any of the substances listed in column (1) of the table given below provided that the amount of that
substance is not more than the amount specified in relation to that substance in column (2) of the
table:
(A) Any additional item or ingredient proposed to be added (other than the substances prescribed
in the said table will be subject to approval by the Food Authority after safety assessment and
substantiating scientific evidence.
(i) A declaration “consume not more than 500 ml per day” shall be made on the label that
represents the per day quantity.
(ii) The per day quantity is the maximum amount of caffeinated beverage (as package or serves)
that is consumed in one day and determined as in sub-clause (iii).
(iii) Where any one of the substances given in column (1) of the following table is consumed at
the maximum level given in column (2), it shall represent the per day quantity and the declaration
shall be made on the basis of the number of packs of serves that cumulatively delivers this amount
when consumed in a day.
Explanation: if taurine is used at 1000mg and D-glucurono-Y-lactone at 300mg in a 250ml pack the
per day quantity is reached by consuming 2×250ml packs and represents the one-day quantity. If the
pack size is a 125ml bottle, then the per day quantity is reached by consuming 4×125ml bottles.”6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]
(B) The vitamins namely, thiamine, riboflavin, niacin, vitamin B6, vitamin B12 may be added at
one Recommended Daily Allowance level (100% Recommended daily allowance)

(IV)(cid:32) In respect of ingredients, flavors, sweeteners, food additives, contaminants and
microbiological requirement the product shall conform to the standards for carbonated water.
(V) Labelling: The product shall comply with all provisions of General Labelling requirements of
Food Safety and Standards (Packaging and Labelling) Regulations, 2011 for pre-packaged foods, with
the following additional provisions: -
a) High Caffeine: “X mg/serving size” (where X is the amount of caffeine in milligrams per
pack/serve;

b)(cid:32) in sub - regulation 2.10.7, after clause 4, the following clause shall be inserted, namely: -
“5. Blue tint as provided in Indian Standard, IS: 9833 may be allowed in plastic container of five liter and
above made of poly carbonate and Poly Ethylene Terephthalate (PET) used for Packaging mineral water:
Provided the overall migration of pigment/colour used in container should not exceed 60 mg/liter
as per IS: 9845.”;
c)(cid:32) in sub-regulation 2.10.8, after clause 5, the following shall be inserted, namely: -
“6. Blue tint as provided in Indian Standard, IS: 9833 may be allowed in plastic container of five liter and

drinking water:
