अतः, अब, भारतीय खा(cid:11) सुर(cid:15)ा और मानक (cid:26)ािधकरण, उ8 अिधिनयम क(cid:31) धारा 16 के साथ पDठत धारा 92 क(cid:31)
उपधारा (2) के खंड (ङ) 0ारा (cid:26)दJ शि8य9 का (cid:26)योग करत े Kए, खा(cid:11) सुर(cid:15)ा और मानक (खा(cid:11) उ(cid:20)पाद मानक और खा(cid:11)
सहयो(cid:25)य) िविनयम, 2011 का और संशोधन करने के िलए िनLिलिखत िव िनयम बनाती ह,ै अथा>त ्:-
1. ससससििंंििंं####$$$$ ननननाााामममम औऔऔऔरररर &&&&ााााररररंंभभंंभभ.- (1) इन िविनमय9 का सिं (cid:15)= नाम खा(cid:11) सरु (cid:15)ा और मानक (खा(cid:11) उ(cid:20)प ाद मानक और खा(cid:11)
सहयो(cid:25)य ) ि0तीय संशोधन िविनयम, 2016 ह।ै
(2) य ेराजप2 म3 इनके (cid:26)काशन क(cid:31) तारीख को (cid:26)वृ(cid:20) त ह9गे ।

(लेUयुRस) ह9, होते ह Xया उनसे उसे बनाया जाता ह।ै
(2) इस पर खा(cid:11) सरु (cid:15)ा और मानक (पकै 3िजग और लेबZलग) िविनयम, 2011 के उप िविनयम 2.4.5 (50) म3 िन(द] घोषणा
से य8ु लेबल लगा होगा।
(3) ऐसे (cid:4)कसी खा(cid:11) क(cid:31), जो (cid:26)कृित Tव(cid:27)प UलDू टन म8ु आहार के भाग(cid:27)प उपयोग के िलए उपयु8 ह,ै “िवशेष आहरीय”,
“िवशेष आहाDरक(cid:31)” या (cid:4)कसी अ‘य समत(cid:6)ु य पद के (cid:27)प म 3 नािमत नह< (cid:4)कया जाएगा, तथािप ऐसे खा(cid:11) लेबल पर ऐसा कथन
(cid:4)कया जा सकता ह ै(cid:4)क ‘यह खा(cid:11) UलDू टन म8ु (cid:26)कृित का ह’ै ।
(4) UलDू टन मु8 उ(cid:20)पाद के (cid:27)प म3 लेबल लगाए जाने के (cid:26)योजन के िलए, जब ऐसे (cid:4)कसी उ(cid:20)पाद का िवaेषण (cid:4)कया जाए तो
उसका UलDू टन Tतर आbथक सहकाDरता और िवकास संगठन या शासक(cid:31)य कृिषक रसायनc संगम 0ारा घोिषत पdित के
अनसु ार 20 िम. eा./(cid:4)क. eा. स ेनीचे का होगा

NOTIFICATION
New Delhi, the 3rd May, 2016
No. 3-16/ Specified Foods/Notification(Food Additive)/FSSAI-2014.—Whereas the draft of the Food Safety
and Standards (Food Products Standards and Food Additives) (Amendment) Regulations, 2015, was published as
required by sub- section (1) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006), vide notification of
the Food Safety and Standards Authority of India number 3-16/ Specified Foods/Notification(Food Additive)/FSSAI-
2014, dated the 28th January, 2015, in the Gazette of India, Extraordinary, Part III, Section 4, inviting objections and
suggestions from the persons likely to be affected thereby, before the expiry of the period of sixty days from the date on
which the copies of the Official Gazette containing the said notification were made available to the public;
And whereas the copies of the said Gazette were made available to the public on the 17th February, 2015;
And whereas the objections and suggestions received from the public in respect of the said draft regulations
have been considered by the Food Safety and Standards Authority of India;
Now, therefore, in exercise of the powers conferred by clause (e) of sub- section (2) of section 92 read with
section 16 of the said Act, the Food Safety and Standards Authority of India hereby makes the following regulations
further to amend the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011,
namely:-
1. Short title and commencement. - (1) These regulations may be called the Food Safety and Standards (Food Products
Standards and Food Additives) Second Amendment Regulations, 2016.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011, after regulation
2.13, the following regulations shall be inserted, namely:-
“2.14 Gluten Free Food.- (1) Gluten free food consist of or is made of one or more ingredients containing rice, millets,
ragi, pulses or legumes.
(2) It shall bear the label declaration referred to in sub-regulation 2.4.5 (50) of Food Safety and Standards (Packaging
and Labelling) Regulations, 2011.
(3) A food which, by its nature, is suitable for use as part of a gluten free diet shall not be named as ‘special dietary’,
“special dietetic” or any other equivalent term, however, such food may bear a statement on the label that ‘this food is by
its nature gluten-free’.
(4) For the purpose of labelling of a product as gluten free, when such a product is analysed, the gluten levels shall be
below 20 mg/kg as per the method declared by the Organization for Economic Co-operation and Development or the
Association of Official Agricultural Chemists.
Provided that it complies with the essential composition provisions for Gluten Free food and such a statement
does not mislead the consumer.
2.15 Food specially processed to reduce gluten content to a level 20 -100mg/kg.- (1) This food consists of or are made
of one or more ingredients which may contain rice, millets, ragi, oats, rye, barley, maize, wheat, pulses and legumes
containing gluten content in range of 20 -100 mg/kg.
(2) It shall bear the label declaration referred to in sub-regulation 2.4.5 (51) and (52) of Food Safety and Standards
(Packaging and Labelling) Regulation, 2011.”

“(50) The term "Gluten Free" shall be printed in the immediate proximity of the name of the product in the case of
products described in regulation 2.14 of the Food Safety and Standards (Food Products Standards and Food Additives)
Regulations, 2011, namely:-
“Gluten Free”
(51) The term “Low Gluten” shall be printed in the immediate proximity of the name of the product in the case of
products described in regulation 2.15 of the Food Safety and Standards (Food Products Standards and Food Additives)
Regulations, 2011, namely:-
“Low Gluten”
(52) The label shall carry a ‘warning’ that ‘the food labelled as Low Gluten may pose a risk for those with celiac
disease.”
