उ‍त अजधसूचना की प्रजतयां िनता को 22 निंबर, 2022 को उपलब् ध कर िी गई थी; उ‍त प्रारुप जनयमों के संबंध म ेंिनता स े प्रा‍ त आक्षेपों और सुझािों पर केंद्रीय सरकार न ेजिचार कर जलया ह;ै अत: अब, केंद्रीय सरकार कीटनािी अजधजनयम, 1968 (1968 का 46) की धारा 36 द्वारा प्रित् त िज‍त यों का प्रयोग करते हुए, कीटनािी जनयम, 1971 का और संिोधन करने के जलए जनम्न जलजखत जनयम बनाती ह,ै अथाचत ् :- 1. सजं क्ष‍त नाम और प्रारंभ :- (1) इन जनयमों का संजक्ष‍ त नाम कीटनािी (तीसरा संिोधन) जनयम, 2023 ह ै। 2303 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) य ेरािपत्र म ेंइनके प्रकािन की तारीख को प्रिृत् त होंगे। 2. कीटनािी जनयम, 1971 (जिसे इसम ें इसके पश् चात् उ‍त जनयम कहा गया ह)ै , के जनयम 6 म,ें उप जनयम (2) म,ें खंड (i) और खंड (ii) के स्ट्थ ान पर जनम्न जलजखत उपखंड रख े िाएंग,े अथाचत् :- (i) कीटनािी अजधजनयम, 1968 की धारा 9 की उपधारा (3) और उपधारा (3ख) के अधीन पंिीकरण के जलए रसायन कीटनािी स े संबंजधत आिेिन के मामल े म ें िो लाख पच् चीस हिार रुपये; (ii) कीटनािी अजधजनयम, 1968 की धारा 9 की उपधारा (3) और उपधारा (3ख) के अधीन पंिीकरण के जलए िैि-कीटनािी से संबंजधत आिेिन के मामले म ेंिस हिार रुपये; (iii) कीटनािी अजधजनयम, 1968 की धारा 9 की उपधारा (3) के अधीन जनयाचत से संबंजधत पंिीकरण के जलए आिेिन के मामल े में बारह हिार पांच सौ रुपये; (iv) कीटनािी अजधजनयम, 1968 की धारा 9 की उपधारा (4) के अधीन पंिीकरण के जलए रसायन कीटनािी स े संबंजधत आिेिन के मामले म ेंपच् चीस हिार रुपये; 3. उ‍त जनयमों म,ें जनयम 6क म,ें “एक सौ रुपय”े िब् िों के स्ट्थ ान पर “पांच सौ रुपय”े िब् ि रखे िाएंगे। 4. उ‍त जनयमों म,ें जनयम 6ख म,ें - (i) “ एक सौ रुपय े की फीस संित् त की िाएगी” िब् िों के स्ट्थ ान पर “फीस का भुगतान सारणी के अनुसार ककया िाएगा” िब् ि रखे िाएंग े । (ii) जनम्न जलजखत “सारणी” अतं :स्ट्थ ाजपत की िाएगी, अथाचत् :- सारणी “ क्रम लबे ल और पर्चयच ों सजहत पिं ीकरण प्रमाण पत्र म ें िधनच , लोप या पररितनच पिं ीकरण के जलए िये फीस सख्ं या (रुपय े म)ें आकि और अन्य सबं जं धत गजतजिजधया ं (1) (2) (3) 1. िैि-कीटनािी के पंिीकरण प्रमाणपत्र की िैधता के जिस्ट्तार के जलए अनुमोिन 5,000/- 2. कीटनािकों के पंिीकरण प्रमाणपत्र की िैधता के जलए अनुमोिन 3. कंपनी/फमच के नाम म ें पररितचन के जलए अनुमोिन 4. पहली बार कारखान े का पता / कारखान े का स्ट्थानांतरण और िसू रा कारखाना पता स्ट्थाजपत करन ेके जलए अनुमोिन 5. अजधग्रहण / जिलय / जिजनिेि / समामेलन / जिजनिेि के मामले म,ें एक व्यजि / उपक्रम के पंिीकरण प्रमाण पत्र का ककसी अन्य व्यजि / उपक्रम के नाम पर स्ट्थानांतरण के जलए अनुमोिन 1,000/- प्रजत प्रमाणपत्र 6. जिजनिेि के कारण रसायनों के आयात के स्रोत के नाम म ें पररितचन करन े के जलए अनुमोिन 7. आयात के स्रोत के नाम म ेंपररितचन 5,000/-[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 8. पंिीकरण प्रमाण पत्र म ें आयात के, पहल े से ही अनुमोकित अजतररि स्रोत, 2,500/- को िाजमल करने के जलए अनुमोिन 9. पंिीकरण प्रमाण पत्र के संबंध म ें कायाचलय के पते में पररितनच करने के जलए 1,000/- प्रजत प्रमाणपत्र अनुमोिन 10. पंिीकरण के प्रमाण पत्र म ें आयात के पहले स े स्ट्िीकृत स्रोत के आपूर्तचकता च 2,500/- के नाम के जलए अनुमोिन 11. लेबल म े जिस्ट्तार करने के जलए अनुमोिन 9(3) 15,000/- 12. लेबल म े जिस्ट्तार करने के जलए अनुमोिन 9(4) 5,000/- 13. िेल्फ-आय ु के जलए अनुमोिन 9(3) 2,500/- 14. िेल्फ-आय ु के जलए अनुमोिन 9(4) 15. नई/िैकजल्पक पैकेजिंग के जलए अनुमोिन 9(3) 5,000/- 16. नई/िैकजल्पक पैकेजिंग के जलए अनुमोिन 9(4) 2,500/- 17. घरेलू उपयोग के जलए कीटनािक का लेबल जिस्ट्तार 9(3) 5,000/- 18. उपरोि श्रेजणयों के अलािा अन्य अनुमोिन 1,000/- 19. आयात अनुज्ञा-पत्र (बहुउपयोगी, बोररक एजसड और िैिनािी) 5,000/- 20 िोध , िांच और परीक्षण (आर. टी. टी.) 2,500/- 21 जन: िल्ु क जिक्रय प्रमाण पत्र 500/- प्रजत प्रमाणपत्र 22 प्रमाणपत्र का अनुप्रमाणन ’’ 5. उ‍त जनयमों म ें जनयम 7 म,ें उपजनयम (3) म,ें “एक हिार रुपय े ” िब्ि ों के स्ट्थ ान पर “िो हिार पांच सौ रुपय”े िब् ि रख े िाएंग े । [फा. स.ं 13028/01/2020-पीपी-I] आिीि कुमार श्रीिास्ट् ति, संय‍ु त सजचि (पीपी) रट‍प ण :- मलू जनयम, भारत के रािपत्र असाधारण, भाग II, खंड 3, उपखंड (i) म ें सा.का.जन. स.ं 1650 (अ), तारीख 19 अ‍ तूबर, 1971 द्वारा प्रकाजित ककए गए थ े और सा.का.जन. स.ं 211 (अ) तारीख 23 माच,च 2023 द्वारा अंजतम बार संिोधन ककए गए ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] MINISTRY OF AGRICULTURE AND FARMERS WELFARE (Department of Agriculture and Farmers Welfare) NOTIFICATION New Delhi, the 24th March, 2023 G.S.R. 274(E) —Whereas the draft rules further to amend the Insecticides Rules, 1971, was published, as required by section 36 of the Insecticides Act, 1968 (46 of 1968) vide notification of the Government of India in the Ministry of Agriculture and Farmers Welfare (Department of Agriculture and Farmers Welfare) number G.S.R. 833 (E), dated the 22nd November, 2022, in the Gazette of India, Extraordinary, Part-II, section-3, sub-section (i), inviting objections or suggestions from all persons likely to be affected thereby, before the expiry of a period of thirty days from the date on which the copies of the Gazette of India in which the said notification was published were made available to the public; And whereas, copies of the said notification were made available to the public on 22nd November, 2022; And whereas, objections or suggestions received from the public in respect of the said draft rules have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 36 of the Insecticides Act, 1968 (46 of 1968), the Central Government, hereby makes the following rules further to amend the Insecticides Rules, 1971, namely :-- 1. Short title and commencement:- (1) These rules may be called the Insecticides (Third Amendment) Rules, 2023. (2) They shall come into force on the date of their publication in the official Gazette. 2. In the Insecticides Rules, 1971 (hereinafter referred to as the said rules), in rule 6, in sub-rule (2), for clauses (i) and (ii), the following clauses shall be substituted, namely:- (i) rupees two lakhs twenty-five thousand in case of application relating to Chemical Insecticides for registration under sub-section (3) and (3B) of section 9 of the Insecticides Act, 1968; (ii) rupees ten thousand in case of application relating to Bio-pesticides for registration under sub-section (3) and (3B) of section 9 of the Insecticides Act, 1968; (iii) rupees twelve thousand five hundred in case of application relating to Export for registration under sub- section (3) of section 9 of the Insecticides Act, 1968; and (iv) rupees twenty-five thousand in case of application relating to Chemical Insecticides for registration under sub-section (4) of section 9 of the Insecticides Act, 1968. 3. In the said rules, in rule 6A, for the words “rupees one hundred”, the words “rupees five hundred” shall be substituted. 4. In the said rules, in rule 6B, --- (i) for the words “A fee of rupees one hundred shall be paid”, the words “The fees shall be paid as provided in the TABLE” shall be substituted, (ii) the following “TABLE” shall be inserted, namely:-- TABLE “ S. Addition , deletion or alteration etc. on the Certificate of Fee payable for No. Registration including labels and leaflets and other related Registration activities (in Rupees) (1) (2) (3) 1. Endorsement of Extension of Validity of CRs of Bio-pesticide 2. Endorsement of Extension of Validity of CRs of Insecticides 5,000/- 3. Endorsement of change of name of the company/firm 4. Endorsement of factory address for the first time/shifting of factory and establishment of second -factory address 5. Transfer of certificate of registration of one person/undertaking in the name of another person/undertaking in case take over /merger/ 1,000/- per Certificate divestment/amalgamation/disinvestment 6. In the said rules, in rule 7, in sub-rule 3, for the words “rupees one thousand”, the words “rupees two thousand five hundred” shall be substituted. [F.
