[G.O. Ms. No. 11, Co-operation, Food and Consumer Protection (CC1), 24th January 2024, தை 10, ச�ோபகிருது, திருவள்ளுவர் ஆண்டு-2055.] No. SRO A-6/2024.— In exercise of the powers conferred by sub-section (1) of section 180 read with sub-section (1) of Section 75 of the Tamil Nadu Co-operative Societies Act, 1983 (Tamil Nadu Act 30 of 1983), the Governor of Tamil Nadu hereby makes the following amendments to the Tamil Nadu Central Co-operative Banks Common Cadre Service Rules, 2019:- Amendments. In the said Rules,- (i) in rule 1, in sub-rule (2), for the expression "General Managers", the expression "General Managers and Assistant General Managers" shall be substituted; (2) in rule 2,- (i) for clause (h), the following clause shall be substituted, namely:- (h) 'Common Cadre Employee' means the holders of the posts of General Manager and Assistant General Manager of Central Co-operative Banks; (ii) in clause (k), for the expression "General Manager", the expression "General Manager and Assistant General Manager" shall be substituted; (3) in rule 3,- (i) in sub-rule (2), for the expression "The post of General Manager", the expression ''The posts of General Manager and the Assistant General Manager" shall be substituted; (ii) in sub-rule (3), for the expression the above said post", the expression "the above said posts" shall be substituted; (iii) for sub-rule (4), the following sub-rule shall be substituted, namely; (4) The Committee consisting of the following officers shall be the Competent Authority (hereinafter called 'Common Cadre Authority') in respect of Central Co-operative Banks under sub-section (3) of Section 75 of the Act- (i) Additional Registrar (Finance and Banking) in the office of the Chairman Registrar of Co-operative Societies. (ii) One non - official member of the registered society concerned to be Member nominated by the Registrar of Co-operative Societies once in two years on rotation basis (iii) Two Managing Directors of the Central Co-operative Banks to be Member nominated by the Registrar of Co-operative Societies once in two years on rotation basis (iv) General Manager (Administration), Tamil Nadu State Apex Co- Member - Secretary operative Bank Limited, Chennai The Member - Secretary, in consultation with the Chairman, shall convene the meetings of the Common Cadre Authority as and when necessary. (4) in rule 6, for sub-rule (e), the following sub-rule shall be substituted, namely;- "(e) To maintain list of members of Common Cadre Service and a list of employees in the feeder post for the cadre posts of General Manager and Assistant General Manager, namely, Assistant General Managers and Managers respectively working in all the Central Co-operative banks";Mar. 13, 2024] TAMIL NADU GOVERNMENT GAZETTE 31 (5) in rule 7 ,- (i) for sub-rule (1), the following sub - rule shall be substituted, namely :- "(1) All the General Managers and the Assistant General Managers working in the Central Co-operative Banks shall be deemed to be Common Cadre Employees in the respective category."; (ii) for sub-rule (3), the following sub-rule shall be substituted, namely:- "(3) Any vacancy in the cadre of General Manager and Assistant General Manager shall be filled up only by way of promotion from the feeder posts of Assistant General Manager and Manager, respectively. For this purpose, the Common Cadre Authority shall prepare a list of Assistant General Managers and Managers working in all Central Co-operative Banks with full details and draw a State level seniority for Assistant General Managers and Managers on the date of first April of every year to facilitate the Common Cadre Authority to call for candidates for selection to the cadres of General Manager and Assistant General Manager, respectively, when vacancy arises."; (6) in rule 10, in sub-rule (2),- (i) for the expression "Gratuity is payable to General Manager", the expression "Gratuity is payable to General Manager and Assistant General Manager" shall be substituted; (ii) in item (c), for the expression" in the cadre", the expression "in any cadre" shall be substituted; (7) in rule 14,- (i) for the provision starting with the expression "The seniority for the post of General Manager" and ending with the expression "of the above criteria", the following sub rule shall be substituted, namely:- " (a) The seniority for the post of General Manager and Assistant General Manager who are presently in position, shall be determined with reference to total length of service in the General Manager and Assistant General Manager cadre, respectively. In other words, the date of entry into the respective posts of General Manager and Assistant General Manager shall be the criteria for fixing inter-se-seniority, for the cadre posts of General Manager and Assistant General Manager. The Common Cadre Seniority List shall be approved and printed by the Common Cadre Authority on the basis of the above criteria"; (ii) the existing sub-rule (a) shall be renumbered as sub-rule (b); (8) for rule 17, the following rule shall be substituted, namely:- "17. Every employee appointed in the service shall retire on attaining the age of 60 years with effect from the afternoon of the last day of the month in which he attains the age of 60 years."; (9) in rule 19, for the first paragraph, the following paragraph shall be substituted, namely:- "The Common Cadre Authority shall be the appointing authority in respect of cadre employees. All the General Managers and the Assistant General Managers working in Central Co-operative Banks shall automatically become Common Cadre Employees in the respective cadre on the creation of the common cadre."; (10) in rule 21, for the second paragraph, the following paragraph shall be substituted, namely:- "The Common Cadre Employee who has already made security deposits in the Parent Bank shall increase his security deposits in the Parent Bank to the amount specified above within six (6) months from the date of commencement of Common Cadre Service. The security deposit of General Managers and Assistant General Managers shall remain as deposits with the parent bank. The security deposit shall be invested in the Bank in which they are posted for the first time and will continue to remain in the Bank till the refund of the security deposit, after completion of audit of the year during which the Common Cadre Employee was in service."; (11) for rule 23, the following rule shall be substituted, namely:- " 23. The Common Cadre Authority may revert a Common Cadre Employee from the service of the Common Cadre in order to effect economy. While doing so, the junior most member in the cadre service in the post of General Manager shall be reverted to the immediate lower cadre from which he was promoted. In case of Assistant General Managers they shall be reverted to the respective immediate lower cadre from which they were promoted in the Parent Bank. "; (12) in rule 26,- (i) for sub-rules (1) and (2), the following sub-rules shall be substituted, namely:-32 TAMIL NADU GOVERNMENT GAZETTE [Part III-Sec.1(a) (1) Every Common Cadre Employee shall furnish a declaration to the Common Cadre Authority about the immovable property held in his name or in the name of his spouse or dependent sons and daughters as at the end of each financial year. He shall also obtain prior permission from the common cadre authority for purchase of or acquiring any interest in immovable property. In addition to furnishing of a statement of immovable property, the Common Cadre Employee shall also furnish a statement of assets and liabilities as on 31st March every year to the Common Cadre Authority. Such report shall be filed within one month from the completion of each financial year. (2) No employee shall enter into any transaction concerning movable property exceeding Rs.25,000/- in value and immovable property of any value, whether by way of purchase, sale or otherwise, without the prior permission of Common Cadre Authority.; (ii) in sub-rule (3), for the expression "action", the expression "auction" shall be substituted; (13) in rule 31,- (i) after sub-rule (4), the following sub-rule shall be inserted, namely:- " (4-A) (1) A common cadre employee may be placed under suspension from service where,- (i) a disciplinary proceeding against him is contemplated or is pending; or (ii) a case against him in respect of any criminal offence is under investigation, inquiry or trial. (2) An employee who is detained in custody whether on a criminal charge or otherwise, for a period longer than forty - eight hours shall be deemed to have been suspended under this rule."; (ii) in sub-rule (7), the expression, "as far as may be, " shall be omitted; (14) in rule 32,- (i) for the marginal heading "Appellate Authority", the marginal heading "Authority to impose punishment and Appellate Authority" shall be substituted; (ii) in sub-rule (a), in the Table,- (a) against the entry "(1) Censure" in column (1) and the corresponding entries in column (2) thereof, for the entry (i) in column (3), the following entry shall be substituted, namely:- "(i) Common Cadre Authority, if punishment is imposed by the Managing Director"; (b) against the entry "(2) Stoppage of increments without cumulative effect upto two years" in column (1),- (i) for the entries in column (2) thereof, the following entry shall be substituted, namely:- "Managing Director/Common Cadre Authority": (ii) for the entry "(i) Board of Central Co-operative Bank, if punishment imposed by President of Central Co-operative Bank" in column (3) thereof, the following entry shall be substituted, namely:- "(i) Common Cadre Authority, if punishment is imposed by the Managing Director"; (iii) for the entry "(4) Recovery of pecuniary loss of pay" in column (1), the following entry shall be substituted, namely:- "(4) Recovery of pecuniary loss from the pay". Ms. No. 29, Co-operation, Food and Consumer Protection (CN1), 15th February 2024, மோசி 3, ச�ோபகிருது, திருவள்ளுவர் ஆண்டு-2055.] No. SRO A-7/2024.—In exercise of the powers conferred by sub-section (1) of section 180 read with sub-section (1) of Section 75 of the Tamil Nadu Co-operative Societies Act, 1983 (Tamil Nadu Act 30 of 1983), the Governor of Tamil Nadu hereby makes the following amendments to the Tamil Nadu Primary Agricultural Co-operative Credit Societies Common Cadre Service Rules, 2019.Mar. 13, 2024] TAMIL NADU GOVERNMENT GAZETTE 33 Amendments. In the said Rules,- (1) in rule 1, in sub-rule (2), for the expression "Secretaries of all Primary Agricultural Cooperative Credit Societies", the expression "Secretaries and Assistant Secretaries of all Primary Agricultural Co-operative Credit Societies" shall be substituted; (2) in rule 2, in clause (g), for the expression "the Secretary" the expression "the Secretary and the Assistant Secretary" shall be substituted; (3) in rule 3,- (i) in sub-rule (2), for the expression 'The post of Secretary", the expression "The posts of Secretary and Assistant Secretary" shall be substituted; (ii) in sub-rule (3), for the expression "The post of Secretary" the expression "The posts of Secretary and Assistant Secretary" shall be substituted; (4) in rule 7, for sub-rule (1), the following sub-rule shall be substituted, namely:- 1) "(a) The post of Secretary shall be filled up by promotion from the feeder post, which is immediately below the post of Secretary, namely, Assistant Secretary in the respective class of Primary Agricultural Co-operative Credit Society. (b) The post of Assistant Secretary shall be filled up by promotion from the feeder post, which is immediately below the post of Assistant Secretary, namely, Senior Clerk/Clerk in the respective class of Primary Agricultural Co-operative Credit Society. (c) Appointment to the post of Common Cadre Employees by promotion shall be made from the respective feeder posts, by the Common Cadre Authority, on the basis of merit, service rendered and efficiency test conducted in an interview for this purpose"; (5) for rule 16, the following rule shall be substituted, namely:- "16.Every employee appointed in the Common Cadre Service shall retire on attaining the age of sixty (60)years with effect from the afternoon of the last day of the month in which he attains the age of sixty (60) years."; (6) in rule 30, in sub-rule (7), for the word "Government", the word "commencement" shall be substituted.
