In exercise of the powers conferred by section 10 of the Tamil Nadu Cinemas (Regulation) Act, 1955 (Tamil Nadu Act IX of 1955), the Governor of Tamil Nadu hereby makes the following amendments to the Tamil Nadu Cinemas (Regulation) Rules, 1957. Amendments In the said Rules,- (1) in rule 5, for sub-rule (2), the following sub-rule shall be substituted, namely:- “(2) A copy of the Digital Projection Technician's Manual, which has been duly prepared by the licensee and attested by the Electrical Inspector, describing the routine, emergency and maintenance procedures and safety instructions to be followed shall be kept in the licensed premises.”; (2) in rule 7,- (i) the expression “such of” shall be omitted; (ii) for the expression “Indian Electricity Act, 1910”, the expression “Electricity Act, 2003 (Central Act 36 of 2003)” shall be substituted; (iii) for the expression “Section 30”, the expression “Section 54” shall be substituted; and (iv) for the expression “has to”, the expression “is to be” shall be substituted; (3) in rule 11,- (i) for sub-rule (1), the following sub-rule and proviso shall be substituted, namely:- “(1) (a) The enclosure shall be in-charge of a Digital Projection Technician holding a licence in Form "G" granted under, and in accordance with, the regulations in Appendix II by the Chief Electrical Inspector on the strength of a Certificate of Training in Form “H’’ issued by the Department of Employment and Training. (b) The Digital Projection Technician shall be present in the cinema premises monitoring the projection system during the whole period of operation of the projector. There shall be atleast two Digital Projection Technicians in each theatre exhibiting three or more shows per day, and for theatres exhibiting up to two shows per day, the number of Digital Projection Technician shall be one. Provided that for multiplex theatres having a common enclosure and exhibiting three or more shows per day, there shall be two Digital Projection Technicians for every two screens.”; (ii) for sub-rule (2), the following sub-rule shall be substituted, namely:- “(2) The Digital Projection Technician shall satisfy himself before the commencement of each performance that all cables, leads, connections, resistances, earthing of all equipment, UPS and batteries are in safe working condition and also the fire extinguishing appliances in the cinema premises are in good working order.”; (iii) for sub-rule (4), the following sub-rule shall be substituted, namely:- “(4) The licensee shall report to the Electrical Inspector the name and licence number of the Digital Projection Technician together with his letter of consent and any change in personnel.“; (4) in rule 37, in sub-rule (1), for clause (iv), the following clause shall be substituted, namely:- “(iv) a single line wiring diagram, site plan, physical and earthing layout drawings of the cinema installations in duplicate, a copy of which shall be sent to the Electrical Inspector.”;Aug. 30, 2023] TAMIL NADU GOVERNMENT GAZETTE 69 (5) in rule 40, in sub-rule (2), for clause (i), the following clause shall be substituted, namely:- “(i) a certificate in Form 'D' from the Electrical Inspector covering provisions in rule 11 in Part I-A, rules 65 to 74, 74-A, 76, 79 in Part IV , the rules 86 to 91, 91-A in Part V, the rules 112, 115 in Part VII and the rule 117 in Part VIII;”. (6) in rule 44,- (i) in sub-rule (1), for the expression “Rs.1,500/- (Rupees one thousand and five hundred only)”, the expression “Rs.5,000/- (Rupees Five Thousand only) for air conditioned (A/C) theatre and Rs.3,000/- (Rupees Three Thousand only) for non-air conditioned (non-A/C) theatre” shall be substituted; (ii) in sub-rule (2),- (a) for the expression “Chief Electrical Inspector's Certificate” the expression “Electrical Certificate issued in Form-D” shall be substituted; (b) for the expression “Rs.25,” the expression “Rs.1,000/-, (Rupees One Thousand only)” shall be substituted; (7) in rule 44-B, in the Table, against Serial Number 4 in column (1), in the entry in column (2) thereof, for the expression “operators” the expression “Digital Projection Technicians” shall be substituted; (8) in rule 48, in sub-rule (4), for the expression “Indian Electricity Rules, 1956” occurring in two places, the expression “Central Electricity Authority (Measures relating to Safety and Electric Supply) Regulations, 2023” shall be substituted; (9) in rule 55-A,- (i) for the expression “bulk head fittings”, the expression “bulk head light fittings or LED lighting luminaires with IP 55 and IK 08 or any other better protection” shall be substituted; and (ii) for the expression “ticket counters”, the expression “ticket counters, lift lobbies, food court, canteen counter” shall be substituted; (10) in rule 56, in sub-rule (1-A), for the expression “Table 5 of the Indian Standard Institution 4878-1968”, the expression “Table 3 of the Indian Standard 4878-1986” shall be substituted; (11) in rule 65,- (i) for the expression “operator”, the expression “Digital Projection Technician” shall be substituted; and (ii) the following proviso shall be added, namely:- “Provided that for mini digital theatres of seating capacity less than 200 seats, separate projection room is not mandatory and the digital projector may be mounted overhead in a fire resistant enclosure with a substantial rigid support, and which is not directly above any seat.”; (12) in rule 66, in sub-rule (1), the following proviso shall be added, namely:- “Provided that for theatres with digital projection system alone, the above provisions are not mandatory.” (13) in rule 67, for the proviso, the following proviso shall be substituted, namely:- “Provided that where a special type of film projector or digital projection system requires a wider opening, the Electrical Inspector may permit a larger opening which is protected with screened glass.”; (14) in rule 69, in sub-rule (1), the following proviso shall be added, namely:- “Provided that for digital projection system, this rule will not apply.”; (15) in rule 70, the following proviso shall be added, namely:- “Provided that for digital projection system, this rule will not apply.”; (16) in rule 71, the following proviso shall be added, namely:- “Provided that for digital projection system, this rule will not apply.”; (17) in rule 72, the following proviso shall be added, namely:- “Provided that for digital projection system, non-metallic FRLS conduits conforming to the relevant Indian Standard Specifications may be used for installations of voltage not exceeding 650 Volts:”;70 TAMIL NADU GOVERNMENT GAZETTE [Part III-Sec.1(a) (18) in rule 73, the following proviso shall be added, namely:- “Provided that for digital projection system, this rule will not apply.”; (19) in rule 74,- (i) in sub-rule (1), after the expression “main circuits” the expression “with 30 milli Ampere sensitivity Residual Current Breaker with Over Current Protection control at the incoming of each phase” shall be added; (ii) after sub-rule (1) as so amended the following sub-rule (2) shall be inserted, namely:- ''(2) The power circuits inside the cinema premises should be protected with suitable Residual Current Circuit Breaker (RCCB/RCBO).”; (20) in rule 74-A,- (i) for the expression “conductors”, the expression ”protection system” shall be substituted; and (ii) after the expression “against lightning” the expression “as per IS/IEC 62305” shall be inserted; (21) in rule 76, in sub-rule (1),- (i) for the expression “cabin” occurring in two places, the expression “enclosure” shall be substituted; and (ii) in sub-rule (1) as so amended the following proviso shall be added, namely:- “Provided that for portable digital projectors, replacement of the same type is permitted, but the details of such replacement must be intimated to the Electrical Inspector and the Licensing authority within 24 hours.” (iii) in sub-rule (2), for the expression “cabin”, the expression “enclosure” shall be substituted; (22) in rule 87, the following proviso shall be added, namely:- “Provided that for digital projection system, this rule will not apply.”; (23) in rule 88, the following proviso shall be added, namely:- “Provided that for digital projection system, this rule will not apply.”; (24) in rule 89, the following proviso shall be added, namely:- “Provided that for digital projection system, this rule will not apply.”; (25) in rule 90, in sub-rule (1), for the expression “of wiring”, the expression “of wiring diagram, site plan, physical and earthing layout” shall be substituted.”; (26) for rule 91, the following rule shall be substituted, namely:- “91. (1) The following fire extinguishing appliances shall be provided:- (A) In the enclosure- (I) In the projection room.- (i) One portable class A, 9 litres water type (gas cartridge or stored pressure) fire extinguisher in case of film projection system, one dry powder, class ABC, not less than 5 kilogram fire extinguisher in case of digital projection system, (ii) one portable, not less than 2 kilogram carbon dioxide, fire extinguisher (iii) one bucket of water, (iv) one bucket of sand and (v) a fire blanket conforming to IS:15381 of size not less than 6’ x 3’ (1.8 metre x 0.9 metre). (II) In the Rewinding Room. - One portable class A, 9 litres water type (gas cartridge or stored pressure) fire extinguisher and a bucket with water. A can containing water not less than 10 centimetre deep in it shall also be provided near rewinding table for depositing the film clippings. The can shall have a self closing type of lid: Provided that for digital projection system, the above sub-clause (II) will not applyAug. 30, 2023] TAMIL NADU GOVERNMENT GAZETTE 71 (B) In the electrical meter room or switch gear room.- One dry powder, class ABC, not less than 5 kilogram fire extinguisher as per IS:15683: (C) In the Generator Area:- One dry powder, class ABC, not less than 5 kilogram fire extinguisher as per IS:15683 (D) In the Auditorium: (i) Two 9 litres water expelling extinguishers or ABC 5 kilogram / 6 kilogram fire extinguisher, for every 200 square metre floor area with minimum of 4 extinguishers. The extinguisher should be so located as to be available within 15 metre radius and supply of not less than twenty-five litres of water per ten square metres of floor area shall be stored in the manner laid down in sub-clause (ii): Provided that for balcony/gallery, one 9 litres water expelling extinguishers or ABC 5 kilogram / 6 kilogram fire extinguisher, for every 50 square metre floor area would suffice. (ii) Two hundred litres of water shall be stored inside the auditorium in twenty fire buckets confirming to sub-rule (2) and the balance stored in tanks or cisterns of any capacity so arranged as to be easily accessible. (2) These appliances shall be so disposed as to be readily available for use. The buckets shall have round bottoms and handles manufactured as per IS 2546 and shall be 12.5 litres capacity each to hold not less than 12 litres of water. They shall be painted red with the word "FIRE" painted on them in large block letters in English and Tamil. (3) The fire extinguishers shall conform to the relevant Indian Standards mentioned against each below and shall be of the following sizes namely:- (a) Class A, 9 litre water type (gas cartridge or stored pressure) shall be as per IS:15683. (b) Dry powder, class ABC fire extinguisher shall be of not less than 5 kilogram as per IS:15683 (c) Carbon-di-oxide type shall be of not less than 2 kilograms-IS:15683. The maintenance, inspection and testing of the portable fire extinguishers shall be done in accordance with the provisions of IS:2190 as amended/revised upto date. Record of maintenance, inspection and testing of fire extinguishers shall be maintained in a register in the form provided in Annex-G to the said Indian Standards issued by the Bureau of Indian Standards. (4) The pressure test of all types of fire extinguishers shall be carried out at intervals maintained against each fire extinguisher at a pressure and for a period mentioned against them in Table below, as per I.S. 2190 as amended/ revised up to date. tAble Type of Fire Test Test Period for which Extinguisher Interval Pressure pressure maintained (1) (2) (3) (4) 1. Carbon dioxide 5 years 250 kg/cm2 2.5 minutes The periodical pressure test shall be carried out in a laboratory accredited to IS/ISO 17025 or by the manufacturing companies of fire extinguishers. (5) The fire extinguisher shall be condemned after expiry of its life as recommended in IS: 2190 (6) Fire water tank with internal hydrant and fire hose reel shall be provided as per relevant IS to deliver a water jet of not less than 7 metre from the tip of nozzle at delivery rate of 13.5 litres per minute. At least two hydrant points each on either side of auditorium and one hydrant point at gallery or balcony shall be provided. The length of hose reel shall be selected to cover the entire auditorium including gallery/balcony. (7) The licensee shall stock not less than 1 spare refill together with requirement amount of chemicals for each of the cartridge type fire extinguisher.72 TAMIL NADU GOVERNMENT GAZETTE [Part III-Sec.1(a) (8) The fire extinguishers shall be mounted on walls in such way that the handle is at a height of not more than 1.5 metres above the floor level. The fire extinguisher shall be easily accessible and the passage leading to the fire extinguisher shall not be obstructed in any way. The fire-fighting appliances in the auditorium shall be located in the manner as not to obstruct the passage aisles or reduce their width in any way. The installation of fire hydrant system shall be as per relevant IS. (9) Attendants and staffs shall be trained in the use of all fire-fighting equipment maintained in the premises.”; (27) in rule 91-A,- (i) for the expression “permanent cinema buildings”, the expression “air conditioned (A/C) cinema buildings and Multiplex” shall be substituted; (ii) for the expression “water sprinklers” occurring in two places, the expression “automatic water sprinklers” shall be substituted; and (iii) the following expression shall be added at the end:- “Also the minimum requirements for fire-fighting installations in cinema buildings recommended in National Building code of India shall be provided.”; (28) in rule 95,- (i) in sub-rule (1), for the expression, “rupees Rs.400 (four hundred per year only)”, the expression “Rs.1000/- (Rupees One thousand only) per year” shall be substituted; (ii) in sub-rule (2), for the expression, “Rs.150 (Rupees One hundred and fifty)”, the expression “Rs.500/- (Rupees Five Hundred only)” shall be substituted; (29) in rule 111, for the expression “Rs.400 (Rupees four hundred only)”, the expression “Rs.2000/- (Rupees Two thousand only)” shall be substituted; (30) in rule 112,- in sub-rule (1), for the expression, “Rs.200 (Rupees two hundred only)”, the expression “Rs.1000/- (Rupees One Thousand only)” shall be substituted; (31) for rule 115, the following rule shall be substituted, namely:- “115. (1) The following fire-extinguishing appliances shall be provided:- (a) In the enclosure- One class A, water type (gas cartridge and stored pressure) fire extinguisher, one bucket of water, one bucket filled with sand and a fire blanket conforming to IS:15381 of size not less than 6’ x 3’ (1.8 metre x 0.9 metre). (b) In the auditorium- (i) Two numbers of 9 litres water expelling extinguishers or ABC 5 kilogram / 6 kilogram fire extinguisher, for every 200 square metre with minimum of 4 extinguishers per compartment/floor. The extinguisher should be so located as to be available within 15 metre radius and supply of not less than 50 litres of water per 10 square metre of floor-area shall be stored in two permanent masonry or Reinforced Cement Concrete tanks, one on either side of the auditorium. (ii) 20 numbers of 12.5 litres capacity buckets which shall be of round-bottom each to contain not less than 10 litres of water; (iii) Fire water tank with internal hydrant and fire hose reel shall be provided as per relevant IS to deliver a water jet of not less than 7 metre from the tip of nozzle at delivery rate of 13.5 litres per minute. At least two hydrant points each on either side of auditorium shall be provided. The length of hose reel shall be selected to cover the entire auditorium: Provided that for the existing theatres with stirrup pumps in use, this sub-clause will not apply. (2) All the extinguishers and fire buckets in the auditorium shall be located in a manner so as not to obstruct the passage or reduce their width in any way.”; (32) in rule 117, for the expression “twenty five”, the expression “two hundred” shall be substituted; (33) in Form C, under the heading ‘conditions of licence’, in condition 14-A, for clause (iii), the following clause shall be substituted namely:-Aug. 30, 2023] TAMIL NADU GOVERNMENT GAZETTE 73 “(iii) as per rule 11 there shall be at least two Digital Projection Technicians in each theatre exhibiting three or more shows per day, and for theatres exhibiting up to two shows per day, the number of Digital Projection Technician can be one: “Provided that for multiplex theatres having a common enclosure, and exhibiting three or more shows per day, there shall be two Digital Projection Technicians for every two screens.”; (34) for Form D, the following Form shall be substituted, namely:- “Form D (See rule 40) GOVERNMENT OF TAMIL NADU ELECTRICAL INSPECTORATE Office of the Electrical Inspector, ______________ Division Certificate No. .................. (1) Application for the issue of Digital Projection Technician licence may be made to the Chief Electrical Inspector by the candidates who have successfully completed the prerequisite training course for Digital Projection Technician conducted by the Department of Employment and Training. (2) The application shall be made along with a fee of Rs.500/- (Rupees five hundred only). The fee may be remitted into a Government Treasury through online to the credit of the Government under the head of account "0043 00 103 AA 21672” and the relevant e-challan enclosed. The Certificate of Training in Form-H issued by the Department of Employment and Training shall also be enclosed with the application for reference and return. (1) The Chief Electrical Inspector may issue the licence. (2) The licence issued shall be valid for a period of five years. (3) The holders of Digital Projection Technician licence shall apply for renewal of licence within three months from the date of expiry of their licence along with a fee of Rs.250/- (Rupees two hundred and fifty only) (4) Any application received in the office of the Chief Electrical Inspector after the expiry of the three months period from the date of expiry of the licence shall be considered as an application for a new licence and a fee of Rs.500/- (Rupees five hundred only) shall be charged. 3. (1) The existing holders of Operators Licence shall apply for licence within three months from the date of expiry of their licence. (2) In such cases, the licence fee shall be Rs.250/- (Rupees two hundred and fifty only). (3) Any application received in the office of the Chief Electrical Inspector after the expiry of the three months period from the date of expiry of the licence shall be considered as an application for a new licence and a fee of Rs.500/- (Rupees five hundred only) shall be charged. 4. Qualification for issuing new licence of Digital Projection Technician.- One must have undergone short term training course from a recognized Institute such as Government ITI, in the subject of digital projection, fire-fighting, basic knowledge on electricity, resuscitation of persons suffering from electric shock, installation wiring, UPS, electronic equipment, computers, Air conditioning equipment, etc. 5. Qualification for the holders of existing cinema operator’s licence for issue of Digital Projection Technician’s licence.- (1) Must not have completed the age of 70 years; (2) The qualification of training may be exempted based on hands-on experience gained for holder of existing cinema operator’s licence; 6. A candidate who had undergone the training by the Department of Employment and Training, but who had not obtained a licence from the Chief Electrical Inspector within a period of three years from the date of issue of the Certificate of Training shall not be eligible for a Digital Projection Technician’s licence unless he completes the training course for Digital Projection Technician conducted by the Department of Employment and Training again. 7. The Digital Projection Technician shall report to the Chief Electrical Inspector whenever he proceeds on leave, resigns or accepts appointment in another cinema theatre. 8. Fees once paid shall not be refunded. 9. Digital Projection Technician licence granted to any person under these regulations shall be liable to be withdrawn, suspended or cancelled by giving notice, if, in the opinion of the Chief Electrical Inspector, the Digital Projection Technician has not complied with these provisions, if found incompetent (sic) malpractices or has impersonated. The decision of the Chief Electrical Inspector shall be final in all matter of issue of licences, their renewals, suspension and cancellation. 10. The Government may, by order, in writing exempt subject to such conditions and restrictions as they may impose any candidate from all any of the provisions of the foregoing regulations.
