और, उड़ीसा रा(cid:12)य ने तारीख 11 (cid:1)दसंबर, 2017 को उ(cid:23) अिधिनयम क(cid:24) धारा 5 क(cid:24) उपधारा (3) के परंतुक के
अधीन उ(cid:23) अिधकरण को और िनद0श (cid:1)कया तथा क(cid:18)+ीय सरकार न े उ(cid:23) अिधकरण को तारीख 12 (cid:1)दसंबर, 2017 को और
िनद0श (cid:1)कया तथा उ(cid:23) अिधकरण ने 10 (cid:1)दसंबर, 2017 को या उससे पहल े एक वष क(cid:24) अविध के भीतर अपनी अित#र(cid:23)
#रपोट ()ततु करनी थी;
और, अब उ(cid:23) अिधकरण न े अपनी अित#र(cid:23) #रपोट ()तुत करने क(cid:24) अविध 11 (cid:1)दसंबर, 2018 से एक वष के िलए

NOTIFICATION
New Delhi, the 25th January, 2019
S.O. 474(E).—Whereas, the Vansadhara Water Disputes Tribunal (hereinafter called the said Tribunal) was
constituted on the 24th February, 2010 vide notification number S.O. 465 (E), dated the 24th February, 2010 under section
4 of the Inter-State River Water Disputes, Act, 1956 (33 of 1956)(hereinafter called the said Act) for the adjudication of
the water disputes regarding Inter-State river Vansadhara, and river valley thereof;
And whereas, the said Tribunal was required to submit its report and decision under sub-section (2) of section 5
of the said Act within a period of three years, on or before the 23rd February, 2013 ;¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
And whereas, the said Tribunal had requested to extend the period of submission of report and decision for a
further period of one year with effect from 23rd February, 2013;
And whereas, the Central Government vide notification number S.O.436 (E), dated the 22nd February, 2013, had
extended the period of submission of report and decision for a further period of one year with upto 23rd February, 2014;
And whereas, the Government of Odisha approached the Hon’ble Supreme Court vide Interlocutory Application
number 8 of 2013 in Writ Petition (C) number 443 of 2006 to direct the Central Government to reckon the date of
constitution of the Tribunal as 17th September, 2012 ;
And whereas, the Hon’ble Supreme Court heard the matter and passed the order on 13th December, 2013 that as
the Tribunal started functioning with effect from 17th September, 2012, that date be considered as the effective date of the
constitution of the Vansadhara Water Disputes Tribunal for the purpose of calculating the period of three years as
provided under sub-section (2) of section 5 of the said Act;
And whereas, the Central Government vide notification number S.O.778 (E), dated the 14th March, 2014, had
decided that the effective date of constitution of said Tribunal shall be 17th September, 2012, and accordingly, under the
provisions of sub-section (2) of section 5 of the said act, the period of three years for submission of report and decision
by the Vansadhara Water Disputes Tribunal shall commence from the 17th September, 2012;
And whereas, the Central Government vide notification number S.O. 2581 (E), dated the 18th September, 2015,
had extended the period of submission of report and decision for a further period of one year with effect from the
17th September, 2015 ;
And whereas, the Central Government vide notification number S.O. 2971(E), dated the 16th September, 2016,
had extended the period of submission of report and decision for a further period of one year with effect from the
17th September, 2016;
And whereas the said Tribunal submitted its report and decision under sub-section (2) of section 5 of the said
Act on the 13th September, 2017;
And whereas the State of Odisha made further reference to the said Tribunal under the proviso to sub-section (3)
of section 5 of the said Act on the 11th December, 2017 and the Central Government made further reference to the said
Tribunal on the 12th December, 2017 and the Tribunal had to submit its further report within a period of one year on or
before the 10th December, 2018;
And whereas, the said Tribunal has now requested to extend the period of submission of further report for a
period of one year with effect from the 11th December, 2018;
Now, therefore, in exercise of the powers conferred by the proviso to sub-section (3) of section 5 of the said Act,
the Central Government hereby extends the period of submission of further report by the said Tribunal for a period of one
year with effect from the 11th December, 2018.
