और उि प्रारूप जवजनयम के सम्बन्ध में िनता से प्राप्त आक्षपे ो और सुाावों पर भारतीय खाद्य सुरक्षा और मानक प्राजधकरण द्वारा जवचार कर जलया गया ह;ै अत:, अब उि अजधजनयम की धारा 92 की उपधारा (2) के खंड (ङ) द्वारा प्रित्त् िजियों का प्रयोग करते हुए भारतीय खाद्य सुरक्षा और मानक प्राजधकरण जनम्नजलजखत जवजनयम बनाता ह,ै अथावत:्- 6179 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] जवजनयम 1. संजक्षप्त नाम और प्रारंभ.- (1) इन जवजनयमों का संजक्षप्त नाम ‘खाद्य सुरक्षा और मानक (िढृ ीकृत खाद्य) प्रथम संिोधन जवजनयम, 2020 ह।ै (2) यह रािपत्र में इनके प्रकािन की तारीख को प्रवत्त होंग े और खाद्य कारबार चालक को 1 िलु ाई 2021 स े इन जवजनयमों के सभी उपबंधों का अनुपालन करना होगा। 2. खाद्य सुरक्षा और मानक (िढृ ीकृत खाद्य) जवजनयम, 2018 (जिन् ह ें इसके पच चात इन् ह ें उतत जवजनयम कहा गया ह)ै म,ें - (क) जवजनयम 2 के उप-जवजनयम (1) के खंड (घ) के पश्चात जनम्न जलजखत खंड अंत:स्ट्थाजपत दकया िाएगा, अथावत,् - ‘’(घक) ‘सुिढृ ीकृत प्रसस्ट्ं क ृत खाद्य’’ से वह खाद्य अजभप्रेत ह,ै जिसे उसकी प्राकृजतक अवस्ट् था से औद्योजगक प्रसंस्ट् करण प्धतजतयों स े बिल दिया गया हो। उसमें सुिढृ ीकृत स्ट् ैपल क‍ ची सामग्री के रूप म ें हो सकत े ह और/अथवा उसे अनुज्ञप्त सूक्ष्म पोकक त्‍व ों से सुिढृ ीकृत दकया िा सकता ह ै और उसम ें खाद्य सुरक्षा और मानक (खाद्य उ्‍ पाि मानक और खाद्य सहयो‍य ) जवजनयम, 2011 में जवजनर्िष्टव सहयो‍य पिाथव भी हो सकते ह। ‘’ (ख) जवजनयम 3 में उप-जवजनयम (4) के पश्चात जनम्न जलजखत खडं अतं :स्ट्थाजपत दकए िाएाँग,े अथावत,् - ‘’(5) सुिढृ ीकृत प्रसंस्ट् कृत खाद्य सुिढृ ीकृत खाद्य वस् तुओं, िो धान्य और/अथवा िधू हो सकते ह, से तैयार दकए िा सकत े ह; (6) सुिढृ ीकृत प्रसंस्ट् कृत खाद्य प्रसंस्ट्क ृत खाद्य पिाथा स से औसतन 600 दकलो कैलोरी (2000 दकलो कैलोरी ऊिाव का ~1/3) सेवन पर आधाररत सूक्ष्म पोकक त्‍व ों के भारतीय वयस्ट् क आर.डी.ए का 15-30% प्राप् त हो। (7) उ‍ च वसा िकवरा लवण (एच.एफ.एस.एस.) खाद्य सुिढृ ीकृत प्रसंस्ट् कृत खाद्य की प्रवग व म ें िाजमल न दकए िाएाँ। खाद्य सुरक्षा और मानक (लेबललगं और प्रििवन) जवजनयम के अधीन एच. एफ़. एस. एस. की पररभाका यथा जवजनर्िष्टव वही अथ वहोंगे। ‘’ (ग) जवजनयम 4 के उप-जवजनयम (1) के पश्चात जनम्न जलजखत उप-जवजनयम अंत:स्ट्थाजपत दकया िाएगा, अथातव ,् - ‘’(2) दकसी प्रसंस्ट् कृत खाद्य को सुिढृ ीकृत करने वाला उ्‍ पािक यह सुजनजश्चत करेगा दक ेसे सुिढृ ीकृत प्रसंस्ट् कृत खाद्य में सूक्ष् म पोकक त्‍व का स्ट् तर अनुसूची-III में जवजहत न् यूनतम स्ट्त र से कम न रह।े ‘’ (घ) जवजनयम 7 के उप-जवजनयम (2) के पश्चात जनम्न जलजखत परंतुक अंत:स्ट्थाजपत दकया िाएगा, अथावत,् - ‘’परंतु उप-जवजनयम (2) में यथा जवजनर्िष्टव अपेक्षाएाँ आयोडीनयुतत लवण (िब आयोडीन से सुिढृ ीकृत होने पर) के मामल े म ेंलागू नहीं होंगी।‘’ (ङ) अनुसूची-I म,ें- (क) के खंड (3) के स्ट्थान पर जनम्न जलजखत रखा िाएगा, अथावत,् - ‘’3. सिु ढृ ीकृत िधू प्रिाजत जचजननत िग्ु ध (अथावत् भ स का िग्ु ध, गाय का िग्ु ध, बकरी का िग्ु ध, भेड़ का िग्ु ध और ऊाँ नी का िग्ु ध), पूण व क्रीम िग्ु ध, ोन् ड िग्ु ध, डबल ोन् ड िग्ु ध, मखजनया िग्ु ध और मानकीकृत िग्ु ध को नीचे सारणी[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 में दिए गए स्ट्त र तक सूक्ष्म पोकक त्‍व ों से सुिढृ ीकृत दकया िाए, जिसमें िग्ु ध का पाच ‍ यरु ीकरण, जनिवमवन, अजत उ‍ च तापमान पर जनिवमवन/उपचार अथवा तव थन दकया िाएगा: क्रम पोकक त्‍व /्ोत प्रिाजत जचजननत िग्ु ध (अथातव ् भस का िग्ु ध, गाय सं॰ का िग्ु ध, बकरी का िग्ु ध, भड़े का िग्ु ध और ऊाँ नी का िग्ु ध)/ पणू व क्रीम िग्ु ध / ोन्ड िग्ु ध / डबल ोन्ड िग्ु ध/ मखजनया िग्ु ध / मानकीकृत िग्ु ध) के प्रजत ली र पोकक त्‍व ों का स्ट्त र 1. जव ाजमन ए (μg RE)- 270 - 450 रेर जनल एजस े अथवा रेर जनल पाजल्म े 2. जव ाजमन डी (μg) 5 –7.5 *कोलकैल् सीफेर ल अथवा *एगोकैल् सीफेर ल (*केवल पािप स्रात से) र प्प ण : जव ाजमन ए (रेर न ल): 1 IU=0.3 μg RE (रेर न ल समतल्ु य); No. REG/Fortification Amendment (1)/Notification/FSSAI-2018.—Whereas the draft of the Food Safety and Standards (Fortification of Foods) Amendment Regulations, 2019, were published as required under sub-section (1) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006), vide notification of the Food Safety and Standards Authority of India number F. No. REG/Fortification Amendment (1)/Notification/FSSAI-2018, dated the 4th February, 2019, in the Gazette of India, Extraordinary, Part III, Section 4, inviting objections and suggestions from the persons likely to be affected thereby before the expiry of the period of thirty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public; And whereas the copies of the said Gazette were made available to the public on the 11th February, 2019; And whereas the objections and suggestions received from the public in respect of the said draft regulations have been considered by the Food Safety and standards Authority of India; Now, therefore, in exercise of the powers conferred by clauses (e) of sub-section (2) of section 92 of the said Act, the Food Safety and Standards Authority of India hereby makes the following regulations further to amend the Food Safety and Standards (Fortification of Foods) Regulations, 2018, namely:-6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] Regulations 1. Short title and commencement.- (1) These regulations may be called the Food Safety and Standards (Fortification of Foods) First Amendment Regulations, 2020. (2) They shall come into force on the date of their publication in the Official Gazette and food business operator shall comply with all the provisions of these regulations with effect from 1st July, 2021. 2. In the Food Safety and Standards (Fortification of Foods) Regulations, 2018 (herein after referred as said regulation)- (A) In regulation 2, in sub regulation (1), after clause (d), the following clause shall be inserted, namely:- “(da) “Fortified Processed Foods” means processed foods (i.e., foods that have been altered from its natural state by industrial processing methods) that have undergone the process of fortification as per the provisions of these regulations. The same may have fortified staples as raw materials and/or fortified with permitted micronutrients and additives as specified under the Food Safety and Standards (Food Product Standards and Food Additives) Regulation, 2011.” (B) in regulation 3, after sub-regulation (4), the following clauses shall be inserted, namely:- “(5) Fortified Processed Foods may be prepared from fortified food articles that may be cereals and/or milk; (6) The Fortified Processed Food shall provide 15-30% of the Indian adult RDA of micronutrient based on an average calorie intake of 600 kcal from processed foods (approximately 1/3rd of daily energy requirement for an adult); (7) High Fat Sugar Salt (HFSS) Foods shall be excluded from Fortified Processed Foods category. The definition of HFSS foods shall have the same meaning as specified under the Food Safety and Standards (Labelling and Display) Regulations, 2020.” (C) in regulation 4, after sub-regulation (1), the following sub-regulation shall be inserted, namely:- “(2) Any manufacturer who fortifies any processed food shall ensure that the level of micronutrients in such fortified processed food shall fall within the range specified in Schedule-III.” (D) in regulation 7, after sub-regulation (2), the following proviso shall be inserted, namely:- Provided that the requirements as specified in sub-regulation (2) is not required in case of iodized salt (when fortified with iodine). (E) in Schedule- I, - (a) for clause (3), the following shall be substituted, namely:- “3. Fortified Milk Species identified milk (namely buffalo milk, cow milk, goat milk, sheep milk and camel milk), full cream milk, toned milk, double toned milk, skimmed milk and standardized milk, when fortified, shall be fortified with the following micronutrients at the level given in the table below, wherein the milk is to undergo the process of pasteurization, sterilization, ultra high temperature sterilization/treatment or boiling: S. Nutrients/Source Level of nutrient per litre of Species No. identified milk (namely buffalo milk, cow milk, goat milk, sheep milk and camel milk)/ full cream milk/toned milk/double toned milk/skimmed milk/standardized milk 1. Vitamin D (µg) *Cholecalciferol 5-7.5 or*Ergocalciferol (*Only from Plant source) Note: Vitamin A (retinol): 1 IU= 0.3 µg RE (Retinol Equivalent); Vitamin D (Cholecalciferol or Ergocalciferol): 1 IU= 0.025 µg”[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7 (b) in clause (4), after the second table, following statement shall be inserted, namely :- “Multi-grain Atta may also be fortified with vitamins and minerals at the same levels specified for ‘Fortified Atta’, provided that the multigrain atta contains more than 50% as wheat flour in it.” (F) after Schedule –II, the following Schedule shall be inserted, namely:- “SCHEDULE-III STANDARDS FOR FORTIFIED PROCESSED FOODS [See sub-regulation (2) of regulation 4] 1.
