जुलाई, 2021 ड्रोन जनयमािली, 2021 प्रस्ट्तािना सा.का.जन. 489(अ).—जबदक, मानिरजित जिमान प्रणाली (यिां इसके बाद ड्रोन किा गया ि)ै आर्थथक जिकास और रोजगार सृजन के जलए अपररजमत अिसर प्रदान करती िै; और जबदक, ड्रोन संबंधी गजतजिजधयों को इस तरीके से जिजनयजमत दकए जाने की जरूरत ि ै दक ये लोगों और पररसम् पजययों की संरक्षा या सुरक्षा के जलए कोई खतरा उत् पन् न न करं; और जबदक, कंद्रीय सरकार ने मानिरजित जिमान प्रणाली जनयमािली (यूएएस जनयम), 2021 प्रख् याजपत की, जो 12 माच,च 2021 से प्रिर्थतत हुई; और इस पर जिद्वानों, उद्योग और अन्य जितधारकों की रर से बहुमूल् य सुझाि प्रा्‍ त हुए; अब, अतएि, कंद्रीय सरकार, जिमान अजधजनयम, 1934 (1934 का 22) की धारा 4, 5, धारा 8 की उपधारा (2), धारा 10 की उपधारा (2), 10क, 10ख और 12क द्वारा प्रदय िजियों का प्रयोग करते हुए, यूएएस जनयमािली, 2021 का अजधक्रमण करते हुए कजतपय जनयम बनाना प्रस्ट् ताजित करती ि ै उक् त प्रारूप जनयम एतदद्वारा उक् त अजधजनयम की धारा 14 द्वारा यथापेजक्षत, इससे प्रभाजित िोने के जलए संभाजित सभी व्य जियों के सूचनाथच प्रकाजित दकए जाते िं; और एतदद्वारा सूचना दी जाती ि ै दक उक् त प्रारूप जनयमों पर 5 अगस्ट्त 2021 के बाद जिचार दकया जाएगा ; सुझाि या आपजययां, यदद कोई िों, श्री कामेश् िर जमश्र, नागर जिमानन मंत्रालय, बी ब् लॉक, राजीि गांधी भिन, नई ददल् ली – 110003 को संबोजधत दकए जा सकते ि ं या ‘‘प्रारूप ड्रोन जनयमािली, 2021 िते ु सुझाि’’ िीर्चक-पंजि सजित sdit.div-moca@gov.in को मेल दकए जा सकते ि ं ऊपर जिजनर्ददष् ट अिजध समा्‍ त िोने से पूिच उक् त प्रारूप जनयमों के संबंध मं प्रा्‍ त दकसी भी सुझाि या आपजय पर कंद्रीय सरकार द्वारा जिचार दकया जा सकता ि ै 3907 GI/2021 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] प्रारूप जनयम भाग I प्रारंजभक 1. अल्प िीर्,च प्रारंभ और अनप्रु योग — (1) इन जनयमों को ड्रोन जनयमािली, 2021 किा जाएगा (2) ये जनयम सरकारी राजपत्र मं इनके प्रकािन की तारीख को प्रिर्थतत िोंगे (3) ये जनम्न जलजखत पर लागू िोंगे, – (क) भारत मं दकसी मानि रजित जिमान प्रणाली का स्ट्िाजमत्ि या कब् जा रखने िाले अथिा इसके जनयाचत, आयात, कारोबार, पट्टे पर दने े, प्रचालन, िस्ट्त ांतरण या अनुरक्षण मं लगे सभी व् यजियों पर; और (ख) तत्स मय भारत मं या भारत के ऊपर प्रचाजलत दकए जा रि ेसभी ड्रोनों पर (4) िायुयान जनयम, 1937 मं जनजित प्रािधान, मानि रजित जिमान प्रणाली और इनसे संबंजधत और अनुर्ंगी मामलों पर लागू निीं िोंगे, उन प्रािधानों को छोड़कर जजनके मानि रजित जिमान प्रणाली पर अनुप्रयोग का प्रािधान जििेर् रूप से दकया गया ि ै (5) 500 दकलोग्राम से अजधक समग्र भार िाले ड्रोन के मामले मं, िायुयान जनयमािली, 1937 के प्रािधान लागू िोंगे (6) ये जनयम संघ की नौसेना, थलसेना और िायुसेना द्वारा प्रयुक् त ड्रोनों पर लागू निीं िोंगे (7) कोई भी व्य जि इन जनयमों का उल् लंघन करते हुए कोई गजतजिजध निीं करेगा 2. पररभार्ाए ं— (1) इन जनयमों मं, जब तक जिर्य या संदभच मं अन्य था अपेजक्षत न िो, – (क) “प्राजधकृत ररमोट पायलट प्रररक्षण संस्ट्थ ा” मं इन जनयमों के अधीन जनधाचररत प्रजिक्षण प्रदान करने के उद्देश्य से मिाजनदिे क द्वारा प्राजधकृत कोई भी संगठन िाजमल िै; (ख) “स्ट्ि चाजलत ड्रोन प्रचालन” से पिले से प्रोग्राम दकया हुए ड्रोन प्रचालन अजभप्रेत ि ै जजसमं ड्रोन पायलट दकसी भी समय िस्ट्त क्षेप करने मं सक्षम िो; (ग) “स्ट्ि ायत् त ड्रोन प्रचालन’ से ऐसा ड्रोन प्रचालन अजभप्रेत ि ै जो उड़ान के प्रबंधन मं ड्रोन पायलट के िस्ट्त क्षेप की अनुमजत निीं दते ा इसमं ड्रोन प्रचालन के िे चरण िाजमल निीं ि ं जजनके दौरान ड्रोन पायलट के पास, या तो आपात प्रदक्रयाओं के कायाचन् ियन का अनुसरण करके, या कमांड और जनयंत्रण संपकच टूट जाने की िजि से, उड़ान के प्रबंधन मं िस्ट् तक्षेप करने की समथचता न िो; (घ) “उड़ान योग् यता प्रमाण पत्र” से भारतीय गुणित् ता पररर्द द्वारा जारी प्रमाणपत्र या भारतीय गुणित् ता पररर्द अथिा कंद्रीय सरकार द्वारा प्राजधकृत दकसी अन्य प्रमाणीकरण जनकाय द्वारा जारी प्रमाणपत्र अजभप्रेत िै, जजसमं प्रमाजणत दकया गया िो दक एक जिजिष्ट प्रकार का ड्रोन इन जनयमों के अंतगचत जिजनर्ददष्ट अपेक्षाओं को पूरा करता ि;ै (ङ) “जनयंजत्रत ििाई क्षेत्र” से पररभाजर्त आयामों िाला ििाई क्षेत्र अजभप्रेत ि ै जजसके भीतर ििाई क्षेत्र िगीकरण के अनुसार जिमान यातायात जनयंत्रण सेिा मुियै ा कराई जाती िै; (च) “जडजीटल स्ट्क ाई ्‍ लटे रामच” से नागर जिमानन मिाजनदिे ालय द्वारा भारत मं ड्रोन गजतिजधयों के प्रबंधन से संबंधी जिजभन्न गजतजिजधयों के जलए िोस्ट्ट दकया गया ऑनलाइन ्‍ लेटरामच अजभप्रेत ि;ै (छ) “मिाजनदिे क” से भारत सरकार द्वारा जनयुि “नागर जिमानन मिाजनदिे क” अजभप्रेत ि;ै (ज) “ड्रोन” से ऐसा जिमान अजभप्रेत ि ै जो उड़ान के दौरान पायलट के जबना दरू से या स्ट्ि ायत्त रूप से प्रचाजलत दकया जा सके; (झ) “ड्रोन पािती संख्य ा” से भारत मं ड्रोनों के जलए स्ट्ि ैजकछक प्रकटीकरण योजना के अधीन जडजीटल स्ट्क ाई ्‍ लटे रामच द्वारा जारी यूनीक संख् या अजभप्रेत ि;ै (ञ) “ड्रोन पायलट” से एक ड्रोन को प्रचाजलत करने के जलए उत्त रदायी प्राकृजतक व्य जि अजभप्रेत ि ै जो ड्रोन प्रचालन के दौरान उड़ान जनयंत्रणों का कुिलतापूिचक प्रयोग करता िै;[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3 (ट) “जजयो-रंससग” से दकसी पररभाजर्त िायुक्षेत्र के भीतर ड्रोन के आिागमन को प्रजतबंजधत दकया जाना अजभप्रेत ि;ै (ठ) “ग्रीन जोन” से भूजम से 400 रुट (120 मीटर) एबि ग्राउंड लेिल (एजीएल) की उर्ध िाचधर दरू ी तक का िायुक्षेत्र; और दकसी प्रचालजनक ििाईअड्ड े की पररजध से 8 दकमी. और 12 दकमी की क्षैजतज दरू ी के बीच भूजम से ऊपर 200 रुट (60 मीटर) एजीएल की उर्ध िाचधर दरू ी तक का िायुक्षेत्र अजभप्रेत ि,ै जजसे ड्रोन प्रचालनों के जलए िायुक्षेत्र के मानजचत्र मं रेड जोन या येलो जोन के रूप मं नाजमत निीं दकया गया ि ै दकस नाजमत ग्रीन जोन मं 400 रुट (120 मीटर) ऊपर के िायुक्षेत्र तथा दकसी प्रचाजलन क ििाईअड्ड े की पररजध से 8 दकमी और 12 दकमी की क्षैजतज दरू ी के बीच भूजम से ऊपर 200 रुट (60 मीटर) के िायुक्षेत्र मं, येलो जोन के प्रािधान लागू िोंगे; (ड) “व्य जि” की पररभार्ा मं कोई व्य जि या कम्प नी या व्य जियों का संघ या व्य जियों का जनकाय या स्ट्थ ानीय प्राजधकरण या कोई जिजधक जनकाय, चाि े िि जनगजमत िो या निीं, कंद्रीय सरकार या राज् य सरकार या इनका कोई जनकाय िाजमल िै; (ढ) “प्रोटोटाइप ड्रोन” से िि ड्रोन अजभप्रेत ि ै जजसे अनुसंधान और जिकास के प्रयोजन से या जनमाचण एिं उड़न योग्यता का प्रमाण पत्र प्राप्त करने िते ु जिकजसत दकया गया िो (ण) “रेड जोन” से, भारत के भूक्षेत्र या सामुदद्रक क्षेत्र के ऊपर, या भारत के सामुदद्रक अजधकारक्षेत्र के बािर कंद्रीय सरकार द्वारा पररभाजर्त दकसी स्ट्थ ापना या अजधसूजचत पत् तन सीमाओं के ऊपर का पररभाजर्त आयामों िाला िायुक्षेत्र अजभप्रेत िै; जजसके भीतर कंद्रीय सरकार द्वारा असाधारण पररजस्ट्थजतयों मं ड्रोन प्रचालनों की अनुमजत दी जाएगी; (त) “ररमोट पायलट लाइसंस” से दकसी प्राजधकृत ररमोट पायलट प्रजिक्षण संगठन द्वारा दकसी जिजिष् ट ड्रोन श्रेणी या ड्रोनों की श्रेजणयों के जलए दकसी प्राकृजतक व्य जि को जारी की गई अनुमजत अजभप्रेत िै; (थ) “ड्रोन का प्रकार” से उन संिोधनों को छोड़कर सभी संिोधनों के साथ एक िी मूल जडजाइन के सभी ड्रोन अजभप्रेत ि,ं जजसके पररणामस्ट्िरूप िडं सलग या उड़ान जििेर्ताओं मं पररितचन िोता िै; (द) “मानि रजित जिमान यातायात प्रबंधन” का आिय ििाई यातायात प्रबंधन के जिजनर्ददष्ट पिलू से ि ै जजसमं सभी पक्षकारों के सियोग से जनबाचध सेिाओं और सुजिधाओं के प्रािधान के जररए संरजक्षत, दकरायती और कुिल रूप से मानि रजित जिमान प्रणाली प्रचालनों का प्रबंधन दकया जाता ि ै और जजसमं िायुजजनत और भू-आधाररत कायचकलाप िाजमल िोते िं; (ध) “जििर्े पिचान सख्ं य ा” स े भारत म ं ड्रोन को पजं ीकृत करन े के जलए जारी जििर्े पिचान सख्ं य ा अजभप्रेत ि;ै (न) “येलो जोन” से भारत के भूक्षेत्रों या सामुदद्रक अजधकार क्षेत्र के ऊपर पररभाजर्त आयामों िाला िायुक्षेत्र अजभप्रेत ि ै जजसके भीतर ड्रोन प्रचालन प्रजतबंजधत िं और जजनके जलए संबंजधत ििाई यातयात जनयंत्रण प्राजधकारी की रर से अनुमजत अपेजक्षत िोगी (2) इन जनयमों मं प्रयुि ककतु पररभाजर्त न दकए गए िब् दों और ितके के ििी आिय िोंगे जो इन् िं क्रमि: िायुयान अजधजनयम, 1934 तथा िायुयान जनयम, 1937 मं प्रदान दकए गए ि ं भाग II ड्रोन का िगीकरण 3. ड्रोनों का िगीकरण — ड्रोनों को पेलोड सजित उनके अजधकतम समग्र भार के आधार पर जनम्न ानुसार िगीकृत दकया जाएगा:- (क) अजत सूक्ष्म ड्रोन: 250 ग्राम से कम अथिा समान; (ख) सूक्ष्म ड्रोन: 250 ग्राम से अजधक तथा 2 दकलोग्राम से कम अथिा समान; (ग) लघु ड्रोन: 2 दकलोग्राम से अजधक तथा 25 दकलोग्राम से कम अथिा समान;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (घ) मर्धयम ड्रोन: 25 दकलोग्राम से अजधक तथा 150 दकलोग्राम से कम अथिा समान; तथा (ङ) जििाल ड्रोन: 150 दकलोग्राम से अजधक भाग III ड्रोन प्रमाणन 4. सामान्य - कोई भी व्यजि भारत मं ड्रोन का प्रचालन तब तक निीं करेगा जब तक दक िि उड़ान योग्यता प्रमाणपत्र के अनुरूप न िो या इन जनयमों के तित उड़ानयोग्यता प्रमाणपत्र की अपेक्षा से छूट प्राप्त न िो 5. प्रमाणन जनकाय - भारतीय गुणिया पररर्द, या भारतीय गुणित् ता पररर्द द्वारा प्राजधकृत प्रमाणन जनकाय या केन्द्र ीय सरकार, दकसी जििेर् प्रकार के ड्रोन के जलए उस प्रकार के ड्रोन के जनमाचता या आयातक द्वारा दायर आिेदन पर दकसी जििेर् प्रकार के ड्रोन के जलए उड़ानयोग्यता का प्रमाण पत्र जडजजटल स्ट्काई ्‍लेटरॉमच पर जारी कर सकती िै, यदद इस प्रकार का ड्रोन जिजनर्ददष्ट प्रमाणन मानकों को पूरा करता ि ै 6. प्रमाणन मानक - भारतीय गुणिया पररर्द की जसराररि पर कंद्रीय सरकार ड्रोन के जलए उड़ान योग्यता प्रमाण पत्र प्राप्त करने के जलए मानकों को जिजनर्ददष्ट कर सकती ि ै ये मानक भारत मं जनर्थमत प्रौद्योजगदकयों, जडजाइनों, घटकों और ड्रोन के उपयोग; और भारतीय कॉस्ट् टीलेिन ददकचाचालन (एनएिीआईसी) नामक भारत के क्षेत्रीय ददक् चालन उपग्रि प्रणाली को बढ़ािा द ेसकते ि ं 7. आिदे न की प्रदक्रया - कोई भी जनमाचता या आयातक, जो उड़ान योग्यता का प्रमाण पत्र प्रा्‍ त करना चािता ि ै उसे जडजजटल स्ट्काई ्‍लेटरॉमच पर रॉमच डी -1 के मार्धयम से भारतीय गुणिया पररर्द या इन जनयमों को अजधकृत कारने िाले दकसी अन्य प्रमाणन इकाई मं आिेदन कर सकता ि ैजिां उसे जनम्नजलजखत सूचना प्रदान करनी िोगी: (क) आिेदक का नाम, संपकच जििरण और जीएसटीआईएन; (ख) प्रोटोटाइप ड्रोन के संबंध मं जििरण और आिश्यक दस्ट्तािेज; (ग) जनधाचररत िुल्क के भुगतान का प्रमाण; तथा (घ) प्रोटोटाइप ड्रोन जजसे भौजतक रूप से प्रमाणन इकाई को सौंप ददया जाएगा 8. आयात पर प्रजतबधं - ड्रोन और ड्रोन घटकों के आयात को जिदिे व्यापार मिाजनदिे ालय द्वारा जिजनयजमत दकया जाएगा 9. जिदिे ी जनयामकों द्वारा ददए गए अनमु ोदनों की स्ट्िीकृजत - भारतीय गुणिया पररर्द अन्य अंतरराष्ट्रीय जिमानन जनयामकों द्वारा उस प्रकार के ड्रोन को दी गई मंजूरी के आधार पर ड्रोन को प्रमाजणत कर सकती िै, जैसा दक कंद्र सरकार द्वारा जिजनर्ददष्ट दकया जा सकता ि ै 10. सामान्य सरु क्षा - कोई भी व्यजि प्रत्यक्ष या अप्रत्यक्ष रूप से दकसी भी तरि से ड्रोन का प्रचालन निीं करेगा, जजससे दकसी व्यजि या संपजय की सुरक्षा और संरक्षा को खतरा िो 11. अजनिाय च सुरक्षा जििर्े ताए ं - (1) कंद्रीय सरकार ड्रोन के स्ट्ि ामी द्वारा ड्रोन पर स्ट्थाजपत दकए जाने िाले सुरक्षा सुजिधाओं को अजधसूजचत करेगी (2) ड्रोन के स्ट् िाजमत् ि िाले सभी व्यजि उि सुरक्षा सुजिधाओं को ड्रोन मं ऐसी अिजध के भीतर लगाएंगे जो केन्द्र ीय सरकार द्वारा जिजनर्ददष्ट की जाएगी, जो ऐसी अजधसूचना की तारीख से छि मिीने से कम निीं िोगी ऐसी सुरक्षा जििेर्ताएं, जजन्ि ं भजिष्य मं अजधसूजचत दकया जा सकता िै, मं जनम्नजलजखत िाजमल ि ं - (क) 'जबना अनुमजत - नो टेकऑर' (एनपीएनटी) िाडचिेयर और रमचिेयर; (ख) रीयल-टाइम रैककग बीकन जो ड्रोन के स्ट्थान, ऊंचाई, गजत और जिजिष् ट पिचान संख्या को संप्रेजर्त करेगा; तथा (ग) जजयो रंससग क्षमता[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 5 12. छूट - जनमाचण, आयात या संचालन के जलए उड़ान योग्यता के प्रमाण पत्र की आिश्यकता निीं िोगी - (क) अनुसंधान और जिकास के उद्देश्य के जलए प्रोटोटाइप ड्रोन; (ख) उड़ान योग्यता प्रमाणपत्र प्राप्त करने के जलए प्रोटोटाइप ड्रोन; तथा (ग) नैनो ड्रोन भाग IV ड्रोन पजं ीकरण 13. जिजिष्ट पिचान सख्ं या - (1) कोई भी व्यजि ऐसे ड्रोन का प्रचालन निीं करेगा, जजसकी जिजिष्ट पिचान संख्या न िो, जब तक दक ऐसे ड्रोन को इन जनयमों के तित छूट प्रा्‍ त न िो (2) व्यजि जडजजटल स्ट्काई ्‍लेटरॉमच पर रॉमच डी -2 मं अपेजक्षत जििरण प्रदान करके ड्रोन की जिजिष्ट पिचान संख्या जनरेट कर सकता ि ै (3) ड्रोन की जिजिष्ट पिचान संख्या को जनमाचता द्वारा प्रदान दकए गए जिजिष्ट क्रम संख् या और उसके उड़ान जनयंत्रण मॉड्यूल और ग्राउंड कंरोल स्ट्टेिन के अजद्वतीय क्रम संख्य ा से सलक दकया जाएगा (4) कोई भी व्यजि जडजजटल स्ट्काई ्‍लटे रॉम च पर नए फ्लाइट कंरोल मॉड्यलू या ग्राउंड कंरोल स्ट्टिे न का यजू नक क्रम सख्ं य ा को इस तरि के प्रजतस्ट्थापन की तारीख से सात ददनों की अिजध के भीतर अपडेट दकए जबना, ड्रोन के फ्लाइट कंरोल मॉड्यूल या ग्राउंड कंरोल स्ट्टेिन को निीं बदलेगा, जजसका सीररयल नंबर ऐसे ड्रोन की जिजिष्ट पिचान संख्या से सलक ि ै 14. मौजदू ा ड्रोन का पजं ीकरण - ददनांक 31 ददसंबर, 2021 को या उससे पिले भारत मं जनर्थमत या भारत मं आयात दकए गए ड्रोन के स्ट् िाजमत्ि िाला जडजजटल स्ट्काई ्‍लेटरॉमच पर रॉमच डी -2 म ं आिश्यक जििरण प्रदान करके अपनी जिजिष्ट पिचान संख्या जनरेट करेगा: बिते दक इस तरि के ड्रोन के पास उपयुचि जतजथ पर या उससे पिले जडजजटल स्ट्काई ्‍लेटरॉमच द्वारा जारी एक िैध ड्रोन पािती संख्या (डीएएन) िो और ड्रोन का प्रकार भारतीय गुणिया पररर्द द्वारा जारी दकए गए उड़ान योग्यता प्रमाण पत्र के अनुरूप िो 15. ड्रोनों का िस्ट्तातं रण. – (1) जडजजटल स्ट्काई ्‍लेटरामच पर रामच डी-3 मं िस्ट्तांतरणकताच, िस्ट्तांतररती एिं जिजिष्ट पिचान संख्या का आिश्यक जििरण दते े हुए एक व्यजि दसू रे व्यजि को िस्ट्तांतररत कर सकता ि ै (2) ये िस्ट्तांतरण अजभलेखों मं प्रभािी िोंगे तथा िस्ट्तांतरणकताच, िस्ट्तांतररजत एिं जिजिष्ट पिचान संख्या के इलैक्राजनक सत्यापन के उपरांत जडजजटल स्ट्काई द्वारा एक रांजैक्िन नंबर जनरेट दकया जाएगा 16. ड्रोनों का जिपजं ीकरण – (1) ड्रोन के स्ट्िाजमत्ि िाला एक व्यजि इस जनष्कर्च पर पहुचुँ ने के बाद दक उस व्यजि के नाम मं पंजीकृत ड्रोन या तो स्ट्थायी रूप से खो चुका ि ै अथिा स्ट्थायी रूप से क्षजतग्रस्ट्त िो चुका िै, इस प्रकार के ड्रोन के जिपंजीकरण के जलए जडजीटल स्ट्काई पर रामच डी-3 मं एक आिेदन पत्र जमा करते हुए आिेदन करेगा (2) इस प्रकार के जिपंजीकरण अजभलेखों मं प्रभािी िोंगे और जडजीटल स्ट्काई द्वारा एक रांजैक्िन नंबर जनरेट दकया जाएगा भाग V ड्रोन प्रचालन 17. एयरस्ट्पसे मपै . – कंद्र सरकार, इन जनयमों की अजधसूचना की तारीख के 30 ददनों के भीतर, जडजजटल स्ट्काई ्‍लेटरॉमच पर, ड्रोन प्रचालन के जलए एक ििाई क्षेत्र का नक्िा, जो भारत के पूरे ििाई क्षेत्र को लाल, पीले और िरे क्षेत्रों मं जिभि करता ि,ै एक क्षैजतज जियोजन के साथ बराबर या 10 मीटर से अजधक या पतला, प्रकाजित कर सकती ि ै6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 18. इंटरैजक्टि म्‍ै स – ड्रोन प्रचालन के जलए ििाई क्षेत्र का नक्िा एक मिीन रीडेबल एज्‍लकेिन प्रोग्रासमग इंटररेस (एपीआई) और इंटरैजक्टि के मार्धयम से प्रोग्रामेरटक रूप से सुलभ िोने के जलए जडजाइन दकया जाएगा तादक ड्रोन पायलट अपनी प्रस्ट्ताजित उड़ान योजना का आधार तैयार कर सके और आसानी से उस क्षेत्र की पिचान कर सकं जजसके भीतर यि आता ि ैतादक यि आकलन दकया जा सके दक उन्ि ंपूिच अनुमोदन के जलए आिेदन करने की आिश्यकता ि ैअथिा निीं 19. पिू चअनमु जत की आिश्यकता – कोई भी व्यजि जबना पूिच अनुमजत के रेड जोन अथिा यलो जोन मं ड्रोन का प्रचालन निीं करेगा 20. क्षेत्रीय बार्धयताओं की उड़ान-पिू च सत्यापन की अजनिायतच ा – ड्रोन प्रचालन िुरू करने से पिले, ड्रोन पायलट को प्रचालन के इजकछत क्षेत्र मं ड्रोन प्रचालन के जलए लागू दकसी भी अजधसूचना या प्रजतबंध की जानकारी के जलए जडजजटल स्ट्काई ्‍लेटरॉमच को अजनिायच रूप से सत्याजपत करना िोगा 21. जोसनग की गजतिील प्रकृजत: (1) एक क्षेत्र से दसू रे क्षेत्र की जस्ट्थजत को बदलने के जलए कंद्र सरकार समय-समय पर ड्रोन प्रचालन के जलए जडजजटल स्ट्काई ्‍लेटरॉमच पर ििाई क्षेत्र के नक्िे को अपडेट कर सकती ि ै (2) इस तरि का कोई भी पररितचन इस तरि के अपडेट की तारीख के सात ददनों से पिले प्रभािी निीं िोगा 22. अस्ट्थायी रेड जोन – (1) यदद दकसी जनर्ददष्ट क्षेत्र मं ड्रोन उड़ानों को अस्ट्थायी रूप से प्रजतबंजधत करने की तत्काल आिश्यकता िै, तो संबंजधत राज्य सरकार, कंद्र िाजसत प्रदिे प्रिासन या कानून प्रितचन एजंसी, इसे जडजजटल स्ट्काई ्‍लेटरॉमच के मार्धयम से अजधसूजचत करके और इसे ििाई क्षेत्र के नक्िे पर िाइलाइट करके ऐसे जनर्ददष्ट क्षेत्र मं एक समय म ं 48 घंटे तक की अिजध के जलए अस्ट्थायी रेड जोन घोजर्त कर सकती ि ै (2) अस्ट्थायी रेड जोन की घोर्णा एक ऐसे अजधकारी द्वारा की जाएगी जो पुजलस अधीक्षक या उसके समकक्ष के पद से नीचे का न िो ऐसा अजधकारी अस्ट्थायी रेड जोन के आकार को उजचत रखने का प्रयास करेगा न दक अत्यजधक (3) जडजजटल स्ट्काई ्‍लेटरॉमच अस्ट्थायी रेड जोन की पररजध से पांच दकलोमीटर की दरू ी के भीतर जिजिष्ट पिचान संख्या के धारकों को इलेक्रॉजनक मार्धयम से इस तरि के प्रजतबंध के बारे मं सूजचत करने का प्रयास करेगा, बिते दक इस प्रकार की जानकारी की प्राजप्त की कमी एक ड्रोन पायलट को एक ड्रोन प्रचालन िुरू करने से पिले जडजजटल स्ट्काई ्‍लेटरॉमच पर क्षेत्रीय प्रजतबंधों को सत्याजपत करने की जजम्मेदारी से बरी निीं करेगी 23. डटे ा तक पहुचुँ – सभी राज्य सरकारं, कंद्र िाजसत प्रदिे ों के प्रिासन और कानून प्रितचन एजंजसयों को जडजजटल स्ट्काई ्‍लेटरॉमच पर उपलब्ध डेटा तक सीधी पहुचं प्रदान की जाएगी भाग VI ररमोट पायलट लाइससं 24. ररमोट पायलट लाइसंस— (1) सामान्य. – जडजजटल स्ट्काई ्‍लेटरॉमच पर सूचीबद्ध िैध ररमोट पायलट लाइसंस धारक के अलािा कोई भी सामान्य व्यजि ड्रोन प्रचाजलत निीं करेगा (2) िगीकरण. – 1. ररमोट पायलट लाइसंस मं जििेर् रूप से ड्रोन के उस िगच का उल्लेख िोगा जजसके जलए उि व्यजि ने जनधाचररत प्रजिक्षण सरलतापूिचक पूरा दकया ि ै 2. ररमोट पायलट लाइसंस मं जििेर् रूप से उल्लेख दकया जाएगा दक क्या उि व्यजि ने स्ट्िचाजलत या स्ट्िायय ड्रोन संचालन के जलए जनधाचररत प्रजिक्षण सरलतापूिचक पूरा कर जलया ि ै (3) योग्यता. – जनम्नजलजखत व्यजि ररमोट पायलट लाइसंस के जलए योग्य िोंगे: 1. अठारि िर्च की आयु से कम तथा पंसठ िर्च की आयु से अजधक निीं िोनी चाजिए; 2. दकसी मान्यताप्राप्त बोडच से दसिीं कक्षा या इसके समकक्ष परीक्षा उयीणच की िो; तथा 3. एक अजधकृत ररमोट पायलट प्रजिक्षण संगठन से ररमोट पायलट लाइसंस के लागू िगच के जलए मिाजनदिे क द्वारा जनधाचररत प्रजिक्षण पूरा कर चुका िो[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 7 (4) ररमोट पायलट लाइससं प्राप्त करन ेके जलए दक्रया प्रणाली– 4. जनधाचररत प्रजिक्षण पूरा करने और एक अजधकृत ररमोट पायलट प्रजिक्षण संगठन द्वारा आयोजजत जनधाचररत दक्षता परीक्षा उयीणच करने के बाद, इस तरि की दक्षता परीक्षा के सरल समापन के सात ददनों के भीतर, प्राकृजतक व्यजि को जडजजटल स्ट्काई ्‍लेटरॉमच के मार्धयम से ऐसे अजधकृत ररमोट पायलट प्रजिक्षण संगठन द्वारा ररमोट पायलट प्रमाण पत्र जारी दकया जाएगा 5. अजधकृत ररमोट पायलट प्रजिक्षण संगठन जडजजटल स्ट्काई ्‍लेटरॉमच पर रॉमच डी-4 मं व्यजि का जििरण प्रस्ट्तुत करेगा और जडजजटल स्ट्काई ्‍लेटरॉमच के मार्धयम से जारी दकए गए प्रत्येक ररमोट पायलट प्रमाण पत्र के जलए लागू िुल्क का भुगतान करेगा 6. मिाजनदिे क, अजधकृत ररमोट पायलट प्रजिक्षण संगठन द्वारा ररमोट पायलट सर्टटदरकेट जारी करने की तारीख से पंद्रि ददनों के भीतर जडजजटल स्ट्काई ्‍लेटरॉमच के मार्धयम से उप-जनयम (4) (क) मं जनधाचररत मानदडं ों को पूरा करने िाले दकसी भी आिेदक को ररमोट पायलट लाइसंस जारी कर सकता ि ै (5) िधै ता. – 7. ररमोट पायलट लाइसंस तभी मान्य िोगा जब िि जडजजटल स्ट्काई ्‍लेटरॉमच पर सूचीबद्ध िो 8. एक ररमोट पायलट लाइसंस जब तक दक जनलंजबत अथिा रद्द न कर ददया गया िो, अजधकतम 10 िर्के की समयािजध के अधीन उसमं जिजनर्ददष्ट समयािजध तक के जलए िैध रिगे ा तथा दकसी भी प्राजधकृत ररमोट पायलट प्रजिक्षण संगठन द्वारा अजधकतम 10 िर्के की समयािजध के अधीन उसमं जिजनर्ददष्ट समयािजध के जलए निीकृत दकया जा सकता िै: बिते दक ररमोट पायलट लाइसंसधारक ऐसे पुनश्चयाच पाठ्यक्रम को पूरा करता ि ै जो समय-समय पर जडजजटल स्ट्काई ्‍लेटरॉमच पर मिाजनदिे क द्वारा जनर्ददष्ट दकया जाता ि ै (6) छूट – दकसी भी व्यजि को सुदरू पायलट लाइसंस की आिश्यकता निीं िोगी जो – (क) नैनो ड्रोन का प्रचालन कर रिा िो; एिं (ख) गैर-िाजणजज्यक उद्देश्यों के जलए माइक्रो ड्रोन का प्रचालन कर रिा िो भाग VII ररमोट पायलट प्रजिक्षण सगं ठन 25. ररमोट पायलट प्रजिक्षण सगं ठन— (1) सामान्य – प्राजधकृत ररमोट पायलट प्रजिक्षण संगठन के अलािा कोई अन्य व्यजि ररमोट पायलट लाइसंस प्राप्त करने के इकछुक दकसी व्यजि को प्रजिक्षण प्रदान निीं कर सकता (2) पात्रता – दकसी भी ररमोट पायलट प्रजिक्षण संगठन को तब तक प्राजधकृजत निीं दी जाएगी जब तक िि पात्रता के जनम्नजलजखत सभी मापदडं ों को पूरा निीं करता: (क) ररमोट पायलट प्रजिक्षण संगठन ऐसे ्‍लॉट (भूखंड) से प्रचाजलत िो रिा ि ै जजसका न्यूनतम आयाम 50 मीटर x 50 मीटर ि;ै (ख) ररमोट पायलट प्रजिक्षण संगठन के पास पयाचप्त संख्या मं कक्षाएुँ िों जजससे यि सुजनजश्चत दकया जा सके दक दकसी भी समय एक कक्षा मं 30 से अजधक छात्र न िों; (ग) ररमोट पायलट प्रजिक्षण संगठन के पास ड्रोन एिं संबंजधत उपकरण अपेजक्षत संख्या मं तथा अकछी जस्ट्थजत मं ि ं और यि सुजनजश्चत दकया जा जाता ि ै दक प्रत्येक छात्र को व्याििाररक प्रजिक्षण के जलए पयाचप्त अिसर जमले; तथा (घ) ररमोट पायलट प्रजिक्षण संगठन के पास अपेजक्षत संख्या मं िैध ररमोट पायलट लाइसंस-धारक प्रजिक्षक ि ंजो छात्रों को प्रजिक्षण दने े के जलए जजम्मेदार िोंगे8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (3) प्राजधकृजत प्राप्त करन ेकी प्रदक्रया – (क) कोई भी व्यजि जो उप-जनयम (2) मं जनधाचररत पात्रता मानदडं ों को पूरा करता ि ै एिं ररमोट पायलट प्रजिक्षण संगठन स्ट्थाजपत करने के जलए प्राजधकृजत की मांग कर रिा िै, िि जडजजटल स्ट्काई ्‍लेटरॉमच पर रॉमच डी-5 मं जनर्ददष्ट िुल्क सजित मिाजनदिे क को आिेदन प्रस्ट्तुत करेगा (ख) मिाजनदिे क, उप-जनयम (3)(ए) मं जनधाचररत मानदडं ों को पूरा करने िाले दकसी भी आिेदक को, ऐसे आिेदन की तारीख से साठ ददनों के भीतर, ररमोट पायलट प्रजिक्षण संगठन की प्राजधकृजत जारी कर सकता ि ै (4) िधै ता – ररमोट पायलट प्रजिक्षण संगठन की स्ट्थापना करने िते ु प्रदान की गई प्राजधकृजत, जब तक दक जनलंजबत या रद्द न की गई िो, दस िर्च की अिजध के जलए िैध रिगे ा, एिं एक बार मं अजधकतम दस िर्च की अिजध के अधीन, उसे जनर्ददष्ट अिजध के जलए निीनीकृत दकया जा सकता ि ै (5) प्रजिक्षण आिश्यकताए ुँ– (क) प्राजधकृत ररमोट पायलट प्रजिक्षण संगठन, जडजजटल स्ट्काई ्‍लेटरॉमच पर मिाजनदिे क द्वारा प्रजिक्षण, दक्षता परीक्षण एिं ररमोट पायलट प्रमाण पत्र जारी करने से संबंजधत जनधाचररत आिश्यकताओं का सख्त अनुपालन सुजनजश्चत करेगा (ख) जनधाचररत प्रजिक्षण आिश्यकताएुँ जिजिष्ट ड्रोन के िगच या िगके के जलए िोंगी (ग) स्ट्िचाजलत और स्ट्िायय ड्रोन प्रचालन के जलए जनधाचररत प्रजिक्षण आिश्यकताएं िोंगी भाग VIII अनसु धं ान एि ंजिकास 26. अनसु धं ान एि ं जिकास के जलए ड्रोन प्रचालन – जनम्नजलजखत व्यजियों को अनुसंधान एिं जिकास उद्देश्यों के जलए ड्रोन के प्रचालन िते ु उड़ान योग्यता प्रमाण पत्र, जिजिष्ट पिचान संख्या, पूिच अनुमजत तथा ररमोट पायलट लाइसंस की आिश्यकता निीं िोगी – (क) कंद्र सरकार, राज्य सरकार अथिा कंद्र िाजसत प्रदिे ों के प्रिासजनक जनयंत्रण मं या मान्यता प्राप्त अनुसंधान एिं जिकास संस्ट्थाएं; (ख) कंद्र सरकार, राज्य सरकार या कंद्र िाजसत प्रदिे के प्रिासजनक जनयंत्रण मं या मान्यताप्राप्त िैक्षजणक संस्ट्थान; (ग) उद्योग संिधचन और आंतररक व्यापार जिभाग द्वारा मान्यता प्राप्त स्ट्टाटचअप; तथा (घ) कोई भी ड्रोन जनमाचता जजसके पास िस्ट्तु एिं सेिा कर पिचान संख्या िै: बिते दक इस तरि के ड्रोन प्रचालन ग्रीन जोन के भीतर एिं उस व्यजि के पररसर के भीतर िों जिां ऐसा अनुसंधान एिं जिकास दकया जा रिा िो; या ऐसे व्यजि के जनयंत्रण मं दकसी ग्रीन जोन मं खुले क्षेत्र के भीतर िो भाग IX ड्रोन यातायात प्रबधं न 27. ड्रोन यातायात प्रबंधन – (1) कंद्र सरकार, इन जनयमों की अजधसूचना की तारीख के साठ ददनों के भीतर, जडजजटल स्ट्काई ्‍लेटरॉमच पर मानि रजित जिमान प्रणाली यातायात प्रबंधन (यूटीएम) प्रणाली से संबंजधत नीजतगत ढांचा प्रकाजित कर सकती ि ै (2) ऐसा नीजतगत ढांचा इन जनयमों के अनुरूप िोगा एिं इन जनयमों के तित आिश्यक स्ट्िचाजलत अनुमजतयों की सुजिधा प्रदान करेगा[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 9 (3) ड्रोन द्वारा समान के सुरजक्षत िस्ट्तांतरण िते ु ड्रोन कॉररडोर जिकजसत करने की रूपरेखा उि नीजतगत ढांचा मं जनर्ददष्ट की जाएगी (4) राज्य सरकारों एिं कंद्र िाजसत प्रदिे ों के प्रिासन की भूजमकाएं, िजियां तथा जजम्मेदाररयां उि नीजत ढांचा मं जनर्ददष्ट की जाएंगी भाग X बीमा 28. मोटर िािन अजधजनयम, 1988 के प्रािधानों एिं उसके अंतगचत बनाए गए जनयम, पररितचन सजित, ड्रोन के तीसरे पक्ष के बीमा तथा ऐसे ड्रोन के कारण जीिन और/या संपजय की िाजन के मामले मं क्षजतपूर्थत के जलए लागू िोंगे इस जनयम मं कजथत दकसी भी बात के बािजूद, नैनो ड्रोन तीसरे पक्ष के बीमा के जबना प्रचालन कर सकता ि ै भाग XI ड्रोन को बढ़ािा दने ा 29. ड्रोन को बढ़ािा दने ा – (1) कंद्र सरकार ड्रोन संिधचन पररर्द के जनमाचण के मार्धयम से ड्रोन को अपनाने और उपयोग को बढ़ािा द ेसकती ि ै (2) ड्रोन प्रमोिन काउंजसल जनम्नजलजखत सुजिधा दगे ी- (क) स्ट्िचाजलत अनुमजतयों सजित व्यिसाय के अनुकूल जनयामक व्यिस्ट्था का जिकास; (ख) ड्रोन प्रौद्योजगदकयों के जिकास के जलए इन्क्यूबेटरों और अन्य सुजिधाओं की स्ट्थापना; (ग) नीजत सलाि मं उद्योग जििेर्ज्ञों और िैक्षजणक संस्ट्थानों की भागीदारी; तथा (घ) ड्रोन और एंटी-ड्रोन प्रौद्योजगदकयों से जुड़े प्रजतस्ट्पधी कायचक्रमों का आयोजन (3) कंद्र सरकार आर्थथक प्रभाि के आधार पर इन जनयमों का मूल्यांकन कर सकती िै, जजसे छि-माजसक ररपोटच मं प्रलेजखत दकया जाएगा, जजसमं भारतीय ड्रोन क्षेत्र की उपलजब्धयों और इस क्षेत्र मं व्यापार करने मं आसानी के जलए दकए गए उपायों की सूची िोगी भाग XII सामान्य 30. िल्ु क: इन जनयमों के तित कंद्र सरकार द्वारा प्रदान की जाने िाली सेिाओं के जलए िुल्क जनम्नानुसार दये िोगा – क्र. स.ं सिे ा रीस (रुपए) 1 उड़ान योग्यता प्रमाण पत्र जारी करना 100 2 जिजिष्ट पिचान सख्ं या को जारी, स्ट्थानातं ररत या 100 जिपजं ीकृत (deregistration) करना 3 दरू स्ट्थ पायलट लाइससं की सचू ीकरण या 100 निीनीकरण 4 दरू स्ट्थ पायलट प्रजिक्षण सगं ठन के प्राजधकरण का 1,000 निीनीकरण या प्राजधकरण10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] नोट:- भारतीय गुणिया पररर्द, प्रमाणन संस्ट्थाएं और अजधकृत दरू स्ट्थ पायलट प्रजिक्षण संगठन आदद जैसी संस्ट्थाएं अपनी सेिाओं के जलए बाजार से जुड़े िुल्क ले सकती ि ं 31. जनदिे - कंद्र सरकार, यदद अपेजक्षत िो, ड्रोन से संबंजधत सामान्य या जििेर् जनदिे जारी कर सकती ि,ै जो जिमान अजधजनयम, 1934 या इन जनयमों से असंगत निीं ि ै 32. छूट की सामान्य िजि — कंद्र सरकार, जलजखत मं एक सामान्य या जििेर् आदिे द्वारा, दकसी भी व्यजि या व्यजियों के िगच को इन जनयमों के संचालन से पूरी तरि या आंजिक रूप से छूट द ेसकती िै, ऐसी ितके के अधीन, जैसा दक उस आदिे मं जनर्ददष्ट दकया जा सकता ि ै 33. अपराधों के जलए दडं – (1) एक व्यजि जजसने इन जनयमों का उल्लंघन दकया ि ै या उसका पालन करने मं जिरल रिा ि,ै िि जिमान अजधजनयम, 1934 की धारा 10 की उप-धारा (2) के प्रािधानों के अनुसार न्यायालय द्वारा दडं नीय िोगा और इस तरि के उल्लंघन या गैर-अनुपालन जिमान अजधजनयम, 1934 की धारा 12ए के प्रािधानों के अनुसार समाधेय िोगा (2) इन जनयमों के प्रािधान कुछ समय के जलए लागू दकसी अन्य कानून के प्रािधानों के अजतररि िोंगे, न दक उनके अल्पीकरण मं 34. दडं - जिां मिाजनदिे क या कंद्र सरकार, राज्य सरकार या कंद्र िाजसत प्रदिे प्रिासन द्वारा अजधकृत अजधकारी; सुनिाई का अिसर दने े के बाद, संतुष्ट ि ै दक दकसी व्यजि ने उल्लंघन दकया ि ै या इन जनयमों के प्रािधानों का पालन करने मं जिरल रिा ि,ै िि जिमान अजधजनयम, 1934 की धारा 10ए के तित जलजखत रूप मं दजच दकए जाने िाले कारणों से प्रािधानों के अनुसार एक लाख रुपये से अजधक का जुमाचना निीं लगा सकता ि ै 35. रद्द या जनलबं न - जिां मिाजनदिे क या कंद्र सरकार, राज्य सरकार या कंद्र िाजसत प्रदिे प्रिासन द्वारा अजधकृत अजधकारी; सुनिाई का अिसर दने े के बाद, संतुष्ट ि ै दक दकसी व्यजि ने उल्लंघन दकया ि ै या इन जनयमों के प्रािधानों का पालन करने मं जिरल रिा िै, इन जनयमों के अंतगचत िि जलजखत रूप मं दजच दकए जाने िाले कारणों के जलए दकसी भी लाइसंस, प्रमाण पत्र, प्राजधकरण या अनुमोदन को रद्द या जनलंजबत कर सकता ि ै 36. बचत - इन जनयमों मं कुछ भी सािचजजनक सुरक्षा के जित मं या सभी मानि या मानि रजित जिमानों के सुरजक्षत संचालन के जलए जारी दकए गए दकसी भी आदिे के संबंध मं कंद्र सरकार की िजि को सीजमत या अन्यथा प्रभाजित निीं करेगा 37. जनरसन - मानिरजित जिमान AV-29017/37/2021-SDIT-MOCA] अंबर दबु े, संयुि सजचि MINISTRY OF CIVIL AVIATION NOTIFICATION New Delhi, the 15th July, 2021 The Drone Rules, 2021 Preamble G.S.R. 489(E).—Whereas, Unmanned Aircraft System (hereinafter referred to as drones) offer immense opportunities for economic growth and employment generation; And whereas, there is need to regulate the drone related activities in a manner such that they do not pose any risk to safety or security of people and assets; And whereas, the Central Government promulgated the Unmanned Aircraft System Rules (UAS Rules), 2021, which came into force on 12th March, 2021; and received valuable feedback from academia, industry and other stakeholders; Now, therefore, the Central Government proposes to make certain rules in supersession of the UAS Rules, 2021, in exercise of the powers conferred by sections 5, sub-section (2) of section 10 and sections 10A, 10B and 12A of the Aircraft Act, 1934 (22 of 1934). The said draft rules are hereby published as required by section 14 of the said Act, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules will be taken into consideration after 5th Aug 2021; Suggestions or objections, if any, should be addressed to Shri Kameshwar Mishra, Ministry of Civil Aviation, B Block, Rajiv Gandhi Bhavan, New Delhi-110003 or mailed to sdit.div-moca@gov.in with the subject line: ―Suggestions for draft Drone Rules, 2021‖. Any suggestion or objection received with respect to the said draft rules before the expiry of the period specified above may be considered by the Central Government.[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 19 Draft Rules PART I PRELIMINARY 1. Short title, commencement and application. — (1) These rules may be called the Drone Rules, 2021. (2) They shall come into force on the date of their publication in the Official Gazette. (3) They shall apply to, – (a) All persons owning or possessing or engaged in exporting, importing, manufacturing, trading, leasing, operating, transferring or maintaining a drone in India; and (b) all drones that are being operated for the time being, in or over India. (4) The provisions contained in the Aircraft Rules, 1937 shall not apply to drones and matters connected therewith or incidental thereto except for those provisions whose application is specifically provided in these rules. (5) In case of a drone with maximum all-up-weight more than 500 kilogram, the provisions of the Aircraft Rules, 1937 shall apply. (6) These rules shall not apply to drones used by the naval, military or air forces of the Union. (7) No person shall carry out any activity in contravention of these rules. 2. Definitions. — (1) In these rules, unless the context otherwise requires, – (a) ―Authorised remote pilot training organisation‖ includes any organisation authorised by the Director General for the purpose of imparting training prescribed under these rules; (b) ―Automatic drone operation‖ means a drone operation with pre-programmed instructions wherein the drone pilot is able to intervene at any time; (c) ―Autonomous drone operation‘ means a drone operation that does not allow intervention of a drone pilot in the management of the flight. This shall not include phases of drone operation during which the drone pilot has no ability to intervene in the management of the flight, either following the implementation of emergency procedures, or due to a loss of the command and control connection; (d) ―Certificate of airworthiness‖ means a certificate issued by the Quality Council of India or any other certification entity authorised by the Quality Council of India or the Central Government, certifying that the drone of a specific type meets the requirements specified under these rules; (e) ―Controlled airspace‖ means the airspace of defined dimensions within which air traffic control service is provided in accordance with the airspace classification; (f) ―Digital sky platform‖ means the online platform hosted by the Directorate General of Civil Aviation for various activities related to the management of drone activities in India; (g) ―Director General" means the Director General of Civil Aviation appointed by the Government of India; (h) ―Drone‖ means an aircraft that can operate autonomously or can be operated remotely without a pilot on board; (i) ―Drone Acknowledgement Number‖ means the unique number issued by the digital sky platform under the voluntary disclosure scheme for drones in India; (j) ―Drone pilot‖ means the natural person responsible for operating a drone who manipulates the flight controls during a drone operation; (k) ―Geo-fencing‖ means restricting the movement of drone within a defined airspace; (l) ―Green zone‖ means the airspace from the ground up to a vertical distance of 400 feet (120 metre) above ground level (AGL) that has not been designated as a red zone or yellow zone in the airspace map for drone operations; and the airspace from the ground up to a vertical distance of 200 feet (60 metre) AGL in the area located between a lateral distance of20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 8 kilometre and 12 kilometre from the perimeter of an operational airport. In the airspace above 400 feet (120 metre) AGL in a designated green zone and the airspace above 200 feet (60 metre) AGL in the area located between the lateral distance of 8 kilometre and 12 kilometre from the perimeter of an operational airport, the provisions of yellow zone shall apply; (m) ―Person‖ includes an individual or a company or a firm or an association of persons or body of individuals or a local authority or any legal entity, whether incorporated or not, Central Government or State Government or an entity thereof; (n) ―Prototype drone‖ means a drone developed for the purpose of research and development or obtaining a certificate of airworthiness (o) ―Red zone‖ means the airspace of defined dimensions, above the land areas or territorial waters of India, or any installation or notified port limits specified by the Central Government beyond the territorial waters of India; within which drone operations shall be permitted only under exceptional circumstances by the Central Government; (p) ―Remote pilot licence‖ means the permission issued by an authorised remote pilot training organisation to any natural person for operating a particular class or classes of drones; (q) ―Type of drone‖ means all drones of the same basic design including all modifications thereto except those modifications which result in a change in handling or flight characteristics; (r) ―Unmanned Aircraft System Traffic Management System‖ means a system that provides traffic management for drone through the collaborative integration of persons, information, technology, facilities and services; supported by air, ground or space-based communications, navigation and surveillance; (s) ―Unique identification number‖ means the unique identification number issued for registering a drone in India; (t) ―Yellow zone‖ means the controlled airspace of defined dimensions above the land areas or territorial waters of India within which drone operations are restricted and shall require permission from the concerned air traffic control authority. (2) The words and terms used but not defined in these rules shall have the meanings respectively assigned to them in the Aircraft Act, 1934 and the Aircraft Rules, 1937. PART II CLASSIFICATION OF DRONE 3. Classification of drones. — Drones shall be classified based upon the maximum all-up weight including payload as under – (a) Nano drone: Less than or equal to 250 gram; (b) Micro drone: Greater than 250 gram and less than or equal to 2 kilogram; (c) Small drone: Greater than 2 kilogram and less than or equal to 25 kilogram; (d) Medium drone: Greater than 25 kilogram and less than or equal to 150 kilogram; and (e) Large drone: Greater than 150 kilogram. PART III DRONE CERTIFICATION 4. General. — No person shall operate a drone in India unless it conforms to a certificate of airworthiness or is exempted from the requirement for a certificate of airworthiness under these rules. 5. Certification entities. – The Quality Council of India or a certification entity authorised by the Quality Council of India or the Central Government may issue a certificate of airworthiness for any particular type of drone, on an application filed by a manufacturer or importer of that type of drone on the digital sky platform, if such type of drone meets the specified certification standards.[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 21 6. Certification standards. – On the recommendation of the Quality Council of India, the Central Government may specify the standards for obtaining a certificate of airworthiness for drones. These standards may promote the use of made-in-India technologies, designs, components and drones; and India‘s regional navigation satellite system named Navigation with Indian Constellation (NavIC). 7. Procedure for application. – Any manufacturer or importer seeking a certificate of airworthiness shall apply through Form D-1 on the digital sky platform, to Quality Council of India or any other certification entity authorised these rules, providing the following: (a) Name, contact details and GSTIN of the applicant; (b) Details and required documents in respect of the prototype drone; (c) Proof of payment of the prescribed fees; and (d) Prototype drone that shall be physically handed over to the certification entity. 8. Restriction on imports. – Import of drones and drone components shall be regulated by the Directorate General of Foreign Trade. 9. Acceptance of approvals given by foreign regulators. – The Quality Council of India may certify drones based on approvals granted to that type of drone by other international aviation regulators, as may be specified by the Central Government. 10. General safety. – No person shall, operate a drone in any manner, either directly or indirectly, so as to endanger the safety and security of any person or property. 11. Mandatory safety features. – (1) The Central Government shall notify safety features to be installed on a drone by the person owning the drone. (2) All persons owning a drone shall adopt the said safety features within such period as may be specified by the Central Government, which shall not be less than six months from the date of such notification. Such safety features, that may be notified in future, may include as under – (a) ‗No Permission – No Takeoff‘ (NPNT) hardware and firmware; (b) Real-time tracking beacon that communicates the drone‘s location, altitude, speed and unique identification number; and (c) Geo-fencing capability. 12. Exemptions. — No certificate of airworthiness shall be required for manufacturing, importing or operating a – (a) prototype drone for the purpose of research and development; (b) prototype drone for obtaining certificate of airworthiness; and (c) nano drone. PART IV DRONE REGISTRATION 13. Unique identification number. – (1) No person shall operate a drone which does not have a unique identification number, unless such drone is exempted under these rules. (2) A person may generate the unique identification number of a drone by providing requisite details in Form D-2 on the digital sky platform. (3) The unique identification number of a drone shall be linked to the unique serial number provided by the manufacturer and the unique serial numbers of its flight control module and ground control station. (4) No person shall replace the flight control module or ground control station of a drone, whose serial number is linked to such drone‘s unique identification number, without updating on the digital sky platform, the unique serial number of the new flight control module or ground control station, within a period of seven days from the date of such replacement. 14. Registration of existing drones. – A person owning a drone manufactured in India or imported into India on or before 31 December 2021 shall generate its unique identification number by providing requisite details in Form D-2 on the digital sky platform:22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Provided that such drone has a valid Drone Acknowledgement Number (DAN) issued by the digital sky platform on or before the above-mentioned date and the type of drone conforms to a certificate of airworthiness issued by the Quality Council of India. 15. Transfer of drones. – (1) A person may transfer a drone to another person by giving the requisite details of the transferor, transferee and unique identification number of the drone in Form D-3 on the digital sky platform. (2) Such transfer shall be effected in the records and a transaction number shall be generated by the digital sky platform after electronic verification of the transferor, transferee and the unique identification number. 16. Deregistration of drones. – (1) A person owning a drone, on arriving at a reasonable conclusion that a drone registered in the person‘s name is either permanently lost or permanently damaged, shall apply for the deregistration of such drone by submitting an application in Form D-3 on the digital sky platform. (2) Such deregistration shall be effected in the records and a transaction number shall be generated by the digital sky platform. PART V DRONE OPERATIONS 17. Airspace map. – The Central Government may, within 30 days of the date of notification of these rules, publish on the digital sky platform, an airspace map for drone operations segregating the entire airspace of India into red, yellow and green zones, with a horizontal resolution equal or finer than 10 metre. 18. Interactive maps. – The airspace map for drone operations shall be designed to be programmatically accessible through a machine readable Application Programming Interface (API) and interactive so that drone pilots will be able to plot their proposed flight plan and easily identify the zone(s) within which it falls so as to assess whether or not they need to make an application for prior approval. 19. Requirement of prior permission. – No person shall operate a drone in a red zone or yellow zone without prior permission. 20. Mandatory pre-flight verification of zonal restrictions. – Before commencing a drone operation, a drone pilot shall mandatorily verify the digital sky platform for any notification or restriction applicable to drone operations in the intended area of operation. 21. Dynamic nature of zoning: (1) The Central Government may update the airspace map on digital sky platform for drone operations from time to time to change the status of an area from one zone to another. (2) Any such change shall come into effect no sooner than seven days after the date of such update. 22. Temporary red zone. – (1) If there is an urgent need to temporarily prohibit drone flights in a specified area, the concerned State Government, Union Territory Administration or law enforcement agency may declare a temporary red zone over such specified area, for a period not exceeding 48 hours at a time, by notifying it through the digital sky platform and highlighting it on the airspace map. (2) The temporary red zone shall be declared by an officer not below the rank of Superintendent of Police or its equivalent. Such officer shall endeavour to keep the size of the temporary red zone reasonable and not excessive. (3) The digital sky platform shall endeavour to inform, through electronic means, holders of unique identification number within a distance of five kilometre from the perimeter of the temporary red zone of such a restriction, provided that the lack of receipt of such information shall not absolve a drone pilot of the responsibility to verify the zonal restrictions on the digital sky platform before commencing a drone operation. 23. Access to data. – All State Governments, Union Territory Administrations and law enforcement agencies shall be provided direct access to the data available on the digital sky platform.[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 23 PART VI REMOTE PILOT LICENCE 24. Remote Pilot Licence.— (1) General. – No natural person other than a holder of a valid remote pilot licence enlisted on the digital sky platform shall operate a drone. (2) Classification. – (a) Remote pilot licences shall specifically mention the class of the drone that the natural person has successfully completed the prescribed training for. (b) The remote pilot licence shall specifically mention if the said natural person has successfully completed the prescribed training for automatic or autonomous drone operations. (3) Eligibility. – The following natural persons shall be eligible for a remote pilot licence: (a) not less than eighteen years of age and not more than sixty five years of age; (b) have passed class tenth or its equivalent examination from a recognised Board; and (c) have completed the training prescribed by the Director General for the applicable class of remote pilot licence from an authorised remote pilot training organisation. (4) Procedure for obtaining remote pilot licence. – (a) After completing the prescribed training and passing the prescribed proficiency test conducted by an authorised remote pilot training organisation, the natural person shall be issued a remote pilot certificate by such authorised remote pilot training organisation through the digital sky platform, within seven days of the successful completion of such proficiency test. (b) The authorised remote pilot training organisation shall provide details of the person in Form D-4 on the digital sky platform and pay the applicable fee for each remote pilot certificate issued through the digital sky platform. (c) The Director General may issue the remote pilot licence to any applicant who satisfies the criteria set out in sub-rule (4)(a), through the digital sky platform, within fifteen days from the date of issue of the remote pilot certificate by the authorised remote pilot training organisation. (5) Validity. – (a) A remote pilot licence shall be valid only if it is enlisted on the digital sky platform. (b) A remote pilot licence shall, unless suspended or cancelled, remain valid for a period of ten years, and may be renewed by any authorised remote pilot training organisation for the period specified therein, subject to a maximum period of ten years: Provided that the holder of the remote pilot licence undergoes such refresher courses as may be specified by the Director General on the digital sky platform from time to time. (6) Exemption. – No remote pilot licence shall be required for a person – (a) operating a nano drone; and (b) operating a micro drone for non-commercial purposes. PART VII REMOTE PILOT TRAINING ORGANISATION 25. Remote pilot training organisation.— (1) General. – No person other than an authorised remote pilot training organisation shall impart training to a person seeking a remote pilot licence. (2) Eligibility. – No remote pilot training organisation shall be authorised unless the following eligibility criteria have been met: (a) The remote pilot training organisation is operating from a plot of land that has minimum dimensions of 50 metre by 50 metre;24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (b) The remote pilot training organisation has an adequate number of classrooms to ensure that there are not more than 30 students in a classroom at any point in time; (c) The remote pilot training organisation has a requisite number of drones and related equipment in good working condition so as to ensure that each student has adequate opportunity for hands-on practical training; and (d) The remote pilot training organisation has a requisite number of instructors with valid remote pilot licences who shall be responsible for training the students. (3) Procedure for obtaining authorisation. – (a) Any person who has met the eligibility criteria set out in sub-rule (2) and is seeking authorisation to establish a remote pilot training organisation shall submit an application to the Director General in Form D-5 on the digital sky platform, along with the specified fee. (b) The Director General may issue the authorisation for the remote pilot training organization to any applicant who satisfies the criteria set out in sub-rule (3)(a), within sixty days from the date of such application. (4) Validity. – An authorisation to establish a remote pilot training organisation shall, unless suspended or cancelled, remain valid for a period of ten years, and may be renewed for the period specified therein, subject to a maximum period of ten years at a time. (5) Training requirements. – (a) The authorised remote pilot training organisation shall ensure strict compliance with the requirements prescribed by the Director General on the digital sky platform in respect of training, proficiency testing and issue of remote pilot certificates. (b) The prescribed training requirements shall be specific to a class or classes of drone. (c) There shall be prescribed training requirements for automatic and autonomous drone operations. PART VIII RESEARCH AND DEVELOPMENT 26. Drone operations for research and development. – The following persons shall not require a certificate of airworthiness, unique identification number, prior permission and remote pilot licence for operating drones for research and development purposes – (a) Research and development entities under the administrative control of, or recognised by the Central Government, State Governments or Union Territory Administrations; (b) Educational institutions under the administrative control of, or recognised by the Central Government, State Governments or Union Territory Administrations; (c) Startups recognised by Department for Promotion of Industry and Internal Trade; and (d) Any drone manufacturer having a Goods and Service Tax Identification Number: Provided that such drone operations take place within a green zone and within the premises of the person where such research and development is being carried out; or within an open area in a green zone under such person‘s control. PART IX DRONE TRAFFIC MANAGEMENT 27. Drone traffic management. – (1) The Central Government may, within sixty days of the date of notification of these rules, publish the policy framework in respect of the Unmanned Aircraft System Traffic Management (UTM) System on the digital sky platform. (2) Such policy framework shall be in alignment with these rules and shall facilitate automated permissions as required under these rules.[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 25 (3) The framework for developing drone corridors for safe transfer of goods by drones shall be specified in the said policy framework. (4) The roles, powers and responsibilities of State Governments and Union Territory Administrations shall be specified in the said policy framework. PART X INSURANCE 28. The provisions of the Motor Vehicles Act, 1988 and rules made there under shall apply, mutatis mutandis, to third party insurance of drone and compensation in case of damage to life and/or property caused by such a drone. Notwithstanding anything contained in this rule, a nano drone may operate without third party insurance. PART XI DRONE PROMOTION 29. Drone promotion.— (1) The Central Government may promote the adoption and use of drones through the creation of a Drone Promotion Council. (2) The drone promotion council shall facilitate – (a) development of a business-friendly regulatory regime, including automated permissions; (b) establishment of incubators and other facilities for the development of drone technologies; (c) involvement of industry experts and academic institutions in policy advice; and (d) organising of competitive events involving drones and counter-drone technologies. (3) The Central Government may evaluate these rules on the basis of economic impact which shall be documented in a six-monthly report that will list the achievements of the Indian drone sector and the measures taken to further the ease of doing business in the sector. PART XII GENERAL 30. Directions.— The Central Government may, if required, issue general or special directions related to drones, not inconsistent with the Aircraft Act, 1934 or these rules. 32. General power to exempt. – The Central Government may, by a general or special order in writing, exempt any person or class of persons from the operation of these rules, either wholly or partially, subject to such conditions, as may be specified in that order. 33. Prosecution for offences. – (1) A person who has contravened or failed to comply with these rules shall be punishable by the Court in accordance with the provisions of sub-section (2) of Section 10 of26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] the Aircraft Act, 1934 and such contraventions or non-compliance shall be compoundable in accordance with the provisions of Section 12A of the Aircraft Act, 1934. (2) The provisions of these rules shall be in addition to, and not in derogation of the provisions of any other law, for the time being in force. 34. Penalties. – Where the Director General or an officer authorised by the Central Government, State Government or Union Territory Administration; after giving an opportunity of being heard, is satisfied that a person has contravened or failed to comply with the provisions of these rules, he may, for reasons to be recorded in writing, levy a penalty not exceeding rupees one lakh in accordance with the provisions of Section 10A of the Aircraft Act, 1934. 35. Cancellation or suspension.— Where the Director General or an officer authorised by the Central Government, State Government or Union Territory Administration; after giving an opportunity of being heard, is satisfied that a person has contravened or failed to comply with the provisions of these rules, he may, for reasons to be recorded in writing, cancel or suspend any licence, certificate, authorisation or approval granted under these rules. 36. Saving. — Nothing in these rules shall limit or otherwise affect the power of the Central Government with regard to any order issued in the interest of public safety or for safe operation of all manned or unmanned aircraft. 37. Repeal. — The Unmanned Aircraft System Rules, 2021 stand repealed.
